STATEMENT OF WORK

Amendment 1 ATTACHMENT 1

SECTION I - THE BPA REQUIREMENT

The purpose of this solicitation and resultant Blanket Purchase Agreement (BPA) is to award multiple BPAs for equipment rental and equipment operator, as required, for the Francis Marion and Sumter (FMS) National Forests in South Carolina, the Savannah River Site (a secured Department of Energy site), National Forests in North Carolina, National Forests in Florida, National Forests in Alabama, the Cherokee National Forest in Tennessee, Chattahoochee-Oconee National Forest in Georgia, and the Southern Research Station locations in North Carolina, South Carolina, Florida, Georgia, Alabama, and Tennessee. BPA Calls will be based on availability of the equipment, price, and awardees’ background and experience evaluated per BPA Call and not necessarily in the order listed. If an equipment operator is required, the appropriate Department of Labor Wage Determination will be issued with the BPA solicitation and Call. The Government reserves the right to award Calls based on factors other than price. BPA Call solicitations will indicate whether award will be based on price alone or price and other factors such as response time, past performance, and a variety of other factors. The Government also reserves the right to award BPA Calls without discussions.

This BPA shall not be substituted for Virtual Incident Procurement (VIPR) or Emergency Equipment Rental Agreements (EERAs). The primary purpose of this BPA is for everyday operations however it may be used in conjunction with incidents and fires. If used in conjunction with incidents and fires, the Incident Center’s protocol shall be followed in the incident area(s) per incident. These incident protocols may vary drastically from daily operation protocols and may only be known at the time of the incident. Special requirements and protocols for incidents and fires will be identified on the solicitation for each BPA Call.

Emergency BPA Calls may occur. Emergencies consist of BPA Calls with a proposal response date of 72 hours or less and delivery of equipment of 24 hours or less. Emergencies may or may not be of Incident or Fire nature; examples of emergencies are water leaks, rock slides, wildfires, and storm damage responses.

This will be a base plus four option year BPA. The following are the periods of performance this BPA covers:

Base Year: 1 February 2020, or date of award, whichever is later, through 31 January 2021.

Option Year 1: 1 February 2021 through 31 Jan 2022 Option Year 2: 1 February 2022 through 31 Jan 2023 Option Year 3: 1 February 2023 through 31 Jan 2024 Option Year 4: 1 February 2024 through 31 Jan 2025

Awardees are not required to cover all locations. Respondents will be asked what locations they are able to cover in response to this BPA. The equipment being rented is an eclectic array of equipment that includes but is not exclusive to agricultural machinery, carpentry equipment, air/gas compressor, farm equipment, generator, industrial and farm truck, lawnmower, sawmill machinery, metalworking machinery and equipment, skidders, excavators, dozers, backhoes, loaders, graders, sound and lighting equipment, telecommunications equipment, farm and garden tractor and machinery, woodworking machinery, ATVs/UTVs, power washer, public address system, pumps, and other assorted equipment.

A list of equipment is not being requested to establish this BPA. This BPA is establishing a list of Contractors that have an office near of each location. All BPA Awardees will be provided the opportunity to submit proposals for each BPA Call. Each BPA Call will identify what equipment is required, accessories, and if an equipment operator is being requested.

Equipment Condition. Equipment shall be no older than three years old or in “like new” condition and shall be the exact match, or of equivalent type, being requested. “Like-type” or “equivalent type” equipment shall be negotiated prior to any BPA Call being awarded. Once a BPA Call has been awarded, the equipment in the BPA Call shall be provided.

Inspections. Inspections will be made of the equipment immediately after delivery and prior to pick-up by the Contracting Officer Representative (COR) or Government Technical Monitor (GTM). Discrepancies will be identified at this time. If the equipment is not in satisfactory condition, the Contractor shall remove the unsatisfactory equipment at no cost to the Government, supply a satisfactory piece of equipment, and will be responsible for additional costs to the government for re-inspection of each equipment that was replaced.

The Contractor shall provide photographs and report any damage to the Contracting Officer within 72 hours of equipment turn in. It shall be the Contractor’s responsibility to file any claim per the Federal Acquisition Regulation.

Delivery and relocation pricing. If a BPA Call does not have a Contract Line Item Number (CLIN) for delivery/pick up, Contractors shall incorporate the delivery/pick up pricing in their proposed pricing. In the event no delivery/pick up CLIN is listed on a BPA Call, delivery/pick up pricing may not be negotiated after award. If there is no CLIN for relocating equipment, Contractors shall assume no relocation will occur. If a relocation request is made after award, pricing shall be negotiated prior to relocating equipment.

Every Contractor that will be awarded a BPA from this solicitation will be afforded the opportunity to send in pricing on each BPA Call of $25,000.00 or more. The Forest Service reserves the right to solicit three Contractors from this BPA for BPA Calls expected to be $2,500.00 or more but less than $25,000.00; and award sole source on BPA Calls expected to be less than $2,500.00. Pricing shall be valid for 120 days after each BPA Call proposal due date. Awardees will not be sent a BPA Call solicitation for the following reasons:

1. The Contractor identified areas they wish not to be considered. These identified areas are geographical areas and/or if they wish not to be considered for equipment operator or equipment without an operator. This will be determined from pages 2, 3, and 4 of the solicitation’s body.

2. The Contractor has not provided relevant experience or technical capability relevant to the Call’s project. This will be determined by the background information and relevant experience documents the Contractor provides with their proposal for each BPA Call.

3. The Contractor or Government terminated the BPA by written notice. At least 30 days written notice must be provided before the BPA is terminated unless a proposal was submitted in response to a BPA Call. If a response was submitted to a BPA Call, the proposal shall not be withdrawn and if awarded the BPA Call, the Contractor shall fulfill the terms of the BPA Call.

4. The Contractor’s System for Award Management (SAM) is no longer active. Contractors must have an active SAM account to be awarded a project. SAM is a free website; do not pay anyone to activate or reactivate your SAM account. Go to www.sam.gov.

The maximum amount of this base plus four option year BPA is $5,000,000.00. See Attachment 2 for historical rental awards and pricing information. Although past contracts are good indicators of how often and where this BPA may be used, the budget Congress provides the Forest Service and actual needs will determine how often, where, and how long equipment can be rented.

Onboarding and Offboarding. The Forest Service reserves the right to re-advertise this solicitation to award additional BPAs with new Contractors and remove Contractors through termination of their BPAs who are not responsive on ALL BPA Calls in areas your company covers, are no longer active in SAM, does not provides equipment that does meets the specifications, or at the discretion of the Contracting Officer without discussions outside the 30 day notification.

SECTION II - INTRODUCING THE BPA

1. A Blanket Purchase Agreement, or BPA, is a simplified method of filling anticipated repetitive needs for supplies or services with qualified sources. BPA's are designed to reduce administrative costs in accomplishing small purchases by eliminating the need for issuing individual purchase documents. In other words, the Government uses BPA's when we know the we will need a basic requirement over and over, but can't say for sure when or how many of the items will be required.

2. A BPA is an agreement between the government and a contractor which sets the stage for the government to buy something quickly. BPAs are agreements, not contracts. Either side may opt out of the BPA at any time by giving at least a 30-day notice in writing. All of the conditions of sale are negotiated when the BPA Call is made.

3. BPA's Calls are made when it is determined a service or supply is required. The Contracting Officer will place the call to the contractor to request pricing for delivery of those items.

4. Contractors are NOT required to submit pricing when BPA Calls are solicited. If your company is awarded a BPA and the equipment is rented out in the area you cover and you do not expect it back by the time proposals are due for a BPA Call, do not submit pricing. Once a BPA Call is awarded, it becomes a contract and you will be expected to fulfill your contract.

SECTION III – BPA TERMS AND CONDITIONS

1. Description of agreement. A Statement that the supplier shall furnish supplies or services, described in general terms, if and when requested by the contracting officer (or the authorized representative of the contracting officer) during a specified period and within a stipulated aggregate amount, if any.

2. Extent of obligation. The Government is obligated only to the extent of authorized purchases actually made under the BPA.

3. Purchase limitation. The dollar limit for each Call shall be $250,000.00. The dollar limit for the entire term of this BPA shall be $5,000,000.00. There is no minimum or maximum guaranteed dollar amounts.

4. Individuals authorized to purchase under the BPA. Only Forest Service Contracting Officers, Contracting Specialists, and Purchasing Agents working projects for or on behalf of the Francis Marion and Sumter National Forests, Savannah River Site, National Forests in North Carolina, National Forests in Florida, National Forests in Mississippi, Chattahoochee-Oconee National Forests, Cherokee National Forest, Southern Research Station, and Job Corps may place Calls under this BPA.

5. Invoices. A summary invoice shall be submitted upon the completion of each BPA Call. Invoicing shall be placed through the Invoice Processing Platform at www.ipp.gov. An IPP account will be established at the time of the Call if the Awardee does not already have an IPP account. All payments under this BPA will be NET 30.
