1. The U.S. Department of Agriculture Animal Plant Health Inspection Services (APHIS) intends to award a firm fixed- price Base plus four (4) year contract for Pest Control Services, located in Miami, FL.
This solicitation is being set aside for small business. The applicable NAICS code 561710 - Pest Control Services $22
All Quotes are due no later than04/23/2024 at 12:00 pm Eastern Time. All questions and quotes must be submitted to Contracting Officer Latisha Hollman via EMAIL ONLY to Latisha.A.Hollman@usda.gov. A late quote will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late quote would not unduly delay the acquisition.

Submit questions no later than three (2) business days prior to the response deadline to ensure adequate time is available to respond and amend the solicitation if necessary. Telephone inquiries will not be honored. The Government is not required to answer questions submitted after the deadline.
3. A prospective contractor may be requested to provide additional information to assist the Government in making a responsibility determination (FAR Subpart 9.1).
4. The U.S. Department of Agriculture (USDA) is an agency of the Federal Government and is tax exempt (Tax ID # 41-069271).
5. Missing, incomplete, or ambiguous information may impact evaluation. The Government reserves the right to award to other than the lowest priced quoter. SERVICES PROVIDED: Continuous abatement/removal of various species of rodents and insects.
WORK HOURS: All pest control/spraying at this location shall be conducted between the hours of 8:00 am to 4:00 PM on a regular basis to consist of once per month or as agreed upon by both agency and contractor, excluding all federal holidays.
STATEMENT OF WORK (SERVICE):
Monthly Services (one time per month or more if needed)
1. The contractor shall furnish all labor, supervision, transportation, tools, materials and supplies necessary to perform pest control services in accordance with the guidelines established by Federal, State and Local Government laws, rules, and regulations. Any and all applicable EPA regulations and rules shall be followed (www.epa.gov). The contractor shall provide monthly coverage. All services provided are to be completed by a certified, trained, and licensed pest control operator in any and all categories as required by the State of Florida.
2. Contractor shall place rodent traps as needed in office areas and other agreed upon common areas such as breakrooms, hallways and restrooms. Contractor shall complete a pre-inspection of the facility and provide recommendations for effective pest control and areas of pest control.
3. Contractor shall not provide rodent or insect abatement in or near aviary space.
4. Contractor shall check in at each visit/service appointment with MAIC AVIC/VIC personnel before performing services.
5. Contractor shall preschedule upcoming service appointments with MAIC AVIC/VIC personnel each month.
6. Contractor shall have MAIC AVIC/VIC personnel sign a receipt of work completion after each pest control service and provide a copy of receipt of service to MAIC AVIC/VIC.
REQUIRED TASKS:
Inspecting and controlling all vermin, such as, but not restricted to: rats, mice, roaches, bedbugs, fleas, stinkbugs, ants, wasps, bees etc., in office buildings/spaces, drains and common areas such as breakrooms and restrooms to exclude the aviary. Number of buildings consists of one building. The Integrated Pest Management (IPM) tasks shall be used in all treatment plans.
Spraying of all outside entranceways (outside door and window frames) into one building and all entrance ways monthly.
DESCRIPTION/SPECIFICATIONS/WORK STATEMENTS
1. General:
The contractor shall provide all supplies, materials, equipment, labor, supervision, management, and transportation to perform all tasks as identified below. All work is to be performed in accordance with the guidelines established by Federal, State, and local ordinances.
2. Scheduling:
Pest management tasks shall be scheduled so as to be performed on definite appointed days and in no event shall the contractor carry on work outside regular agreed-upon working hours without prior approval from the Port Veterinarian in Charge (VIC)/Assistant VIC). In the event that climate or weather conditions become unsuitable for work or may induce an environmental hazard, then the entire work shall be rescheduled to a date and time satisfactory to the contractor and MAIC. Postponement will not reflect any penalties assessed to the contractor, nor should there be any additional cost to the Government.
3. Standards:
All IPM tasks shall be executed to meet the guidelines as prescribed by the National Pest Control Association.
4. Coverage:
The contractor shall provide complete IPM tasks for buildings and on grounds.
5. Special contractor Provisions:
The following provisions shall be adhered to by the contractor in performing pesticide applications of the areas specified below:
a. Breakroom(s)/Kitchens: Treatment of these areas is limited to ONLY times when food is not being held, processed, prepared, served, and when not occupied by facility employees.
The contactor must be licensed in the state of Florida. All contractor personnel must have on their uniforms with the individuals’ names and the company name so they are easily recognizable at all times.
In cases where the contractor has two or more persons reporting to work under contract, one of these will be designated as a supervisor; and must be fully certified in all pest management categories in which work is to be performed. Non-certified employees may only assist the supervisor in the performance of the work, as long as the supervisor assumes responsibility for their work.
NOTE: Certification shall mean a current Certificate of Competency in pest management in any and all categories or subcategories, as identified by the state in which work is being performed under the contract. All other definitions are as defined in CFR 40, Subchapter E, and Part 162-180.
6. IPM Tasks:
Services required of the contractor are as follows:
a. Inspect to determine which pest management measures are appropriate and required.
b. Recommend environmental sanitation practices that restrict or eliminate food, water, or harborage for pests
c. Select and utilize non-chemical control methods that eliminate, exclude, or repel pests (i.e. insect electrocution devices, traps, caulking, air screens, etc.).
d. Select and use of the most environmentally sound pesticide(s) to control when chemical control methods are necessary.
e. Evaluation effectiveness of control measures through follow-up inspections.
f. Control:
• General structural anthropoid pests (i.e., cockroaches, ants, carpet beetles, spiders, carpenter ants, carpenter bees, etc.).
• Flying insect pests (i.e., house flies, stable flies, fruit flies, blow flies, etc.).
• Predatory pests (i.e., bedbugs, fleas, mites, ticks, bees, wasps, mosquitoes, etc.).
• Stored products pests (i.e., saw-tooth grain beetle, red/confused flour beetles, bromoderma beetles, grain moths, etc.).
• Mice and rats (i.e., house mouse, field mouse, roof rat, Norway rat, etc.).
• Skunks, raccoons, and stray cats.
7. Interference to Normal Function:
The contractor is not to interfere with the normal functioning of the facility, including utility services, fire protection systems, and passage of facility personnel and equipment.
8. Storage of Pest Control Materials:
No pest control materials or equipment shall be stored or kept at the MIAIC when the contractor is not working, without the expressed approval of the VIC.
9. Disposal of Hazardous Wastes:
The contractor shall not dispose of any excess pesticide, pesticide containers or any other materials contaminated by pesticides at any location on the facility premises except as specified by the VIC.
Conformity to Regulations: The contractor shall conform to all Federal, State and local regulations governing, examining and licensing of pest control operators, performance of pest control, use of approved pest control chemicals and equipment, which may be in effect in the area in which the work under the contract will be performed.
10. Required Contractor Reporting: The contractor shall:
a. Check in at the beginning of scheduled service and check out at the end of the service call in the main office. This will be done at the VIC’s/AVIC office. Upon checking in at the VIC/AVIC office, a tentative treatment plan and/or follow-up of pest problems (work orders) and scheduled inspections shall be provided by the contractor.
b. Complete and maintain a Pesticide Log Book containing Safety Data Sheets for all pesticides used in conformance with this contract and records listing the following: pesticide name, date/time of application, fluid ounces of pesticide applied, areas treated, equipment used, name of insect, and name of applicator.
c. Complete and submit to the VIC/AVIC, the IPM Operations Report. All IPM services provided during the work shift will be documented. The document is a permanent record and must be maintained the life of the contract.
d. Be responsible for supplying, completing, and submitting all reports required or requested by Federal, State or local ordinances that pertain to any duties contained in the contract.
e. Provide the VIC/AVIC, prior to initial application of pesticides, the trade names (if any) and chemical names of the chemicals used and a label showing the contents, the use strength of the chemical as applied and the antidote thereto. The contractor shall furnish the same information each time chemicals or products used are changed in the performance of this contract. This information is required by Employee Health for emergency treatment in the event of ingestion of and/or contact with the material by humans.
SUPPLIES:
a. Contractor shall furnish all supplies, equipment, labor, transportation, tools, supervision, and materials to perform pest control services.
Vendor will provide the necessary personnel, equipment, and supplies to perform the above proposed services from date of award through May 31, 2029.
Prior contract: No prior contract
1. Safety and Security
All persons employed in the work, while on the premises, shall comply with all building regulations.
The contractor shall not employ persons for work on this contract if such employee is considered by the contracting officer to be a potential threat to the health, safety, general well-being or operational mission of Marketing and Regulatory Programs and its population. The contractor shall exercise due diligence in assuring that only trustworthy and reliable persons are allowed to enter the building and that each such person shall have had the Tenant 's rules and regulations reviewed with them regarding the security of Tenant's property.
Due to the nature of work under this contract, it is required that the contractor personnel working under this contract at the USDA facility are subject to satisfactory completion of a background investigation conducted by the Federal Protective Service (FPS). In accordance with USDA regulations, a Basic Law Enforcement background investigation is required prior to starting work under this contract as well as maintaining it throughout the duration of the contract. The contractors will be required to complete the background investigation forms and submit them to the program contact person for submission to the FPS office responsible for processing the background investigations. The USDA APHIS will be responsible for paying for these background investigations.
During the performance of janitorial work herein, the Contractor shall take all reasonable precautions to guard the secrecy of the Tenant's records and information, shall limit access to records and information of the Tenant to authorized employees or agents of the Contractor only, and shall inform all such authorized personnel of the confidential nature of records and information of the Tenant and of the applicable laws regarding security of communication.
2. Background Investigations
A. In accordance with the USDA regulations, a Background Investigation of the janitorial personnel is required prior to starting work under this contract as well as maintaining it throughout the duration of the contract. Prior to start of work, the CONTRACTOR shall provide only fully qualified and properly cleared personnel for the work to be performed under this SOW. The contractor shall, through their own internal background investigation protocol and pre-employment investigation, ensure that each contractor employee submitted for a background investigation is reasonably expected to receive a favorable adjudication of their respective investigation.
B. The USDA, APHIS will pay for the required background investigation. The government shall have and exercise full and complete control over granting, denying, withholding, or termination the background investigation clearance for employees.
C. All contractor personnel that will have access to the APHIS, PPQ facility will be required to have, at Low Risk, NACI Background Investigation (BI) with no less than favorably adjudicated results. Once approved and working at the facility, the contractor personnel shall not be removed or diverted from the site without prior notification to the PPQ facility representative or the designated COR.
D. The contractor shall not employ persons for work on this contract if such employee is considered by the Contracting Officer Representative or Technical Representative or Contracting Officer to be a potential threat to health, safety, general well-being or operational mission of USDA and its employees. If the contracting officer finds a prospective employee to be unsuitable for his or her assigned duties, the contractor will be advised immediately that such employee cannot continue to work or be assigned to work under the contract.
E. The Contracting Officer Representative will assist the contractor, where practical, with the background investigation process and the associated paperwork. Where necessary they will provide contractor information to the security personnel and provide information and documents to the contractor.
(a) Contractors shall comply with the personal identity verification (PIV) policies and procedures established by the AGAR Advisory No. 81, Revision 03 dated July 19, 2010 – Common Identification Standard for Contractors. In addition, procedures to be followed by contractors and contractor employees are specified in the Departmental Regulation and Departmental Manual (DM) 4620-002.

(b) All background investigations or clearances must be completed one week prior to commencing work. Where this is not practical and the prime or subcontractor requires intermittent access to federally controlled facilities or are under the aggregate 180 day limit, a temporary guest ID badge will be issued and/or such personnel may be under constant supervision and their access to areas or data may be more restricted. Contractor employees who will NOT have routine unaccompanied physical access to a Federally-controlled facility and/or routine unaccompanied access to a Federally-controlled information system may be excluded from coverage by AGAR Advisory 81 based on the LincPass Distribution Risk Assessment. The LincPass Distribution Risk Assessment will be conducted by a USDA Sponsor for contract personnel (Contracting Officer’s Representative, or other Government designated program/project officers) as part of the PIV II registration, identity proofing, and credential issuance procedures.
(c) The Contractor shall provide to the USDA PIV Sponsor and the Personnel Security Specialist listed below, a list of all contractor and subcontractor employees full name, job title, employer (prime or subcontractor), contract number, performance period and/or the days employee is expected to be on-site for base year and each period of performance, if applicable, and information on OPM’s background investigation or clearance conducted by the prime or subcontractor and that contractor employees pass the background check.
(d) The Contractor shall take full responsibility to ensure that prime and subcontractor employees who require routine, long-term physical access to federally controlled facilities and logical access to Federally controlled information systems except for "national security systems" as defined by 44 U.S.C.
3542(b)(2), are required to complete and submit HRO 1197, Contractor Supplement and the AD-1197, Request for USDA Identification (ID) Badge, along with copies of two identity source documents (one being a photo ID) and two completed fingerprint cards (FD-258 attached), to the following. You can obtain these forms and further guidance from the Personnel Security Specialist who oversees the investigation process for contractors:

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.204-9 Personal Identity Verification of Contractor Personnel. (Jan 2011)
(a) The Contractor shall comply with agency personal identity verification procedures identified in the contract that implement Homeland Security Presidential Directive-12 (HSPD-12), Office of Management and Budget (OMB) guidance M-05-24 and Federal Information Processing Standards Publication (FIPS PUB) Number 201.
(b) The Contractor shall account for all forms of Government-provided identification issued to the Contractor employees in connection with performance under this contract. The Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government:
(1) When no longer needed for contract performance.
(2) Upon completion of the Contractor employee’s employment.
(3) Upon contract completion or termination.
(c) The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements.
(d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts when the subcontractor’s employees are required to have routine physical access to a Federally-controlled facility and/or routine access to a Federally-controlled information system. It shall be the responsibility of the prime Contractor to return such identification to the issuing agency in accordance with the terms set forth in paragraph (b) of this section, unless otherwise approved in writing by the Contracting Officer.

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.
(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the 12639521Q0187 persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

52.217-8 Option to Extend Services. (Nov 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

(a) The Government may extend the term of this contract by written notice to the Contractor within 15 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.
(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.
(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.
(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may-
(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and
(2) Reduce the contract price to reflect the reduced value of the services performed.
(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may-
(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or
(2) Terminate the contract for default.
