SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 SCOPE OF CONTRACT

The performance-based services covered in this solicitation and resultant contract require the contractor to furnish all labor, equipment, supervision, transportation, operating supplies, and incidentals necessary to perform road maintenance work including but not limited to machine roadside brush cutting, road reconditioning, road clearing, and road shoulder repair on designated roads in compliance with the terms, specifications, conditions, and provisions of this solicitation. The equipment used to perform this work shall meet safety standards and shall be in good mechanical condition. Option Items are awarded at the discretion of the Contracting Officer.

C.2 PROJECT LOCATION

The roads are located approximately 100 miles southeast of Coeur d Alene, ID. The project area is located on the St. Joe Ranger District of the Idaho Panhandle National Forests. Refer to Table

1. for road descriptions.

C.3 MAGNITUDE OF CONSTRUCTION PROJECT

C.4 TECHNICAL SPECIFICATIONS

AGAR 452.211-72 Statement of Work/Specifications (FEB 1988) The Contractor shall furnish the necessary personnel, material, equipment, services and facilities (except as otherwise specified), to perform the Statement of Work/Specifications referenced in Section J.

AGAR 452.211-73 Attachments to Statement of Work/Specifications (FEB 1988) The attachments to the Statement of Work/Specifications listed in Section J are hereby made part of this solicitation and any resultant contract.

AGAR 452.211-74 Period of Performance. The period of performance is from the date of Notice to Proceed to 30 September 2023. Estimated start date is 30 June 2023 or earlier as field conditions permit.

FAR 52.237-1 Site Visit. (Apr 1984) Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affectthe cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

C.4.1 Work Objective. Roadside Brush Cutting: Successful, quality performance will result in a road with a clear line of sight, clear of debris, and a road surface that is accessible by motorized vehicles as outlined in specifications. Road Reconditioning: Successful, quality performance will result in a road with a uniform grade and cross section free of hollows, depressions, berms, and projections above the road surface. Provide adequate road drainage by sloping the road surface. Road Clearing: Successful, quality performance will result in a road with a clear line of sight, clear of debris, and a road surface that is accessible by motorized vehicles as outlined in specifications. Road Shoulder Repair: Perform work necessary to meet objectives as outlined in specifications.

C-4.3 Government-Furnished Items. Riprap and embankment for road shoulder repair.

Source for Riprap and embankment shall be sourced from government owned quarry located at east side of entrance of FS Road 1223 South, 73 miles east of St. Maries on Highway 50. Riprap shall be sorted to achieve the requirements of gradation in section C- 8.14.1.

C-4.4 Restrictions.

Bridge overload permits are required for any vehicle which exceeds the maximum allowable gross vehicle weight of 120,000 pounds; if the vehicle is in violation of the of the Federal Bridge Formula including single axle loads that exceed 20,000 pounds or tandem axle loads that exceed 34,000 pounds; if the vehicle exceeds the posted load limits for the bridge.

Bridge overload permits may not be issued for bridges with posted load limits.

NOTE: Equipment with metal tracks are not allowed on paved roads.

C-8 Contractor Work Requirement and Standards

C-8.1 Moving of Equipment and Supplies. The moving of equipment and supplies to the job site and between job sites shall be the Contractor's responsibility and is incidental to Pay Items as shown in the Schedule of Items and no separate payment shall be made. Costs for moving of equipment and supplies will be considered incidental to the ordered work, therefore the Contractor must consider this expense in their pricing.

C-8.2 Mobilization. Mobilization is defined, for the purposes of this contract, as moving equipment, accessories, support equipment, and personnel to the point of hire and return to the point of origin at the conclusion of the project. Costs for mobilization will be considered incidental to the ordered work, therefore the Contractor must consider this expense in their pricing.C-8.3 Replacement of Equipment. Contractor shall provide quality equipment capable of safely performing the work under the terms of the contract.

If equipment is rejected because it does not meet minimum requirements, including but not limited to safety and operability, or if it becomes inoperative, the Contractor shall correct the deficiencies or furnish replacement equipment meeting contract requirements within 2 days. All repairs are the total responsibility of the Contractor.

C-8.4 Equipment Performance Standards. Contractor shall make equipment available for inspection and approval before use.

The Contractor must satisfy all applicable OSHA and DOT requirements or certifications for the operation of offered equipment. There will be no obligation to make payment for any equipment delivered that does not meet the Technical Specifications.

C-8.4.1 All equipment, material, and articles incorporated into the work covered by this contract shall be of the most suitable grade for the purpose intended, unless otherwise specifically provided in this contract. References in the specifications to equipment, material, articles, or patented processes by trade name, make, or catalog number, shall be regarded as establishing a standard of quality and shall not be construed as limiting competition. The Contractor may, at its option, use any equipment, material, article, or process that, in the judgment of the Contracting Officer, accomplishes the intended work in the contract, unless otherwise specifically provided in this contract.

C-8.4.2 The Contractor shall obtain the Contracting Officer’s approval of the machinery and mechanical and other equipment to be incorporated into the work. When requesting approval, the Contractor shall furnish to the Contracting Officer the name of the manufacturer, the model number, and other information concerning the performance, capacity, nature, and rating of the machinery and mechanical and other equipment. When required by this contract or by the Contracting Officer, the Contractor shall also obtain the Contracting Officer’s approval of the material or articles which the Contractor contemplates incorporating into the work. When requesting approval, the Contractor shall provide full information concerning the material or articles. When directed to do so, the Contractor shall submit samples for approval at the Contractor’s expense, with all shipping charges prepaid.

Machinery, equipment, material, and articles that do not have the required approval shall be installed or used at the risk of subsequent rejection.

C-8.4.3 All work under this contract shall be performed in a skillful and workmanlike manner.

The Contracting Officer may require, in writing, that the Contractor remove from the work any employee the Contracting Officer deems incompetent, careless, or otherwise objectionable.

C-8.5 Rental Equipment if required may include:

*End dump truck. 10-12 cubic yard rated capacity; minimum 10 cubic yard capacity at water level with sideboards; removable tail gate; spare tire with 50% original tread mounted on truck.

*Hydraulic excavator. 150 – 200 horsepower; minimum 50,000 LBS operating weight;

track mounted with bucket equipped with a hydraulic "thumb" and claw syle with teeth capable of grasping material; minimum 20’ digging depth; minimum 1 cubic yard bucket capacity. Hook or eye on backside of bucket to allow attachment of chain or cable.

*Or other types of equipment as approved by the Contracting OfficerC-8.6 Existing Facilities.

All existing facilities such as signs, cattleguards and drainage structures and road surfacing damaged by the Contractor's operations shall be replaced or repaired by the Contractor at no cost to the Government.

C-8.7 Pollution and Erosion Control. During all operations under this contract, the Contractor shall exercise reasonable measures to direct surface runoff water to stabilized waterways and to keep the drainage systems functioning effectively to prevent or minimize soil erosion and pollution of water and other resources. All refuse, including garbage, rubbish, and solid or liquid wastes from the Contractor's operations, including camps, parking areas, and equipment maintenance areas shall be stored and collected in a sanitary manner and disposed of in a State-approved sanitary landfill.

Oil from crankcases or gear boxes, equipment waste or spilled or excess fuel shall be placed in containers and removed from the work site and disposed of as approved and required by Federal, State and Local laws.

Equipment uses for operations in close proximity to streams or bodies of water will be required to meet more stringent requirements regarding seals and fittings that prevent the leaking of hydraulic fluids, lubricants and fuels. Failure to comply will result in immediate rejection of equipment.

C-8.8 Noxious Weed Control. Prior to moving of the equipment to the worksite, the Contractor shall be required to clean all equipment prior to entry on to the project area. This cleaning shall remove all dirt and plant parts and material that could carry noxious weed seeds into the project area. Failure to provide clean equipment may result in the rejection of equipment.

C-8.9 Maintenance of Traffic and Use of Warning Devices. The Contractor shall provide signs, other devices, and traffic control for occupied work areas in accordance with National standards as contained in Part VI of the Manual of Uniform Traffic Control Devices (MUTCD), current edition, and these specifications. All signs and devices remain the property and responsibility of the Contractor.

C-8.9.1 Traffic Conditions

C-8.9.1.1 Roads shall be open to traffic unless otherwise provided.

C-8.9.1.2 One lane roads shall be always available for one lane channelized passage of traffic unless approved in writing by the CO.

C-8.9.2 Devices

C-8.9.2.1 Required signs can be mounted on portable or temporary mountings.

Standard MUTCD legends shall be used.

C-8.9.2.2 Signs will at all times be within one mile of the operating equipment or personnel unless otherwise approved by the CO.

C-8.9.2.3 Hazards incidental to the work within or on the roadbed, shoulders, or turnouts shall be marked with hazard identification, illuminated beacons, or other MUTCD devices to safely guide road users through the area. Work shall be scheduled to provide for completion of segments on a daily basis.

C-8.9.2.4 Advisory speed plates may be used to control traffic through the work area.

C-8.9.3 Equipment

C-8.9.3.1 All vehicles and machinery operating on or from the road bed shall have flashing 4-way or top mounted flashing amber lights or rotary beacons operated continuously while work is in progress.

C-8.9.3.2 Vehicles and machinery not directly used in the maintenance operation shall be parked off the roadbed to minimize interference with the normal use of the road.

C-8.9.3.3 Use of motorized equipment other than hand held equipment such as power saws and brush cutters will not be permitted off designated roads in the project area without approval of the Contracting Officer.

C-8.11 Roadside Brush Cutting Methods.

Refer to Exhibit A. C-8.11.1 All material.

C-8.11.1.1 All brush, slash, trees, and herbaceous plants (grass and weeds), etc., shall be cut off cleanly, with no material left partially cut, bent over, or matted down.

C-8.11.1.2 No brush, slash, or other material shall be disposed of in creeks or streams and shall not interfere with or obstruct drainage facilities.

C-8.11.1.3 All slash having a diameter greater than two (2) inches and a length greater than two (2) feet or a length greater than three (3) feet regardless of diameter shall be disposed of by scattering outside the clearing limits on the fill slope side of the road so that no material extends above the road bed surface.

Fragmented debris of smaller dimension may remain within the clearing limits but must be removed from the road bed surface. Scattered debris in road bed is acceptable in minor amounts that will not contaminate aggregate surfacing or may readily be in incorporated into native surface materials. On roads open to travel with motorized vehicles the contractor shall maintain the road bed to a condition that is safe for public traffic to pass which may require removing all brush that is a driving hazard within the same day it was cut. All other brush shall be picked and scattered within 7 consecutive days of being cut.

C-8.11.2 Logs and windfalls.

C-8.11.2.1 Logs and windfalls lying within or across the clearing limits shall be cut off at the top of the backslope and moved to the fillslope side of the road beyond the clearing limits.

Logs placed on the fillslope side of the road shall be outside the clearing limits and at least two feet below the road bed elevation. The remaining portion of a log or windfall that lies on the upper side of the road shall either be firmly anchored to prevent sliding inside the clearing limits or moved across the road as described above.

C-8.11.2.2 Windfalls on the fillslope side which extend above the road bed surface shall be cut off at least two (2) feet below the road bed surface and disposed of as outlined above.

Logs shall be placed, limbed, or scattered so that limbs do not extend above the road bed elevations.

C-8.11.2.3 Windfalls and logs may be disposed of in creeks or streams, but shall not interfere with or obstruct drainage facilities.

C-8.11.3 Brush and trees six (6) inches or less in diameter

C-8.11.3.1 All brush and trees with a stump diameter of six (6) inches or less located outside of the road bed but within the clearing limits, shall be cut off no higher than six (6) inches above the ground level, as measured on the uphill side. The tree diameter shall be measured on the uphill side. Roadbed clearing limits vegetation stump height shall not exceed two (2) inches and shall be cut as not to create a hazard to foot or vehicle traffic.

C-8.11.4 Trees in excess of six (6) inches in diameter.

C-8.11.4.1 Trees in excess of six (6) inches in diameter, when measured six (6) inches above the ground, shall be limbed so that no limb extends within a clear height of 14 feet above the roadbed surface. Limbs shall be cut to within six (6) inches of the trunk to produce a reasonably smooth vertical face.

C-8.11.5 Debris shall not be allowed to accumulate in heavy concentrations and should be distributed outside the clearing limits adjacent to the cutting area.

C-8.11.6 Piling. Will not be required under this contract, however, may be approved by Contracting Officer (CO).C-8.12 Road Reconditioning Methods. Refer to Exhibit A.

Performance of road reconditioning includes removing slumps, slides, sediment, rocks, trees, logs (including firewood), stumps, and slash, within the clearing limits. Shape the roadbed and ditches, including shoulders, turnouts, turn arounds, parking areas, and approach road intersections, and clean culvert inlets and outlets. Remove ruts, washes, slough, and other irregularities that prevent normal runoff from the road surface. Where equipment is used to remove excessive, large, or deleterious (damaging) material from the shaped road template, wasted material shall not be placed in a drainage or within 300 feet of a live stream. The end result shall be the restoration and maintenance of the original cross section, grade and drainage of the road. Water application may be necessary to achieve suitable compaction. The following standard industry practices will be reviewed during inspections to determine the results will be met.

C-8.12.1 Dispose of slumps, slides, sediments, and rocks by sidecasting on the road fill slope in layers not more than 1 foot in depth. Avoid sidecasting in locations where erosion will carry materials into streams. Wasted material shall not be placed in a drainage or within 300 feet of a live stream. Maximum slide or slump size is 20 cubic yards. Maximum rock size is 4 feet in diameter.

C-8.12.2 Use equipment to restore the surface without loss of road material. Oversized material exceeding 4 inches in size removed by equipment shall be disposed of by sidecasting over the fill slope except within 100 feet each side of culverts, other stream crossings or within 300’ of a perennial stream that is inhabited by fish, 150’ from a perennial steam not inhabited by fish and 100’ from any intermittent stream.

C-8.12.3 If work operations produce excess material, feather it out or haul it away. Avoid sidecasting in locations where erosion will carry materials into streams. Avoid leaving a berm that channels water down the road unless it is routed into an effective vegetation filter which removes sediment.

No berm or ridge of any material shall be left along either shoulder of the roadbed unless directed by the Contracting Officer (CO) or designated representative.

C-8.12.4 Elimination of ruts, potholes, and washes. These defects shall be repaired by scarifying or cutting to the bottom of such defects to provide for uniform compaction of roadbed material. Remove all organic, deleterious material larger than 6 inches from the top 6 inches of the road surface. Large rock or organic material removed from drainage facilities during cleaning process shall not be used as fill. Dispose of rock larger than 4 inches brought the surface during scarification to the surface by sidecasting. For portions of the road not requiring scarification the roadbed may contain rocks larger than 4 inches provided they do not extend above the finished roadbed surface.

C-8.12.5 Repair of settlement sections shall be performed where possible by cutting from the roadbed on each end of the settled area and filling into the settled area to provide smooth transitions to adjacent road grades. If this will not accomplish the objective, the CO shall be informed.

C-8.12.6 Shaping operations shall not undercut road backslopes.

C-8.12.7 Outslope roads without a roadside ditch 2% - 4% the full width of the roadbed unless otherwise approved by the CO. Inslope roads with a roadside ditch 2% - 4% the full width of the roadbed unless otherwise approved by the CO.

C-8.12.8 On roads with a roadside ditch on both sides, reshape to maintain a crown except on curves were the crown is omitted. Road cross section shall slope uniformly both ways from crown apex to shoulders between 2% - 4%.C-8.12.9 Existing ditches shall be excavated to a minimum depth of 1 foot and wood, rocks, and other debris shall be removed from roadside drainage ditches to provide unobstructed flow of water and disposed of on the jobsite as determined by the CO. The backslope of the ditch shall not be undercut by ditch shaping or cleaning operations; and the slope to road shoulder shall be maintained at an approximate ratio of 2:1 from the bottom of the ditch to the edge of the roadbed. Roadside ditches shall not be excavated to a depth of greater than 2 feet below roadbed grade. Existing ditch dikes shall be restored, reshaped, and compacted as needed for effective drainage through culverts.

Clean inlets and outlets of existing culverts so that flow is not impaired.

C-8.12.10 At the conclusion of the shaping operations the roadbed shall be smoothed and dressed to produce a uniform grade and cross section and a surface free of hollows, depressions, and projections above the adjacent roadbed surface. No berm or ridge or any material shall be left along either shoulder of the roadbed unless directed by the CO.

C-8.12.11 Remove from bridge decks all rock and other material that would create a hazard to traffic or is otherwise detrimental to the traveled surface. Cattleguards shall be left clean between the bottom of the rails and ground beneath. No additional material may be deposited within cattleguards.

C-8.12.12 Contractor is responsible to ensure that performance does not reduce the level of fines in the road surface. Therefore, operations may be suspended when soil moisture conditions are not favorable for obtaining a satisfactory result. Blade and shape when the moisture content is suitable for compaction. Suitable moisture content is determined to be in excess of 12 percent and less than 25 percent by weight unless otherwise authorized by the CO. Water application may be required to achieve suitable compaction. To achieve compaction operate compaction equipment over the full width of each layer until visible deformation of the layer ceases. Make at least three complete passes.

C-8.12.13 Compact bridge approaches with a roller for 100 feet, both sides. Compact each layer of material full width with one of the following and until there is no visible evidence of further consolidation.

C-8.12.14 Perform 4 roller passes of a vibratory roller having a minimum dynamic force of

40,000 pounds impact per vibrations and a minimum frequency of 1000 vibrations per minute.

C-8.12.15 Eight roller passes of a 20-ton compression-type roller.

C-8.12.16 Eight roller passes of a vibratory roller having a minimum dynamic force of 30,000 pounds impact per vibration and a minimum frequency of 1000 vibrations per minute.

C-8.13 Road Clearing.

Refer to Exhibit A. C-

8.13.1 All material.

C-8.13.1.2 Windfall trees, tree limbs, logs, stumps, and slash and rocks.

C-8.13.1.3 Windfall trees, tree limbs, logs, stumps, and rocks larger than 24 inches in diameter within or across the clearing limits shall be removed; vegetation shall be cut off at the top of the cutslope and moved to the fill slope side of the road beyond the clearing limits.

Vegetation and rocks placed on the fillslope of the road shall be outside the clearing limits and at least two feet below the shoulder elevation. The remaining portion of a log or windfall that lies on the upper side of the road shall either be firmly anchored to prevent sliding inside the clearing limits or moved to the fillslope side of the road as described above.C-8.13.1.4 Windfall trees on the fillslope side of the road which extend above the road surface shall be cut off at least two (2) feet below the road elevation and disposed of as outlined above. Logs shall be placed, limbed, or scattered so that limbs do not extend above the roadway elevations.

C-8.13.1.5 Windfalls and logs may be disposed of in creeks or streams, but shall not interfere with or obstruct drainage facilities.

C-8.14 Road Shoulder Repair. Refer to Exhibit A.

Furnish hard, durable angular rock that is resistant to weathering and water action and free of organic other unsuitable material. Do not use shale, rock with shale seams, or other fissile or fissured rock that may break into smaller pieces in the process of handling and placing.

(1) Gradation includes spalls and rock fragments graded to provide a stable mass.

(2) The intermediate dimension is the longest straight-line distance across the rock that is perpendicular to the rock’s longest axis on the rock face with the largest projection plane.

(3) Rock mass is based on a specific gravity of 2.65 and 85 percent of the cubic volume as calculated using the intermediate dimension.

Placed riprap. Placed riprap is rock placed on a prepared surface to form a well-graded mass.

Place riprap to its full thickness in one operation to avoid displacing underlying material.

Do not place riprap material by methods that cause segregation or damage to the prepared surface. Place or rearrange individual rocks by mechanical or hand methods to which a dense uniform blanket with a reasonably smooth surface.

Backfill. Furnish a well-graded compactible material free of excess moisture, muck, frozen lumps, roots, sod, or other deleterious material conforming to the following:

(1) Maximum particle size 6 inches

(2) Soil classification, AASHTO M 145 A-1, A-2 or A-3

Place backfill in 12 inch lifts and compact by mechanical tamper.

C-8.15 Developing Water Supply and Watering. This work shall consist of developing water supplies, and furnishing, hauling, and applying water. The Contractor shall be responsible for obtaining the right to use water, including any royalty costs. To prevent spread of aquatic nuisance species follow

C-8.16 Damage to Structures. The Contractor shall be held liable and is responsible for any damage caused by his/her personnel or equipment to any existing traffic loops, cattleguards, culverts, signs, and riprap protecting culvert inlets or fill slopes. Repair to these structures shall be at the Contractor's expense.

C-9Measurement.

C-9.1 Method of Measurement and Payment. Accepted work will measured in miles to the nearest one hundredth of a mile along the centerline of the roadway cross sections, and shall include only those roads or road portions which are ordered under the contract and completed to satisfactorily meet the contract objectives. Measurement will be by a Forest Service vehicle. The measuring device will checked for accuracy and calibrated as necessary on a section of road that has been carefully measured with an approved engineering measuring device. Note: Parking areas, turnouts, and approach road connections are considered as incidental to the main roads and shall not be measured separately. Mileage measurement includes all work on both sides of the road, regardless of the number of passes made to accomplish the work. These features are considered as adjuncts to the main roads and shall not be measured separately.

C-9.2 Hourly Work Method of Measurement. An hour consists of 60 minutes of actual operation of equipment on authorized Government work. Moving of equipment under its own power, when so ordered by the Contracting Officer, will constitute authorized work.

Non-productive time such as, but not restricted to, lack of operating supplies or being stuck, or moving and loading time of equipment and specified accessories, shall not constitute “actual operation”.

C-9.2.1 Record of Work. The government will maintain a daily written record for each piece of equipment:

- Contract and Task Order number and work sub-item number applicable to the equipment

- Name of Contractor and Operator

- Hours of operation authorized to the nearest quarter hour

- Hour of actual operation of regular work

- Authorized hours of operation lost and reason

This daily record can be documented on a shift ticket. The Operator performing the work or Designated Representative and COR or Inspector shall sign the daily record each day.

The daily record will be used to reconcile the contractor’s proper invoice for payment.

Appropriate Government surveillance of contractor performance is required for ALL hourly work to give reasonable assurance that efficient methods and effective cost controls are being used.

C-9.3 Measurement and Payment Terms and Definitions.

C-9.3.1 Lump Sum (LS). Do not measure directly. The bid amount is complete payment for all work described in the contract and necessary to complete the work for that item.

Estimated quantities of lump sum work shown in the contract are approximate.

SECTION D--PACKAGING AND MARKING

D.1 PACKING AND MARKING

All shipments of materials, equipment and/or supplies shall be addressed to the Contractor and not to the Government.

D.2 PROJECT LABELING FOR OFFICIAL CORRESPONDENCE

The Government singularly identifies each project with a contract number at time of award. The contract number is a unique identifier to purposely and permanently represent an awarded project. The Government issued contract number is to be referenced on all official communication starting upon notice of award.

SECTION E--INSPECTION AND ACCEPTANCE

E.1 CLAUSES

52.246-12 Inspection of Construction (AUG 1996)

E-1 Government Quality Assurance Inspection. The Government will, at its convenience, make periodic inspections of the work to assure contract compliance and will perform Quality Assurance Inspections to determine that the Contractor is performing quality control in accordance with their Quality Control Plan.

Methods may include visual survey and review of Contractor quality control documents, procedures, plan inspection reports and/or customer comments. The Contractor is still responsible for maintaining their quality control to meet the terms of the contract. The Contracting Officer’s Representative or designated inspector will conduct all inspections.

E-2 Acceptance. Acceptance of the work under the contract will be made after steps above have been taken and the COR has made the determination of satisfactory compliance with the specifications. For acceptance purposes, complete segments as defined above shall be satisfactorily completed before acceptance will be made unless otherwise approved by the CO. Acceptance will not be made for segments broken by unacceptable portions of work inspections after rework will be made in the same manner as the first inspection. Payment will not be made until the Contractor has assured the Government that its Quality Control measures have corrected the deficiencies.

E-3 Rework and Re-Inspection after Work. When inspection indicated that the performance objectives were not met, the work will be deemed unsatisfactory and payment will not be made until the Contractor has assured the Government that its Quality Control measures have corrected the deficiencies. Inspections after rework will be made in the same manner as the first inspection. The Contractor may be charged for actual costs incurred by the Government for re-inspection of the rework.

*NOTE: The Contractor will be immediately notified if not meeting the contract specifications. Roads not meeting the acceptable standard will be reworked to the standard before payment is made. If the Government is required to re-inspect the Contractor’s work, the Contractor may be charged for actual costs incurred by the Government for re-inspection of the rework.

E-4 Contractor Quality Control Plan. The Contractor shall submit a Quality Control Plan (QCP) that demonstrates how the Contractor will assure that quality of performance meets the objectives and requirements of the contract. The QCP is required before work begins. The QCP shall specify:

• How quality will be monitored to assure performance standards are met and rate of progress.

• How the work will be supervised and by whom.

• Identify the personnel responsible for performing quality control.

• Identify designated representative on site at all time during performance.

Failure of the Contractor to maintain satisfactory inspection results will be grounds for deduction in payment or termination for cause.

E-5 Contractor Quality Control Inspection. The Contractor shall assure performance meets contract specifications, in acordance with FAR 52.212-4 Contract Terms and Conditions-Commercial prior to requesting the Government to inspect for payment or acceptance. Upon completion of a road, the Contractor shall notify the CO in writing to set a mutually agreed upon date for inspection of completed work. The Government will inspect completed sections of road within 3 business days (i.e. Monday – Friday, excluding Holidays) following Contractor’s notification of completion of the work.

The Contractor’s Quality Control inspections will be the basis for computing payment unless the Government verification results indicate the work is unacceptable. Refer to Section F – Deliveries or performance for additional details.

SECTION F--DELIVERIES OR PERFORMANCE

F.1 CLAUSES

52.211-18 Variation in Estimated Quantity (APR 1984) 52.242-14 Suspension of Work (APR 1984)

52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984) The Contractor shall be required to (a) commence work under this contract within _10__calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than __9/30/2023.

F.2 OTHER REQUIREMENTS

F-2 Work shall be accomplished during daylight hours (one-half hour before sunrise to one-half after sunset). The Government may restrict operations on weekends or holidays of expected high use. The road shoulder repair shall be done between 15 July and 1 Sept to mitigate adverse effects to aquatic organisms unless otherwise approved by the CO.

F-3 The Government reserves the right to specify the sequence in which the work is performed.

F-4 Performance Period. The contractor shall maintain progress at a rate, which will assure completion of the work within the period specified.

F-5 Peformance Summary. The following describes the major items in the contract with the incentives and deductions for the work described.

Failure to comply shall be sufficient grounds for suspension of work, or contract deduction of 10%. Rejection of equipment does not relieve contractor from responsibility to complete the work.

SECTION G--CONTRACT ADMINISTRATION DATA

G.1 CLAUSES

452.215-73 Post Award Conference (NOV 1996) A post award conference with the successful offeror is required. It will be scheduled and held within __15__days after the date of contract award.

The conference will be held online, over the phone or at a location to be agreed upon.

G.2 OTHER REQUIREMENTS

Invoice Platform Processing (IPP).

The Forest Service is utilizing the Invoice Processing Platform (IPP) for the electronic submission and tracking of contracts/purchase orders, invoices, and payment information. IPP is a secure Government-wide, Web-based invoice processing service. Visit http://www.ipp.gov to learn more. Upon award of a contract, Contractors must enroll at https://www.ipp.gov/vendors/enrollment-vendors.htm. Contractors shall submit all invoices electronically via IPP. Paper copies of invoices will no longer be accepted.

SECTION H--SPECIAL CONTRACT REQUIREMENTS

H.1 CLAUSES

452.237-74 Key Personnel (FEB 1988)

(a) The Contractor shall assign to this contract the following key personnel:

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

H.2 OTHER REQUIREMENTS

H-1 Safety.

Contractors shall comply with OSHA regulations and provide employees a work environment that is sanitary and not hazardous, which includes providing personal protective equipment.

Contractors must maintain a health and safety plan and an accident prevention program, which includes frequent and regular inspections of the project site, materials and equipment.

Contractors are responsible for risk management regarding contractor/employee and public safety, which include experience of operator to handle road and terrain conditions, getting to the worksite, traffic control, and coordination with other users.

H-2 Personal Protective Equipment.

(a) The Contractor will train in the safe operation and use of equipment to all workers using such equipment.

(b) Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards or processes encountered in a manner capable of causing injury or impairment in the function of any part of the body.

(c) Defective or damaged personal protective equipment shall not be used.

(d) The Contractor shall provide, at no cost to the employee, to each employee who operates a chain saw, chain saw chaps and assure the chaps are worn during saw operations.
