2. All questions must be submitted in writing to Katie Maloney (katie.maloney@usda.gov). Submit questions no later than two (2) days prior to the response deadline to ensure adequate time is available to respond and amend the solicitation if necessary.

3. Quoters must have an active registration in the System for Award Management (beta.SAM.gov), including current online representations and certifications, no later than the solicitation response date. Registration must show small business size status per SBA Size Standards for NAICS 325120 Industrial Gas Manufacturing.

4. A prospective contractor may be requested to provide additional information to assist the

Government in making a responsibility determination (FAR Subpart 9.1).

5. This Request for Quote for commercial services is being conducted in accordance with FAR Subpart

13.5 procedures for commercial services. The Government will award a contract in accordance with FAR part 13.106 resulting from this solicitation to the responsible contractor whose quote, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. The Government does not assume the duty to search for information to cure the problems it finds in the information provided by the Contractor. The burden of providing thorough information remains with the Contractor.

Statement of Work (SOW)

1.0 General

1.1 Background

The USDA NVSL Warehouse in Ames, Iowa requires a constant supply of dry ice (solid carbon dioxide) pellets to preserve and ship biologic and reagent samples to external customers. These samples require dry ice during storage and transport to maintain viability, the loss of which could cause significant failures in the NVSL’s network capabilities to research and identify samples that have the means to destroy US agriculture.

1.2 Objective

The Government anticipates awarding a single five year firm fixed price Indefinite Delivery Indefinite Quantity (IDIQ) contract for dry ice pellets.

2.0 Requirements

2.1 Specifications

Per each delivery order, multiple containers of dry ice pellets must be delivered onto the loading dock at the NVSL facility in Ames, IA (address below) every week, and the empty containers from the previous week removed.

Each container must be filled with 500lbs of dry ice (solid carbon dioxide) pellets. The diameter of each pellet must be between .5 inch (1/2”) and .625 inch (5/8”). The dimensions for each container must not exceed 45” length, 32” width, 42” height.

The contractor must deliver three (3) wheeled containers between 7:45 a.m. and 9:00 a.m. local time every Monday (see below for holiday observance instructions) by use of an enclosed hard‐ bodied vehicle that is capable of unloading at dock height (48”‐52”). The contractor is responsible for unloading the full containers onto the dock and loading the empty containers into their vehicle.

The Government estimates that an additional container of 500lbs will be needed up to five weeks out of each calendar year. These dates will be scheduled ahead of time by the technical representative and the delivery procedure remains the same.

For the weeks in which the Monday is a Federal holiday or the observance of a Federal holiday, the delivery must be made during the same designated timeframe on Tuesday morning of that week. The calendar of Federal holidays and their observances can be found at Federal Holidays (opm.gov) and confirmed with the Contracting Officer’s Representative (COR) as needed.

2.2 Contract type

This is a firm fixed price Indefinite Quantity Indefinite Delivery (IDIQ) contract with five (5) one‐ year ordering periods. The full period of performance of the IDIQ is estimated to be 2/1/24‐ 1/31/29. We anticipate delivery orders will placed on an annual basis against this IDIQ, though additional orders may also be placed on an as‐needed basis.

2.3 Pricing Schedule

The pricing provided for in the contract includes full compensation for providing supplies, labor, supervision, equipment, incidental materials, quality control, environmental protection, meeting safety standards, and performing all work under the contract in a complete and acceptable manner. The Government is not obligated to pay the Contractor for any supplies or services performed other than those specified in the Pricing Schedule. Each Weekly Delivery must consist of three (3) containers (CH) meeting the specifications in Section 2.1, unless otherwise directed by the COR. The COR may request an additional container (for a weekly delivery total of four (4) containers) up to five times per 12‐month order. Deliveries requested in excess of four (4) containers require a separate order against this IDIQ.

The quantities listed below are estimates and do not indicate minimum or maximum values.

3.0 Administration

This is an Indefinite Delivery Indefinite Quantity (IDIQ) contract vehicle with a guaranteed order minimum (see 3.2). Delivery orders will be placed for 12‐months of deliveries at a time, estimated once per calendar year. Additional orders may be placed on an as‐needed basis and must adhere to the order minimums and maximums as listed in Section 3.2. Orders may be issued orally or by electronic commerce methods by a warranted contracting officer. Only warranted contracting officers from the issuing office may award orders using this IDIQ.

3.1 Firm fixed price

This IDIQ and all orders placed against it are priced per container, not per weight. The unit price per container will be established on the IDIQ and confirmed with the contractor as each new order is considered. The Government is not responsible for and will not pay for any costs incurred by the contractor if the source of the dry ice that the contractor delivers charges per pound and more than 500lbs per container are provided/delivered. We recommend ensuring that each container contains as close to 500lbs as possible to avoid unnecessary losses in profit.

3.2 Contract Minimums and Maximums

IDIQ Guaranteed Minimum: $12,000.00

IDIQ Maximum Ceiling (includes all orders placed within 5‐yr ordering period): $150,000.00

Delivery Order Minimum: $100.00

Delivery Order Maximum: $30,000.00

3.3 Facility Access

The following rules and regulations apply to all property at the National Centers for Animal Health (NCAH), Ames, Iowa under the custody of the USDA and to all persons entering on such property.

Admission to Property: The campus is closed to the general public. Admission to the facility is restricted to authorized persons and approved visitors. Upon entry, visitors:

1. Will be required to present Government or other identifying credentials to the Officer at the Visitor Gate (photo driver’s license, passport, or other official photo identification).

2. Will be issued a visitor’s badge and must wear and display the badge at all times while visiting the facilities.

3. Will proceed to the loading dock located at 1920 Dayton Ave, Ames, Iowa 50010 (Building 24).

Conduct on Federal Property

1. Contractor employees shall be escorted by a facility escort officer while on grounds. The facility escort officer shall ensure that contractor employees receive a brief overview of emergency procedures to first‐time visitors and when there any major changes in procedure. Facility escort officer shall also provide timely instructions to contractor employees during an emergency. If a facility escort officer is not present at any point during the contractor’s time on site, contractor shall immediately contact the COR for direction. If the COR cannot be reached, contractor shall contact the other POCs and/or facility security for directions.

2. All contractor employees shall have a valid picture identification, such as a driver’s license or state identification card, and shall adhere to the facility requirements for identification.

3. Contractor employees shall not operate any vehicles without a valid driver’s license.

Each contractor provided vehicle or towed trailer shall display the contractor’s name so that it is clearly visible on the vehicle. A valid state license plate, vehicle registration, and insurance are required for each vehicle. All vehicles operated on government property shall be maintained in a good state of repair.

4. Contractor is advised that the facility grounds are under security camera surveillance at all times and employees are subject to all facility regulations concerning Closed Circuit Television while on grounds.

5. Contractor employees are prohibited from taking any photos or video recordings while on grounds, per facility regulations, unless authorized by facility escort officer or security officer.

6. Contractor employees shall comply with all facility and Federal Property regulations and policies, including:

3.5 Invoicing

Contractor may submit invoices on a weekly basis after delivery being invoiced has been made.

USDA uses the Invoice Processing Platform (IPP) for electronic submission and tracking of purchase orders, invoices, and payment information to its suppliers of goods and services. The IPP is a government‐wide secure web‐based invoice processing service offered free of charge to government agencies and their suppliers by the U.S. Department of Treasury’s Financial Management Service (FMS). Invoices must be submitted in arrears and include the following information:

(i) Name and address of the Contractor.

(ii) Invoice date and number.

(iii) Contract number and contract line‐item number.

(iv) Description, quantity, unit of measure, unit price and extended price of the items delivered.

(v) Name, title, and phone number of persons to notify in event of defective invoice.

Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government:

(1) When no longer needed for contract performance.

(2) Upon completion of the Contractor employee’s employment.

(c) The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements.

(d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts when the subcontractor’s employees are required to have routine physical access to a Federally‐controlled facility and/or routine access to a Federally‐controlled information system. It shall be the responsibility of the prime Contractor to return such identification to the issuing agency in accordance with the terms set forth in paragraph (b) of this section, unless otherwise approved in writing by the Contracting Officer.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215‐2, Audit and Records‐Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause‐
