FAR (48 CFR) 53.110
Solicitation No.: 1240LT21Q0061 Amendment No.: 2 Q1: There is site visit scheduled for July 7 and since we are late to the dance, we will not be able to attend. What kind of information will be shared at that meeting and will that be made available through sam.gov? Are there any provisions for remote participation?
A1: Any significant discussions or questions/answers from the site visit will be made available throughout this amendment. As for the provisions, please refer to
Q2: I see this is a NAICS code 541330 set aside for a small business. How is this acquisition exempt from the Brooks Act?
A2: The NAICS code selected for this requirement was based off the environmental engineering work needed, specifically involving the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). CERCLA does not include architect-engineer services as defined in the Brooks Act and FAR Part 2 since this requirement does not include design or construction services as defined in the Federal Acquisition Regulations Part 36 and Part 2.
Q3: Does the Forest Service have any templates or preferred formats for work plans and reports, or is the contractor free to submit these documents in accordance with applicable regulatory guidance and/or industry standards?
A3: The FS does not have any templates or preferred format for work plans. The Engineering Evaluation and Cost Analysis shall meet criteria from US EPA EE/CA Guidance.
Q4: Page 4 of the solicitation implies that a health and safety plan and detailed project work plan must be submitted within 5 days of receiving authorization to proceed. If the PA/SI report for this site (recently completed) is not available for a complete review until after proposals have been submitted, can the 5-day submittal requirement be extended to give the contractor time to digest the information presented in the PA/SI report?
A4: The final version of the PA/SI report will be provided to the contractor (offeror) who is awarded this contract. The FS has posted an amendment that includes select items (analytics, findings, and conclusion) and the 2009 Characterization report for this site. No additional time is needed to prepare the health and safety plan. The site and issues are straightforward at this location.
Q5: The draft EE/CA Preparation phase of the RFQ (page 3) references a schedule of deliverables. Is this schedule of deliverables the RFQ itself? If not, where can this document be found?
A5: The schedule of deliverables includes due dates for the work plan, a draft EE/CA report, and a final EE/CA report. The contractor will provide the deliverables as part of this solicitation.
Q6: A major component of the EE/CA process is Public Involvement including designating a community relations spokesperson, establishing the information repository, conducting community interviews and developing a community relations plan, coordinating public notices and meetings. Are these Public Involvement tasks assumed to be performed by the USFS Public Affairs Officer, or is the consultant responsible for providing these services?
A6: This solicitation does not include Public Involvement Tasks. The USFS will take the lead in this task.
Q7: If these services are included in the scope, should they be included in the Draft EE/CA phase or the Final EE/CA phase?
A7: Public Involvement tasks are not applicable.
Q8: Please confirm that the only required cost information for submittal is the table on Page 2 of the RFQ – (v) Schedule of Items/Price Schedule. Is any back-up costing information required? Does the bidder need to fill out and submit the table on Page 8 regarding employee class and Monetary Wage- Fringe Benefits?
A8: The cover page of the solicitation states the requirements, which does not include back-up costing information. As for page 8 of the solicitation, as stated on the stop of the table on page 8, it is for information purposes only.
Q9: Please confirm that the only areas to be filled out by the bidder in the Reps and Certs section are highlighted in yellow in the RFQ (pg 6 and 16) A9: As stated in on the cover page of the solicitation, you can complete the representative and certifications electronically via SAM website.
Q10: The RFQ discusses the need to stabilize the mine waste pile. The 2009 site characterization report discusses a flowing adit with poor quality drainage and other smaller waste piles. Does USFS want a plan that specifically addresses only the waste pile or a broader plan that addresses other sources (e.g., the adit flow, other smaller waste piles, etc.)?
A10: The FS does not discuss the need to stabilize the mine waste pile. The solicitation states (page 3):
“Results from the site characterization show that the existing mine waste pile is potentially a significant source of acidity and heavy metals”. The mine waste pile is a source, and the EECA will evaluate whether or not the FS needs to address the source OR provide alternatives to address the source.
Q11: Since selection is stated as “Best Value” and if the Forest Service would like to keep to a schedule close to that shown in the solicitation, would it be possible to submit qualifications/experience packages for evaluation first and follow that up with the fee estimates following adequate review of the report?
A11: This is a simplified acquisition; therefore, a follow up fee estimate is not necessary. Please refer to page 4 of 18 of the solicitation regarding instructions and what is required to be considered for award.
Q12: When will the site visit record/documentation be available for all offerors?
A12: The site visit information that will be shared will be included with this amendment.
Q13: Is there a page limit to the proposal?
A13: No; however, it is recommended that interested parties consider the size limitation set when sending emails with attachments.
Q14: Does the FS want treatment of water from draining mine adit?
A14: No, the FS does not want long term maintenance.
Q15: Has the FS notified the CDPHE regarding water treatment A15: No. See above.
Q16: What about road maintenance?
A16: FS will consider all options presented in final EECA report.
Q17: What is the flow of water from the mine adit?
A17: Unknown, but flow is consistent throughout the year.
Q18: The submittals must include a technical proposal and cost estimate, correct.
A18: No. Please review solicitation, specifically page 4 of 18 regarding instructions with what shall be submitted to be considered for award.
Q19: Will the prime and sub-contractors be evaluated equally?
A19: The prime and the sub-contractors selected by the prime, will be evaluated as one proposal since the award will be with the prime not the sub-contractors.
Q20: What information is required in Table on Page 8? Do we include the hourly rate, overhead rate, fringe benefits, etc.
A20: As stated on page on page 8 directly above the table, it is for information only. To comply with the Service Contract Labor Standards statute and the regulations of the Secretary of Labor, this table identifies class, wage and fringe benefits payable to each. However, since the USDA, FS will not enforce DOL requirements. Therefore, please be sure to work with DOL to ensure compliance is met with the applicable Service Contract Labor Standards statute and the regulations. Again, the information on page 8 is for information purposes only.
Q21: My company has an ID/IQ with the government. Do we use the same hourly rates?
A21: The hourly rate is a decision each interested party shall make.
Q22: Do you have any more details to share about the site visit – whether it’s at the Ranger Station or at the actual mine site?
A22: The site visit location is included amendment 1, which states the ranger station. Please refer to amendment 1. As stated on the cover page of the solicitation, all amendments shall be acknowledged.
Q23: Would we meet at the Ranger Station and then drive to the site together or independently?
A23: Government does not provide transportation to anyone other than their own employees.
Q24: Are there any health and safety equipment requirements for the site visit?
A23: Standard health and safety equipment are expected to be met by each interested party.
Q25: Page 2 of 18 – Section vi, states that “……….A preliminary assessment/site investigation report is being prepared by a third party and will likely be available in late July 2021”. In reference to said PA/SI Report – who is preparing this report for the USFS (Name of Consultant)?
A25: The PA/SI report is not being prepared by a consultant.
Q26: Page 2 of 18 – Section vi, states that “……….A preliminary assessment/site investigation report is being prepared by a third party and will likely be available in late July 2021” In reference to said PA/SI Report – is the consultant who is preparing report “precluded” from submitting a bid for this procurement – Evaluation and Costs Analysis (1240LT21Q0061)?
A26: The PA/SI report is not being prepared by a consultant.
Q27: Page 2 of 18 – Section vi, states that “……….A preliminary assessment/site investigation report is being prepared by a third party and will likely be available in late July 2021”
A significant portion of this proposal’s technical approach, risks, key personnel to propose, past performance and associated costs to complete the EE/CA is going to be based on the data presented in that report (this is Best Value award and our response to the evaluation factors rests on the report). Without having this report now to review and analyze the data has caused many preparing this proposal to “pause & wait” till said report is issued to the public. Can the USFS consider an extension to the due date to correlate to at least 2 weeks after said report is made available to the bidders?
A27: All vendors will be given a reasonable amount of time to review the information provided in this solicitation. The portion of the report that is needed for interested parties to review is attached to this amendment. Since it is not the entire report, a two-week extension is not necessary. Combination of the PA/SI report and the 2009 characterization report is sufficient information for each interested party to prepare a proposal for our review.
