(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, FAR Subpart 13 and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation;

offers are being requested and a written solicitation will not be issued.

(ii) This solicitation is issued as a Request for Quotation (RFQ).

(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-04.

(iv) This procurement is set aside for Small Business concerns. The NAICS code is 238910 – Site Preparation Contractors and the Small Business Size Standard is $16.5 million.

STATEMENT OF WORK

SECTION 025251 - WATER SUPPLY WELL ABANDONMENT

PART 1 - GENERAL

1.1 SUMMARY

A. This Section includes the following:

1. Water supply wells Abandonment.

1.2 DEFINITIONS

A. Water Well Abandonment Includes abandoning existing well, appurtenances, including pump, piping, casing and concrete pad.

1.3 SUBMITTALS

A. The Contractor shall provide the following:

1. Well Abandonment Log.

2. Abandoned well GPS location to horizontal accuracy of 12’.

3. Digital picture of abandoned well site, before and after.

4. Application for Permit from the West Virginia Department of Health and Human

Resources to abandon each water well, EW 100.

1.4 WELL ABANDONMENT

A. Comply with AWWA A100 when abandoning water supply wells. Fill and seal well holes and casings, remove casing to 24” below ground level, remove any items in the well, any well slab, restore ground surface to finished grade.

B. Follow well-abandonment regulation of the EPA and the West Virginia Department of Health.

3.1 PREPARATION

A. Well Data, Location, depth and size of casing ,well contents, and year well was drilled:

1. Well #17, State ID No. 9942033

Location: Stuart Group Campground , Randolph County, WV, off of State Secondary Route 6.

Approximately 38°55’03.54”, 79°46’06.9” Casing Diameter is 6”. Depth of well is approximately 122 feet.

Well was drilled in 1962.

2. Well #015A, State Permit No. 13,283 Location: Stuart Recreation Area picnic shelter, Randolph County, WV, off of State Secondary Route 6.

Approximately 38°55’ 14.36”, 79°46’35.06” Casing Diameter is 6”. Depth of well is approximately 250 feet.

Casing depth 22.5 feet.

Well was drilled in 1994 and modified to a deeper depth in 1997.

3. Well #0110, State ID No. 9942046 Location: Bear Heaven Campground, Randolph County, WV, off of Forest Road 91, approximately 3 miles from the intersection of FR 91 and US 33.

Approximately 38°55’35.6”, 79°39’52.9” Casing Diameter is 6”. Depth of well is approximately 85 feet.

Casing depth feet 18’.

Well was drilled in 1963.

3.2 ABANDONMENT

A. Abandon well as per AWWA100 as per State of West Virginia Department of Health and EPA requirements.

B. Remove and dispose of any appurtenances in the well.

C. Remove and dispose of concrete well pad and casing from the top to 24” below grade.

D. Dispose of all materials at a recycling center or a legal land fill.

E. Furnish well abandonment log, GPS location of abandonment and a digital picture of the abandoned well site. Submit form EW-199 to the West Virginia Department of Health and Human Resources.

Located at Bear Heaven Campground, approximately 14 miles from Elkins, WV via US 33 for 11 miles to FR 91 on top of Shavers Mountain, then 2.8 miles to Bear Heaven Campground.

(vii) Date(s) and Place(s) of Delivery and Acceptance/Location

The desired date for starting for starting work is July 2021. Period of performance will be 45 calendar days.

Project is located at Stuart Recreation Area, approximately 6 miles from Elkins, WV via US 33 for 3.5 miles to Old 33, then 2 miles to WV Secondary 6, then 0.6 miles to Stuart Group Camp Site. The picnic area well is in the Stuart Recreation Area. From WV Secondary 6 turn onto FR 391 and proceed to the large picnic shelter.

Bear Heaven Campground is located on FR 91. From Elkins, WV 11 miles east on US 33, then

2.8 miles on FR 91.

(viii) 52.212-1 Instructions to Offerors – Commercial Items (JUN 2020) (Provision) Addenda to provision 52.212-1 paragraph (b) Submission of Offers:

1) Offerors must have an active entity registration in the System for Award Management in order to submit an offer. https://www.sam.gov/SAM/

2) Offers submitted in response to this solicitation shall include past performance information (a form has been provided and attached for optional use), a priced quote, and contractor representations and certifications. All line items must be priced and included in order to be considered for award.

a) Past Performance – provide a list of similar projects completed by your firm over the past three years. An optional form has been attached for your use. Include a brief description of the project, dollar amount, year completed, and project owner contact information (name, phone, email).

b) Priced Quote – Include the following: 1) completed price schedule from section v of this solicitation (page 1) and 2) acknowledge any amendments issued on bea.sam.gov for this solicitation by completing and signing the posted SF-30.

c) Representations and Certifications – Fill in the check boxes for provisions 52.204-24 and 52.212-3 found in this solicitation. Include your DUNS number.

3) Submit offer by email to carrie.edwards@usda.gov so that it is delivered into this inbox by the due date and time. Be aware that large attachments may increase the time required to deliver an email. It is the offerors responsibility to confirm receipt of the offer.

(ix) 52.212-2 Evaluation – Commercial Items (OCT 2014) (Provision)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision—

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".

(d) Representation. The Offeror represents that—

(1) It ☐will, ☐will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that—

It ☐ does, ☐ does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.

(e) Disclosures. (1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment—

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number;

and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services—

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment—

(a) In full consideration of the performance of the work called for in the Schedule, the Government will pay to the Contractor the awarded contract amount.

(b) The Government shall make progress payments monthly as the work proceeds, or at more frequent intervals as determined by the Contracting Officer, on estimates approved by the Contracting Officer. Except as provided in paragraph (c) of this clause, in making progress payments the Contracting Officer shall retain 10 percent of the estimated payment until final completion and acceptance of the contract work. However, if the Contracting Officer finds that satisfactory progress was achieved during any period for which a progress payment is to be made, the Contracting Officer may authorize such payment in full, without retaining a percentage. Also, on completion and acceptance of each unit or division for which the price is stated separately, the Contracting Officer may authorize full payment for that unit or division without retaining a percentage.

(c) When the work is substantially completed, the Contracting Officer shall retain an amount considered adequate for the protection of the Government and, at the Contracting Officer’s discretion, may release all or a portion of any excess amount.

(d) In further consideration of performance, the Contractor shall receive title to all property to be dismantled or demolished that is not specifically designated as being retained by the Government. The title shall vest in the Contractor immediately upon the Government’s issuing the notice of award, or if a performance bond is to be furnished after award, upon the Government’s issuance of a notice to proceed with the work. The Government shall not be responsible for the condition of, or any loss or damage to, the property. If the Contractor does not wish to remove from the site any of the property acquired, the Contracting Officer may, upon written request, grant the Contractor permission to leave the property on the premises. As a condition to the granting of this permission, the Contractor agrees to waive any right, title, claim, or interest in and to the property.

(e) Upon completion and acceptance of all work and receipt of a properly executed voucher, the Government shall make final payment of the amount due the Contractor under this contract. If requested, the Contractor shall release all claims against the Government arising under this contract, other than any claims the Contractor specifically excepts, in stated amounts, from operation of this release.

Alternate I (Apr 1984). If the contracting officer determines that the Government shall retain all material resulting from the dismantling or demolition work, delete paragraph (d) from the basic clause and renumber the remaining paragraphs.
