52.223‐1, BIOBASED PRODUCT CERTIFICATION (MAY 2012)
The following provisions are incorporated by full text:
52.204‐20 PREDECESSOR OF OFFEROR (JULY 2016)
(a) Definitions. As used in this provision‐‐ “Commercial and Government Entity (CAGE) code” means‐‐
(1) An identifier assigned to entities located in the United States and its outlying areas by the Defense Logistics Agency (DLA) Contractor and Government Entity (CAGE) Branch to identify a commercial or government entity, or
(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file.
This type of code is known as a NATO CAGE (NCAGE) code.
“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor. “Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
(b) The Offeror represents that it [ ] is or [ ] is not a successor to a predecessor that held a Federal contract or grant within the last three years.
(c) If the Offeror has indicated “is” in paragraph (b) of this provision, enter the following information for all predecessors that held a Federal contract or grant within the last three years (if more than one predecessor, list in reverse chronological order):
Predecessor CAGE code: (or mark “Unknown”). Predecessor legal name: . (Do not use a “doing business as” name).
52.212‐1 ADDENDUM
FAR 52.212‐1 Instructions to Offerors – Commercial Items, is replaced in its entirety by this addendum.
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of Quotes. Submit quotes to Lisa Draves at lisa.a.draves@aphis.usda.gov.
Quoters are responsible for ensuring completeness of Quotations. The Government may evaluate solely on the information provided with the quotation.
(c) Submission deadline. Quotes must be received by the date and time specified in this solicitation. A late quote will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late quote would not unduly delay the acquisition. In the case of an emergency or unanticipated event that delays Government operations so that quotes cannot be received, the deadline will be extended by one working day.
(d) Terms and content. Quotes must be based on the terms of this solicitation. The Government may reject any quote that is not based on these terms in every respect.
Quotes must contain all of the information required by the solicitation.
(e) Contract award. The Government intends to evaluate quotes and award contract(s) without discussions. Therefore, a quote should contain the quoter’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; and waive informalities and minor irregularities in quotes received.
(f) System for Award Management. The quoter acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation.
If the quoter does not become registered in the SAM database by the response date specified in the solicitation, the Contracting Officer will proceed to award to the next otherwise successful registered quoter. Quoters may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.
52.212‐2 EVALUATION‐COMMERCIAL ITEMS (OCT 2014)
(a) Award will be made to the responsible quoter representing the Lowest‐Price Technically‐ Acceptable (LPTA) quotation. Proposals will be evaluated in accordance with FAR Part 13, Simplified Acquisition Procedures.
Each technical evaluation factor must be found “acceptable” in order for the quotation to be found technically acceptable. Quotations will not be ranked. Missing, incomplete, or ambiguous information may result in a rating of “unacceptable” for that factor. Evaluation factors are listed below:
(i) Price
(ii) Technical Capability. The “technical capability” factor will receive a rating of “acceptable” or “unacceptable” based on its entirety. In order to receive an “acceptable” rating, the quoter must provide the required submittals with sufficient detail to convince the evaluators that the quoter (prime contractor and/or subcontractors) is capable of performing the work.
Required Submittals:
Complete Attachment 1, Project Experience Questionnaire, for a minimum of three
(3) projects to demonstrate relevant experience. Relevant experience is defined as maintenance and repair of similar HVAC Systems performed within the past three years.
A letter of commitment is required in order for a proposed subcontractor’s experience to be evaluated.
Missing, incomplete, or ambiguous information could result in a rating of “unacceptable”
(iii) Past Performance.
The past performance factor will receive a rating of “acceptable” or “unacceptable” based on its entirety. There are no separate submittal requirements for this evaluation factor.
There are no separate submittals for this factor. To evaluate past performance, the Government may rely on any of the following: Government personnel familiar with work performed by the contractor; customer surveys and past performance questionnaire replies; and the Governmentwide Past Performance Information Retrieval System (PPIRS) at www.ppirs.gov.
Past performance will be rated “unacceptable” if the contractor receives an unsatisfactory rating from a reference unless the quoter can demonstrate that adequate corrective actions were taken. In the case of a quoter without a record of past performance or for whom information on past performance is not available, the quoter will not be evaluated favorably or unfavorably on past performance provided the quoter certifies that additional past performance information is not available and provides an acceptable explanation as to why past performance information is not available.
