SECTION C PERFORMANCE WORK STATEMENT

Replace Building Main Electrical Supply Switchboard

Department of Agriculture, Forest Service

Northern Research Station

1992 Folwell Avenue

Falcon Heights, MN 55108

Introduction This statement of work covers the removal of the existing electrical supply switchboard to facilitate the installation of a new switchboard. The primary point of contact (POC) for this work is the project manager, Gerald Hautamaki, at 651-649-5121, email is gerald.hautamaki@usda.gov.

Background

The existing electrical supply switchboard for the Northern Research Station at 1992 Folwell Avenue is outdated. The current switchboard has a manufacture date of 1963. The age of the switchboard creates issues and/or obstacles in the restoration of power and normal operation.

The existing switchboard is an I-T-E circuit breaker company Bulldog electric product. 1600 main amps, 30-4W service, 277-480 AC voltage, S.O. NO 76-08589-051, type 60-SW. ED., date of manufacture MAR-1963.

The electrical room is approximately 20’ long, 11’ in height (directly above the location of current switchboard), and 9’ wide. The entrance doors to the space measure 33 ¼” wide and 83.25” in height each, with a center frame that is removable. The deck consists of concrete.

Electrical service is provided to the switchboard via an adjacent transformer, located approximately thirty feet away outside of the facility due west. Building supply power from transformer located outside of building to switchboard is fed from below into the switchboard. A ground bar is provided inside the electrical room to facilitate grounding. As shown on attached drawings and diagrams, incoming power is converted to 480/277 and also into 120/208.

The 480/277 is supplied throughout the building via a 1200A Bus which distributes power to panel P2-1 (600A 3 phase), panel P-6 (400A 3 phase), a temporary feeder not currently in use (200A 3 phase), panels L1 through L5 (100A 3 phase), panel L2-E (100A 3 phase) and electrical supply to where 480V is stepped down to 120/208 (400A 3 phase).

The 120/208 is supplied throughout the building via an 800A Bus which distributes power to panel PL-2 (400A 3 phase), 1st floor telephone room (200A 3 phase) and panels LL-1 through LL-5 (200A 3 phase).

Currently, there are two power meters in use with the existing switchboard. A Square D “PowerLogic PM800” that is owned and operated by the University of Minnesota and a Square D “PowerLogic ION7550” that is mandated by federal law to be integrated with incoming electrical power supply to the government agency owned facility.

Attached to the solicitation is photographs of the original design drawings, locally generated electrical service diagrams, and images of the existing switchboard and electrical room.

A loading dock on the same level as the worksite is available for contractor use. There is an overhead door for initial access into the building; however, two additional doors exist in the path to the electrical room access. One door measures 66.5” wide by 83” in height and the other measures 58.5” wide by 83” in height.

The Davis-Bacon wage act is enforced. Wage rates may be located at https://beta.sam.gov/.

Scope The new switchboard shall be Schneider electric, Square D, Cutler-Hammer, Eaton, or approved equal. It is understood there may be advance lead times to procure parts and material.

Due to the hazardous nature of electrical work, all work, materials, hardware and testing procedures shall meet the requirements set forth by NFPA 70 - National Electric Code and applicable building codes.

· The contractor shall furnish all labor, materials, tools and resources (temporary power for tools/lighting, ETC…) required to successfully fulfill this contract.

· Contractor shall coordinate with Forest Service and the University of Minnesota personnel to identify, secure, and lock out electrical service per OSHA requirements. U of M facility services contact number is 6126267838.

· Coordinate with Forest Service personnel when electrical outage is required. Provide 7 days of notice for proposed building electrical outage date.

· Remove doors and center support bar (if installed) within the path from the loading dock to the electrical room to avoid damage while moving parts and material. Reinstall doors upon completion of work.

· Remove and dispose of existing switchboard and associated hardware.

· Prepare location for new switchboard. Inspect and test weather to reuse or replace associated hardware and electrical wiring from switchboard to outside transformer. Reuse existing conduit under the switchgear that runs to outside transformer.

· Replacement switchboard will require both the Square D “PowerLogic PM800” and the Square D “PowerLogic ION7550” power meters (both currently in operation with existing switchboard) to be integrated and monitor the incoming power. If replacement switchboard has an integrated power meter, the contractor may negotiate with the University of Minnesota regarding weather the new switchboard’s power meter would be an acceptable substitute in lieu of the Square D “PowerLogic PM800”. The Square D “PowerLogic PM800” power meter is a requirement of the University of Minnesota that must be satisfied. Regardless, the USDA owned Square D “PowerLogic ION7550” must be integrated and fully operational with the new switchboard.

· Install, test, and commission new switchboard per applicable manufacturer, safety and regulatory requirements with qualified personnel. Submit final drawings, testing results, and system commission results to Forest Service personnel upon completion of contract.

· The allowable time for this project is 7 to 10 days.

FAR Clause # Title Date Change

Any changes provided by the offeror are applicable to this solicitation only, and do not result in an update to the representations and certifications posted on ORCA.

FAR 52.209-5 Certification Regarding Responsibility Matters (APR 2010) (a)(1) The Offeror certifies, to the best of its knowledge and belief, that—

(i) The Offeror and/or any of its Principals—

(A) Are o are not o presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have o have not o, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation);

(C) Are o are not o presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision;

(D) Have o, have not o, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.

(1) Federal taxes are considered delinquent if both of the following criteria apply:

(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(2) Examples.

(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(ii) The Offeror has o has not o, within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) “Principal,” for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

This Certification Concerns a Matter Within the Jurisdiction of an Agency of the United States and the Making of a False, Fictitious, or Fraudulent Certification May Render the Maker Subject to Prosecution Under Section 1001, Title 18, United States Code.

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror’s responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

Such a concern is “not dominant in its field of operation” when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(3) For long-term contracts—

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract.
