Amendment 0001 to Solicitation 1240BF26Q0013 – Questions and Answers
This document is a Questions and Answers amendment to a solicitation for prescribed burning services in Briggs Valley, Region 6, issued by the USDA Forest Service CSA Northwest 4 (Portland, Oregon). The contract period of performance runs from February 25, 2026, through December 31, 2028. The amendment consists of clarifications addressing 13 contractor questions regarding contract scope, line item structure, staffing requirements, regulatory licensing, and technical performance standards.
Key clarifications include: Line Item 1 (Prescribed Fire and Mop-Up: Swamper/Jackpot Burn) covers only Level II work at 21-40 tons per acre; Line Items 2 and 3 represent modular daily rates with 20 and 10 available modules respectively, ordered based on project needs throughout the period rather than as minimum or maximum durations; the Period of Performance extends through 2028 to accommodate burn windows and seasonal restrictions, with formal notice to proceed issued at contract award and a 6-hour notification requirement for burn window changes; personnel in Line Items 2 and 3 may assist with Line Item 1 or perform separate mop-up and patrol tasks; and the Government provides burn plans. The amendment deletes the non-existent "Department of Labor issued Farm/Forest Labor License" requirement and replaces it with "Department of Labor issued Farm Labor Contractor Certificate of Registration" and "State of Oregon Farm/Forest Labor License," both of which must be obtained by the solicitation due date. The amendment also adds detailed Performance Work Statement section 5.6 specifying swamper/jackpot burning technical requirements, performance standards, clearance-to-burn procedures, and surveillance methods.

Amendment 0001 – Questions and Answers
1240BF26Q0013 - 1150183 – RRS - Briggs Valley R6 Prescribed Burning
Contractor Question 1: From Attachment 001 - Performance Work Statement section 1.7 :
"For this specific contract the Contractor shall provide a Prescribed Fire Burn Boss Type 3 (RXB3) for all levels I-VI of Line Item 0001 (Prescribed Fire and Mop-Up: Swamper/Jackpot Burn; Level II - Average 21-40 tons per acre)."
Does Line Item 1 have multiple levels included, or is Line Item 1 expected to only include the "Prescribed Fire and Mop-Up: Hand Pile Burn b. Level II - An average of 21-40 piles per acre".
Government Response: Line Item 1 is Level II only because we only expect to order such work with that 21-40 tons per acre.
Contractor Question 2: From Attachment 001 - Performance Work Statement section 1.5 Period of Performance: "The period during which work will be performed may be dependent on burn windows, and the Government shall provide the expected burn window’s for each order when issued.
1.5.1 The COR for each order shall notify the contractor at least 6 hours before the start of a changed, cancelled, or postponed burn window. If the Government changes a burn window and provides a notice of the change to the contractor at least 6 hours in advance, then the Contractor shall provide services under the new burn window."
The Attachment 001 Performance Work Statement also states the "Period of Performance:
Award Date to December 31, 2028"
What kind of notice would be given to mobilize for the actual period of performance?
(Clearly it is unrealistic to have a 6-hour response time for a project occurring sometime within the next 3 years.)
Government Response: The Period of Performance is through December 31, 2028 to allow for ample opportunities to utilize all of the modules and/or acres of swamper/jackpot burning. Burn windows can be limited some seasons and hard to come by. Some burn clearances or burn windows may close in the planning phase or weather may change drastically, causing a burn window change and a notice to be made to the contractor, which in these circumstances, would have to be identified a minimum of 6 hours in advance. As for the Period of Performance itself, a notice to proceed would be established at the beginning of the award and line items would be able to then be ordered in accordance to the contract from start to finish of the Period of Performance’s entirety, weather, fire season restrictions, and burn clearances dictating the schedule.
Contractor Question 3: In the SF1449, line items 2 and 3 specify a discrete duration of 20 days and 10 days, respectively. Would those durations be the minimum for this task order, or the maximum?
Government Response: Those are modules to be ordered at a daily rate. Therefore, the government is asking for 20 modules and 10 modules of those items that could be ordered on any given day which would be paid out at the daily rate. The government would not order any specific amount of the line items on any day, but would be ordered based on the project need for any given day that they were ordered. For example, If the government ordered 4 of line item 2 and 2 of line item 3 for November 25, 2026, then there would only be 16 modules (line item 2) and 8 modules (line item 3) left available on the contract to be ordered. That is the intent of the contract and the scope of work.
Contractor Question 4: Would the Period of Performance for line items 2 & 3 overlap or be consecutive?
Government Response: The Period of Performance is set for all line items on the contracts entirety and the deadline to utilize and fulfill all work is the same. With that being said, they would overlap, in order to complete certain tasks and projects.
Contractor Question 5: Would the personnel in line items 2 & 3 be assisting with line item 1, or would they be performing different tasks?
Government Response: They could be ordered to assist with line item 1 or they could be performing different tasks within the contract to meet different needs, such as mop up and patrol, assisting in other prescribed burn projects within the project map area.
Contractor Question 6: Would the burn plan for line item 1 be provided by the Government?
Government Response: Yes
Contractor Question 7: I must admit to being a bit confused about the exact scope of the project. Section 1.1 Description of Services of the Performance Work Statement doesn't specify which line items it applies to.
My initial read of it is that you want to burn 125 acres of logging slash and you want 2 Five person burn modules and a type 6 engine to conduct the burn. You want the first burn module for 20 days, presumably to do some prep work, then you want the engine and second burn module for 10 days, presumably for the ignitions and mop up phase. There would be a 10 day overlap where all the resources are working. The entire project would be 20 consecutive days, with burn windows identified by the Government during this 20 day period.
The second scenario that I see with this solicitation is that you want a contractor to burn the 125 acres, all planning and execution included, and the burn modules are for completely separate project areas and periods of performance. Can you provide more details and some kind of project narrative?
Government Response: Those are modules to be ordered at a daily rate. Therefore, the government is asking for 20 modules and 10 modules of those items that could be ordered on any given day which would be paid out at the daily rate. The government would not order any specific amount of the line items on any day, but would be ordered based on the project need for any given day that they were ordered. No line item has to be ordered overlapping with another, but projects may dictate that and so would be overlapping at times. To speak on line item 1, yes that is 125 acres of jackpot/swamper burning to be ordered by the government and to be filled by the contractor in its entirety, but not all acres have to be accomplished at once or within in a single day. That is why there is a total Period of Performance date that extends out to the end of 2028. There may be one unit that has 30 acres of downed slash needing to be swamper burned one day and then maybe 5 another day. The level is labeled at the 21-40 tons per acre and therefore no work of line item 1 would exceed that level. Depending on burn windows, clearances, seasonal restrictions ie fire seasons, the award period allows for ample time to complete the project and get the total work allocated. There are maps included that line items 1-3 will be ordered for.
Contractor Question 8: What is a "Department of Labor issued Farm/Forest Labor License"? The US Department of Labor has a Farm Labor license, but no Farm/Forest Labor License.
Government Response: This amendment makes the following change to solicitation page 4 of 13:
Delete “Department of Labor issued Farm/Forest Labor License.”
Replace with “Department of Labor issued Farm Labor Contractor Certificate of Registration.”
Contractor Question 9: Is the Department of Labor Farm/Forest Labor License a requirement in order to respond to this solicitation, or would we be able to apply for such a license after receiving the award, prior to commencing work?
Government Response: The Certificate of Registration must be obtained by the solicitation due date.
Contractor Question 10: Can you clarify why a Federal Department of Labor Farm/Forest Labor license is required for non-agricultural labor?
Government Response: This type of work is applicable to the MSPA. Contact the DOL if you need further clarification.
Contractor Question 11: Can you clarify why a State of Oregon Farm/Forest Labor License is required for non-agricultural work?
Government Response: This type of work is applicable to BOLI. Contact BOLI if you need further clarification.
Contractor Question 12: Is the State of Oregon Farm/Forest Labor License required for companies based outside of Oregon?
Government Response: I’m unaware of each state’s requirement. However, any Contractor performing the services of this solicitation must be registered with BOLI as a Farm/Forest Labor Contractor.
Contractor Question 13: Would we be able to apply for a State of Oregon Farm/Forest Labor License after receiving an award, but prior to commencing work?
Government Response: No, Contractors must have a valid License by the solicitation due date.
This amendment adds the following into the Performance Work Statement:
5.6 Prescribed Fire and Mop-Up – Swamper/Jackpot Burn
Swamper/Jackpot burning consists of burning concentrations of fuels (jackpots) within an identified unit boundary at a time and under conditions that won’t allow fire to spread from the target area. Additional slash may be added to the concentration while the pile is burning (swamper burning).
The levels of difficulty for swamper/jackpot burning are identified in the task order and are based on the estimated amount of slash, in tons per acre, requiring burning in accordance with 5.6.1:
a. Level 1 – Units with an average of 20 tons/acre or less.
b. Level II – Units with an average of 21 to 40 tons/acre.
c. Level III – Units with an average of 41 or more tons/acre.
The swamper/jackpot burning season in Oregon and Washington generally occurs between late October and May. Major control problems can occur during a period of frontal passage and strong wind conditions. Close attention to weather forecasts and securing and patrolling of previously burned units is common practice to eliminate any escaped burns.
5.6.1 Performance Standards - All prescribed fire operations shall be initiated only when a Prescribed Fire Plan has been approved and signed by the prescribed fire plan preparer, Fire Management Officer, Technical Reviewer, and Agency Administrator. All elements of the plan shall be followed unless a deviation has been approved in advance by the COR. The Contractor shall conduct a pre-burn crew briefing, as prepared in the Plan.
Clearance to Burn - The Contractor shall monitor fuel and weather conditions to determine time periods when units are in the prescription parameters identified in the Prescribed Fire Plan. The Contractor may consult the Government regarding short, mid, and long-term weather forecast to determine the potential impacts to fuel moisture conditions and the ability to meet Prescribed Fire Plan objectives. The Contractor shall notify the Government no later than 1100 hours on the day prior to ignition when specific units are within burn prescription parameters and of their request to burn. The Government will notify the Contractor via telephone or direct communications at or before 0900 hours on the day of the proposed ignition of smoke management conditions and any updated weather forecasts that would cancel the burning. The Government will grant final approval to conduct burning. Approval is based on the Government verifying: 1) unit fuel and weather conditions are within Prescribed Fire Plan parameters and prescribed fire and resource objectives are attainable; 2) Prescribed Fire Plan parameters and objectives for smoke management are attainable based on smoke management instructions and forecast, and weather forecasts for proposed burn date and time; and 3) successful completion of the Go/No Go Checklist and the test fire.
All slash more than 2 feet long and between 1 inch and 6 inches in diameter at the large end shall be burned.
Larger material which has a portion meeting this specification must be bucked at the 6-inch diameter and the smaller portion burned. In all cases, the debris after treatment shall be less than 6 inches deep. Stoke each pile until at least 90 percent of the pile is consumed.
Unless otherwise designated, slash concentrations shall not be located closer than 25 feet from unit boundary and reserved areas. Slash concentrations shall not be located closer than 10 feet from standing snags, wildlife trees, and live trees in order that no damage occurs to these from burning operation. Slash shall not be piled or burned on logs or stumps, in roadways or drainage ditches, or within reserved areas such as riparian zones, channel bottoms or streams.
During ignition operations, the Contractor's crew supervisor shall maintain contact with the Government representative at all times through a mutually-agreed-upon communications system.
Conduct holding operations in accordance with the prescribed fire plan. Relocation of personnel and equipment may be required as ignition and burnout progress. The Contractor's crew supervisor shall recognize the need for and make such relocations, dependent upon on-site weather and fire conditions.
Extinguish any fire outside the fire line of the unit, or unit boundary and promptly report this to the
COR at the site. A fire line shall be constructed completely around active fire spread within the unit boundary, each slop-over, spot fire or fire outside the primary unit boundary. The minimum shall be a fire line scraped to mineral soil 18 inches in width with all overhanging combustible material cleared for 3 feet on each side of the fire line and 6 feet overhead.
Do not fell any wildlife trees or snags which may have fire in them without approval of the COR.
Mop-up shall be performed in accordance with 5.8, Standard Mop-up and Patrol.
5.6.2 Performance Threshold - Performance thresholds will be identified in the task order for specific projects.
5.6.3 Method of Surveillance - The COR will be on site during burning operations (ignition and holding). The Contractor's activity will be monitored throughout the operation for compliance with the prescribed fire plan, daily shift plan, and that objectives for resources, prescribed fire, and smoke management are being met.
100% inspection of the designated mop-up areas will be made by the Government either visually and/or with infrared-scan equipment to ensure that all burning material has been detected. The Contractor shall extinguish any burning material detected before final acceptance is made.
Compliance with the Prescribed Fire Plan and Daily Shift Plan will be required unless concurrence is obtained from the COR prior to deviating from the plan.
The Government will inspect patrol and mop-up operations to determine compliance with the required mop-up standards for compliance with all specifications in 5.8.
5.6.4 Incentives & Remedies - A notice of noncompliance or a notice to stop work will be issued for all deviations from the Prescribed Fire Plan not previously approved by the COR.
All other terms and conditions remain unchanged.
