Statement of Work
The Chequamegon-Nicolet National Forest has nearly 100 active potable drinking water wells required to comply with both the Safe Drinking Water Act (Federal direction enforced by Wisconsin DNR) and Forest Service Directives. They are a mix of Public and Private Drinking Water systems and to comply, hundreds of water quality tests are required for:
• Annual Nitrate Sampling for all systems.
• Monthly Routine Coliform Sampling for all seasonal systems.
• Quarterly Routine Coliform Sampling for all systems open year-round.
• Follow Up/Corrective Action Coliform Sampling, as needed.
Forest Service Sample Collection and Delivery:
The Forest Service will collect and deliver or overnight ship all samples to the lab. Samplers are responsible for delivering with viable sample timeline, on ice (for nitrate), and with the complete and correct paperwork.
Sampling kit delivery:
The testing lab will return shipping container with new sample kits to the sampler when test samples are received and processed. They will provide additional kits if required throughout the season to maintain an adequate number for samplers on hand to provide for repeat samples and continuance of water system operation.
Lab Analysis and Reporting:
Requirements by category as described below.
1. Certification
• Lab must be certified in Wisconsin to test drinking water for Coliform and Nitrate testing.
2. Analysis:
• Analyze all viable samples received.
• If a sample received is deemed non-viable due to spillage, age, or improper paperwork, notify sampler immediately so the sample may be retaken.
3. Notification and Reporting
• If a coliform sample is safe, no immediate notification required.
• If a sample is Coliform +/E. coli -, notify the sampler by phone the same day; leaving a voicemail is acceptable.
• If a sample is Coliform +/E. coli +, notify the sampler by phone immediately.
o If you do not reach the sampler, leave a voicemail -AND- notify the COR by phone immediately. If you do not reach the COR, leave a voicemail there as well.
• If nitrate results exceed set MCL limit, notify COR by phone immediately. Otherwise, no immediate notification is required.
4. Reporting Results
• Comply with Wisconsin DNR required electronic transmission (timeline and format) for all
Public Water System analysis results.
• Produce reports for Private Water Systems including, but not limited to: System Name, Unique Sample Identification Number, Date and Time Collected, Name of Sampler, Location of Sample, and Result (Coliform & E.coli -OR- Nitrate).
• Email all results (public and private) to the sampler and the COR within 5 business days of analysis completion.
Note: COR is the same for all systems, sampler is specific to which part of the forest a well is located.

(a) Definitions. As used in this clause–
“Covered contractor information system” means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.
“Federal contract information” means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.
“Information” means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).

“Information system” means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).
“Safeguarding” means measures or controls that are prescribed to protect information systems.
(b) Safeguarding requirements and procedures.
(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:
(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).
(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.
(iii) Verify and control/limit connections to and use of external information systems.
(iv) Control information posted or processed on publicly accessible information systems.
(v) Identify information system users, processes acting on behalf of users, or devices.
(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.
(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.
(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.
(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.
(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.
(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.
(xii) Identify, report, and correct information and information system flaws in a timely manner.
(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.
(xiv) Update malicious code protection mechanisms when new releases are available.
(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.
(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.
(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial products or commercial services, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

(d) Comptroller General Examination of Record. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to
FAR 13:
(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.
(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a Release of Claims be completed by the contractor, although not required for contract and orders using SAP procedures.) Personal Identity Verification of Contractor Employees
(a) The contractor shall comply with the personal identity verification (PIV) policies and procedures established by the Department of Agriculture (USDA) Directives 4620-002 series.
(b) Should the results of the PIV process require the exclusion of a contractor's employee; the Contracting Officer will notify the contractor in writing.
(c) The contractor must appoint a representative to manage compliance with the PIV policies established by the USDA Directives 4620-002 series and to maintain a list of employees eligible for a USDA LincPass required for performance of the work.
(d) The responsibility of maintaining a sufficient workforce remains with the contractor. Contractor employees may be barred by the Government from performance of work should they be found ineligible or to have lost eligibility for a USDA LincPass. Failure to maintain a sufficient workforce of employees eligible for a USDA LincPass may be grounds for termination of the contract.
(e) The contractor shall insert this clause in all subcontracts when the subcontractor is required to have routine unaccompanied physical access to a Federally-controlled facility and/or routine unaccompanied access to a Federally-controlled information system.
(f) The PIV Sponsor for this contract is a designated program point of contact, which in most cases is the COR, unless otherwise specified in this contract. Security Requirements
As required in USDA Manual No. DM 4620-002, Common Identification Standard for U.S. Department of Agriculture, dated December 9, 2021, unaccompanied contractor employees must obtain temporary credentials and a site badge through USDA security procedures. Contractor employees must also take the required annual training in the grid below titled, “Mandatory Contractor Training.” Pursuant to section 10(a) of DM 4620-002, “[a] site credential is issued locally by the facility to persons that have had a favorably adjudicated fingerprint check who do not require a LincPass and do not have IT access rights but need unaccompanied access to the workspace only. Also, a site credential issued to individuals requiring a LincPass who have had their fingerprints taken and are waiting for credential to be printed and returned for activation.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.237-1 Site Visit (APR 1984) Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.
