0.0 INSTRUCTION TO QUOTERS

1. This Request for Quote for commercial items is being conducted in accordance with FAR part 13.

This is a brand name purchase for Telone II® Chemical per FAR 13.5: 41 U.S.C § 1901 - Simplified Acquisition Procedures up to $7.5 million, as authorized by FAR 13.500(a) and implemented by FAR 13.501(a). Please see the Brand Name Justification Document for more information. USDA APHIS intends to issue one firm fixed price purchase order for this requirement.

2. This solicitation is being issued as a total small business set aside. The NAICS Code is 325320 with a size standard of 1,150 employees, or less. USDA APHIS intends to issue one Firm fixed price service contract as a result of this solicitation.

3. Quotations will be evaluated in accordance with provision 52.212-2 Evaluation—Commercial items.

4. All questions must be submitted in writing to Kim Yen Tu (Kimyen.N.Tu@usda.gov ). NO PHONE INQUIRIES WILL BE TAKEN. Submit questions no later than three (3) days prior to the response deadline to ensure adequate time is available to respond and amend the solicitation if necessary.

5. A prospective contractor may be requested to provide additional information to assist the Government in making a responsibility determination (FAR Subpart 9.1).

6. The U.S. Department of Agriculture (USDA) is an agency of the Federal Government and is tax exempt (Tax ID # 41-069271).

7. A COMPLETE QUOTE SHALL INCLUDE THE FOLLOWING INFORMATION:

1.0 STATEMENT OF WORK

BACKGROUND

The USDA Animal and Plant Health Inspection Service (APHIS) Plant Protection and Quarantine Services (PPQ) in Idaho intends to secure services including all labor, equipment, supervision, transportation, operating supplies, and incidentals necessary for supplying 9,452.988 gallons of the chemical Telone II® (1,3-Dichloropropene 97.5 %, inert ingredients 2.5 %) to an application contractor performing fumigation treatments in Bingham County, Idaho, United States.

The type and amount of equipment and personnel needed to accomplish the contract work is the responsibility of the Contractor. The work shall be done in strict compliance with the specifications provided by the Contracting Officer Representative and the terms, specifications, conditions, and provisions of this solicitation and Statement of work. USDA APHIS will solicit for an application contractor separately. This solicitation is for the transport, storage, and delivery of the chemical Telone II® (1, 3-Dichloropropene 97.5 %, inert ingredients 2.5 %).

SCOPE OF WORK

The Contractor shall be required to commence work under this contract as early as August 15, 2025, or upon official notification by the Contracting Officer. No application will be performed on Sundays unless otherwise approved by PCN program staff. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the U.S. Federal Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

Offerors are reminded that there are numerous biological and entomological factors that determine the time and sequence of treatments. The importance of starting and completing a program within specified limits is critical. The objective of each program is to achieve the desired coverage of the designated geographic areas within specified time frames.

The minimum technical factors are:

• Possession of an Idaho pesticide dealer’s license, with certification for selling and distributing the restricted use pesticide 1,3-Dichloropropene (TELONE II®), or the ability to obtain one before start of application.

• Ability to store the pesticide appropriately in a secured storage area.

• Demonstrates the ability, has the equipment and labor to provide the chemical to the applicator as needed to ensure fumigation can be completed within 14 operational days.

CONTRACTOR RESPONSIBILITY

1. Supplies, materials, equipment. The Contractor shall furnish all supplies, materials, equipment, transportation and personnel to provide products and services in accordance with the provisions of this solicitation, except as shown under Government obligations.

2. Personnel. The Contractor shall furnish qualified personnel to carry out all phases of the work to ensure that the chemical is safely and properly stored, transported, and delivered to the treatment areas in accordance with all local, state, and federal regulations.

3. Personal Protective Equipment (PPE). The Contractor shall follow all directions regarding PPE as specified on the pesticide label.

4. Fumigant. EPA Reg. No. 95290-1 which is 1,3-Dichloropropene = 97.5 by weight and inert ingredient 2.5 % by weight - liquid.

5. Sanitation. Vehicles, equipment, personnel and conveyances which have entered PCN-infested fields will be required to be cleaned and/or steam treated in accordance with state and federal regulations before departure from each field. Government inspectors will perform the required sanitation, inspection, permitting, and certification for equipment leaving PCN-infested fields.

6. Consultation. The Contractor will provide consultation to USDA APHIS and field operators to ensure field conditions are within standards for an effective fumigation treatment. Crop residues, soil temperature, soil tilth, and soil moisture should be considered.

SAFETY

The following safety precautions and procedures will be adhered to:

1. In the event of contamination of personnel, water for washing and a change of clothes will be readily available.

2. When not in use, the pesticide will be stored in tightly closed original container, in a specially secured and labeled storage location away from dwellings (i.e. truck).

GOVERNMENT RESPONSIBILITY

The Government will:

A. Maps, Information, and Briefing: Provide maps, information and briefing for fields to be treated in the Shelley, Idaho area.

B. Record Keeping Requirements: Provide Federal Register, 7 CFR part 110 (Record keeping Requirements for Certified Applicators of Federally Restricted Use Pesticides), to the Contractor for their review and information.

C. Payment for Acres of Fumigant Applied: Pay the Contractor for each gallon of pesticide acceptably furnished based on the application records and partial delivery receipts prepared by the Government providing the following conditions are met:

1. Invoices shall show the total number of gallons acceptably delivered with inclusive date for the period covered.

2. Invoices shall not be submitted for less than a one-week period, except upon completion of the contract. The Contractor shall coordinate with the COR when partial payments are desired.

3. Invoices shall be forwarded to the billing address shown on Block 18B of the Standard Form 1449 (Award/Contract).

Failure to comply with the above conditions may result in delay of payment.

(1)The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2)The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3)As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

AGAR 452.204-70, Modification for Contract Closeout (DEVIATION JULY 2022) Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to FAR Part 13.

(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a Release of Claims be completed by the contractor, although not required for contract and orders using SAP.) If the bilateral modification and Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment. (Nov 2021) The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part ofts offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision— Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub.
