1. Submit quotes to Lisa Draves at lisa.a.draves@aphis.usda.gov at or before the time specified in this solicitation.

A COMPLETE QUOTE SHALL INCLUDE THE FOLLOWING INFORMATION:

Cover page or Signed Standard Form (SF) 1449. Reference the solicitation number and include company name, address, DUNS number and point of contact information.

Pricing Schedule (Page 4). Provide a unit price for each line item specified in the Pricing

Schedule. Alternative pricing schedules will not be considered.

Technical Information. Provide a technical description of the items being quoted in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents as necessary.

2. This solicitation will result in a fixed price Indefinite‐Delivery Indefinite‐Quantity (IDIQ) type contract. Contract and delivery order minimums and maximums are addressed in the following clauses: 52.216‐22 Indefinite Quantity, 52.216‐19, Order Limitations, and 452.216‐73 Minimum and Maximum Contract Amounts. The line item quantities listed in the Pricing Schedule are for evaluation purposes only and are not intended to convey a minimum or maximum quantity that will be ordered by the Government.

3. This solicitation is issued as a total small business set‐aside. The end items quoted must be manufactured or produced by small business concerns in the United States or its outlying areas (52.219‐6, Notice of Total Small Business Set‐Aside). A firm submitting a quote or offer in its own name that proposes to furnish an end product it did not manufacture (a “nonmanufacturer”), is considered a small business if it has no more than 500 employees AND the product is of a small business manufacturer or producer (FAR Subpart 19.102).

4. All questions must be submitted in writing to Lisa Draves lisa.a.draves@aphis.usda.gov. Submit questions no later than three (3) business days prior to the response deadline to ensure adequate time is available to respond and to amend the solicitation if necessary.

5. Offerors must be registered in the System for Award Management (www.sam.gov), including current online representations and certifications, no later than the solicitation response date.

6. In accordance with Federal Acquisition Regulation (FAR) Subpart 9.1, a prospective contractor may be requested to provide additional information in order to assist the Government in making a responsibility determination.

7. The United States Department of Agriculture Animal and Plant Health Inspection Service is an agency of the Federal Government and is tax exempt (Tax ID# 41‐0696271).

PRICING SCHEDULE

Unit Price shall include all costs associated with furnishing and delivering all materials and for performing all work required under the contract in a complete and acceptable manner.

1.0 SPECIFICATIONS

1. Statement of Work.

The contractor shall furnish and deliver Polypropylene plastic fencing rolls, as specified, on an as‐needed basis. These materials will be distributed by the Government as deemed appropriate as part of the Wisconsin Wildlife Damage Abatement and Claims Program to cooperators experiencing crop damage caused by white‐tail deer, wild turkeys, Canada geese, or elk.

2. Product Specifications Polypropylene plastic fencing rolls UV protection 6’ x 330’ roll (exact dimensions required) Hole size 1.75” x 1.96” (maximum size) Minimum strength 450 pounds per square foot horizontal by 610 pounds per square foot vertical.

3. Type of Contract

This is an Indefinite‐Delivery Indefinite‐Quantity (IDIQ) type contract. Supplies will be ordered through the issuance of individual delivery orders as the requirements of the Government are defined. Each delivery order will specify the quantity being ordered and delivery location. Delivery order prices will be in accordance with the fixed unit prices established in the Pricing Schedule. The unit price that will be paid for any line item will not be changed based on the quantity actually ordered by the Government. See clause 52.216‐22 Indefinite Quantity, 52.216‐19, Order Limitations, and 452.216‐73 Minimum and Maximum Contract Amounts. The payment provided in the contract shall constitute full compensation for performing all work under the contract in a complete and acceptable manner.

4. Period of Performance

The contract period of performance consists of the following ordering periods:

Ordering Period 1: Date of Award through March 31, 2019 Ordering Period 2: April 1, 2019 through March 31, 2020 Ordering Period 3: April 1, 2020 through March 31, 2021

5. Delivery of Product:

FOB Destination within 2 week following the issuance of a delivery order. Delivery shall be made to the following locations:

Special Requirements: Lift gate required for delivery to be included in cost. Neither location has capability of unloading truck without the lift gate, there are no loading docks or forklifts available at either location.

Call the Government Delivery Point of Contact 24 hours prior to delivery to assure that someone is available to received delivery at both locations. No other security clearance, travel or special knowledge required. Government Delivery Point of Contact: Laurinda Koeck 920‐324‐4514.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215‐2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.216‐18 ORDERING (OCT 1995)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued according to the following schedule:

(b) All delivery orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

For the purposes of this contract, a delivery order must be in writing and signed by the Contracting Officer.

Orders may be issued by mail, by fax transmission, by personal service, or by electronic transmission. A delivery order shall be considered to have been issued: (1) at the time the Government transmits written notification to the Contractor if transmission is by fax, mail, or other electronic means;

(2) at the time the contractor receives the order if the transmission is by mail or personal service.

52.216‐19 ORDER LIMITATIONS (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $3,500 the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor ‐‐

(1) Any order for a single item in excess of $3,500

(2) Any order for a combination of items in excess of $150,000; or

(3) A series of orders from the same ordering office within seven (7) business days that together call for quantities exceeding the limitation in subparagraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216‐21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum‐order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within two (2) business days after issuance, with written notice stating the Contractor’s intent not to perform the services called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216‐22 INDEFINITE QUANTITY (OCT 1995)

(a) This is an indefinite‐quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the “maximum.” The

Government shall order at least the quantity of supplies or services designated in the Schedule as the “minimum.”

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 30 days after contract expiration.

452.216‐73 MINIMUM AND MAXIMUM CONTRACT AMOUNTS (FEB 1988)

During the base period specified in FAR clause 52.216‐18, Ordering, the Government shall place orders totaling a minimum of $25,000. Delivery Orders will not exceed a cumulative maximum of $350,000 from date of award through date of contract expiration.

However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

A COMPLETE QUOTE SHALL INCLUDE THE FOLLOWING INFORMATION:

Acknowledge of any Amendments to the Solicitation

Quotes will be evaluated in accordance with 52.212‐2, Evaluation – Commercial Items. Quoters are responsible for ensuring completeness of quotes. The Government may evaluate solely on the information provided with the initial quotation.

(c) Submission deadline. Quotes must be received by the date and time specified in this solicitation. A late quote will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late quote would not unduly delay the acquisition. In the case of an emergency or unanticipated event that delays Government operations so that quotes cannot be received, the deadline will be extended by one working day.

(d) Terms of and content. Quotes must be based on the terms of this solicitation. The Government may reject any quote that is not based on these terms in every respect. Quotes must contain all of the information required by the solicitation.

(e) Contract award. The Government intends to evaluate quotes and award a contract without discussions.

Therefore, a quote should contain the quoter’s best terms from a price and technical standpoint. However, the

Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in quotes received.

(f) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the quoter acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the quoter does not become registered in the SAM database by the response date specified in the solicitation, the Contracting Officer will proceed to award to the next otherwise successful registered quoter. 52.212‐2 EVALUATION ‐‐ COMMERCIAL ITEMS (OCT 2014)

a) Award will be made to the responsible quoter representing the Lowest‐Priced Technically Acceptable (LPTA) quote. Quotes will be evaluated in accordance with FAR Part 13 Simplified Acquisition Procedures.

Each technical evaluation factor must be found to be “acceptable” in order for the quotation to be found technically acceptable. Quotes will not be ranked. Missing, incomplete, or ambiguous information may result in a rating of “unacceptable” for that factor.

Evaluation factors are listed below:

(ii) Product Conformance to Specifications. The proposed product will receive a rating of “acceptable” or “unacceptable”. The product must conform to all specification requirements to receive an “acceptable” rating.

52.212‐3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS—COMMERCIAL ITEMS (NOV 2017)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) website located at https://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.

(a) Definitions. As used in this provision—

“Economically disadvantaged women‐owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women‐owned small business eligible under the WOSB Program.

“Highest‐level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil‐related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110‐174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the

Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

“Sensitive technology”—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic

Powers Act (50 U.S.C. 1702(b)(3)).

“Service‐disabled veteran‐owned small business concern”—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service‐disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service‐ disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service‐disabled veterans or, in the case of a service‐disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service‐disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service‐ connected, as defined in 38 U.S.C. 101(16).

“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

“Small disadvantaged business concern”, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that—
