(ix) 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) (Provision)

1.0 Basis for Contract Award

The Government will review proposals received to determine if they are responsive to the requirements. A responsive proposal is one that meets all of the terms, conditions and specifications in the solicitation. The Offeror must provide all documents listed and comply with all proposal instructions in order for their proposal to be considered “responsive” to this solicitation. Only responsive proposals will be evaluated for award.

In accordance with the Lowest Price Technically Acceptable (LPTA) process, technical trade-offs will not be made and no additional credit will be given for exceeding acceptability. Award will be made to the Acceptable Offeror with the lowest Total Evaluated Price (TEP) whose proposal is evaluated as acceptable under both Factors I Technical and Factor II Past Performance, and which is deemed responsible in accordance with the Federal Acquisition Regulation (FAR). The Government reserves the right to award without discussions. Therefore, each initial offer should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions.

The contract will be awarded to the Offeror who is deemed responsible in accordance with FAR, whose proposal conforms to the solicitation requirements (including all stated terms, conditions, representations, certifications, and all other information required by this solicitation), and is judged, based on the evaluation factors to represent the best value to the Government, considering both cost and non-cost factor. The Government intends to make award on the basis of initial offer, without discussions, but reserves the right to conduct discussions, if determined necessary.

Each Offeror shall respond to the criteria listed below to be considered responsive.

COMMERCIAL SERVICE Page 19

2.0 Evaluation Criteria

Only those Offerors determined to be technically acceptable with an acceptable past performance rating, either initially or as a result of discussions, will be considered for award. An award will be made to the lowest priced Offeror with an Acceptable Factor I

– Technical and Acceptable Factor II – Experience/Past Performance rating.

The Government will evaluate the following factors:

a. Factor I – Technical

i. Quality Control Plan

ii. Biobased products utilized

b. Factor II –Experience/Past Performance

Subfactor 1 – Minimum 1 year experience

Subfactor 2 – Minimum 3 Recent and Relevant Projects performed in the last 3 years from the issuance date of solicitation

Subfactor 3 – Projects similar in size and scope of this solicitation.

c. Factor III - Price

Factor I – Technical – Quality Control Plan and Biobased products.

The Technical Acceptability evaluation provides an assessment of the offeror’s capability to satisfy the Government’s requirement. The evaluation will focus on whether the offeror’s proposal meets or does not meet the Government’s requirements. Also, whether the offeror provides a complete, written Quality Control Program to ensure the requirements of the contract are provided as specified in the guidelines. The Technical Acceptability factor will receive one of the adjectival ratings defined below in Table 1. Sub-factors will not be rated separately, rather they will be evaluated together in order to derive an overall Technical Acceptability factor rating.

Offerors must receive an “Acceptable” rating for the Technical Acceptability factor in order to be considered for award.

Table 1 – Technical Acceptable/Unacceptable Ratings

Rating Description Acceptable Offeror provides a complete Quality Control Plan and a quote that demonstrates an understanding and sound approach to meeting the contract requirements. The Offeror Quote clearly states the list of products that will be used.

Unacceptable Offeror does not provide a Quality Control Plan and does not demonstrate an understanding and sound approach to meeting the requirements. Quote does not clearly state the list of products that will be used.

Factor II – Experience/Past Performance.

Past performance will be evaluated on the basis of the following sub-factors of equal importance:

Recency Assessment. An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past three (3) years from the solicitation issuance date. Recent past performance is defined as not more than 3 years from the RFQ release date; relevant in terms of similar nature of work, size and complexity.

Relevancy Assessment. To be relevant, the effort must be similar in nature of work, size, and complexity. The Government will conduct an in-depth evaluation of all recent performance information obtained to determine if it is the same or similar in nature of work, size, and complexity to the services being procured under this solicitation.

Assigning Rating. The Experience/Past Performance Factor will be assigned one of the ratings defined below.

Table 1 – Past Performance Evaluation Ratings Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

The evaluation team will perform a Factor II Past Performance evaluation on each offerors proposal.

The Government will use past performance information from Government databases such as the Contractor Performance Assessment Reporting System(CPARS) Database and the Federal Awardee Performance and Integrity Information System (FAPIIS), etc., which is available using the Offerors DUNS number submitted with 52.212-1 Instructions to Offerors. An offer will be determined to be acceptable under Factor II Past Performance in accordance with the following procedures:

1) The Government will use your past three (3) years performance in CPARS for that assessment.

2) For the Offeror to receive an acceptable Past Performance Ranking, their CPARS ratings must be equal to or greater than “Satisfactory” in at least half of all proposals evaluated.

3) If the Offeror does not have at least three (3) CPARS records, the Offeror will be required to provide three (3) but no more than five (5) recent and relevant, in magnitude and scope, Experience/Past Performance Questionnaire.

COMMERCIAL SERVICE Page 21

4. ) Offerors without a record of relevant past performance or for whom information on past performance is not available or so sparse that there is no meaningful past performance rating can be reasonably assigned; the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.

Once all offerors are evaluated under both Factor I Technical and Factor II Experience/Past Performance, award will be made to the Offeror who has the lowest price with acceptable ratings in both Factor I - Technical and Factor II - Experience/Past Performance.

Factor III – Price

(1) Price evaluation will be performed on all quotes in accordance with 52.212-1 Instructions to Offerors. Proposals will be ranked from lowest to highest price based on the Total Evaluated Price (TEP). The TEP is the total of the base year and all option years including the option to extend IAW FAR 52.217-8.

(2) Reasonableness: Prices are reasonable in comparison to estimates, prior prices paid, and competition and can be supported by suitable estimating techniques. If a price is unreasonably low to realistically perform the work for the proposed price, the offer will be not considered in the competitive range and will not be considered for contract award.

(3) Total Evaluated Price: As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding total price for all options to the total price for the basic requirement. Thus, the offeror’s total price for the purpose of evaluation will include the base period, first option year, second option year, third option year and fourth option year. Offerors are not required to enter a price for the six month extension period.

(4) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the option(s).

The Government reserves the right to not award this contract to a contractor whose price is unrealistic.
