FAR 52.212-2 Evaluation – Commercial Products and Commercial Services (USDA Deviation, NOV 2025)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

• Past Performance

• Technical – proposed equipment

• Price

The Government may perform a comparative evaluation (comparing offers to each other) to select the contractor that is best suited and provides the best value, considering the evaluation factors in this solicitation.

Past Performance

Past performance must be verifiable, recent, and relevant.

Recent past performance must include performance that occurred within three (3) years of the solicitation issuance date.

Page: 14

FAC 2025-04 June 11, 2025

Relevant performance includes performances of efforts involving snow and ice removal services similar to the dollar value and complexity of this solicitation.

In evaluating past performance, the government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this solicitation.

Past Performance must be successfully verified by someone with direct knowledge of the performance, other than the quoter, in order to be considered.

Quoters are cautioned to submit sufficient information and, in the format, specified.

Quoters may be asked to clarify certain aspects of their quote (for example, the relevance of past performance information).

THE GOVERNMENT RESERVES THE RIGHT TO AWARD TO OTHER THAN

THE LOW.

Technical – Proposed Equipment

Proposed Equipment will be evaluated on age, and type of equipment intended for use to meet the SOW requirements. Newer equipment and the type of equipment most suited for the execution of this type of requirement will be rated higher than others. Awardees’ list of proposed equipment will be incorporated into the contract.

Price

The price evaluation will document the reasonableness and affordability of the proposed total evaluated price. Affordability may be controlled in circumstances where two or more quotes are evaluated for past performance, and the technical proposed equipment is at a cost that the Government cannot afford.

The Government reserves the right to conduct a price realism evaluation to assess an offeror’s low fixed price. If conducted, a determination will be made whether the low price reflects a lack of understanding of the contract requirements. Vendors submitting unrealistically low pricing may be excluded from the competition.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

As part of the price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one half of the quoter's final option period price (base and four option periods). Thus, the quoter’s total price for the purpose of evaluation will include

Page: 15 the base year, 1st option and 2nd option period, 3rd option period, 4th option period, and ½ of the 4th option period price. Quoter's are not required to enter a price for the potential six-month extension period.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

FAR 52.217-5 Evaluation of Options (USDA Deviation, NOV 2025) Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

(End of provision)

52.237-1 Site Visit (APR 1984) Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award. The site visit will be November 14, 2025, at 1100 ET. The site visit(s) will begin at NRS Hamden, CT., and once completed, the second site visit will require the prospective contractors to travel to NRS Ansonia, CT. The site visit(s) are expected to last no longer than three hours between both of these locations.

To request a site visit on this date, please contact/submit your reservation to the following points of contact: nathan.p.havill@usda.gov; james.anderson@usda.gov; patrick.jones2@usda.gov
