Dumpster Specification:

1. Dumpsters must be bear proof.

2. Must be able to fulfill order and deliver dumpsters prior to February 1, 2022.

3. Manufactured from 12 gauge steel and available in 6 cubic yard size.

4. Must be compatible with front end loader trash trucks.

5. Have double access doors secured with a bear-resistant paddle latch, which allows for personal trash disposal. Unloading lid that is unlatched by a gravity latch during the dumping operation.

The Gravity Latching Mechanism has a hook that is on a pivot.

6. When the dumpster is lifted and rotated forward, the hook can pivot away from the pin and allow the door to swing open. When the bear proof dumpster is set down the hook slides over the pin and engages to secure the lid in place.

7. A hook and pin setup on each side of the bear resistant dumpster, making it a cooperative 2-person operation to open manually if so desired. The hook/pins are slightly recessed for added resistance.

8. Color Dark Brown.

(d) Comptroller General Examination of Record. Contractor is responsible for verifying receipt of quotation by the Contracting Office. All emails, regardless of size, need to be received by the Government server, by the stated date and time. points of contact (POCs) authorized to negotiate with the Government on the Offeror's behalf; the solicitation number; and a statement confirming the Offeror is willing to hold its prices firm for at least 90 days from the date specified for receipt of offers.

4. Offeror shall be registered in the System for Award Management (SAM) with the appropriate NAICS Code and shall not have any Active Exclusions listed within SAM. If the Offeror is currently registered in SAM with completed representations and certifications, an affirmation on the title page (or second page) that these representations and certificates are current, complete, and accurate as of the date quotations are due shall suffice. 52.212-2 Evaluation-Commercial Items.

As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:

EVALUATION-COMMERCIAL ITEMS (OCT 2014)

Evaluation will be completed as follows:

The Government will review quotes received to determine if they are responsive to the requirements. A responsive quote is one that meets all terms, conditions, and specifications in the solicitation. The Offeror must provide all documents listed and comply with all quotation instructions for their quote to be considered “responsive” to this solicitation. Only responsive quotes will be evaluated for award.

In accordance with the LPTA process, technical tradeoffs will not be made, and no additional credit will be given for exceeding acceptability. Award will be made to the Acceptable Offeror with the lowest Total Evaluated Price (TEP) whose quote is evaluated as acceptable under both Factors I Technical Capability and Factor II Price which is deemed responsible in accordance with the Federal Acquisition Regulation (FAR). The Government reserves the right to award without discussions. Therefore, each initial offer should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if determined to be in the Government’s best interest.

EVALUATION CRITERIA

Only those Offerors determined to be technically acceptable, either initially or as a result of discussions, will be considered for award. An award will be made to the lowest priced Offeror with an Acceptable Factor I Technical Capability and Acceptable Factor II - Price.

The Government will evaluate the following factors:

Factor I – Technical Capability – Provide a one-page description of the product being proposed. Bear Proof Trash Dumpster must be to specifications listed on page 4 of 4 and within drawing specifications (Attachment 1).

Factor II – Price

Factor I – Technical Capability. The Technical Acceptability evaluation provides an assessment of the offeror’s capability to satisfy the Government’s requirement. The evaluation will focus on whether the offeror’s quote meets or does not meet the Government’s requirements. The Technical Acceptability factor will receive one of the adjectival ratings defined below in Table 1. Offerors must receive an “Acceptable” rating for the Technical Acceptability factor to be considered for award.

Once all offerors are evaluated under Factor I Technical Capability award will be made to the Offeror who has the Lowest Price Technically Acceptable (LPTA) with an acceptable rating for Factor I Technical Capability.

Factor II – Price.

(1) Price evaluation will be performed on all Offerors Pricing in accordance with FAR 52.212-1 Instructions to Offerors. Quotations will be ranked from lowest to highest price based on the Total Evaluated Price (TEP).

(2) Reasonableness: Prices are reasonable in comparison to estimates, prior prices paid, and competition and can be supported by suitable estimating techniques. If a price is unreasonably low to realistically perform the work for the proposed price, the offer will not be considered in the competitive range and will not be considered for award.

52.212-3 Offeror Representations and Certifications-Commercial Items.

As prescribed in 12.301(b)(2), insert the following provision:

OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL ITEMS (FEB 2021)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.

(a) Definitions. As used in this provision—

"Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest-level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror.

Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government.
