1.0 STATEMENT OF WORK

Analytical chemistry methods development and validation FIFRA GLP Preliminary (5-batch) Analysis study Draft an Enforcement Analytical Method for the pesticide active ingredient, hardwood charcoal

1.1 BACKGROUND

The U.S. Department of Agriculture’s Animal and Plant Health Inspection Service (APHIS) will be applying to the U.S. Environmental Protection Agency (EPA) to add a new unregistered source of a pesticide active ingredient (hardwood charcoal) to APHIS’s pesticide product registrations in accordance with Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). As part of this application, APHIS must provide a preliminary (5-batch) analysis study and an Enforcement Analytical Method for the source of hardwood charcoal.

1.2 OBJECTIVES

1. Characterize the concentration of the active ingredient (fixed carbon) and certain impurities in samples from five independent manufacturing batches of hardwood charcoal in accordance with EPA OPPTS 830.1700 [1] and FIFRA GLP requirements [2]. 2.Provide a final report that meets the FIFRA GLP requirements and EPA's data submission format requirements (EPA PRN 2011-3 Standard Format for Data Submitted Under FIFRA and Certain Provisions of FFDCA [3].

3. The analytical chemistry method for fixed carbon and sulfur must also be written up as an Enforcement Analytical Method following EPA’s study guideline EPA OPPTS 830.1800 [4] and in accordance with EPA PR 2011-3 [3].

1.3 DELIVERABLES

The contractor is required to provide all labor and materials required to complete the following deliverables:

1. Develop and validate analytical chemistry methods to characterize the concentration of fixed carbon, sulfur, ash, moisture, volatile matter, and heavy metals in granular hardwood charcoal in accordance with all applicable FIFRA GLP requirements [2]. The ASTM’s Standard Test Method for Chemical Analysis of Wood Charcoal (D1762–84, 2021) [5] may be used for measuring ash, moisture, and volatile matter if the contract laboratory chooses, and should be included in the price.

2. Draft a study protocol for the subsequent preliminary (5-batch) analysis study, which will be approved by the study sponsor's representative prior to initiation of any laboratory testing of the five batches of the test substance. Any amendments to the study protocol will also be approved by the sponsor's representative prior to implementation.

3. Procure and characterize any reference standards and other materials required for use in the method development and validation and the preliminary (5-batch) analysis study in accordance with any applicable FIFRA GLP requirements [2]. Any incurred costs to procure reference standards should be included in the price.

4. Characterize the concentration of the active ingredient, fixed carbon, and the impurities sulfur, moisture, volatile matter, ash, and heavy metals in the samples from five independent manufacturing batches of charcoal that will be provided to the test facility by the sponsor’s representative in accordance with EPA OPPTS 830.1700 [1] and the FIFRA GLP requirements [2].

5. Draft a final study report and obtain approval of the final report from the sponsor’s representative. Once approved, provide a final report that meets the FIFRA GLP requirements [2] and EPA's data submission format requirements in EPA PRN 2011-3 [3].

6. Draft an Enforcement Analytical Method for the analytical chemistry method for fixed carbon and sulfur, including the method validation data, following EPA’s study guideline EPA OPPTS 830.1800 [4], and in accordance with EPA PR 2011-3 [3].

7. Dispose of the test substance and samples.

1.4 APPLICABLE STANDARDS

The contractor must adhere to the standards as outlined below:

a) All aspects of the Preliminary (5-batch) Analysis study and study records will be completed in compliance with EPA OPPTS 830.1700 [1] except when agreed upon in writing ahead of time by the sponsor’s representative.

b) All aspects of the study and study records will be completed in compliance with FIFRA GLP requirements [2].

c) All deviations from EPA guidelines require written approval of the sponsor’s representative.

- Written approval of the sponsor’s representative may be obtained via e-mail, or signed study protocol or protocol amendment, as appropriate.

d) The final report for the Preliminary (5-batch) Analysis study and the Enforcement

Analytical Method will be formatted to conform to EPA’s PRN 2011-3.

- Any deviations from the EPA study guidelines must be well documented with sound justification in the final report as approved by the sponsor’s representative.

e) If EPA determines during their science review after submittal by the Government that the final report or Enforcement Analytical Method do not fulfill the data requirements because of the test facility’s errors or omissions in the documents, or failure to adhere to the EPA study guideline and/or GLP standards during the study phase in ways not previously agreed upon by the sponsor’s representative, the vendor shall repeat the study at the vendor’s cost. If EPA does not find the reports acceptable to fulfill the core data requirement for reasons unrelated to the test facility’s compliance with EPA guidance or regulations, the vendor is not responsible for failure to meet the terms of this order.

1.5 CONTRACTOR QUALIFICATIONS

The contractor shall have demonstrated successful experience in conducting studies in accordance with OPPTS 830.1700 and in compliance with EPA FIFRA GLP standards using GLP-validated chemistry analytical methods as described in 3.1 below.

1.6 PLACE OF PERFORMANCE

The order shall be conducted within the Contractor’s research facilities.

1.7 PERIOD OF PERFORMANCE

The GLP final report shall be completed within 150 calendar days after the Contractor receives the test substance (5 batches of hardwood charcoal) from the sponsor’s representative (USDA Technical Contact).

1.8 CONTRACT TYPE

The Government intends to issue this requirement as a firm fixed price purchase order.

1.9 INVOICING

Upon completion of all the deliverables, the contractor shall submit an invoice detailing description of deliverables completed through the Invoice Processing Platform (www.IPP.gov).

3.0 Evaluation Factors and Submission Requirements

3.1 Evaluation Factors

In this acquisition, the Government will identify the quote that offers the best value to the Government based on price and non-price factors and allows the Government to accept other than the lowest priced quote.

Submittal evaluation will occur in accordance with Simplified Acquisition Procedures as outlined in FAR part 13.106-2.

EVALUATION FACTORS:

Price Please complete a firm fixed price in accordance with Section 2.0.

Technical Capability The contract laboratory shall demonstrate experience in conducting at least 3 prior studies in accordance with EPA OPPTS 830.1700 [1] and EPA FIFRA GLP requirements [3] within the past 15 years. Provide documentation from the contract laboratory facility’s ‘Master Schedule’ or equivalent documentation.

The laboratory must have had at least one inspection or data audit by the U.S. EPA for compliance with EPA FIFRA GLP standards [2] within the last 15 years. If one or more audits were conducted in the past 15 years, the three most recent closed audits within the timeframe must not have resulted in EPA’s rejection of a study either partially or fully due to failure to comply with all EPA GLP standards. Provide documentation of the one, or if available in the previous 15 years, up to three most recent audit findings. Foreign companies may provide the results of the most recent inspection by their authority responsible for GLP compliance.

Personnel

Identify the Study Director and demonstrate prior experience participating in development of at least one other study following the EPA OPPTS 830.1700 [1] guideline. Provide a statement summarizing personnel experience.

Describe the qualifications of those performing and managing testing services. Based on professional resumes submitted, higher ratings will be given to individuals with experience in providing regulatory testing and participating in legal proceedings as a result of tests.

Past Performance Past performance is a measure of the degree to which an offeror has satisfied customers in the past, and complied with federal, state, and local laws and regulations. Offeror’s with no past performance information will be given a neutral rating.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid , is in excess of the simplified acquisition threshold , as defined in FAR 2.101, on the date of award of this contract , and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States , or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor ’s directly pertinent records involving transactions related to this contract .

(2) The Contractor shall make available at its offices at all reasonable times the records, materials , and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract . If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data , regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

5.0 Provisions

52.212-3 Offeror Representations and Certifications—Commercial Products and Commercial Services.

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.

(a) Definitions . As used in this provision—

"Covered telecommunications equipment or services " has the meaning provided in the clause 52.204-

25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment .

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror , or that owns or controls one or more entities that control an immediate owner of the offeror . No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror , that has direct control of the offeror .

Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment , and the common use of employees.

Inverted domestic corporation , means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
