About this file

This is a Questions and Answers document for federal contract opportunity 12445526Q0055 addressing clarifications regarding project staffing, scheduling, phasing, tax status, and quality control requirements for a construction project.

The document clarifies that a single individual may simultaneously serve as the Superintendent, Safety and Site Health Officer (SSHO), and Quality Control Manager. The period of performance will commence upon issuance of the Notice to Proceed (NTP), which will be issued once material lead times are confirmed and figured out given current market conditions. The project requires phasing typical of dirt and gravel road reconstruction following Forest Service supplemental specifications to the FP-14 and FP-14 standards, with phases including brushing, road reconditioning, culvert replacement or installation, base and surface stone placement, and seeding within specified construction timeframes. The project is not tax-exempt. Third-party inspections are required only when the contractor disputes a government determination that materials do not conform to specifications; the contractor must provide third-party analysis to support such disputes. All materials must be certified with certifications presented upon government request, including examples such as Pennsylvania state certification for aggregate and certified scale printouts for weight verification. Quality control is the contractor's responsibility and may be performed by an employee or a third-party vendor; the government independently performs quality control to verify that both materials and construction operations meet contract specifications.

12445526Q0055 Question and Answer Document

1. Can one individual serve simultaneously as the Superintendent, SSHO, and QC Manager? Yes.

2. Can the period of performance be extended after the award once material lead times are confirmed, given current market conditions? The notice to proceed will be issued when that is figured out. One the NTP is issued is when the period of performance starts.

3. Does this project require phasing? Typical phases of reconstruction of dirt and gravel roads following Forest service supplemental to the FP-14 and FP-14 specifications. Typical scenario would phase: Brushing, road reconditioning, culvert replacement or installs, base and surface stone placement, and seeding within the required timeframes listed in the construction notes.

4. Is this project tax-exempt? No.

5. Are third-party inspections required? If the government determines that materials do not conform to specifications, and the contractor disputes the determination. A third-party analysis would be required by the contractor to support the dispute. All materials must be certified and certification presented upon government request. An example would be aggregate requires PA state certification based on the provided specifications. A certified scale and printout of weight must be supplied to conform to material amounts specified. Other certifications may also be required to ensure contract materials meet the supplied specifications.

6. Must the QCM and the Tester be two separate individuals? As stated above a third party would only be required if the contractor disputes the rejection of materials supplied. If in fact materials are determined to be out specification like moisture content of aggregate or other provided materials. Quality control is the responsibility of the awarded contractor and can be an employee or employed as a third party if desired. The government acts as quality control on its own behalf to ensure the contract specifications are being met for both materials and construction operations.
