(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. Past performance
2. Performance plan
3. Bio-base list of products
4. Price
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Performance plan and past performance, when combined, are approximately greater than price. Award will be made on a “Best Value” determination and the Government reserves the right to award this project to other than the lowest priced offer. Best value is a process used in competitive contracting to select the most advantageous offer by evaluating and comparing factors in addition to cost or price.
Factor 1. Past performance (List of References) Past performance is a measure of the degree to which an offeror satisfied its customers in the past and complied with Federal, State and Local laws and regulations. The Government may contact some of each offeror’s customers to ask whether or not that: (1) that the offeror was capable, efficient and effective; (2) the offeror’s performance conformed to the terms and conditions of its contract; (3) finished within contract time; (4) the offeror was reasonable and cooperative during performance; and (5) the offeror was committed to customer satisfaction. In evaluating past performance, the Government may contact some of the references provided by the offeror and other sources of information, including but not limited to: Federal, state and local government agencies, better business bureaus, published media and electronic data bases.
If a company does not have past performance information available, information may be provided for predecessor companies, key personnel, or subcontractors. In the event that there is no past performance information available, the offeror will receive a neutral rating in this factor.
Methodology 2.4 Past Performance Confidence:
Rating
Description
Relevant
Past/present performance effort involved much of the similarity,
magnitude of effort and complexities this solicitation requires.
Somewhat Relevant
Past/present performance effort involved some of the similarity,
magnitude of effort and complexities this solicitation requires.
Not Relevant
Past/present performance effort involved not any of the similarity,
magnitude of effort and complexities this solicitation requires.
Factor 2. Performance plan The performance plan outlines the Contractor's approach for meeting the performance standards set forth in the contract and ensuring continuity of services without interruptions for the term of the contract. Since the Government does not describe how and when tasks should be done (except under special circumstances) we need to understand the service approaches that Contractors are employing in our buildings.
Methodology 2.5 Performance Confidence Assessment:
Rating
Description
Substantial Confidence
Based on the offeror’s performance record, the government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence
Based on the offeror’s performance record, the government has an expectation that the offeror will successfully perform the required effort.
Limited Confidence
Based on the offeror’s performance record, the government has a low expectation that the offeror will successfully perform the required effort.
No Confidence
Based on the offeror’s performance record, the government has no expectation that the offeror will be able to successfully perform the required effort.
Unknown Confidence
No performance record is identifiable, or the offeror’s performance record is so sparse that no confidence assessment rating can be reasonably assigned.
Factor 3. Bio-base list of products As required by FAR 52.223-2, Biobased products must be used in performance of this contract. Therefore, Contractor will submit a list of chemical products to be utilized in the performance of its work. The Contractor shall not use any materials, chemicals, or compounds that the Contracting Officer Representative, determines to be unsuitable to perform the required work. If it is determined that a product does not meet Government performance requirements, the Contractor shall submit a proposed alternative that would meet the performance requirements with the lowest environmental impact for evaluation and acceptance. The Contractor shall utilize products and material made from biobased materials (e.g., biobased cleaners, biobased degreasers, biobased laundry detergent) to the maximum extent possible.
Methodology 2.2 Adjectival Ratings:
Adjectival Rating
Definition
Exceptional
Quote/Offer contains no deficiencies and fully addresses all aspects of the criteria and demonstrates an excellent approach/solution and understanding of the requirements. Many strengths exist, far outweighing any weaknesses. The highest quality of contract performance is anticipated with very low risk.
Very Good
Quote/Offer contains no deficiencies; fully addresses all aspects of the criteria and demonstrates a very effective approach/solution and understanding of the requirements. Some weaknesses may exist; however, the weaknesses, if any, are outweighed by strengths. A high quality of contract performance is anticipated with low risk.
Satisfactory
Quote/Offer contains no deficiencies; addresses all aspects of the criteria and demonstrates an adequate approach/solution and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. A quality contract performance is anticipated with an acceptable amount of risk.
Marginal
Quote/Offer may contain deficiencies; fails to address all of the criteria and does not demonstrate an adequate approach/solution or understanding of
the requirements. One or more weaknesses exist which are not offset by strengths. Contract performance is anticipated with high risk.
Unsatisfactory
Quote/Offer contains many deficiencies and does not address all aspects of the criteria and/or does not present evidence demonstrating an adequate
approach/solution and understanding of the requirements. Many weaknesses and/or omissions exist creating an unacceptable risk.
Factor 4. Price The Government will evaluate the Offeror’s firm fixed price quote for price reasonableness. Price reasonableness will be established by competition and determined primarily by comparison with other offers submitted. The proposed quote will also be compared with the Independent Government Cost Estimate (IGCE).
Methodology 2.6 Quote Metrics:
Rating
Definition
Strength
A significant, outstanding, or exceptionally positive aspect of a Quote/Offer.
Weakness
Any aspect of a Quote/Offer increasing the potential for problems and issues with regard to contract performance. The Quote/Offer provides a minimally acceptable response to the Government’s requirements. The response leaves the evaluator with uncertainty as to the understanding of the work, capability to successfully perform the work, or capability to effectively manage the work effort.
Deficiency
A material failure of a Quote/Offer to meet a Government requirement or a combination of significant weaknesses in a Quote/Offer increasing the risk of unsuccessful contract performance to an unacceptable level.
(End of provision) FAR 52.217-3 Evaluation Exclusive of Options. (Apr 1984) The Government will evaluate offers for award purposes by including only the price for the basic requirement; i.e., options will not be included in the evaluation for award purposes.
(End of provision) FAR 52.217-4 Evaluation of Options Exercised at Time of Contract Award. (June 1988) Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate the total price for the basic requirement together with any option(s) exercised at the time of award.
(End of provision) FAR 52.217-5 Evaluation of Options. (July 1990) Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
