About this file
This file is a Questions and Answers document addressing contractor inquiries regarding Solicitation 1240LQ26Q0010, issued by the Department of Agriculture Forest Service for Sulphur Ranger District Green Ridge Water Augmentation Services. The Q&A clarifies key scope elements related to water engineering analysis and consulting deliverables required for filing with Colorado Water Court.
The document confirms that contractors must originate consumptive-use analysis from raw data records, as no existing StateCU/StateMod modeling or diversion-record datasets are available from the Forest Service. The engagement scope concludes at preparation and filing of the Water Court application, with Task 5 budgeted at an estimated 20 hours on an hourly rate basis to cover application drafting and responses to questions from the Office of General Counsel, Department of Justice, and USFS; any additional time needed will require a modification. The contractor will prepare Substitute Water Supply Plans (SWSP), Plans of Augmentation, draft decrees, and engineering reports, with additional hours addressed through future modifications if required. The Forest Service intends to file combined applications for both water supply wells unless separate management becomes necessary for future operations. The scope does not include costs for SWSP renewals or preparation of water accounting reports beyond the initial filing; such items will be addressed through future contract modifications if needed.

1. For the structure(s)/water right(s) requiring augmentation, is a historical consumptive-use analysis (or existing StateCU/StateMod modeling and diversion-record dataset) already available from the Forest Service or prior filings, or must the contractor originate that hydrologic/CU analysis from raw records — this is the primary driver of level of effort for the SWSP/augmentation plan.
There is not an existing consumptive-use analysis or StateCU/StateMod modeling or diversion-record data set. The contractor will need to originate this from limited raw data records.
2. Is the engagement scoped to conclude at preparation and filing of the SWSP/Plan of Augmentation/decree and engineering report, or does it extend through Water Court opposition and trial (responding to statements of opposition, providing expert testimony/rebuttal reports), which would require ongoing rather than one-time engineering support?
Task 5 includes drafting the water court application and then answering questions from OGC, DOJ, and USFS so that DOJ can file. DOJ should be the lead for the Water Court needs, but we built in Task 5 at an hourly rate to cover both the application and any questions, with an estimate of 20 hours. If more time is needed, it will have to be addressed through a modification of hours.
3. With regards to the Scope of Work, am I correct in assuming that the water engineering analysis and water resources consulting for this phase will be up through the filing of a Water Court application (including preparation of a SWSP request)? Put another way, any consulting support needed to process the Water Court application will be handled under a future SOW – correct?

DOJ should be the lead for the Water Court needs, but we built in Task 5 at an hourly rate to cover both the application and any questions, with an estimate of 20 hours. If more time is needed, it will have to be addressed through a modification of hours.
4. For the SWSP part of the SOW, most SWSP requests are annual, and often require submittal of an accounting report showing the volumes of water used and the replacement of depletions. Given that the Water Court application may not be filed until December 2027, will the selected consultant need to include costs for a renewal of the SWSP, if any, and the preparation and submittal of water accounting reports?
This was not included in the SOW, so don’t include those costs. If needed, this will be addressed through a modification.
5. The documents often refer to work efforts required for each well or both systems (there are two water supply wells described). It would seem to make sense to file the SWSP and court applications for both wells combined. Does the FS anticipate a need to manage each well separately?
The intent is to file them combined unless there is a reason that would impact future needs or future reduced augmentation water processes.
