Instruction to Quoters

Solicitation 12639525Q0041 is for Ivermectin Treated Corn. The U.S. Department of Agriculture (USDA) Animal and Plant Health Inspection Services (APHIS) Cattle Fever Tick Eradication Program (CFTEP) intends to put out a solicitation for bulk/bagged Ivermectin treated corn which will be fed to the wild deer population on appropriate properties in south Texas for the purpose of controlling cattle fever ticks.

This solicitation is being set aside for small business. The applicable NAICS code 311119 – other animal food manufacturing (Size Standard of 650 employees) and the PSC will be 6840 – pest control agent.

The government intends to award a FAR Part 13 Firm-Fixed Price, Purchase Order as a result of the pre-solicitation notice and solicitation. This is due to the years of historical data, market research and volatile commodity that is the corn industry. Evaluation of Quotations will be of Best Value according to FAR Part 13.106-2.

In order for a contractor to have a complete package, the following must be submitted to the

Contracting Officer before solicitation close date to be considered acceptable:

1. Signed SF1449 Form

2. Filled out Price Schedule. Alternate price schedules will not be allowed.

3. A copy of a SAM registration

4. Technical Capabilities Statement. Should address vendor’s capability to store

Ivermectin used for the treated corn, cleaning method for corn kernels, and the mixing method intended to use for combining corn and ivermectin.

5. Three Past Performance references with contract numbers with this agency or similar scope of work with federal/state/local entities.

1. Background

The U.S. Department of Agriculture (USDA) Animal and Plant Health Inspection Services (APHIS) Cattle Fever Tick Eradication Program (CFTEP) requires bulk Ivermectin treated corn, which will be fed to the wild deer population on appropriate properties in south Texas for the purpose of controlling cattle fever ticks. The treated corn will be used only during the non-deer season, February through July.

The USDA APHIS intends to award one fixed price Purchase Order not to exceed September 30, 2024.

3. Requirements

USDA, APHIS, VS, CFTEP representatives will perform a walkthrough of any prospective facilities to determine minimum standards for quantity and quality of product prior to award.

The contractor shall provide double-clean yellow whole kernel corn and treat the corn with Ivermectin on an as needed basis. Corn shall be re-cleaned, twice cleaned or other very clean whole kernel yellow corn to not contain appreciable dust, dirt, cob fragments or other fines.

The Contractor shall use government provided equipment (pump) for the mixing and processing of the corn. See section 6 for list of government furnished equipment. The USDA will provide the contractor with Pour-on Ivermectin in bulk for mixing. The Contractor is responsible for storing unused Ivermectin at their facility for use as needed. The contractor is required to notify USDA when Ivermectin is running low.

The contractor shall supply:

• Double-clean yellow whole kernel corn

• Labor for mixing the corn per government provided formulation

• Ivermectin-treated bulk corn is delivered by the semi load,

- FY25: 1,000 Tons (TG)

4. The formulation of treated corn

Double Clean corn shall be formulated using an alcohol-based pour-on formulation of Ivermectin to produce a homogeneous concentration of approximately 10 mg of Ivermectin active ingredient (AI) per pound of corn that yields 16-24 ppm Ivermectin concentration. The ivermectin product should be titrated using a metered drip system into the corn bin while mixing. The corn should be sampled prior to delivery for laboratory confirmation of ivermectin concentration.

The contractor shall submit samples through FedEx from each ton of treated product to the National Veterinary Services Lab (NVSL), Ames, Iowa, for testing before delivery to the five sites to ensure that Ivermectin levels are within the specified range. All sample shipment expenses are paid for by the CFTEP. This is the established system between the CFTEP and NVSL. (Further instructions will be provided for shipping through FedEx upon award). Two (2) one-pound samples of corn for every 10 tons of corn mixed shall be taken at the beginning and the end of the bagging process to be submitted to NVLS. NVSL sample submission tests are then faxed to the CFTEP Main Office within one week.

Any samples of shipments that do not meet the 16-24 ppm Ivermectin concentration will be rejected pending proper compliance and will be remedied at the contractor’s expense.

5. Government Furnished Facility or Property

Separate equipment is required by the Food and Drug Administration to ensure that there is no cross contamination of product available for sale to the public. The USDA shall provide a metering device for Ivermectin treatment of the corn.

Government-provided equipment will be delivered by the government to the contractor after contract award. The equipment shall be returned by the contractor (through delivery other methods) to government once contract has ended. 52.245-1 Government Property. (Sep 2021)

(a) Definitions. As used in this clause-

Cannibalizemeans to remove parts from Government property for use or for installation on other Government property.

Contractor-acquired property means property acquired, fabricated, or otherwise provided by the Contractor for performing a contract, and to which the Government has title.

Contractor inventory means-

(1) Any property acquired by and in the possession of a Contractor or subcontractor under a contract for which title is vested in the Government and which exceeds the amounts needed to complete full performance under the entire contract;

(2) Any property that the Government is obligated or has the option to take over under any type of contract, e.g., as a result either of any changes in the specifications or plans thereunder or of the termination of the contract (or subcontract thereunder), before completion of the work, for the convenience or at the option of the Government; and

(3) Government-furnished property that exceeds the amounts needed to complete full performance under the entire contract.

Contractor’s managerial personnel means the Contractor’s directors, officers, managers, superintendents, or equivalent representativeswho have supervision or direction of-

(1) All or substantially all of the Contractor’s business;

(2) All or substantially all of the Contractor’s operation at any one plant or separate location; or

(3) A separate and complete major industrial operation.

Demilitarization means rendering a product unusable for, and not restorable to, the purpose for which it was designed or is customarily used.

Discrepancies incident to shipment means any differences (e.g., count or condition) between the items documented to have been shipped and items actually received.

Equipment means a tangible item that is functionally complete for its intended purpose, durable, nonexpendable, and needed for the performance of a contract. Equipment is not intended for sale, and does not ordinarily lose its identity or become a component part of another article when put into use. Equipment does not include material, real property, special test equipment or special tooling.

Government-furnished property means property in the possession of, or directly acquired by, the Government and subsequently furnished to the Contractor for performance of a contract. Government-furnished property includes, but is not limited to, spares and property furnished for repair, maintenance, overhaul, or modification. Government-furnished property also includes contractor-acquired property if the contractor-acquired property is a deliverable under a cost contract when accepted by the Government for continued use under the contract.

Government property means all property owned or leased by the Government.

Government property includes both Government- furnished and Contractor-acquired property. Government property includes material, equipment, special tooling, special test equipment, and real property. Government property does not include intellectual property and software.

Loss of Government property means unintended, unforeseen or accidental loss, damage or destruction to Government property that reduces the Government’s expected economic benefits of the property. Loss of Government property does not include purposeful destructive testing, obsolescence, normal wear and tear or manufacturing defects. Loss of Government property includes, but is not limited to-

(1) Items that cannot be found after a reasonable search;

(2) Theft;

(3) Damage resulting in unexpected harm to property requiring repair to restore the item to usable condition; or

(4) Destruction resulting from incidents that render the item useless for its intended purpose or beyond economical repair.

Material means property that may be consumed or expended during the performance of a contract, component parts of a higher assembly, or items that lose their individual identity through incorporation into an end item. Material does not include equipment, special tooling, special test equipment or real property.

Nonseverable means property that cannot be removed after construction or installation without substantial loss of value or damage to the installed property or to the premises where installed.

Precious metals means silver, gold, platinum, palladium, iridium, osmium, rhodium, and ruthenium.

Production scrap means unusable material resulting from production, engineering, operations and maintenance, repair, and research and development contract activities. Production scrap may have value when re-melted or reprocessed, e.g., textile and metal clippings, borings, and faulty castings and forgings.

Property means all tangible property, both real and personal.

Property Administrator means an authorized representative of the Contracting Officer appointed in accordance with agency procedures, responsible for administering the contract requirements and obligations relating to Government property in the possession of a Contractor.

Property records means the records created and maintained by the contractor in support of its stewardship responsibilities for the management of Government property.

Provide means to furnish, as in Government-furnished property, or to acquire, as in contractor-acquired property.
