7. Evaluation and Basis for Award – LPTA
FAR 52.212-2, Evaluation—Commercial Products and Commercial Services, is not applicable to this solicitation. In lieu of that provision, quotations will be evaluated in accordance with FAR Part 12 and simplified acquisition procedures.
Award will be made to the responsible offeror whose quotation conforms to the solicitation, is technically acceptable, and represents the lowest evaluated price determined fair and reasonable.
The Government will use a Lowest Price Technically Acceptable evaluation methodology.
Tradeoffs will not be conducted. Award will not be made to a higher-priced quotation if a lower-priced quotation is technically acceptable and otherwise eligible for award.
7.1 Evaluation Factors
Quotations will be evaluated using the following factors:
1. Technical Acceptability
2. Price
3. Responsibility
7.2 Technical Acceptability
Technical acceptability will be evaluated on an acceptable/unacceptable basis.
A quotation will be considered technically acceptable if it clearly demonstrates that the offeror will provide products that meet all minimum requirements of this solicitation.
To be considered technically acceptable, the offeror shall submit sufficient information to demonstrate the following:
Technical Requirement Acceptability Standard
Culvert pipe
Quote clearly confirms 24-inch diameter galvanized corrugated metal pipe, 16-gauge steel, 20-foot lengths, conforming to FP-24 Section 707.02 and applicable AASHTO recommendations.
Coupling bands Quote clearly confirms 24-inch diameter CMP coupling bands with hardware and gaskets, conforming to FP-24 Section 707.02 and applicable AASHTO recommendations.
Quantity Quote provides the required quantities for all CLINs.
Delivery Quote confirms delivery within 45 calendar days after award.
Shipping Quote includes shipping to the specified F.O.B. Destination delivery location.
Complete pricing Quote includes unit and total prices for all CLINs.
A quotation that fails to demonstrate compliance with the minimum technical requirements may be rated technically unacceptable and may be excluded from further consideration.
7.3 Price Evaluation
Price will be evaluated by adding the total price for all CLINs to determine the total evaluated price.
The Government will evaluate price to determine whether it is fair and reasonable. Price reasonableness may be determined using one or more methods permitted by the FAR, including but not limited to comparison of quotations received, comparison to historical prices, market research, or other price analysis techniques.
The lowest-priced quotation will be evaluated first for technical acceptability. If the lowest-priced quotation is technically acceptable and the price is determined fair and reasonable, award may be made without evaluating higher-priced quotations. If the lowest-priced quotation is technically unacceptable, the Government may evaluate the next lowest-priced quotation and continue this process until a technically acceptable quotation is identified.
7.4 Responsibility
Award will be made only to a responsible contractor. The Government may consider information available in SAM.gov, Federal Awardee Performance and Integrity Information System, past performance records, exclusions, or other available sources when determining responsibility.

United States Department of Agriculture Protest Procedures
The United States Department of Agriculture is committed to fair, transparent, and efficient acquisitions. Interested parties with concerns about this solicitation are encouraged to seek resolution through the following USDA procedures.
Tier 1: Contracting Officer Concern Resolution
Interested parties with concerns about either the solicitation or subsequent award should first submit their concern directly to the Contracting Officer, providing sufficient detail to allow the Contracting Officer to understand and assess the issue.
The Contracting Officer will review the concern, seek clarification as needed, and engage with the interested party to attempt prompt resolution.
The Contracting Officer will make every effort to provide a response or resolution within 10 business days of receiving the concern.
Tier 1 engagement is not considered an official notification of filing an agency protest and does not pause solicitation deadlines, delay award decisions, or suspend contract performance.
If the matter cannot be resolved at Tier 1, the interested party may file a written agency protest under Tier 2.
USDA encourages all parties to seek resolution with the Contracting Officer before filing an agency protest.
Tier 2: Agency Protest
If concerns cannot be resolved at Tier 1, an interested party may file a written agency protest with either the Contracting Officer or the USDA Independent Review Authority.
The protest shall state whether the protester elects review by the Contracting Officer or by the USDA Independent Review Authority. If no election is stated, the Contracting Officer will decide the protest.
Protests shall include the information required by FAR protest procedures. Failure to submit required information may result in a delay or dismissal of the protest.
Agency protests should be submitted electronically to:
SPE.inquiry@usda.gov and to the Contracting Officer identified in this solicitation.
Protests must be filed within the applicable regulatory timeframes.
Contract awards or performance may be suspended during the protest period unless justified in writing for urgent and compelling reasons or determined to be in the best interest of the Government.
USDA strives to resolve agency-level protests within 35 business days of receipt.
By filing a protest with USDA, the protester agrees not to file a protest on the same matter with the Government Accountability Office or any other external forum while the agency protest is pending. If such a protest is filed externally, the USDA agency protest may be dismissed.
Questions regarding this notice or protest procedures should be directed to the Contracting Officer identified in this solicitation.
