RESPONSES TO QUESTIONS

May 17, 2018

1. Would it be possible to carry the logs whole to Michigan and cut into pieces there in the lots of the storage areas then stack in the coolers?

Response: Yes. The contractor is responsible for scheduling and executing the work in the most efficient way possible.

2. Any special permit needed to transfer wood from state to state?

No special permitting will be necessary on condition that the drivers route stays within Gypsy Moth quarantined counties (see attached “European Gypsy Moth (Lymantria dispar) North America quarantine”). Lake County of Indiana is not under quarantine and likely will fall within the route of transport. This county has been made an exception by the USDA State Plant Health Director of Indiana, and a permit is not required to pass through Lake County. If transport requires leaving a quarantined county to enter a county not under quarantine (with the exception of Lake County, Indiana), please consult your State or Federal plant protection inspector or your county agent for assistance regarding exact areas under regulation and requirements for moving regulated articles (See attached State Plant Health Directors list).

3. Is there a penalty for going beyond 3 weeks? (i.e weather delays) Response: Yes. The contractor will be liable for default unless nonperformance results from an excusable delay in accordance with clause 52.212‐4. Unusually severe weather is considered an excusable delay. The contractor is responsible for considering the uncertainties of weather when scheduling and executing the work.

52.212‐4 (f) Excusable delays: "The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers..."

Section 1.5 Unusual or Differing Site conditions: " (a) The contractor shall take steps reasonably necessary to ascertain the nature and location of the work at a given property site, and to investigate and satisfy itself as to the general and local conditions which can affect work or its cost, including but not limited to (1) conditions bearing upon transportation, disposal, handling, and storage of materials; (2) the availability of water, electric power, and roads; (3) uncertainties of weather, or similar physical conditions at the site; (4) conditions of the ground; (5) the character of equipment and facilities needed preliminary to and during work performance.

4. What size of diameter of wood needs to be transferred?

Response: See Exhibit B, Tree Inventory. See also Section 1.7, Transportation of Harvested Material. The contractor is required to transport the whole trees (everything ≥ 2 inches in diameter) bucked into sections of ~20 inches.

(continued)

5. Can a wood chipper be used for the brush?

Response: See Section 1.10, Performance Requirements. The contractor is responsible for determining the methods and equipment necessary to perform the work.

6. How long can the trees be laying on the ground before they need to be placed into a cooler?

Response: See Paragraph 1.5, Period of Performance.

7. Stumps need ground down?

Response: No. See Section 1.10, Performance Requirements. Trees are to be cut as close to level with the ground as possible, but left no taller than 6 inches.

8. Permission for extended stay at the park with RV camper?

Response: Permission has been granted by the Wisconsin Department of Natural Resources to stay on the premises overnight free of charge. All park rules and regulations apply to any parties staying within the park during the period of harvest. Only individuals that are employed by and a part of the contracted crew may stay on the premises. Any individuals staying within the park must keep any and all overnight equipment within the designated Staging Area. The period in which the contractor is allowed to stay on site expires when work has concluded.

9. Will the pieces of wood need to be transported in an enclosed truck/trailer?

Response: There are no USDA APHIS regulations requiring the transport of the wood material in an enclosed truck/trailer. See section 1.3.5 Transport.

10. Will you provide a map of tree locations?

Response: See Exhibit A, Site Summary
