TERMS AND CONDITIONS

SCHEDULE NOTES:

The Department of Labor Service Contract Act applies to this contract. The contractor is responsible for determining the appropriate labor categories/occupation codes under the Attachment 2 - Wage Determination for the personnel performing the services of the contract.

1.0 PURPOSE

USDA APHIS PPQ requires the installation of Bipolar Ionization Units For Air Purification at Building 6418, Moore Air Base, Edinburg, TX. Recirculated air allows for transmission of airborne pathogens within an occupied environment. The identified site will require installation of a Bi-Polar Ionization units designed to destroy pathogens, viruses, and allergens at the source. The ionization units shall be installed at each air handler.

2.0 SUBMISSION REQUIREMENTS

The following items are required to be submitted in order to be eligible for award:

a) A signed copy of the SF 1449 Form. Please complete Block 17a including vendor name, address, phone number, Federal Tax ID number, and DUNS number. Then, sign in block 30a.

b) Provide unit price and extended amount in the pricing schedule of the solicitation provided in Item 20 Schedule of Supplies/Services section of the SF1449 Solicitation in accordance with the Attachment 1 – Statement of Work.

Provide the grand total amount in Block 26 of the SF1449 Solicitation.

c) Past performance information will be evaluated through the Past Performance Information Retrieval System

(PPIRS).

d) System for Award Management (SAM) registration: SAM registration is required of all entities doing business with the federal government. SAM registration enables electronic funds transfer of contract payments. If your company is not already registered, please register in the SAM database at https://www.sam.gov/portal/public/SAM/.

i. A DUNS number is required for SAM registration. If your company does not have DUNS #, obtain one by calling

800-333-0505.

ii. If the prospective awardee for this request for quotes is not registered in the SAM database by the solicitation close date, the government will proceed to award to the next otherwise successful registered offeror.

iii. Ensure FAR Clauses 52.212-3 and 52.204-24 are completed as they are new versions of the clauses and may not be updated in your SAM registration.

e) Quotes are due via email no later than 5:00 PM CT on 5/14/2021. It is the contractor’s responsibility to ensure quotes are received on time. Please note that file size limitations, formatting, or other problems may hamper receipt so please verify that the contracting officer has received your quote in accordance with Section 2.0 Submission Requirements to martha.worlein@usda.gov.

f) Evaluation Criteria are found at 52.212-2 Evaluation-Commercial Items.

g) All questions concerning the solicitation must be forwarded by email to martha.worlein@usda.gov; no questions by telephone will be entertained.

3.0 WAGE DETERMINATION AND LABOR RATES

The Department of Labor Service Contract Act applies to this contract. The contractor shall be responsible for determining the appropriate labor categories/occupation codes in the applicable wage determination for the personnel performing services under this contract. Attachment 2 is the Dept. of Labor Service Contract Act Wage Determination for Edinburg, Hidalgo County TX.

4.0 CONTRACTING OFFICER’S REPRESENTATIVE (COR)

The Contracting Officer has designated the Contracting Officer’s Representative (COR) as shown in item 1.2. The COR will be the contractor’s local Government contact for contracts awarded against this requirement.

The COR is responsible for monitoring the performance of work under contracts awarded as written in the contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms mailto:martha.worlein@usda.gov of the contract be effective or binding upon the Government unless advance authorization is received from the Contracting Officer, and proper contractual documents executed by the Contracting Officer prior to performing the work.

The COR shall inform the Contracting Officer as soon as possible of any recommended modifications, and actions or inactions of the contractor or the Government which could affect the contractor’s ability to comply with the contract performance requirements or completion times.

Whenever, in the opinion of the contractor, the COR requests effort outside the scope of the contract, the contractor shall so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer shall be notified immediately.

PROCEEDING WITH WORK WITHOUT PROPER CONTRACTUAL COVERAGE AND APPROVAL OF THE CO COULD RESULT IN A

BREACH OF CONTRACT AND NONPAYMENT.

The designation (delegation of authority) shall be provided in writing to the COR and the contractor. The delegation of authority shall clearly explain the COR’s role and responsibility on the contract, and limitations of authority.

Contracting Officers Representative (COR), and Technical Point of Contact will be included in the award document.

5.0 INVOICES AND PAYMENT INFORMATION

The USDA, APHIS uses the Invoice Processing Platform (IPP) for electronic submission and tracking of invoices and payment information to its suppliers of goods and services. Invoices shall be submitted electronically to the IPP invoicing system.

The contractor must enroll at https://ipp.gov. The IPP is a government-wide secure web-based invoice processing service offered free of charge to government agencies and their suppliers by the U.S. Department of Treasury’s Financial Management Service (FMS). Upon contract award, you will receive a notification of your one-time enrollment requirement in an automatic invoice payment notification system available through IPP. This one-time enrollment in IPP means that you will receive a series of e-mails from Treasury services. Invoices must be prepared in accordance with 52.212-4 (g).

Invoices for repairs must include the signed authorization to proceed from the COR.

Contractors must submit invoices and attach all supporting documentation as required within five (5) business days of completion of services provided.

A proper invoice must include:

a) Name and address of the Contractor

b) Invoice date and number

c) Contract number, Delivery Order number, and line item number

d) Description, quantity, unit of issue, unit price and extended amount of the items successfully provided

e) Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on

Government bill of lading

f) Name, title, and phone number of people to notify in event of defective invoice; and

g) Taxpayer Identification Number (TIN).

The Government reserves the right to reject an invoice that does not include the information above.

6.0 SAFETY AND SECURITY REQUIREMENTS

6.1 Contractors shall comply with the personal identity verification (PIV) policies and procedures established by the AGAR Advisory No. 81, Revision 03 dated July 19, 2010- Common Identification Standard for Contractors.

6.2 Procedures to be followed by contractors and contractor employees are specified in the Departmental Regulation and Departmental Manual (DM) 4620-002. Copies can be downloaded from the website at http://hspd12.usda.gov

6.3 In accordance with the USDA policy and directives, a Background Investigation (BI) of the contractor personnel onsite performing services under this contract may be required prior to starting work under this contract as well as maintaining it throughout the duration of the contract. 6.4 The USDA, APHIS will pay for any required federal background investigations. The government shall have and exercise full and complete control over granting, denying, withholding, or termination the background investigation clearance for employees.

6.5 The USDA APHIS will determine the type of background investigation that is required. All contractor personnel subject to a BI must have no less than favorably adjudicated results. Once approved and working under the contract, the contractor personnel shall not be removed or diverted from the site without prior notification to the Contracting Officer, Contracting Officer Representative, or the designated point of contact.

6.6 The contractor shall not employ persons for work on this contract if such employee is considered by the USDA to be a potential threat to health, safety, general well-being or operational mission of USDA and its employees and property. If the USDA finds a prospective employee to be unsuitable for his or her assigned duties, the contractor will be advised immediately that such employee cannot continue to work or be assigned to work under the contract.

6.7 The Contracting Officer Representative or other designated point of contact will assist the contractor, where practical, with the background investigation process and the associated paperwork.

6.8 The Contractor shall provide to the USDA Personal Identity Verification Sponsor and the Personnel Security Specialist the information required to initiate the background investigation, including information on previous Office of Personnel Management background investigations or clearances conducted by the contractor. The Contractor shall ensure that prime and subcontractor employees requiring background investigations complete and submit the proper paperwork and forms. 452.228-71 Insurance Coverage. (NOV 1996) Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and 500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.
