AMENDMENT 0002 TO SOLICITATION 1240BF27Q0001
This is Amendment 0002 to a federal solicitation issued by the USDA Forest Service (CSA Northwest 4, Portland, Oregon) for toilet pumping and sanican rental services at the Powers and Gold Beach Ranger Districts in Oregon. The amendment is effective October 22, 2026, with a period of performance from November 11, 2026 to September 30, 2027 (base period of 11 months with two optional 12-month extension periods). This is a small business set-aside for a Firm-Fixed Price Indefinite Delivery/Indefinite Quantity (IDIQ) service contract with up to a 2-year ordering period.
The amendment adds a critical pre-award responsibility requirement mandating that prime contractors possess a valid Oregon Sewage Disposal Service (SDS) Pumper License or Combined Pumper/Installer License in the contractor's corporate name prior to award; both prime and subcontractors must hold valid SDS licenses if subcontractors are used. The contracting officer will verify license status with the Oregon Department of Environmental Quality before award, with apparent successful quoters given five days to provide valid license copies. The amendment also publishes responses to 37 questions and answers addressing clarifications on license requirements, sanican rental specifications, disposal facility approvals, vault data corrections (Daphne Grove changed to 1,000 gallons; Foster Bar identified as one primary vault), pumping frequencies (most vaults serviced less than once per year based on actual need), submission instructions (electronic email to specified Forest Service representatives in Excel format for the price list), and billing procedures for weekly sanican rentals. Quotations were originally due November 4, 2026, but Amendment 0001 changed the deadline to November 9, 2026. Award will be evaluated on price and non-price factors including technical capability and past performance, with pricing evaluated separately for each ranger district.

Project Title: Toilet Pumping for Powers & Gold Beach RD Solicitation: 1240BF27Q0001
Amendment 0002
This amendment adds the following regarding the applicable pumper license requirement.
Pre-Award Responsibility / Licensing Requirement:
In accordance with Oregon law, a contractor must possess a valid Oregon Sewage Disposal Service (SDS) Pumper License or a Combined Pumper/Installer License to perform the work included in this contract. The license shall be in the contractor's corporate name prior to contract award. If a subcontractor is used, both the prime and subcontractor are required to have an SDS pumper license. The contracting officer will verify the apparent successful quoter's license status with the Oregon Department of Environmental Quality (DEQ) before awarding the contract. Failure to provide a copy of a valid license upon request prior to award will result in a determination of non-responsibility, and the contractor will be ineligible for award. The contracting officer will provide the apparent successful quoter five days to provide a copy of a valid license.
This amendment publicizes responses to the following questions:
Question 1:
Will we need to provide the sanicans right away and how long they will be needed?
Government Response: None are needed immediately. Some are needed for 4 months, some 6 months and some year-round.
Question 2:
Will we be providing water for the Vault Pumps?
Government Response: The contractor is required to provide their own water. The Government is not seeking to ‘charge’ the vaults with water.
Question 3:
“We are performing independent research on the Combined Synopsis/Solicitation (1240BF27Q0001). We would like to know if this is a brand-new contract OR if there is (was) an incumbent performing these services. If not brand new, could you please provide the current / previous contract number and what the total contract value was?”
Government Response: The is a brand-new contract.
Question 4:
(Attachment 001 PWS 4.0 – "one or two awards") The PWS states the Government intends to make one or two awards and that quoters may quote one or both Ranger https://sam.gov/workspace/contract/opp/aff966ddba8d48be9b16fa5e0fdc2a3e/view https://sam.gov/workspace/contract/opp/aff966ddba8d48be9b16fa5e0fdc2a3e/view

Districts. Will price be evaluated separately for each Ranger District, and may a quoter who quotes both districts receive an award for only one?
Government Response: Price will be evaluated separately for each Ranger District.
Quoters who submit pricing for both Ranger Districts may receive an award for only one of the Ranger Districts.
Question 5:
(Attachment 001 PWS 3.0 – Offsite Disposal) The PWS states the contractor is responsible for disposal arrangements and the Contracting Officer shall approve all disposal sites before pumping begins. Does the Government have a list of previously approved disposal facilities near Powers and Gold Beach, and what information must be provided to obtain approval of a facility?
Government Response: The Government does not have a list of previously approved disposal facilities, and it is unknown what information each facility would need.
Question 6:
Will an organized site visit be held?
Government Response: No
Question 7:
Is water available on site?
Government Response: Some sites have water, others do not. The Government is not seeking to ‘charge’ the vaults with water.
Question 8:
The PWS (Offsite Disposal of Sewage and Debris) states: "The Contractor shall be properly licensed by the state of Oregon.
1. Does this requirement apply to whoever physically performs the pumping and septage hauling, so that a properly licensed Oregon subcontractor satisfies it?
2. Or must the prime contractor hold its own Oregon license?
Government Response: The prime contractor must also be licensed in Oregon if the work being performed requires an Oregon license, even if all work is subcontracted to a properly licensed subcontractor. This requirement applies to the prime contractor, regardless of whether they self-perform the work or subcontract portions or all of it.
Oregon Law Requires Licensing of Any Business Engaging in Regulated Activities
The type of work in the PWS (toilet pumping, sewage hauling, disposal operations) generally falls under activities regulated by the Oregon Department of Environmental Quality (DEQ) and potentially other state regulatory bodies.
Under Oregon law, any entity engaging in regulated wastewater, pumping/hauling, or disposal operations must be appropriately licensed or permitted—and that obligation applies to the business entering into the contract, not just the subcontractor performing the hands-on work.
Amendment 0002
Even if the subcontractor holds the needed license, the prime is still considered to be engaging in the regulated activity by contracting to provide that service.
Question 9:
I came across SOL 1240BF27Q0001, Toilet Pumping for the Forest Service in Medford, OR, through Kizzy Parks' network. My name is Randi Jones, and I own Kaizen Legacy LLC, a small business registered in SAM.gov with an active UEI (JVJ7YMT9P383).
We're a newer firm, and our CAGE code is pending and expected next week. I'm interested in quoting this requirement with a licensed local pumping contractor performing the work.
Could you confirm whether the full performance work statement and any attachments are posted on SAM.gov, whether a site visit is planned, and how you'd like quotes submitted ahead of the November 4, 2026 due date? I'd also appreciate knowing whether a pending CAGE code would affect eligibility if it's assigned before award.
Government Response:
• The full performance work statement and any attachments are currently posted on SAM.gov.
• A site visit is not planned.
• Quotes shall be submitted electronically via email to lorenzo.montoya@usda.gov and raymond.padgett@usda.gov
• The status of your CAGE code will not be reviewed for eligibility purposes; what is reviewed is the following: Quoters are required to have an active Federal Government contracts registration in SAM when they submit a quotation, and at the time of award.
Question 10:
The controlling quotation deadline and time zone. Third-party listings show November 4, 2026 at 4:30 PM Pacific/7:30 PM Eastern; is this correct?
Government Response: The Quote Due Date was changed to November 9, 2026 via amendment 0001.
Question 11:
Whether a mandatory site visit, bid/offer guarantee, or bond must be completed or furnished with the quote.
Government Response: A site visit is not planned. The contractor should verify and comply with the Oregon Department of Environmental Quality (DEQ) regarding any bonding requirements.
Question 12:
Whether a small-business prime may subcontract the pumping and permitted waste disposal to a licensed Oregon commercial operator, with the prime managing the mailto:lorenzo.montoya@usda.gov mailto:raymond.padgett@usda.gov
Amendment 0002 contract, or whether any pumping/disposal license, specialized past performance, or other qualification must be in the prime's own name.”
Government Response: The prime contractor must also be licensed in Oregon if the work being performed requires an Oregon license, even if all work is subcontracted to a properly licensed subcontractor. This requirement applies to the prime contractor, regardless of whether they self-perform the work or subcontract portions or all of it.

Question 13:
Where the full current solicitation package, schedule of items, locations/maps, and detailed submission instructions can be obtained if SAM downloads are unavailable.”
Government Response: There is no other place to obtain the solicitation.
Question 14:
Please provide the complete PWS and all attachments.
Government Response: The complete PWS and all attachments were provided.
Question 15:
What is the complete list of toilet sites, locations, toilet counts and types, and sanican locations to be serviced?
Government Response: Your question of “what” is the complete list does not make sense. This question cannot be answered.
Question 16:
What are the required pumping frequencies, service frequencies, estimated quantities, and any seasonal variations per location?
Government Response: The requiring activity estimates that most vault toilets shall require servicing less than once per year. The actual ordered quantity shall be based on actual needs.
Amendment 0002
Task Orders shall be issued at the fixed-priced rates specified in Contractor’s “Price List”.
The Government shall issue Task Orders for toilet pumping services as the needs arise.
The exact dates on which services shall be required cannot be predetermined.
Question 17:
For sanican rentals, how many units, what types, what delivery, pickup and servicing requirements, and what rental periods apply?
Government Response: The actual ordered quantity and duration of the rentals shall be based on actual needs. Task Orders shall be issued at the fixed-priced rates specified in Contractor’s “Price List” for all sanican rentals/service.
The Government shall issue Task Orders for sanican rentals and services as the needs arise. The exact dates on which services shall be required cannot be predetermined.
Question 18:
“What is the period of performance, including start date, end date and any option periods?
Government Response: The PWS states the following on page 5:
The period of performance (POP) shall be for 1 Base Period of 11-months and 2 Option Periods of 12-months each.
Period POP Start Date POP End Date Base Period (11-Month Base Period) November 1, 2026 September 30, Option Period 1 (12-Month Option Period) October 1, 2027 September 30, Option Period 2 (12-Month Option Period) October 1, 2028 September 30, Question 19:
“What is the contract type, pricing structure / line items and unit of measure, and estimated value if available?
Government Response:
The unit of measure is include in the Price List under the header of “UNIT”.
The PWS states the following on page 5:
The Government shall award a Firm-Fixed Price (FFP), Indefinite Delivery, Indefinite Quantity (IDIQ) contract, Service Contract with up to a 2-Year Ordering Period.
Amendment 0002
Question 20:
What is the set-aside type, if any, and what licenses, permits or disposal approvals are required under State and Federal regulations?
Government Response: The solicitation is a small business set-aside. It’s the responsibility of the Contractor to obtain any applicable licenses, permits or disposal approvals required under State and Federal regulations. The question is too vague to provide a response.
Question 21:
What approved waste disposal sites or disposal requirements apply?
Government Response: The Government does not have a list of previously approved disposal facilities.
Question 22:
“What is the applicable wage determination?
Government Response: Each Task Order awarded will include an applicable Wage Determination. C04_Attachment 017 - Service Wage Determination is included as a sample of the current Wage Determination that would be used if a Task Order was awarded today.
Question 23:
What are the submission instructions (channel, format and subject line), required forms, and evaluation criteria, including whether award is price-only?
Government Response: Award will be based on price and other factor mentioned in the solicitation below the header of “Evaluation and Basis for Award”.
The solicitation states the following:
Emailed quotations should contain the following:
• SF-1449 (only complete page 1 of this document)
• * Attachment 002 - Price List (IN EXCEL FORMAT). The Contractor may choose to quote on one, or both Ranger Districts (Powers & Gold Beach).
• Responses to nonprice Evaluation Criteria (FACTOR I -- Technical Capability & FACTOR II -- Past Performance)
* Return in Excel format (not pdf). Completing and submitting this in Excel format helps both parties quickly confirm additions are accurate.
Question 24:
Is there a site visit? If so, what are the date, location, registration requirements and whether attendance is mandatory?
Amendment 0002
Government Response: There is no site visit.
Question 25:
What is the deadline for clarification questions?
Government Response: The Deadline/Quote Due Date was changed to November 9, 2026 via amendment 0001.
Question 26:
What are the performance standards, QASP requirements and any deductions or penalties?
Government Response: The performance standards are provided in the PWS (page 9).
The solicitation has no QASP requirement. Any deductions/penalties are provided in the PWS (pages 7-8).
Question 27:
I hope you're both doing well. I'd love to confirm one point on RFQ 1240BF27Q0001.
The PWS says the Contractor shall be properly licensed by the State of Oregon. If the prime contractor subcontracts the pumping work to an Oregon-licensed septic pumping company that holds the required state license, does that meet the requirement, or does the prime contractor itself need to hold the Oregon license?
Government Response: The prime contractor must also be licensed in Oregon if the work being performed requires an Oregon license, even if all work is subcontracted to a properly licensed subcontractor. This requirement applies to the prime contractor, regardless of whether they self-perform the work or subcontract portions or all of it.

Even if the subcontractor holds the needed license, the prime is still considered to be engaging in the regulated activity by contracting to provide that service.
Question 28:
The Performance Work Schedule (Attachment 001) states that the Contractor shall be properly licensed by the State of Oregon. UA LLC would perform the pumping, hauling and disposal through a subcontractor that holds an Oregon DEQ sewage disposal service license. Will the subcontractor's Oregon license satisfy this requirement?
Amendment 0002
Government Response: No, the subcontractor's Oregon license would not satisfy this requirement.
The prime contractor must also be licensed in Oregon if the work being performed requires an Oregon license, even if all work is subcontracted to a properly licensed subcontractor. This requirement applies to the prime contractor, regardless of whether they self-perform the work or subcontract portions or all of it.

Question 29:
Regarding item 0003 AG/AH, should they both be regular, or ADA sanican?
Government Response: Typo on 0003AG. Item 0003 AG/AH are both for an ADA sanican.
Question 30:
Attachment 002 (Price List) lists an estimated quantity of 1 EA for each vault line (e.g., 0001AA-0001AN, 0002AA onward). Is the price per single pump-out event, and can the Government provide the expected number of pump-outs per site during the base period (Nov 1, 2026 - Sep 30, 2027) so quoters can price on a consistent basis?
Government Response: Pumping is ordered based on need. When vault is near capacity, we will call in to have vault pumped empty. Some vaults may not need pumped in a particular year, some vaults may need pumped more than once – it is based on usage.
Question 31:
Vault data does not match between attachments: Attachment 002 line 0001AC lists Daphne Grove as 1 vault, 750 gallons, while Attachment 004 lists Daphne Grove CG with a 1,000-gallon underground storage vault. Also, Attachment 002 line 0002AA lists Foster Bar as 1 vault, 3,200 gallons (three toilets sharing one vault), while Attachment 003 lists Foster Bar Vault 2 and Vault 3 as separate 3,200-gallon vaults.
Which capacities and vault counts should be priced?
Amendment 0002
Government Response:
0001, 1001, 2001 AC - Daphne Grove – Is changed to 1000 Gallons from 750 gallons, one vault.
0001, 1001, 2001 AD - Daphne Grove – 750 Gallons, four vaults. (3,000 gal total) 0001, 1001, 2001 AA - Foster Bar – 3200 Gallons, one vault. (Only one vault will be pumped.)
Question 32:
Attachment 003 (Sanican Rentals tab) shows weekly or every-other-week service from Memorial Day to Columbus Day. Should sanican rentals be priced per unit per month or per service visit, and where on the Price List should they be entered?
Government Response: Some services are weekly, some are Every Other Week.
Monthly billing should reflect weeks used. No change to sanican rental unit pricing. All remain as weekly. Pricing should be entered in marked column nest to the sanican line items.
Question 33:
PWS 3.0 (Offsite Disposal) states the Contracting Officer must approve disposal sites before pumping. Does the Forest Service have any previously approved disposal facilities for the Powers and Gold Beach districts?
Government Response: The Government does not have a list of previously approved disposal facilities.
Question 34:
“Foster Bar vault count: Attachment 002, CLIN 0002, item AA, and the corresponding option-year lines describe one 3,200-gallon vault shared by three toilets. Attachment 003, tab "Gold Beach PUMP Contract," lists three Foster Bar entries (rows 9-11), each showing one 3,200-gallon vault at the same GPS coordinates. Could you please confirm how many distinct vaults must be pumped per service and whether we should price one or three 3,200-gallon pump-outs?
Government Response: Foster Bar Campground, 3200 Gallons, One Vault. (There are three vaults, but only one will be emptied.) (Other two vaults work with the drain field and into the main vault that is the primary one that is pumped. The other two are not be pumped unless there is a maintenance issue, but all vaults are next to one another, and are the same capacity.)
Question 35:
“Sanican service frequency: Attachment 003, tab "Gold Beach PoJ Contract," lists Quosatana Creek CG (1 ADA and 4 regular units) and Foster Bar (1 ADA and 1 regular unit) for service every other week from Memorial Day through Columbus Day. However, the Attachment 002 rental lines (CLINs 0003, 1003, and 2003, items AA, AC, AU, and AW) specify weekly service. Could you please confirm which frequency we should use for these locations?
Government Response: Weekly servicing for Sanicans at Quosatana and Foster. In “C04_Attachment 002”
Amendment 0002
Question 36:
“South Fork sanican type: CLIN 0003, item AG, specifies one regular sanican rental with weekly service at South Fork CG/Day Use, while item AH specifies delivery and removal of one ADA sanican. The corresponding option-year lines contain the same descriptions, while Attachment 003 lists one regular unit at South Fork. Should delivery and removal be priced for a regular or an ADA unit?
Government Response: See response to Question 29. Typo on the sheet, it should be an ADA Sanican for South Fork.
Question 37:
“**Billable rental and service weeks:** The sanican rental/service line items are priced per week (WK), with an estimated quantity of 1. Could you please clarify how we should calculate the total billable weeks for each location and whether rental and service charges apply during weeks when no service visit is scheduled at locations serviced every other week?
Government Response:
Invoices should include all sanicans being rented and invoiced at the quoted unit price as shown in the quoted “price list” submitted by the contractor. The same weekly unit price should be invoiced for each week of rental service, including every other week when no services are done.
Notify the Contracting Officers Repressive in writing if a service cannot be completed.
All other terms and conditions remain unchanged.
