Notes to Quoters:
1. This solicitation is for a fixed-price, Indefinite Delivery Indefinite Quantity (IDIQ) supply contract. The National Veterinary Stockpile (NVS) has an immediate need for a review of Air Quality Permitting Requirements and obtainment of such permits, as required, within all 50 U.S.
States and the U.S. Territory of Puerto Rico. The USDA APHIS requires to deploy mobile incinerators/cremation units (a.k.a., crematorium or crematory units or crematories) in response to a national animal health disease emergency and must have in place the necessary permits (or exemptions) in each State and Puerto Rico to expeditiously contain such diseases.
2. Simplified acquisition procedures will be used for this requirement per Federal Acquisition Regulation (FAR) Part 13. This requirement is being offered as a Small Business Set-Aside. The North American Industry Classification System (NAICS) code for this requirement is 541620 with a standard business size of $5 million.
3. This requirement is for the United States Department of Agriculture (USDA), Animal Plant Health Inspection Service (APHIS), National Veterinary Stockpile (NVS).
5. Evaluations will be conducted using FAR part 13 procedures, award will be made based on best value, price and other factors considered. Interested vendors must submit a completed pricing schedule located in Section 1.0 below. Quoted price shall include all costs necessary to perform the work. Quoter’s are responsible for ensuring completeness of quotations. The Government may evaluate solely on the information provided in the quotation. Quotations that include additional terms may be excluded from consideration. Alternate Pricing Schedules will not be considered. Quotations must include a price for all items in the solicitation to be eligible for award. The following items are required to be submitted in order to be eligible for award:
1) A signed completed copy of the SF 1449 Form. (Please note the disclosure requirements contained in the last 17 pages of the SF 1449 that are required to be completed.) Please complete Block 17a including vendor name, address, phone number, Federal Tax ID number, and DUNS number. Then, sign in block 30a.
2) Price schedule for each year of the contract as organized in Section 1.0 of the Solicitation.
3) SYSTEM for AWARD MANAGEMENT (SAM) REGISTRATION: SAM
Registration is required of all federal contractors. SAM registration enables electronic funds transfer of contract payments. If your company is not already registered, please register in the SAM database at https://www.sam.gov/portal/public/SAM/. Quoters must be registered in SAM when they submit their quote.

STATEMENT OF WORK
Title: USDA Air Quality Permits Completion or Exemptions - Large and Small Mobile Incinerators/Crematorium Units – 50 U.S. States & U.S. Territory of Puerto Rico
1.0 SCOPE
Under emergency response responsibilities, the United States Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) Veterinary Services (VS) has an immediate need for a review of Air Quality Permitting Requirements and obtainment of such permits, as required, within all 50 U.S. States and the U.S. Territory of Puerto Rico. The USDA APHIS requires to deploy mobile incinerators/cremation units (a.k.a., crematorium or crematory units or crematories) in response to a national animal health disease emergency and must have in place the necessary permits (or exemptions) in each State and Puerto Rico to expeditiously contain such diseases.
The goal is to determine any potential regulatory exemptions, permitting or other related requirements and obtain the necessary permits. Note, the final designation of the units as incinerators or cremation units should be determined as that designation providing the most advantage to the USDA APHIS.
2.0 DEFINITIONS
Emergency Use - the ability to mobilize and use mobile incineration/cremation units within 24 hours of notification.
Operation and maintenance - performing necessary functional, operational and performance techniques, tactics, and measurements to ensure units are capable of functioning as intended at a moment’s notice for catastrophic emergencies only.
3.0 BACKGROUND
The USDA APHIS (lead) and USDA Natural Resources Conservation Service (NRCS) are working on a National Emergency Management Plan and related response measures required to thwart the potential spread of zoonotic and non-zoonotic animal diseases - within the continental United States and its territories. One such example is the African Swine Fever virus (ASFv) that is a highly contagious, deadly viral disease affecting both domestic and feral swine of all ages, most recently detected in the Caribbean Region, most specifically, the Dominican Republic and Haiti. Currently, the only and most effective method to stop the spread of the disease is to remove all infected or exposed swine herds within the affected area which could threaten the

It is imperative that a Continuity of Operations Emergency Preparedness Plan be developed that includes effective animal carcass disposal methods. Given the limited resources in the Caribbean Region, incineration of carcasses as an effective and expeditious disposal method is critical.
The Clean Air Act (CAA (42 U.S.C. §7401 et seq.) is the comprehensive federal law that regulates air emissions from stationary and mobile sources. The U.S. Environmental Protection Agency (US EPA), alongside federal, state, local, and tribal regulatory partners, monitor and ensure compliance with the CAA and other related regulations in order to protect human health and the environment. The EPA establishes minimum air quality national standards. The CAA is primarily implemented by states, local and tribal authorities which are delegated regulatory authority. Additionally, each state has or may have a site implementation plan (SIP) that includes a facility permitting program that provides specific permitting and emission requirements amongst other parameters.
The USDA APHIS is procuring mobile incinerators/crematories to be used when a diseased animal emergency occurs. The incinerator units will be one of two sizes, referred to as large and small units, and will be stored in various locations in the continental United States. As of February 2024, 26 total units are being procured: 20 large units and 4 small units. Reference material providing the units’ manufacturer specifications and operations is included in Appendix A. To deploy these units in an emergency response, the regulatory framework must be clearly defined and understood. The deliverables from this contract will serve that purpose by identifying the regulatory framework and specific requirements - including existing regulatory exemptions, permitting, notification and other requirements.
4.0 GENERAL REQUIREMENTS
Emissions testing will be conducted in approximately May 2024, IAW 40 CFR Part 60. Results of the testing will be provided to the contractor for necessary permits, exemptions, training and or other regulatory response to ensure emergency use of the mobile units. The following sections define the specific regulatory review services required. The Contractor shall be fully responsible for performing the services specified. Work may be conducted at multiple sites and various locations within the United States or its territories and/or involve research and interaction with state and federal regulatory agencies across the U.S. A comprehensive summary of air quality regulatory requires as they pertain to the deployment and operations of the USDA owned mobile incineration/cremation units will be required. All permitting, recordkeeping and emissions testing requirements should be identified in order to (IOT) effectively respond to a real-world animal disease incident within the fifty (50) U.S. States and its territories. The 50 States and U.S. Territories of interest are grouped as follows:

6.0 TASK ORDERS
The Contractor will provide services under this contract as directed by the USDA, VS personnel. Funding will be provided on an as needed basis and issued on task orders or by verbal orders paid on a government purchase/credit card. Services to be provided under the task order are to be firm fixed price and in accordance with the contract Schedule of Items.
If a task order is issued, in accordance with FAR 16.505, each task order will include: (i) Date of order (ii) Contract number and order number (iii) Contract item number and description, quantity, and unit price or estimated cost or fee (iv) Delivery or performance date (v) Place of delivery or performance (including consignee) (vi) Packaging, packing, and shipping instructions, if any (vii) Accounting and appropriation data (viii) Method of payment and payment office, if not specified in the contract (ix) Any other pertinent information.
(a) Services under each Task Order may be requested either verbally or in writing with the contractor to meet their scheduling needs, up to the task order total.
The Contracting Officer may issue Task Orders under this contract obligating funds for the procurement of specific services prior to the Government needing delivery of said ordered quantities. Task Orders may be issued by any USDA APHIS Contracting Officer
All ordering of services must be coordinated with the COR and the COR must be informed of all services ordered.
PART 1.0 – THE SCHEDULE OF ITEMS Continued
The Contractor shall submit a firm-fixed price quote to perform all requested Task Order (including Options 1 and 2) in accordance with the Statement of Work. The Contractor's price shall be their fully burdened rate which includes all costs associated with the performance of any and all services ordered against this contract in accordance with this “statement of work” (SOW).
Quotes should be of sufficient detail to determine their adequacy.

Line items … for the labor hours are firm fixed price indefinite delivery indefinite quantity line items. The quantities as listed in the “Schedule of Items” are estimated requirements for this contract period. The Government estimates, but does not guarantee, the volume of purchases under this contract. The USDA, APHIS attempts to be as accurate as possible when providing estimated quantities, however, actual quantities required may vary from the quantities listed. Other than the minimum contract amount stated in AGAR clause 452.216-73 below, no guarantee is given as to the actual number of assessor hours required during the term of this contract.
Line items … for travel expenses are reimbursable line items. Travel expenses shall be in accordance with Federal Travel Regulations (FTR) and all travel costs will be reimbursed at the rates and restrictions provided in the Federal Travel Regulations. The Contractor shall be paid for travel expenses based on actual cost but not exceeding the FTR per diem rates.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment. (Aug 2020) The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services— Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.
(a) Definitions. As used in this provision—
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to—

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(d) Representation. The Offeror represents that— quipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds “will” in paragraph (d)(1) of this section; and

The whole of the machine is controlled and sequenced by the main control panel. This is provided with a combination of hard-wired safety circuits, hard wired interface circuits and a PLC system that is programmed to control the plant operation through the four distinct cycles, the Preheat Cycle, the low burn period, high burn period and the Cooldown Cycle. During the operation of each of the incineration cycles the PLC will sequentially energise and de-energise various sub-circuits for the control, monitoring and general operation of the component parts of the complete system. The function of each incineration cycle is described as follows:
Preheat Cycle This cycle is used to raise the temperature of the secondary combustion chambers to 850C in preparation of the waste burning period. The cycle duration is variable depending on the residual temperature of the combustion chambers. Secondary chamber burners maintain the minimum >850C temperature @ 2 sec residence time to start treating the emissions generated during the burn cycle.
Low burn period During the low burn period the temperature setpoints are set a lower temperature for all the burners during which all the high calorific waste are combusted. The cycle duration is determined by the operator depending upon the quantities of available wastes. All through the low burn period the secondary chamber maintains the minimum required temperature for the treatment of the emissions from the waste incineration process.
High burn period During the high burn period the temperature setpoints are set a higher temperature for all the burners during which the thorough destruction of all remaining wastes held within the primary combustion chamber. All through the high burn period secondary chamber maintains the minimum required temperature for the treatment of the emissions from the waste incineration process.
Cooldown Cycle This cycle is used to allow the cooling of the respective combustion chambers and to bring the whole plant to a controlled stop.
