PERFORMANCE WORK STATEMENT
FORECLOSURE SERVICES
FEBRUARY 7, 2018
SECTION 1: GENERAL INFORMATION
1.1 INTRODUCTION AND OVERVIEW.
Rural Development (an Agency of the United States Department of Agriculture herein called the “Agency” or “the Government”) seeks to retain private licensed attorney(ies) or law firm(s) (hereinafter the “Contractor”) to provide legal and related services for foreclosures, bankruptcies, and/or actions to recover possession related to Section 502/504 Single Family Housing debts to the United States of America, United States Department of Agriculture, Rural Development. These services shall be provided for properties in the State of Colorado. The majority of the foreclosures will be completed using the non-judicial foreclosure process through the relevant public trustee. Where the Contractor indicates after review that an assigned case does not meet the technical requirements for non-judicial foreclosure, the Agency may reassign the case to the Contractor for judicial foreclosure.
1.2 BACKGROUND
The Agency provides loans to individuals to purchase single family homes. These loans are made to individuals in the very low and low income categories in rural areas of Colorado. The loan security is a Deed of Trust and may be in a senior or junior lien position. Upon default of the loan terms, it is necessary for the Agency to complete foreclosure of the Deed of Trust in accordance with the Colorado Revised State Statutes.
Section 1045 of the Stewart B. McKinney Homeless Assistance Act of 1988 amended Section 510(d) of the Housing Act of 1949 [42 U.S.C. 1480(d)] to provide the Secretary of Agriculture, in the prosecution or defense of any litigation under Section 502/504, the discretion to use the services of U. S. Attorneys, the USDA Office of the General Counsel, or any other attorney with whom the Secretary enters into a contract, upon determining that the attorney will provide competent and cost-effective representation for Rural Development. Section 502/504 loans are generally secured by first mortgages on modest dwellings located on non-farm tracts of one acre or less. In some instances, Rural Development also holds subsequent mortgages on the security, usually without intervening liens.
1.3 OBJECTIVE AND SCOPE
The Contractor must provide all facilities, materials, supplies, tools, equipment, personnel, travel arrangements and miscellaneous costs necessary to accomplish the performance of the agreement requirements including:
• Non-judicial foreclosure,

If these notifications are made by telephone, the Contractor must follow up in writing.
If a borrower files bankruptcy under Chapter 7 after a case has been assigned to the Contractor for foreclosure, then the Contractor shall keep the foreclosure file open pending final disposition of the bankruptcy proceeding. Final disposition of a Chapter 7 proceeding means notification that the case has been dismissed, that the property has been abandoned, or that the debtor has been discharged. Upon final disposition of the bankruptcy, the Contractor shall continue with the foreclosure.
