Submission of an offer for the basic contract period constitutes an offer to perform in the option period(s), if exercised. This project is set-aside 100% for small businesses. Award will be made based on the best value to the Government and can be made on initial offers.

SPECIAL CONTRACT REQUIREMENTS
SCR1 ORDERING PROCEDURES FOR COMPETITIVE TASK ORDERS.
SCR1.1 REQUESTS FOR QUOTES. When the Government requires work under this contract, a Notice of Proposed Task Order Request for Quotes will be issued VIA EMAIL ONLY.
SCR1.2 COMPETING FOR A TASK ORDER. The Contracting Officer will provide that each awardee receive a fair opportunity (FAR 16.505(b)(1)) to be considered for each order. It is expected that contractors will submit proposals for all RFQ notices received. In the event a Contractor is unable to submit an offer in response to an RFQ notice, the Contractor shall notify the Contracting Officer electronically via email. Failure to respond or compete for projects may be considered failure to make progress or perform and will be a consideration for option year renewal.
SCR1.3 COMPETITION. Task Orders will be awarded based on Fair Opportunity, FAR 16.505(b)(1). Awardees will compete for projects among themselves. The Government reserves the right to accept other than the lowest priced offer. The right is also reserved to reject any and all offers. The basis of award will be a conforming offer, the price or cost of which may or may not be the lowest. If other than the lowest offer, it must be sufficiently more advantageous than the lowest offer to justify the payment of additional amounts.
SCR1.4 OFFER CONTENTS. Depending upon the requirements of each Task Order, the Contractor will typically provide a price proposal in response to an RFQ notice. Contractors shall respond within the number of calendar days stated in the RFQ notice by submitting a proposal to the Contracting Officer in accordance with requirements stated in the RFQ notice. Some task orders may require the submission of a technical proposal. If required, this will be spelled out in the RFQ notice.
SCR1.5 CONTRACT PRICES-SCHEDULE OF ITEMS. The Government's payment for the items listed in the Schedule of Items of individual task orders shall constitute full compensation to the Contractor for- (1) Furnishing all plant, labor, equipment, services, materials and expertise; and (2) Performing all operations required to complete the work in conformity with the requirements. The Contractor shall include in the prices for the items listed in the Pricing Schedule all costs for work in the specifications, whether or not specifically listed in the Pricing Schedule. The Contractor may offer the Contracting Officer a voluntary price reduction at any time during the contract period.
SCR1.6 EVALUATION METHOD AND PROCEDURES. The primary technical and price criteria will vary depending on the unique requirements for each task order. The Contracting Officer may develop evaluation criteria which reflect the instant requirement and contracting environment. Examples of these criteria are past performance on prior task orders under the contract, which includes quality and timeliness, special expertise or other factors the Contracting Officer determines are relevant to award of a particular task order and the unit’s status of achieving small business goals/targets. In making decisions in award of any individual task order, the Government intends to select the most advantageous, responsive, and responsible proposal, price and other factors considered. Each RFQ notice will describe the criteria to be utilized in evaluating task order proposals.
SCR1.7 DISCREPANCIES IN THE EVALUATION OF OFFERS SUBMITTED IN RESPONSE TO RFP NOTICES FOR
INDIVIDUAL TASK ORDERS.
a. For the purpose of initial evaluations of offers proposed for individual Task Orders, the following will be utilized in resolving arithmetic discrepancies found on the face of pricing schedule as submitted by the Offeror: (1) Obviously misplaced decimal points will be corrected; (2) Discrepancy between unit price and extended price, the unit price will govern; (3) Apparent errors in extension of unit prices will be corrected; (4) Apparent errors in addition of lump-sum and extended prices will be corrected.
b. For purposes of price evaluation, the Government will proceed on the assumption that the Offeror intends the proposed price to be evaluated on basis of the unit prices, the totals arrived at by resolution of arithmetic discrepancies as provided above.
c. These correction procedures shall not be used to resolve any ambiguity concerning which price is low.
SCR1.8 EVALUATION OF OPTIONS (FAR 52.217-5) (JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for the purpose of awarding task orders by adding the total price for all optional line items to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the optional line items.
PBSC for Timber Sale Preparation and Professional Forestry Services PAGE 6 of 51
SCR1.9 AWARD DECISION. Whenever possible, award will be made without discussions. If discussions are required, each contractor will be requested to provide a final proposal revision, unless eliminated from discussions through the establishment of a competitive range. Task Order award will be made based on either the best value to the Government or the lowest price, technically acceptable proposal as described in the RFQ notice. The awarded Task Order will be firm fixed-price with a specific number of calendar days. When optional line items are included in the Schedule, the Task Order will specify the number of days after award for exercising the Options.
SCR1.10 TASK ORDER ISSUANCE. Task Orders will be issued on Form 347 and will be submitted by mail, facsimile or electronic commerce; however, the preferred method will be use of email. The Task Order becomes binding when the Contracting Officer signs the order.
SCR1.11 PROTESTS. In accordance with FAR 16.505(a)(7), no protest under FAR Subpart 33.1 is authorized in connection with the issuance or proposed issuance of an order under a Task Order Contract except for a protest on the grounds that the order increases the scope, period, or maximum value of the contract.
SCR1.12 OMBUDSMAN. If the Contractor believes it was not fairly considered for a particular task order, the Contractor may present the matter to the Contracting Officer. The Contractor may appeal the explanation or decision of the Contracting Officer to the Ombudsman, who is the Head of the Contracting Activity. The Ombudsman will review the Contractor's complaint, and in coordination with the Contracting Officer, ensure that the Contractor was afforded a fair opportunity to be considered for the Task Order.
SCR1.13 STATEMENT OF WORK AND ATTACHMENTS. The Contractor will be provided an electronic copy of the Statement of Work (with pertinent supplemental specifications and maps/drawings as applicable) upon issuance of each Task Order. All further reproduction shall be at the Contractor's expense. The Government may provide these as hard copy or as electronic media, such as email or CD ROM, at its option.
SCR2 ORDERING PROCEDURES FOR SOLE SOURCE ORDERS
In the event it becomes necessary to negotiate with one firm on a sole-source basis, the following procedures shall be used in accordance with FAR 16.505(b)(2):
SCR2.1 CIRCUMSTANCES PERMITTING SOLE SOURCE ORDERS. Contractors will be given a fair opportunity to submit a proposal on projects unless the Contracting Officer determines:
a. An urgent need exists, and seeking competition would result in unacceptable delay
b. Only one Contractor is capable at the level of quality required because the requirement is unique or highly specialized
c. A sole source is in the interest of economy and efficiency as a logical follow-on to an order already competed (e.g. site adapt a competed design)
d. To satisfy contract minimum award obligations.

CONTRACT DOCUMENTS, EXHIBITS OR ATTACHMENTS
DESCRIPTION/SPECIFICATION/PERFORMANCE WORK STATEMENT
PERFORMANCE WORK STATEMENT
SECTION I – GENERAL
1.1 SCOPE: The National Forests in Mississippi is soliciting for timber sale preparation and professional forestry services on lands within its administrative boundaries. Timber to be sold must be designated and scaled prior to awarding a timber sale contract.
Timber Sale Preparation involves layout of operating units based on stands or other criteria, area determination of units, designation of boundary lines, and designation of timber to be removed or left, depending on the type of cut. Timber may be designated by marking and scaling or by cruising timber for volume estimation purposes. For this requirement, the contractor shall provide all materials, labor, equipment, tools, transportation, permits, licenses, supervision, expertise, and other incidentals necessary to successfully complete timber sale preparation including but not limited to sale unit layout, boundary flagging, GPS acreage determination, timber cruising, timber marking, stand examination and associated professional forestry services.
1.2 SILVICULTURAL PRESCRIPTION AND MARKING GUIDES: The Silvicultural Prescription files for each Timber Sale will be provided to the Contractor and contains the following: individual stand description and prescription narratives and maps.
These documents should be referred to prior to beginning any sale preparation work on any task order. An individual Cruise Plan with specific Marking/Cruising Guidelines will be provided to Contractor for each Timber Sale at task order award. These Guidelines will provide specific direction on where the timber is located and how it is to be designated and scaled. All divisions of a Timber Sale are designated as Payment Units (tree measurement sales) or Subdivisions (weight scale sales).
1.3 MARKER CERTIFICATION: Contractors are required to obtain a Qualified Cruiser Certification through the Forest Service by passing a written examination and field test PRIOR TO AND IN ORDER TO COMPETE FOR CONTRACT AWARD OF TIMBER SALE PREPARATION TASKS AND SUBTASKS. This certification will remain valid for a period of one year and annual recertification is required in order to continue performing services under this contract. Contact Bob Smiley at (601)965-1643, to obtain information about the qualified cruiser certification and recertification.
1.4 TREE MARKING/TRACER PAINT: The Government will furnish the necessary tree marking paint, also referred to as tracer paint, required to complete the project. Paint accountability is considered a very serious aspect of successful completion of contract requirements and will be handled according to the methods outlined in the, National Forests in Mississippi Tracer Paint Accountability Plan (Attachment 1).
The procedures outlined in the National Forest in MS Tracer Paint Accountability Plan will be reviewed during the prework conference for the individual task order. All Government tree marking paint cans, full or empty, not in immediate use by the contractor, are required to be in locked storage. Tree marking paint remains property of the United States. Any unused quantities will be returned to the Government upon completion of the individual task order. All used paint cans shall be returned to the Government with the residual paint in the cans dried. Final payment invoices will not be processed until all paint is accounted for as described within this document and completed “National Forests in Mississippi Contractor Tree Marking Paint Log” (Attachment 2) forms for the entire task order are provided to the Contracting Officer’s Representative (COR).
1.5 LOCATION: Treatment areas are located within the boundaries of the National Forests in Mississippi. Specific locations, unit data, and maps will be supplied with each task order.
1.6 PERFORMANCE OF SIMILAR WORK BY THE GOVERNMENT: Nothing in this contract restricts the Government from performing any of the work with its own organization and workforce.

1.7 PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND IMPROVEMENTS.
The Forest Service may identify protected areas such as Red-cockaded Woodpecker nest trees, gopher tortoise burrows, sensitive plants, or archaeological or historical sites in the sale area or individual units. Should the contractor discover potential protected areas not designated by the Forest Service within the sale area or individual unit, notify the Contracting Officer’s Representative (COR) immediately and before proceeding so that proper preservation or safety measures can be taken if necessary.
The Contractor shall preserve and protect all structures, equipment, and vegetation (such as trees, shrubs, and grass) on or adjacent to the work site, which are not to be removed and which do not unreasonably interfere with the work required under this contract. The Contractor shall only remove trees when specifically authorized to do so, and shall avoid damaging vegetation that will remain in place.
The Contractor shall protect from damage all existing improvements and utilities (1) at or near the work site, and (2) on adjacent property of a third party, the locations of which are made known to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor.
Fuel and Machine Fluids. The contractor shall instruct employees in environmental protection practices. The contractor is responsible for operating under conditions which preclude the waste of fuel or spoiling the environment. Machine fluids (fuel, oils, coolants, etc.)
shall not be drained on the ground or allowed to enter any watercourse.
