Inquiries
Any prospective quoter desiring additional information about the solicitation, drawings, specifications, etc., must request it in writing, not later than 4 business days before the closing date, to allow a reply to reach all prospective quoters before submission of their quotes. Requests for information received after that time may not receive a response. Oral explanations or instructions given before the award of a contract will not be binding. In no event shall failure to inspect the site constitute grounds for a claim after contract award. Requests for information about the solicitation, drawings, specifications, etc. should be submitted in writing by email to Tracy Marino at tracy.marino@usda.gov.
Instructions for Submission of Quotes
(a) Submit signed and dated quotes to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotes should be submitted via the Schedule of Items plus Technical Response documents of the Quoter's design as specified in the solicitation. Quotes shall be submitted in two parts (technical and price). Each part shall be separate and complete in itself so that evaluation of one may be accomplished independently of the other.. As a minimum, quoters must show:
(1) Pricing and Contact Information (use SF 1442 and Schedule of Items (Section 00 10 00)). This should be considered as your price submission)
(2) Acknowledgment of any Solicitation Amendments (use SF 1442);
(3) Response to non-price evaluation factors (see Section 00 21 00, Evaluation).
(4) All applicable fill-in provisions. For solicitations issued on an SF 1442, this would include Section 00 45 00.
(b) Late submissions, modifications, revisions, and withdrawals of quotes. Quoters are responsible for submitting quotes, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. Quotes received after the designated time may not be considered if the Contracting Officer has begun the evaluation process.
(c) System for Award Management (SAM). To be considered for award all Quoters must be successfully registered in the SAM database (www.sam.gov) AT THE TIME A QUOTE IS SUBMITTED. See FAR Clause 52.204-7, System for Award Management, as applicable for requirement information. Contractors shall have representations and certifications completed in www.sam.gov OR provide FAR clause 52.204-8, Annual Representations and Certifications, with paragraph (c) completed. If completing the aforementioned clause, provide with submitted quote.

SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Quoter does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Quoter should indicate that it is a Quoter for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
(e) Electronic Submissions
(1) Quoters must submit electronic responses this solicitation. Email quotes to tracy.marino@usda.gov. Please limit the size of your files to 2 MB or less; more is not always better, so please be concise. Include the solicitation number in the subject line of the email. Files in Adobe Acrobat are the preferred file type; other types may be accepted but the quoter may be required to change type if the Government cannot open the attachment.
(2) If any portion of a quote received by the Contracting Officer is unreadable to the degree that conformance to the essential requirements of the solicitation cannot be ascertained from the document--
(i) The Contracting Officer immediately shall notify the quoter and permit the quoter to resubmit the quote.
(ii) The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the quoter; and
(iii) The resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timeliness, provided the quoter complies with the time and format requirements for resubmission prescribed by the Contracting Officer.
(3) Facsimile Submissions will not be accepted.
(4) Hard Copy Submissions will not be accepted
Basis for Award
(a) Award will be made using the Simplified Acquisition Procedures in accordance with FAR Part 13 to the Quoter whose acceptable quote provides the best value to the government considering price and non-price factors.
The Government intends to do a comparative analysis of quotes and award a contract without communication with Quoters. Therefore, Quoter's initial response should contain the best terms from a price and technical standpoint. The Government reserves the right to communicate if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest (i.e., cost prohibitive); accept other than the lowest-priced quote; and waive informalities and minor irregularities in quotes received. If a quote is rejected, it will not be considered for award.
(b) The government will make an award to a responsible contractor. To be determined responsible, a prospective contractor must --
(1) Have adequate financial resources to perform the contract, or the ability to obtain them;
(2) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;
(3) Have a satisfactory performance record. A prospective contractor shall not be determined responsible or nonresponsible solely on the basis of a lack of relevant performance history;
(4) Have a satisfactory record of integrity and business ethics;
(5) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors).
127EAW21Q0016
http://www.sam.gov/ mailto:tracy.marino@usda.gov
(6) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them; and
(7) Be otherwise qualified and eligible to receive an award under applicable laws
Evaluation
(a) Acceptability of Quote - The Government will determine the acceptability of each quote on a pass or fail basis considering the following items. Quotes that fail any of these items will not be considered for award.
(1) A quoter takes exception to the any of the terms and conditions of the RFQ, including attachments;
(2) A quoter is not currently registered in the System for Award Management (SAM) by the closing date of the solicitation;
(3) A quoter cannot be verified as a Small Business as shown in SAM or other proof as submitted by the quoter;
(4) An incomplete quote that lacks sufficient information for the government to perform a technical evaluation to determine acceptability;
(5) A quoter failed to acknowledge a material amendment;
(6) not furnishing prices for each item listed in the Schedule requiring a unit price. If the quoter fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. Should any mathematical check made by the Government show a mistake in the extended amount quoted, the corrected unit price extension shall govern. If a quoter omits both the unit price and the extended amount or estimated amount for any item, its quote shall be declared unacceptable and therefore ineligible for award. Pricing must be submitted for all items. If the quoter does not intend to charge for a bid item, a price of "0" or "No Cost" should be shown; and
(7) not furnishing a bid guarantee, if required, based on dollar value of quote.
(b) Capability of the Quoter - The Government will assess the capability of each quoter based on the following criteria 1) Understanding of the Government's requirement; 2) Organizational Experience; and 3) Organizational Past Performance. The Government will not assess capability on a pass/fail basis but will use its assessments of capability as a basis for comparing quoters to determine best value. Quoters are encouraged to provide their response using the attached Questionnaire. Since the Contracting Officer is considering price and other factors, award may be made to other than the lowest-priced quote.
1) Understanding of the Government's Requirements. The Government will evaluate each quoter's relative understanding of the Government's requirement on the basis of its written response addressing the following subfactors: a) any information that indicates the extent to which the site for this project was visited; b) the results concluded from the site visit; c) the resources (personnel and equipment) which are planned for use on the project and how realistic that plan is given concurrent obligations. Discuss any subcontractors and their background and capability; d) site specific safety plan (safety plan for this specific project shall address, among other things, a communications plan, egress of injured workers and protection of the public and Government personnel); e) plan of work to include the major tasks and timelines; and where applicable, estimated production rates.
2) Organizational Experience. Experience is the opportunity to learn by doing. The Government will evaluate each quoter's organizational experience based on its breadth, its depth, and its relevance to the work that will be required under the prospective contract. The Government will not evaluate an quoter's organizational experience on the basis of the personal experience of the quoter's key personnel. However, the Government will consider the extent to which the quoter's key personnel have worked together in the past. The Government will evaluate the organizational experience of the quoter's proposed key subcontractors
3) Organization Past Performance. Past performance is a measure of the degree to which an quoter satisfied its customers in the past and complied with Federal, state, and local laws and regulations. The Government will contact some of each Quoter's customers to ask whether: (1) quality services were performed; (2) the quoter was committed to customer satisfaction; (3) the quoter stayed within contract cost; (4) the quoter was reasonable and cooperative during performance; and (5) met contract performance time. In evaluating past performance, the Government will contact some of the references provided by the offeror and other sources of information, including, but not limited to: Federal, state, and local government agencies, better business bureaus, published media, and electronic data bases.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. (2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers. (1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

SECTION 00 24 00 - Procurement Scopes
Project
McCloud River Loop Masonry Finish and Rock Fascia Repair
General Information
1.0 Scope of Work
Much of the volcanic stone masonry that adorns the furnishings of the recreation day use sites of the McCloud River Loop have begun to loosen and break down (rock wall, park bench, stairwell). In addition to the normal wear and tear, at least two infrastructures are unfinished: The Upper Falls day use site information kiosk and a bench at the Middle Falls day use site.
2.0 Background
The rock fascia was installed over 15 years ago and with the amount of use that occurs at Lower Falls day use site, damage is particularly prevalent where the use and abuse from thousands of visitors has caused damage to the walls (people sit and stand upon them, kids pry off rocks, etc.). Due to funding limitations the implementation of the rock fascia on the remaining infrastructures in Middle and Upper Falls was not complete.
Contractor Requirements
3.0 Technical Requirements / Tasks
Materials Collection Collection of volcanic rock material on NFS lands at an area known as: Julia Glover Flat (see map) Julia Glover Flat is a plain located in a high steppe in the northeast of the Shasta McCloud Management Unit and is the location that furnished the materials for the McCloud River Loop site furnishings originally.
