SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

Mystic Ranger District / RMRS Grounds Maintenance Contract

Statement of Work

DESCRIPTION OF WORK

The Contractor shall provide all labor, supervision, equipment, tools, supplies, and services necessary to perform year-round grounds maintenance services. This includes mowing lawns, fertilizing grass, weed control, snow removal and ice treatment for the Mystic Ranger District and Rocky Mountain Research Station administration building and warehouses. The work is located at: Mystic Ranger District Office

DESCRIPTION OF WORK AREA

The work area encompasses the grounds surrounding the Mystic Ranger District building, as well as the warehouse area and adjoining property. A site map is attached to delineate specific areas.

SAFETY

Contractors are subject to all applicable State and Federal OSHA rules and regulations.

Prior to the start of the contract, the Contractor shall submit to the COR a list giving the name and manufacturer, the brand name, and Material Safety Data Sheets with the intended use of each of the materials the Contractor proposes to use in the performance of work. The Contractor shall not use any materials which the COR determines to be unsuitable for the work, or harmful to the surfaces it is intended to be applied to. This does not relieve the Contractor of any damages resulting from the application of such materials.

CONTRACTOR REPRESENTATIVE

The contractor shall provide a contract representative for the performance of the work. The name of this person and an alternate(s) who shall act for the contractor when the contractor is absent shall be designated in writing to the contracting officer. The contractor representative or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contractor representative and alternate(s) must be able to read, write, speak, and understand English.

SECURITY

The Contractor shall protect Government property, buildings, equipment, materials, records, and data against unauthorized access, loss, or damage.

The Contractor shall ensure that all keys issued by the Government are kept secure and not used by unauthorized persons. Government-issued keys shall not be duplicated. The Contractor shall reimburse the Government for replacement of locks or re-keying as a result of Contractor loss or negligence.

Only the Contractor’s employees are allowed in the building or on the job site. The Contractor is prohibited from opening locked areas to permit entrance of persons other than the Contractor’s employees.

CONTRACTOR FURNISHED PROPERTY

The Contractor shall supply all labor and supervision as well as supplies and equipment necessary to satisfactorily meet or exceed the performance standards of this contract.

The Government will approve all equipment utilized by the Contractor prior to work to ensure that they do not harm, cause permanent damage to Government property or endanger the health and safety of the building users. This does not relieve the Contractor from any damages resulting from use of these materials.

Contractor furnished equipment shall include but may not be limited to:

· All safety equipment (to include PPE) and materials to insure compliance with State and Federal OSHA regulations. Contractor employees will be required, at a minimum, to wear shirts and pants when performing work at the Mystic office during business hours. “Tank Top” or Sleeveless shirts are not acceptable.

· All grounds maintenance equipment to include mowers, edger’s, trimmers, pruners, weed whackers, leaf blowers, hand tools and associated vehicles as well as all fuel for the equipment. The contractor will be responsible for supplying refuse bags, if needed, for removal of lawn clippings, etc.

· All fuel required for equipment will be the responsibility of the Contractor. The Contractor shall have available the manpower, material and equipment necessary to accomplish lawn care and maintenance for the facility.

GOVERNMENT FURNISHED PROPERTY

The government shall furnish the contractor with the standard spray report form for reporting semi-annual and annual weed treatments.

WORK SCHEDULE

The Government may schedule events after normal business hours or on weekends that may affect scheduled lawn maintenance services. In such cases, the COR will notify the Contractor within 24 hours of the event.

LAWN MAINTENANCE

Lawn maintenance services may be performed during or after the duty day, and/or on weekends. Mowing and general maintenance of the immediate surrounding area is required weekly from April 15 through September 15. The outlying areas, which contain natural grasses and are not irrigated, will be mowed on a bi-weekly or monthly basis from April 15 to September 15. Edging and trimming will be scheduled to coincide with the lawn maintenance. Semi-annually, in April and September, the contractor will fertilize and chemically treat for weeds the immediate lawns, and chemically treat for weeds in all remaining Turf Areas. Contractor shall also spray annually for weeds within the rocked landscaped areas adjacent to the main Mystic/RMRS building as well as the rocked areas around the sign adjacent the entrance off Moon Meadows Road. The contractor shall also preform annual bare ground treatment around the track north of the warehouse and fence lines around fleet and warehouse areas.

CONTRACTOR’S SUBMITTALS

· Schedule – Submit a schedule at least 1 x per month in advance of required work, showing dates, “weekly”, “bi-weekly”, and “semi-annual” work will be performed. Inform the Government of schedule changes at least one week in advance.

· MSDS Sheets – Provide the Government with a copy of MSDS sheets for all chemicals being used for fertilization and weed control.

· Fertilization Information – Manufacturer’s or supplier’s information describing the contents and recommended uses for each fertilization product used.

· Weed Treatment- Herbicide used and standard spray report form.

· Personnel – Provide and keep current a written list of the names of all contractors’ employees performing duties under this contract.

· Contractor shall submit a copy of their current South Dakota Department of Agriculture Commercial Applicators Licenses with a Turf and Ornamental endorsement.

DEFINITIONS

ACCEPTABLE QUALITY LEVEL (AQL): The maximum allowable deviation from perfect performance that may occur before the Government will invoke payment deduction. An AQL does not allow a contractor to knowingly offer defective service, but limits reduced payment to circumstances in which defective performance results in a measurable reduction in the value of services rendered.

DEFECTIVE SERVICE: A unit of service which contains one or more defects, or nonconformance with specified requirements.

PERFORMANCE REQUIREMENTS SUMMARY (PRS): Identifies the key service outputs of the contract that will be evaluated by the Government to assure contract performance standards are met by the contractor.

QUALITY ASSURANCE: Those actions taken by the Government to assure services meet the requirements of the Performance Work Statement (PWS).

CONTRACTING OFFICER’S REPRESENTATIVE (COR): A Government employee appointed by the contracting officer to help the contracting officer with contract administration and surveillance.

GOVERNMENT INSPECTOR: A Government employee responsible for surveillance of contractor performance.

QUALITY ASSURANCE SURVEILLANCE PLAN (QASP): An organized written document used for quality assurance surveillance. The document contains specific methods the Government will use to perform surveillance of the contractor.

QUALITY CONTROL: Those actions taken by a contractor to control the performance of services so that they meet the requirements of the Performance Work Statement (PWS).

RANDOM SAMPLING: A sampling method in which each service output in a unit has an equal chance of being selected.

Frequency Schedule – Lawn Maintenance

Weekly Services

The Contractor shall provide all labor, equipment, and material associated with the mowing of formalized building grounds of moderate size and mixed use (as designated by yellow shading). All turf grounds shall be policed for trash, litter, and debris which shall be removed prior to operation. The turf shall be mowed at a height between 2.5 and 3.0 inches on a weekly schedule as requested by Forest Service. To assure a high quality cutting, all mower blades shall be sharpened prior to operation and all mowers shall be kept in top maintenance condition. All mowing operations shall be conducted at a speed that allows for the even cutting of all grass. Grass clippings from mowing operation shall be allowed to decay naturally to keep with our environmental procedures. Excessive clippings will be removed only upon request and as a separate charge. Trimming shall be performed by mechanical nylon cord string trimmer to define edges of sidewalks, buildings, curbs, poles and major fixed objects within the contract area sidewalks and immediate parking lot areas will be cleared of grass trimmings through use of a leaf blower. Bi-Weekly Services

The contractor shall provide all labor, equipment, and material associated with the mowing of large natural fields, and /or open spaces, and road right of ways outside of immediate areas (as designated by orange shading); All turf grounds shall be policed for trash, litter, and debris which shall be removed prior to operation. The turf shall be mowed at a height between 3 and 6 inches on a bi- weekly schedule as requested by client. To assure a high quality cutting, all mower blades shall be sharpened prior to operation and all mowers shall be kept in top maintenance condition. All mowing operations shall be conducted at a speed that allows for the even cutting of all grass. Grass clippings from mowing operation shall be allowed to decay naturally to keep with our environmental procedures. Excessive clippings will be removed only upon request and as a separate charge. Trimming in the bi-weekly designated area will be trimmed as a part of the monthly services (see monthly services) (See attached map for detail).

Monthly Services

Work will be performed under the direction of a certified applicator in accordance with product label use and approved industry guidelines.

The contractor shall provide all labor, equipment, and material associated with the immediate irrigated lawn area by use of chemical weed preventative treatments. Lawns will be treated for weeds in the assigned area. Work will be performed by a certified applicator in accordance with product label use and approved industry guidelines.

The contractor shall provide all labor, equipment, and material for the application of weed control chemicals to all turf areas outside of the immediate irrigated lawn areas. Turf Areas will be treated for weeds in the assigned area. Work will be performed by a certified applicator in accordance with product label use and approved industry guidelines.

Annual Services

The contractor shall on annual bases treat all landscape areas for weeds adjacent to Mystic/RMRS main building as well as landscaped area surrounding sign at entrance off Moon Meadows Road.

The contractor shall also perform an annual bare ground treatment for weeds along track north of warehouse area and along all fence lines as designated on contract map.

On Call Services

In the event that clippings become excessive due to rapid growth during the warm and wet periods of spring and early summer, the contractor, at the request of the government may be required to remove the clippings to improve the appearance of the irrigated lawn areas and also to reduce the chance of damage to the turf.

Snow and Ice Removal

Work Schedule

Work schedule will be as needed – weather dependent and will be determined solely by snow and / or ice accumulation.

Office Parking Lot Snow Removal and Ice Treatment

Prior to Office Opening

Service will be required on those days the office is scheduled to be open, prior to arrival of employees or visitors. All snow 2 inches or deeper is to be removed.

Snow removal shall be performed prior to 6:30 A.M. but no sooner than 5:00 A.M. The Contractor is not required to move vehicles. The Contractor will remove snow from around these vehicles, as close as practical with the plow. The Contractor will be provided with a key to the Fleet parking lot.

Ice will be treated on sidewalks and parking lots with granular ice melt product to prevent slips, falls and / or motor vehicle accidents. This service will be provided on an on-call basis. This service may be combined with snow removal service or as a separate service.

During the Day When Office is Open

Snow plowing service shall automatically be the responsibility of the Contractor when two or more inches of snow has fallen on those days the office is scheduled to be open. The Contractor shall exercise good judgment during times of heavy snowfall or storms so that duplication of services does not occur. In the event of an ice storm, ice will be treated on sidewalks and parking lots with granular ice melt product.

When Ordered The Contracting Officer may order service at any time of the day. When ordered, the Contractor shall move his equipment to the site and begin work within a maximum of two (2) hours after service is ordered or at the time specified by the Contracting Officer.

Office Sidewalk Clearing During the Day When Office is Open

The Contractor will be responsible for clearing the sidewalks prior to 6:30 A.M. but no sooner than 5:00 A.M. Removal may be by mechanical or hand methods. Mechanical equipment shall be by approval of the Contracting Officer. Ice will be treated with granular snow melt product.

Snow removal service shall automatically be the responsibility of the Contractor when two (2) or more inches of snow has fallen on those days the office is open. The Contractor shall exercise good judgment during times of snowfall or storms so that duplication of the removal effort does not occur. Snow shall be placed in the parking lot, such that it is accessible to the snowplow.

When Ordered The Contracting Officer may order service at any time of the day.

The Contractor shall begin work within a maximum of two (2) hour after service is ordered or at the time specified by the Contracting Officer.

Snow Placement An area has been designated for snow placement. For safety purposes, to prevent run off from melting, snow will be piled at the south end and southeast corner of the employee parking lot. In other parking lots, snow will be piled as necessary. In all areas, care will be taken to avoid breaking or piling snow on trees and bushes that have been planted throughout the compound.

The contractor shall use caution not to place snow in walkways and to not block street approaches, mailboxes, drainages and to not place snow in parking spaces, unless so directed. The contractor shall use caution when snow removal is in progress to not damage pavement, walks, curbs, grass, fences, signs, other structures or vehicles. The contractor shall be held liable for any damage incurred to property during the performance of work.

All damage by the contractor to property (to include personal property of employees) due to performance of snow removal/clearing operations shall be repaired/replaced by the contractor at no additional cost to the Government. All vegetation damage due to snow operations shall be repaired or replaced by the contractor, at no additional cost to the Government. Repairs shall be made in a timely manner, in no case more than two weeks, unless agreed to in writing. Repairs/replacements of damaged vegetation/trees/bushes will be made during the appropriate growing season.

All prescribed safety regulations, laws and practices shall be carefully observed in performance of the work.

PERFORMANCE STANDARDS AND THRESHOLDS

Performance threshold standards are described in the Quality Assurance Plans for weekly, bi-monthly, and semi-annual, annual, and as needed work.

Customer complaints will be substantiated by the COR for validity. Should the COR determine that the complaint is valid, the COR will inform the Contractor orally and in writing and give the Contractor additional time to correct the defect, if additional time is available. The COR will determine how much time is available.

Should the Contractor disagree with the complaint after investigation of the site, the Contractor shall notify the COR. The COR will review the matter to re-examine the validity of the complaint.

Should the threshold of customer complaints or COR acceptance not be obtained and the Contractor is not able to correct the next scheduled maintenance, a deduction of up to twenty-five percent may be taken off the appropriate pay item.

INSPECTION AND ACCEPTANCE

Inspection Procedure Inspection of the office grounds to determine the acceptability of the workmanship will be made by the Government and any deficiencies encountered will be called to the attention of the Contractor. Correction of all deficiencies will be made prior to re-inspection and acceptance of work by the Government in conformance with the work standards. Inspections will be done at a minimum of once per month or more frequently if needed.

The Government will visually inspect the services for compliance prior to acceptance and issuing any payments. Inspections will consist of direct observations.

Any Government personnel or visiting public may observe unacceptable services, incomplete work, or required services not performed and they may contact the COR to communicate a complaint.

Inspection, and acceptance are covered further in C.1 52.212-4 Contract Terms and Conditions—Commercial Items (Feb. 2002) under (a) Inspection/Acceptance.

Acceptance

Workmanship shall be of an acceptable quality such as would be found at a business office visited by the general public

PAYMENT

Upon acceptance, the Government will pay on a monthly and per job basis as stated in the schedule of items. For example: Weekly, Bi-weekly services are bid on and invoiced/paid on a monthly basis while semi-annual and annual services are invoiced/paid on a per job basis.

Payments

Payment will be made monthly for work completed and accepted by the Government covering the previous months' service or other period of time as determined by the Government. All invoices shall be submitted through the IPP (Invoice Processing Platform) as directed by the Contracting Officer.

Designation OF CONTRACTING OFFICER’S REPRESENTATIVE

The Contracting Officer will designate a Contracting Officer's Representative (COR) at the time of contract award.

The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.

The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract).

On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.
