STATEMENT OF WORK

TITLE: Pickup and Destruction of Bio Medical Waste

United States Department of Agriculture (USDA), Animal and Plant Health Inspection Service (APHIS) Veterinary Services (VS) has an immediate need for Pickup and Destruction of Bio Medical Waste.

SCOPE

Contractor shall weekly pickup Biohazard Waste from Laboratorio Diagnóstico Veterinario and dispose of waste. Address is

Laboratorio Diagnóstico Veterinario Carretera 694 KM 4.0 Interior Bo. Higuillar Dorado, PR 00646-3445 Phone 787-769-1650

BACKGROUND

African Swine Fever (ASF) was discovered in Haiti and the Dominican Republic (DR).

During discussions it was decided that APHIS would activate a lab in Dorado, PR and make it a regional lab for testing for the ASF. It was determined that APHIS would support the lab by providing services including the pickup and disposal of Medical Biohazard Waste from the sampling of swine in PR and samples shipped from the USVI, DR and Haiti, It is estimated that there will be approximately 4 boxes of medical waste per week. This lab will be in operation for at least the next 5 years with the same estimated costs per year.

GENERAL REQUIREMENTS

The following sections define the specific services required. The Contractor shall be fully responsible for performing the services specified.

The specifications herein are a statement of the minimum level of waste pick up and disposal services and standards of performance that the Contractor shall abide under the Award. They are not intended to represent maximum performance levels or limitation of the effort the Contractor shall expend to accomplish said work. The task and expectations related to the hauling function are all inclusive. The CO may add or delete from these functions, as justified. All changes to any contract terms or functions will be executed by modification.

All costs associated with complying with the requirements herein are included in the firm fixed fully loaded monthly service rate. The Contractor shall provide all labor, supervision, management, materials, equipment, containers, supplies (including consumables), vehicles, recordkeeping, reporting and all other supplies and services necessary to successfully perform waste hauling and all related supplemental services in accordance with the standards described and set herein.

The Contractor shall provide waste hauling services and related supplemental services for the Department of General Services. The Contractor shall use best efforts, skill, judgment, innovation, technology, and abilities to meet the industry and Federal Government performance standards specified herein.

a) Points-of-Contact (POCs):

APHIS POC for coordination for pickup is Elizabeth Rivera 787-919-7787 Elizabeth.riveratirado@usda.gov

BIOSECURITY/BIOSAFETY

Site biosecurity must be maintained at all times and must follow protocols established by USDA or the State. As part of initial orientation, all SMEs shall receive a biosecurity briefing and instructions on how to maintain personal and vehicle biosecurity when visiting infected premises.

PERSONAL PROTECTIVE EQUIPMENT AND PERSONNEL SAFETY

Contractors are responsible for protecting the health of their employees. Information on proper PPE for doing the prescribed work can be obtained from CDC. Contractors are responsible for meeting OSHA requirements for safety of their employees.

HEALTH AND WELFARE

Contractor is required to notify the POC of any medical or safety problems immediately.

REGULATORY COMPLIANCE

Contractor shall comply with all federal, state, and local statutes and regulations including but not limited to the Occupational Safety and Health (OSH) Act, the Federal Compensation Act, the Clean Water Act, the Clean Air Act, the Resource Conservation and Recovery Act, the Oil Pollution Act, the Comprehensive Environmental Response, Compensation and Liability Act, the Public Health Act, National Fire Protection Association standards, and National Electrical Code.

OSHA REGULATIONS

Contractor shall know, understand, and comply with the OSH Act of 1970 and implementing regulations (29 CFR 1910 and 1926) as it pertains to their work activities. The OSH Act is administered by the U.S. Department of Labor in conjunction with the federal Occupational Safety and Health Administration (OSHA) or OSHA-approved state programs. Contractor must also comply with OSHA regulations and the General Duty Clause, if applicable, which state that each employer “shall furnish to each of their employees’ employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.” Furthermore, the SME must comply with OSHA recordkeeping requirements (29 CFR 1904) using OSHA logs 300, 301, and 300A, Logs of Occupational Injuries and Illnesses. The Contractor, if applicable, must report all work-related fatalities to OSHA within 8 hours. The Contractor must report all accidents in which one or more people experience inpatient hospitalizations, amputations or losses of an eye, to OSHA only if they occur 24 hours of the work-related incident (29 CFR 1904.39).

HEALTH MONITORING

Contractors potentially exposed to avian influenza shall be monitored for the development of illness consistent with influenza, [e.g., respiratory symptoms and/or conjunctivitis (i.e., eye infections)] after their first exposure and for 10 days following demobilization.

The Contractor shall notify the APHIS Safety Officer and the State and local public health departments if the Contractor becomes ill with influenza like illness during deployment. Ill employees shall seek prompt medical care under the direction of State and local public health departments, who will give notification prior to arrival at the health care provider’s office or clinic that the ill employee may have been exposed to a virus.

To ensure adequate monitoring of influenza like illness following demobilization, demobilization information for each SME responder will be shared with the Centers for Disease Control and Prevention (CDC) in the same format used by APHIS. State and local public health department personnel will oversee the responder monitoring in the ten days following demobilization. State and local public health departments will use contact information provided by the contractor solely to monitor for influenza like illness in exposed employees. CDC has indicated that the State and local public health departments will keep this information confidential and that they will not maintain the information beyond the 10 day monitoring period.

HAZARDOUS MATERIALS

Contractors are responsible for the safe use, storage, transportation and disposal of hazardous materials in accordance with all federal, state, and local laws. Contractors must have available for APHIS a list of chemicals or hazardous materials used in performance of their work and a copy of the Safety Data Sheets (SDS) for each material. The receipt of the list of SDS by APHIS does not relieve the Contractor from requiring employees and other persons performing work to assume responsibility for the safe use, storage, and disposal of hazardous materials.

Contractors must require their suppliers, agents, and employees performing work, to use an approved substitute chemical or material in the place of a chemical or material that APHIS has restricted for use. Chemicals or materials brought onsite by employees and other persons performing work must bear a label stating the identity of the chemical or material, hazards associated with it, and the name of the responsible party bringing the chemical or material onsite.

Waste resulting from the work must be properly disposed of by the responsible contractor in accordance with federal, state, and local regulations. If the contractor is uncertain about proper waste disposal, he/she should contact the APHIS environmental representative. The contractor should report to the APHIS safety program any hazardous materials, pollutants, and contaminants encountered or generated from soils or facilities in place prior to commencement of work, or from portions of the contract already completed by other contractors. These will be disposed of in accordance with applicable laws. Contractors are required to keep accurate records of the types and quantities of waste, including but not limited to hazardous waste, and the facilities in which the waste is treated, incinerated, or disposed. The contractor must provide APHIS with copies of these records. Contractors cannot discharge or allow liquids (including muddy water) or chemicals to flow into a sewer or an open body of water, such as rivers, lakes, streams, washes, or drainage ditches.

Each new employee of the contractor will attend a safety and health orientation that includes the following information and training:

A. Complete overview of the OSHA Hazard Communication Standard (29 CFR 1910.1200).

B. Hazardous chemicals present at his/her work site.

C. Physical and health risks of the hazardous chemicals employees will be working with.

D. Signs/symptoms of an overexposure to a chemical.

E. Proper use of equipment to determine the presence or release of hazardous chemicals at the work site.

F. How to reduce or prevent exposure to hazardous chemicals through use of control procedures, work practices, and personal protective equipment (PPE).

G. Steps the company has taken to reduce or prevent exposure to hazardous chemicals.

H. Procedures to follow for overexposures to hazardous chemicals.

I. How to read labels and SDS to obtain hazard information.

J. Location of the SDS and written hazard communication program.

K. Proper storage, transport, and disposal of hazardous materials.

WORKERS’ COMPENSATION AND EMPLOYERS’ LIABILITY

Contractors, whether or not their contracts are subject to Cost Accounting Standard 416, are required by law and this regulation to provide insurance for certain types of perils (e.g., workers’ compensation) per 48 CFR 28.301.

SECURITY

The contractor shall perform, at a minimum, a comprehensive FBI national felony conviction search on any prospective employee. For any new prospective employee (anyone currently not already working on one of the APHIS job sites) the APHIS security office must be notified of any past felony convictions. For any current employees on the APHIS job sites the contractor must complete the FBI national felony conviction search within 7 days of the date of this modification. Once the FBI national felony conviction search is complete the contractor shall notify APHIS Security immediately of any employee with past felony convictions. Felony convictions will not mean an automatic termination from the job site nor be the sole grounds of employees not working on future sites. APHIS Security will assess the felony conviction information and work with the contractor to determine the course of action for any affected current or prospective employee of the contractor. This requirement is also applicable to any subcontractors working on job sites under the prime APHIS contract.

ADMINISTRATION

Invoices should be submitted weekly in IPP with all supporting documentation.

USDA uses the Invoice Processing Platform (IPP) for electronic submission and tracking of purchase orders, invoices, and payment information to its suppliers of goods and services: Enroll at https://ipp.gov. The IPP is a government-wide secure web-based invoice processing service offered free of charge to government agencies and their suppliers by the U.S. Department of Treasury’s Financial Management Service (FMS).

You will receive a notification of your one-time enrollment requirement in an automatic invoice payment notification system available through IPP. This one-time enrollment in IPP means that you will receive a series of e-mails from Treasury services.

Upon demobilization contractors must submit final invoices and attach all supporting documentation as required within 5 business days.
