a) Items labeled as optional are not required to be exercised by the government. If exercised, the contractor will be required to perform the optional work in accordance with the terms and conditions of this contract.

b) The Government anticipates multiple awards resulting from this solicitation.

c) Contractors must submit pricing for all items in Attachment 2.

d) The Government will use the term zones to refer forests/grasslands hereafter

e) Contractors are required to provide pricing on the Schedule of items for at least one zone for which the Contractor is willing to provide services. Pricing provided must be valid for all areas contained in that zone.

f) AGAR 452.216-73 Minimum and Maximum Contract Amounts (FEB 1988) - During the period specified in FAR clause FAR 52.216-18, ORDERING, the Government shall place orders totaling a minimum of $2500.00, but not in excess of $20,000,000.00.

g) The ceiling for this multiple award schedule (MAS) shall not exceed a ceiling of $20,000,000.00 cumulatively. The guaranteed minimum is $500.00 and is for the base period only.

h) The maximum order value under this solicitation is $500,000.00. This value is based on the IGE. Contractors can price and award can be made in excess of this amount, however, actions with an IGE exceeding this amount will not utilize this contract vehicle in order to preserve contract ceiling.

PERFORMANCE WORK STATEMENT

Project Title

US Forest Service Region 1 (R1), Road Maintenance IDIQ

1.0 Background and Purpose

The Purpose of this contract is to provide road maintenance services within the geographic area of region 1 of the US Forest Service. Award for this solicitation will result in an Indefinite Delivery Indefinite Quantity (IDIQ) contract.

2.0 Definitions

R1 – The regions are broken down into the following zones, Region 1 East: Dakota Prairie Grasslands, Custer Gallatin National Forest, Helena Lewis and Clark National Forest and Beaverhead Deerlodge National Forest; Region 1 West: Lolo National Forest, Bitterroot National Forest, Flathead National Forest and Kootenai National Forest, and Region 1 Idaho: Idaho Panhandle National Forest and Nez Perce Clearwater National Forest.

IDIQ – Indefinite Delivery Indefinite Quantity. Indefinite delivery, indefinite quantity contracts provide for an indefinite quantity of services for a fixed time.

3.0 Scope of Work

The Contractor shall furnish everything necessary, including but not limited to all labor, equipment, supervision, transportation, operating supplies, and incidentals necessary to perform road maintenance. Road maintenance work may include: Road Grading to include maintaining the crown, inslope or outslope of the traveled way and shoulders, drainage dips, leadoff ditches, berms, turnouts, removal of minor slides and slumps that can be accomplished with a typical road grader, and other irregularities that prevent normal runoff from the road surface. Vegetation Clearing to include cutting and disposing of all vegetative growth including trees from the road surface that reduces the operational capability of the road, and removal of hazard trees as directed by the Forest Service.

3.1 Location, Hours of Operation, Holidays

The work is located throughout R1 within the following forests:

Region 1 East:

Dakota Prairie Grasslands Custer Gallatin National Forest Helena Lewis and Clark National Forest and Beaverhead Deerlodge National

Forest

Region 1 West:

Lolo National Forest Bitterroot National Forest Flathead National Forest Kootenai National Forest

Region 1 Idaho:

Idaho Panhandle National Forest Nez Perce Clearwater National Forest

Orders for work will be issued per forest. (i.e. an order will not include work on more than one forest). With Orders for work will include specific locations and locations are typically identified by road number and milepost staked wood lathe displaying road number and milepost.

Other methods for identifying work locations may include georeferenced maps intended to be used with mapping apps like Avenza Maps.

Hours of Operation

Normal operational hours for these office locations are approximately from 07:30 am to 4:30 PM Mountain Time, Monday through Friday. Contractor’s work hours for individual Task Orders may extend beyond the normal operational hours when approved by COR.

Emergency services may be performed as required on weekends or during the following Federal Holidays. The following are Federal Holidays Observed:

3.2 Traffic control

Unless otherwise specified in the order for work, the contractor shall provide traffic control as needed in accordance with the current edition of Manual on Uniform Traffic Control Devices for Streets and Highways (MUTCD).

3.3 Weed-Free Equipment

In order to prevent the potential spread of noxious weeds into the project area, the Contractor shall be required to furnish weed-free equipment. Equipment shall be washed and the contractor shall request inspection of the equipment by the Contracting Officer and shall obtain the written approval of the CO prior moving the equipment to the jobsite. If the equipment is removed from the jobsite, the equipment shall be re-washed and re-inspected.

4.0 Deliverable / Schedule

The contract time and estimated start work date for each order will be specified within each order. Contract time for individual orders may extend past the last day of the contract period.

The count of contract time for each Task Order will start on the date specified on the Notice to Proceed.

The Contractor shall commence work under this contract within 4-calendar days of the effective date of the Notice to Proceed for the Task Order. The Contractor shall not commence work before the issuance of the Notice to Proceed.

5.0 Government Furnished

Government furnished materials, if any, will be identified within individual orders for work.

6.0 Order Attachments

Each task order issued by the government may include the following items (as applicable):

7.0 Measurement and Payment

Measurement will be made for actual work acceptably completed. Payment will be for the contract price per unit of measurement shown in the schedule of items.

PERFORMANCE REQUIREMENTS SUMMARY

1 Surface Maintenance. Performance of Surface Maintenance includes grading and shaping the roadbed, including shoulders and turnouts and removing ruts, washes, slough, and other irregularities that prevent normal runoff from the road surface. The end result shall be the restoration and maintenance of the original cross section, grade and drainage of the road. The following standard industry practices will be reviewed during inspections to determine the results will be met.

1.1.1 – Grading to restore surface without loss of aggregate/gravel surfacing or disturbance or loss of road base material. Performance on gravel surfaced road shall be accomplished so the base is not disturbed and no surface material is lost in ditches or over the road shoulders.

Grading of unsurfaced roads shall be performed so no base material is lost. Surface material shall be bladed from one edge of the road to the other in a berm in order to eliminate any segregation prior to spreading. Sections having segregated materials after spreading shall be reprocessed and spread. Oversized material exceeding 4 inches in size removed by equipment shall be disposed of by sidecasting over the fill slope except within 100 feet each side of culverts, other stream crossings or within 300’ of a perennial stream that is inhabited by fish, 150’ from a perennial steam not inhabited by fish and 100’ from any intermittent stream. If work operations produce excess material, feather it out or haul it away. Avoid sidecasting in locations where erosion will carry materials into streams. Avoid leaving a berm that channels water down the road unless it is routed into an effective vegetation filter which removes sediment. No berm or ridge of any material shall be left along either shoulder of the roadbed unless directed by the Contracting Office or designated representative.

1.1.2 – Elimination of ruts, potholes, and washes. These defects shall be repaired by scarifying or cutting to the bottom of such defects to provide for uniform compaction of roadbed material.

Large rock or organic material removed from drainage facilities during cleaning process shall not be used as fill. High grading, or any method which merely fills depressions with loose material, does not eliminate the defect or provide for uniform compaction and is therefore not acceptable.

1.1.3 – Repair of Settlement sections shall be performed where possible by cutting from the roadbed on each end of the settled area and filling into the settled area to provide smooth transitions to adjacent road grades. If this will not accomplish the objective, the COR shall be informed.

1.1.4 - Grading and shaping operations shall not undercut road backslopes.

1.1.5 - Sections of roads constructed without roadside ditch shall be uniformly insloped or outsloped the entire width of the roadbed, unless otherwise specified on each individual task order (i.e. crowning). The inslope or outslope grade shall be a minimum of 2 percent and a maximum of 4 percent unless staked otherwise on the ground.

1.1.6 - Existing drainage dips shall be cleaned and the outslope grade restored to equal or exceed the gradient of the road.

1.1.7 - Sections of roads constructed with a roadside ditch shall be bladed and reshaped to maintain crown at centerline of the roadbed, or insloped except on curves where crown is omitted. Road cross section shall slope uniformly both ways from crown apex to shoulders at a minimum blade of 2 percent and a maximum blade of 4 percent.

1.1.8 - At the conclusion of the grading and shaping operations the roadbed shall be smoothed and dressed to produce a uniform grade and cross section and a surface free of hollows, depressions, and projections above the adjacent roadbed surface. No berm or ridge or any material shall be left along either shoulder of the roadbed unless directed by the COR.

Compacting. Operate equipment over the full width of the road until visible deformation of the layer ceases.

2 Vegetation Management. Performance of Vegetation Management includes removal of all vegetative material within clearing limits shown on Exhibit A – Typical Clearing Details. This area includes turnouts and curve widening. Vegetative material (alive or dead) includes grass, weeds, residual brush, live brush, and trees. The end result will be the restoration of sight distance and clear limits of the road.

2.1.1 - Cut all trees, without exception, 6 inches diameter at stump height, brush and vegetative material within the clearing limit as shown on Exhibit A. Cut material to within 6 inches above the ground or obstructions and remove from the clearing limits. Remove ALL downed trees from the clearing limits shown on Exhibit A. Cut limbs which obtrude into the clearing limits as close to the tree trunk as practical on trees that remain standing. Maximum stump/cut heights may only increase while transitioning over obstacles and only for a maximum distance equal to the length of the mower head before and after the obstacle.

2.1.2 – Disposal: Slash with a length greater than 36 inches (diameter less than 2 inches) or with a length greater than 24 inches (diameter greater than 2 inches), is to be scattered so as not to produce concentrations and shall not be deposited in watercourses. All slash shall be removed at the end of each workday.

2.2.1 – Hazard removal shall include bucking and removing downed trees impinging on road ditches, driving surface and shoulders. All limbs and debris shall be removed from road as well.

2.2.2 – Disposal: cut logs shall be rolled off the road and out of ditches in such a way that they will not roll back into the road or ditch.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at FAR 52.215-2, Audit and Records- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

“System updates may lag policy updates. In advancement of Section 2 of Executive Order 14208, the removal of requirements related to Executive Order 14057 eliminates all non-statutory sustainability requirements or preferences in purchases of food service wares, including paper straws. In addition to removing requirements related to Executive Order 14057, the attachment also reflects recent updates to Code of Federal Regulation citations for the U.S. Department of Agriculture’s BioPreferred® Program, a statutory purchasing preference program.

FAR 52.216-18 Ordering (AUG 2020)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule.

Such orders may be issued from approximately January 2025 through January 2030.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract.

In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) A delivery order or task order is considered “issued” when—

(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;

(2) If sent by fax, the Government transmits the order to the Contractor's fax number; or

(3) If sent electronically, the Government either—

(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or

(ii) Distributes the delivery order or task order via email to the Contractor's email address.

(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.

FAR 52.216-19 Order Limitations (Oct 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,500.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor—

(1) Any order for a single item in excess of $500,000.00;

(2) Any order for a combination of items in excess of $750,000; or

(3) A series of orders from the same ordering office within 7 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 5 days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

FAR 52.216-22 Indefinite Quantity (Oct 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the “maximum.” The Government shall order at least the quantity of supplies or services designated in the Schedule as the “minimum.”

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after January 2030.

FAR 52.217-8 Option to Extend Services (Nov 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

AGAR 452.211-74 Period of Performance (FEB 1988)

The period of performance of this contract is from approximately January 2025 through January 2030.

AGAR 452.215-73 Post Award Conference (NOV 1996)

A post award conference with the successful offeror is required. It will be scheduled within 30 days after the date of contract award. The conference will be held at: TBD.

AGAR 452.228-71 Insurance Coverage (NOV 1996) (Alternate I)

Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. (1) The Contractor shall have bodily injury liability coverage written on a comprehensive form of policy of at least $500,000 per occurrence.

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and 500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

If a previously unidentified archaeological or historic site(s) is encountered, the Contractor shall discontinue work in the general area of the site(s) and notify the Contracting Officer immediately.

Task Order – Request for Quote (RFQ) Procedures

a) A Task Order is a contractual instrument issued by an authorized and warranted government Contracting Officer to order work for the government.

b) As the need exists for performance under the terms of this IDIQ Contract any warranted Forest Service Contracting Officer may solicit quotes and issue task orders against this contract.

c) Additional specifications and requirements will be provided with each RFQ.

d) RFQs will be transmitted primarily via e-mail.

e) RFQs will generally be evaluated based on price but may include evaluation criteria (ie: past performance, technical approach, etc.) which will require the submission of a technical response. All RFQs shall specify the method for award determination and indicate the required response documentation.

f) Upon the receipt of an RFQ from the Government, the Contractor shall respond as specified. In the case that an awardee cannot submit an offer in response to a solicitation the awardee should notify the Contracting Officer as to the business reason for why a response will not be submitted. While no mandatory requirement exists for the submission of a task order solicitation response, firms consistently declining to submit a response or failing to notify the Contracting Officer as to the business reason why a response was not provided risk not having their option year exercised.

Contractor rationale may be lack of capacity, conflicting scheduling with other projects, etc.

g) Contract holders will receive fair opportunity to be considered for each Task Order within the zones of interests unless one of the exceptions in FAR Subpart 16.505(b)(2) applies. Fair opportunities for the purpose of all zones is offered at the time of this solicitation. All contractors are required to submit pricing for a minimum of one (1) zone.
