SCHEDULE NOTES

1)The quantities as listed in the “Schedule of Items” are estimated amounts for the BPA period.

The USDA, APHIS attempts to be as accurate as possible when providing estimated quantities, however, actual quantities required may vary from the quantities listed.

The estimated quantity does not convey either a minimum or maximum quantity that will be ordered by the government. The contractor shall not set their unit price based upon obtaining a guaranteed award amount.

2) Reference section 2.6 BPA ORDERS AND ORDERING PROCEDURES for information on ordering when there are multiple award BPA’s.

3) The government reserves the right to order different test kits that are similar in nature to the kits being requested in the Schedule of Items. All orders even if they are different test kits will be subject to the BPA ceiling limit and the ordering thresholds listed in 2.5 PURCHASE LIMITATION.

All orders must comply with 13.303-5.

4) The BPA holder has requested to reserve the right to increase BPA prices on February 1st of each contract year. The contractor shall provide the Contracting Officer with a minimum of a 30 day written notice prior to any price changes taking effect. Any BPA price increase shall not take effect until the Contracting Officer receives written notification via e-mail and the BPA is modified to incorporate the price changes. Any order already issued shall not be affected by any change to BPA pricing. The prices offered under this BPA will undergo annual review by the Contracting Officer.

5) If additional delivery locations other than AMES, IA is requested, then the pricing will be determined at that time and the BPA will be modified to include those future locations.

6) Every year in accordance with FAR 13.303-5 the Contract Officer may solicit to inquire if there are any other contractors able to provide the supplies listed in the SOW. This will be conducted if only one BPA holder or one quote is received. Contract Officer must make a determination that the BPA(s) are still in the best interest of the government and that pricing is fair and reasonable.

If such contractors exist and the Contracting Officer determines that it is in the governments best interest, the Contracting Officer must establish multiple award BPA’s and compete subsequent call orders amongst all BPA holders.
