NOTES TO QUOTER:
The Government will award a firm fixed price indefinite delivery indefinite quantity commercial supply contract to the responsible quoter whose quotation, conforming to the solicitation, is the Best Value.
Quotes will be evaluated based on best value in accordance with FAR Part 13.
Price shall include all costs necessary to deliver the required supply as described.
All Quotes must be received no later than 1600 CT on June 20, 2025.
In order to be considered for award of this contract the Contractor must submit the following:
• A complete quote
• Information about your company’s technical capability to meet the requirements of this contract
• Information about your company’s past performance relevant to the requirements of this contract
If a contractor’s quote package doesn’t contain all the items listed above or isn’t received by the closing date and time, the quote may be considered incomplete for evaluation purposes, and no further consideration will be given to the contractor’s quote.

EVALUATION OF QUOTES
The Government will award a purchase order in accordance with FAR part 13.106 resulting from this solicitation to the responsible contractor whose quote conforming to the solicitation will be most advantageous to the Government, price, past performance, and technical capability considered. Award will be made to the quote determined to be the best value. The USDA’s comparative evaluation of contractor quotes will consider the contractors ability to meet the agency’s needs and the contractor’s demonstrated ability to timely provide the supply requested in the statement of work. The Government does not assume the duty to search for data to cure the problems it finds in the information provided by the Contractor. The burden of providing thorough and complete technical capability remains with the Contractor.

NOTICE
System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in agency solicitations. SCHEDULE NOTES
The quantities as listed in the “Schedule of Items” are estimated requirements for this contract period. The Government estimates, but does not guarantee, the volume of purchases under this contract. The USDA, APHIS attempts to be as accurate as possible when providing estimated quantities, however, actual quantities required may vary from the quantities listed. Other than the minimum contract amount of $10,000.00, no guarantee is given as to the actual supply required during the term of this contract.
2.0 STATEMENT OF WORK
2.1 Background:
The Pocatello Supply Depot (PSD) manufactures several bait products used to control nuisance pests. Zinc phosphide is used in several of the pesticides manufactured at the Pocatello Supply Depot.
2.2 Contract Type
The government is awarding a firm fixed price indefinite delivery indefinite quantity commercial supply contract with a five-year period of performance.

2.4 Delivery Requirements
The contractor shall deliver all supplies ordered under this IDIQ to:
USDA Pocatello Supply Depot 238 E. Dillon St Pocatello, ID 83201
Supplies must be shipped in compliance with DOT regulations. All deliveries will occur during normal business hours: Monday – Friday 8:00am – 4:30pm.
2.5 Delivery Orders and Ordering Procedures
Purchase price will include all shipping costs, FOB destination, to the delivery address specified in the order.
Delivery orders will be issued in accordance with the Ordering clause (52.216-18, Ordering).

2.7 Invoicing
The USDA, APHIS uses the Invoice Processing Platform (IPP) for electronic submission and tracking of invoices and payment information to its suppliers of goods and services. Invoices must be submitted electronically to the IPP invoicing system. The contractor must enroll at https://ipp.gov

(d)Comptroller General Examination of Record. (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from date of award through the period of performance end date of the last ordering period.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) A delivery order or task order is considered "issued" when—
(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;
(2) If sent by fax, the Government transmits the order to the Contractor's fax number; or
(3) If sent electronically, the Government either—
(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or
(ii) Distributes the delivery order or task order via email to the Contractor's email address.
(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.

52.216-19 Order Limitations (Oct 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $10,000 the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor-
(1) Any order for a single item in excess of $100,00.00
(2) Any order for a combination of items in excess of $200,00.00; or
(3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216- 21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part https://www.acquisition.gov/far/52.216-21#FAR_52_216_21 https://www.acquisition.gov/far/52.216-21#FAR_52_216_21 of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 10 days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-22- Indefinite Quantity (Oct 1995)
(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum."
(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after the period of performance end date of the last ordering period.

452.204-70 Modification for Contract Closeout (DEVIATION JUNE 2024)
“Upon contract closeout for contracts utilizing anything other than cost reimbursement:
(a) If unliquidated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.
(b) Upon contract closeout for contracts utilizing SAP: if unliquidated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature.
