About this file
This document provides details for a federal contract solicitation to install exterior fencing around a bison pasture at Midewin National Tallgrass Prairie. The firm fixed price contract requires furnishing and installing a combination of woven wire and steel welded fencing including steel posts, gates, hardware, fasteners and incidentals. Questions must be submitted by May 16th. The selected contractor will be required to follow protocols for working in an active bison pasture to ensure the herd remains contained, including being issued one key and assigning a gatekeeper responsible for opening and closing gates. The amendment removes an earlier wage determination and replaces it with the current rates. No other changes are included in the amendment.

Questions and Answers (Q&A) 12445522B0005 Bison Pasture Fencing, Midewin National Tallgrass Prairie
As of 5/4/2022
Q1. Can I visit the site to evaluate what type of equipment can be used? Is there a site visit for this, A1. A portion of the location is in an area open to the public and can be walked next to.
the remainder is behind a locked gate. It about a mile hike from the parking lot on our trail to the start of the site that accessible. No driving is possible without an escort.
Contact Robert Hommes for additional site visit details or to schedule a visit.
robert.hommes@usda.gov or (815) 423-6370
Q2. I am assuming you want the disturbed footprint to be minimal. Also does there need to be site restoration (seed and blanket, sod, natural prairie grasses/wild flowers) after the fence is installed? If yes, can you specify how the site is to be restored.
A2. Ground disturbance area must be kept to a minimum. Soil from post excavations is to be used to cap the concrete as show in the detail and any remaining soil is to be spread evenly along the fence line. If that is done properly, no additional planting, seeding, etc. will be required. Any major ground disturbance above what is considered minimal will be dealt with on an individual case by case basis, but will require seeding and stabilization.
Q3. We have worked on this exact project before with Midewin. We received half down when all the materials were on site. Will this still be the same with this contract if awarded?
A3. The contracting officer may approve a progress payment for some materials with proper receipts.
IAW Solicitation, 52.232-5 Payments under Fixed-Price Construction Contracts
(b) Progress payments. The Government shall make progress payments monthly as the work proceeds, or at more frequent intervals as determined by the Contracting Officer, on estimates of work accomplished which meets the standards of quality established under the contract, as approved by the Contracting Officer
Q4. The Bid bond.. The requirements are 20 percent or $60,000 what ever amount is less. Does this accompany the Bid or is there a time frame to get this to you after the award?
A4. Bid bond must accompany bid. See solicitation 52.228-1 Bid Guarantee
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
SF24 can be downloaded https://www.gsa.gov/forms-library/bid-bond
Q5. Will Bison be in the area of work?
A5. We cannot guarantee that bison will be excluded from the work area. Please see the attached ‘Midewin Bison Pasture Protocol” that elaborates on what will be expected from the contractor while working in the pastures.
Q6. Will the contractor be responsible for fire control or will Midewin supply a tank with water in case of fire?
A6. The contractor will be responsible for having water and other fire suppression materials on hand while they are working.
Q7. Will payroll audits be weekly , biweekly or monthly? Who receives them?
A7. The FAR indicates payrolls will be submitted weekly. This also in the solicitation:
52.222-8 Payrolls and Basic Records
(b) (1) The Contractor shall submit weekly for each week in which any contract work is performed a copy of all payrolls to the Contracting Officer.
Payrolls would need to be reviewed prior to approving invoices subject to response in A3.
Q8. When I went through the prevailing wage I need not see categories for fencing and welding in Will County. Can you please direct me to the correct section to determine the current Prevailing wage ?
A8. An amendment is forthcoming to use Wage Determination IL20220011 02/25/2022 (also attached at the end of this document). The amendment will remove Wage Determination IL20220020 02/25/2022.
Q9. Pipe specs.. In the written description for the 2-3/8 I see the spec is 6.5# per foot.
and in the drawing i see sch 40.. I assume its sch 40 for the 2-3/8 and the 2-7/8 rails. can you verify this?
A9. Specifications and drawing for pipe should read as follows:
Steel Line Posts, Corner Posts & Top Rail – 2-7/8 “ O.D. SCH 40 at 5.79 pounds per foot Steel Cross Rails- 2-3/8” O.D. SCH 40 at 3.65 pounds per foot Steel Gate Posts- 6” I.D. SCH 40 at 18.97 pounds per foot Brace Pipes-not required
Q10. I see the post spec is 2-7/8 sch 40. sch 40 weighs about 5.6 pounds per foot.. is the 6.5 pounds per foot for the posts?
A10. See answer to Q9 above.
Q11. Does the required pipe have to be SCH 40? Can SS40 be used in its place?
A11. Pipe shall be raw steel SCH 40. Pipe may NOT be galvanized SS 40
Q12. Is there a due date for questions?
A12. Due date for questions is 16 May 2022 by COB. Government will not guarantee questions will be addressed if submitted after this time.
Q13. Will survey staking be required to place fence? If staking is required will owner provide a ALTA?
A13. No ALTA will be provided. Contractor shall use whatever method necessary to deliver a straight fence that parallels the existing fence and is located 2-3 feet inside (bison side) of the current fence line.
Q14. Will concrete testing be required for fence post concrete?
A14. No
Q15. C.1 states woven wire, drawings only show steel tube schedule 40, please clarify.
A15. Woven wire fence is not required in this contract.
Q16. C.1 states wood posts, please clarify, drawings only show steel.
A16. Wood posts are not required in this contract
Q17. C.1 states gate repairs, please clarify.
A17. There are no gate repairs required. New gate posts will be installed in locations that reflect the size and locations of the existing 2 gates, with COR approval before installation. Existing gate will be re-hung in the new openings after completion of the entire run of new pipe fence. Contractor will be required to temporarily close-off these gate openings until the gates can be relocated.
Q18. Attachment 3a and 3b appear to be the same drawing.
A18. The drawings are the same and there is not another one to be added. It was just duplicated in error.
Q19. Please confirm if all steel is to be galvanized or left raw.
A19. Raw steel, no galvanizing.
Q20. Execution (SOW) states the owner will remove any large trees… should we assume the diameter of the brush remaining will be 2” and less?
A20. Everything above 4” diameter will be removed by the owner, the contractor will be required to remove any remaining small woody vegetation that interferes with fence installation.
Midewin Bison Pasture Protocol Contractor Information
May 3, 2022
Due to the special circumstance that this project occurs within an active bison pasture, the following requirements and procedures must be planned for and included in the scope of this contract. Maintaining the security of the bison herd is of the utmost importance.
Currently there are approximately 60 bison occupying the pasture, with many of them expected to bear new calves within the next month. We will be unable to exclude the bison from the project work area. Past experience has shown that the herd will be curious about your presence but should not interfere with your ability to work and complete this project. Please also be aware that Midewin is not responsible for any damage to equipment caused by the bison’s curiosity that could occur when equipment is left on-site during non-work hours.
In order to contain the herd, all of the bison pasture gates are locked with a restricted lock and key. These gates must remain closed and locked at all times except when opened for entry and or exit. Failure to close and lock any gate is a violation of the Federal Code of Regulations, 36 CFR 261.7c.
The contractor shall be issued only one key for the duration of the project. Under no circumstance shall this key be duplicated. This key is government property and its use is covered under the terms of Title 18 USC-641.
If that key is lost the contractor will be responsible for the cost of material and labor required to change all of the locks on all of the bison gates and to re-issue keys to all of the current key holders. The contractor will not be issued a new key until all of the locks have been replaced, meaning work will have to stop.
Additionally, we require that one individual from the contractor’s staff be assigned the primary duty of being the gate keeper, truck escort, and key holder. The objective is to reduce the possibility of the key being passed around to different drivers and being misplaced or misused. This person should be the only contactor employee that opens and closes the gates. Midewin staff will also be monitoring the gates to ensure the protocol is being followed.
In specific reference to the Bison Fence Replacement Project, the contractor must also prevent bison from entering and becoming trapped between the existing perimeter fence and the new pipe fence installation.
Since the new fence is to be constructed 2-3 feet inside the existing fence, a narrow corridor will be created between the fences. Each day as work progresses, the contractor must close off the ends of this narrow space to prevent bison from entering. Closure must be sufficient to deter both full grown bison and new-born calves from gaining access to the narrow corridor between the fences.
Although these requirements may add cost to the project, we cannot overstress the importance of containing Midewin’s bison herd. Due to their nature, bison are not as easily re-captured as other domestic livestock.
The bison are government property with a monetary value of about $10,000 and up, per head, and the herd is highly regarded by the general public. Any accidental release would quickly be covered by the media with follow-up investigations by both federal and local law enforcement agencies. If any negligence is found during an investigation, any and all parties involved are subject to the corresponding legal ramifications.
Ramifications could include restitution for any damage caused by the bison while loose, replacement costs for bison that cannot be re-captured, or criminal charges depending on the outcome of the investigation.
Midewin and our contractors must take every precaution necessary to assure that herd remains within the designated bison pastures.
