Performance Work Statement

General Information

1.0 General

This is a non-personal services contract to provide Roadside Brushing to the Mckenzie River Ranger District (MRRD) of the Willamette National Forest (WNF). The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government. Interested parties are highly encouraged to visit the site before submitting an offer.

2.0 Purpose

The purpose of this contract is to perform Roadside Brushing to ensure safe and productive road conditions.

3.0 Description of Services

The Contractor shall furnish all labor, supervision, management, tools, materials, equipment, facilities, transportation, and other items and non-personal services necessary to provide roadside brushing services. The contractor shall provide services in accordance with this Performance Work Statement (PWS), and all applicable federal, state and local laws and regulations.

4.0 Place of Performance and Accessibility

The work shall be performed throughout the Mckenzie River Ranger District of the WNF in Oregon.

SCHEDULE OF ITEMS

Work areas may be reached by Forest roads that are accessible by a standard two-wheel drive pickup equipped with snow tires and chains, if needed, during normal operating seasons, unless otherwise indicated on Project Maps. Vehicles shall not operate off-system roads without prior written approval of the Contracting Officer Representative (COR).

Inaccessibility due to snow, fallen trees, slides or washouts on roads may or may not be corrected at the option of the Government. If road access is blocked, the Government may: (1) provide an alternate access route; (2) delete the inaccessible sub items (s) or; (3) substitute similar sub item(s).

Roads shown on unit maps indicate access to units and do not suggest the roads are open within units or for any further travel.

Use of motorized equipment other than handheld equipment such as power saws and brush cutters will not be permitted off designated roads in the project area without approval of the COR or as hereinafter provided.

No vehicle shall bypass any officially blocked road (barriers, locked gates, posted signs, rock/log/dirt, etc.) without approval of the CO or their representative.

5.0 Period of Performance

The period of performance shall be from June 1, 2026 to December 1, 2026.

6.0 Contract Type

The Government will award a Firm-Fixed Price (FFP), Stand-Alone, Service Contract. Contractor shall furnish to the Government all services specified in the Schedule of Items and called for by the contract.

7.0 Government Regular Working Hours

The Government's regular working hours are Monday through Friday from 0700 to 1700, except federal holidays or when the government installation is closed due to local or national emergencies, administrative closings, or similar government directed closings.

8.0 Federal Observed Holidays

When a federal holiday occurs on a Saturday, federal employees are normally granted the previous Friday as the holiday observance. When a federal holiday occurs on a Sunday, federal employees are normally granted the following Monday as the holiday observance. Below is the list of recognized federal holidays:

9.0 Contractor Key Personnel

Contract Manager: The Contractor shall provide a Contract Manager or designated alternate, as applicable, who has full authority to act for the Contractor on all contract matters relating to this contract. The Contract Manager or alternate shall be available during the Government's regular working hours.

Quality Control Representative: The Contractor shall provide a Quality Control Representative who shall be responsible for the Contractor’s Quality Control Plan (QCP) to ensure services are performed IAW the PWS. The Quality Control Representative shall implement and maintain full compliance of the QCP throughout the contract period.

10.0 Government Key Personnel

Contracting Officer (CO): The CO is the only person with the authority to: enter into, administer, or terminate contracts;

make related determinations and findings on behalf of the government; and legally bind the government. The CO shall ensure that the contractor receives impartial, fair, and equitable treatment under this contract. The CO shall determine and document the final assessment of the contractor's performance in the government’s past performance tracking system.

Contracting Officer’s Representative (COR): A COR may be assigned to this contract to monitor all technical aspects and assist in contract administration. The COR may be authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communication with the Contractor concerning technical aspects of the contract;

issue written interpretations of technical requirements (without increasing or decreasing contract scope), including Government drawings designs, and specifications; monitor Contractor's performance and notify both the CO and Contractor of deficiencies; and provide site entry of Contractor personnel. The COR is not authorized to change any of the terms and conditions of the contract.

11.0 Post-Award Conference and Periodic Progress Meetings

The Contractor agrees to attend any post award conference convened by the CO and or CORThe CO and/or COR shall meet periodically with the Contractor to review the contractor's performance. At these meetings the CO will appraise the Contractor of how the Government views the contractor's performance and the contractor will appraise the Government of problems, if any, being experienced. Appropriate action will be taken to resolve outstanding issues.

12.0 Changes

The quantities specified in the Schedule of Items are estimates only and are not guaranteed quantities. The government reserves the right to add, remove, or change the items and quantities to be serviced under this contract, as required. Price adjustments for these changes shall be based on the rates specified in the Schedule of Items for identical or similar items.

Changes will only be authorized by a warranted CO.

13.0 Inspection and Acceptance

Any inspection and acceptance will be at the location specified in the contract. The designated COR will act as the representative of the CO for purposes of inspection and acceptance of services to ensure compliance with the terms, conditions, and specifications of the subject contract. The COR has no authority to make any changes to the terms and conditions of the contract.

14.0 Invoicing and Payment

All contractor invoices shall be submitted via the Invoice Processing Platform (IPP) using contract line item numbers (CLINs). The contractor shall be required to establish account(s), access method(s), log-in(s), and necessary training in order to submit invoices through IPP. Invoices not submitted via IPP shall not be accepted or paid.

Note: The contractor shall only invoice for work performed and as authorized by the contract. Payment will be made only for those items listed on the Schedule of Items. All other work is incidental to those pay items.

Security and Safety Requirements

15.0 Security

The contractor shall be responsible for safeguarding all government property provided to the contractor for contractor use under this contract. At the close of each work period, all government property shall be secured.

16.0 Conduct of Contractor Personnel

The CO may require the contractor to remove from the work site any employee working under this contract for reasons of misconduct, security, or found to be or suspected to be under the influence of alcohol, drugs, or other incapacitating agent. Contractor employees shall be subject to dismissal from the premises upon determination by the CO that such action is in the best interests of the government. Such removal from the work site or dismissal from the premises shall not relieve the contractor of the requirement to provide sufficient personnel to perform the services as required by this PWS.

17.0 Safety

Contractor activities will be conducted in a safe manner that minimizes accidents as well as any impact on Government operations and members of the public. Contractor shall comply with applicable federal, state, and local codes and standards, including safety and occupational health requirements, as well as any additional specific requirement contained in this PWS.

Technical Requirements

18.0 Specific Tasks

The Contractor shall provide all labor, supervision, management, tools, materials, equipment, facilities, transportation, and other items and non-personal services necessary to provide roadside brushing to MRRD road systems. The following establishes the required tasks and the minimum acceptable levels of service.

842.01 Service Required

Roadside Brushing:

Remove vegetation, trees < 6 inches diameter when measured at 6 inches above the ground and limbs by mechanical brushing and hand removal methods on roadway and roadside surfaces.

Brush cutter equipment shall be in accordance with the Equipment Specification Table 1.0

842.02 Performance Standard

Roadway vegetation maintenance is complete when the vegetation has been removed and scattered from the designated treatment area not to interfere with traffic, obscures signs, impedes the flow of water or diverts water from drainage structures.

842.03 Roadside Safety

Roadside Safety refers to providing safe conditions for the traveling public and adjacent public use or recreation during mechanical brushing operations. All efforts should be made to conduct activities safely for both the public and brushing operations.

Debris caused from brushing operations should be removed from roadway surface, road shoulder and drainage feature(s) in a safe, efficient, and timely manner.

Large debris shall be placed on the downhill fill slope and shall not interfere with drainage features and structures.

When the traveling public, either vehicle or pedestrian enter the immediate work-zone, all brushing operations should be stopped or minimized when practicable to provide safe access past mechanical brushing equipment.

When work occurs in limited visibility areas, efforts should be made to minimize conflicts with the traveling public, such as incorporating additional work signs, or utilizing a follow vehicle to warn the approaching public of the work zone, when required.

If hazardous situations are created or detected during brushing operations (for example broken limbs, damaged trees) these should be removed or reported prior to leaving the work site each day.

842.05 Location of Work

842.06 Measurement

Measurement under this Section will be made by the total number of units for each item listed in the SCHEDULE OF ITEMS completed and accepted.

A. Mile: Work activity will be measured along the road regardless of the number of lanes.

Item 3 – 881 Mobilization:

881.01 Service Required

Mobilization of personnel, equipment, and material to the project site.

881.02 Performance Standards

Equipment shall be clean and weed free prior to moving it to the project area. This cleaning shall remove all soil, plant parts, seeds, vegetative matter, or other debris that could contain or hold seeds. All subsequent move-ins of equipment to the project area shall be treated in the same manner as the initial move-in.

Equipment shall be considered free of soil, seed, and other such debris when a visual inspection does not disclose such material. This requirement does not apply to service vehicles, water trucks, pickups, cars, and/or similar vehicles.

Additional equipment washing is applicable to all equipment on site requiring washing, NOT individual pieces of equipment.

Unless otherwise agreed, the Forest Service shall be given a minimum of 24 hours notice when equipment is ready for inspection. Notification will include an agreed upon location where the equipment will be available for inspection by the Forest Service. Inspection will be required after every cleaning.

881.03 Measurement:

Measurement under this Section will be made by the total number of units for each item listed in the SCHEDULE OF ITEMS completed and accepted.

881.04 Acceptable Quality Levels

19.0 Payments

All accepted quantities will be paid at the contract price per unit of measurement for the per line items in the schedule of items. All invoices will be submitted no later than 10 days after final inspection is carried out.

20.0 Activity Report

The contractor shall maintain an activity report for all services performed on each road covered under this contract. At a minimum, the report shall include road number, road name, beginning milepost, ending milepost, total miles, type of work performed, date of performance, and final status. Reports shall be submitted with their corresponding invoice for payment.

21.0 Safety and Traffic Control Plan

The contractor shall develop a work-specific safety plan that addresses all possible hazards that may exist on the work site, ensures the safety and convenience of the public, and protects the residents and property adjacent to the work site.

The plan shall include accommodating public traffic on roads adjacent to and within the work site until the work is completed and accepted by the government. Warning signs shall be placed IAW the standards of the Manual on Uniform Traffic Control Devices (MUTCD), current edition, while work is in progress. This shall include “Slow Moving Equipment” signs attached to all road surface equipment. The contractor shall submit the plan to the CO and COR NLT 5 business days after contract award. An updated copy shall be provided to the CO and COR as changes occur.

The Contractor shall provide adequate two-way communication as to report a fire to Forest Service within 15 minutes of detection. FCC Regulations prohibit commercial use of Citizen Band (CB) radios. (CB’s are not considered adequate two-way communication).

Such communication shall be operable during periods of operation of power-driven equipment, including the time fire security is required.

22.0 Contractor Furnished Equipment

All contractor furnished equipment and vehicles to be used at the work site shall be cleaned and free of invasive species (noxious weeds), seeds, external grease and oil and shall be inspected at an approved location prior to entrance onto federal government lands. The restriction shall include equipment and vehicles intended for off-road use, whether they are owned, leased, or borrowed by the contractor or subcontractor. All protective plating and armoring shall be intact and properly functioning on the equipment to reduce the potential for damaging hydraulic hoses or the undercarriage. Spill kit approved by OSHA for petroleum product leaks shall be on-site at all times.

23.0 Special Qualifications

The contractor shall, at no additional cost to the government, obtain all licenses and permits required for performance of work and for complying with all applicable local, state, and federal laws and regulations.

24.0 Service Interruptions

If any services must be interrupted (even temporarily) due to maintenance of contract work, the Contractor shall notify the CO and COR at least 3 business days in advance. If the service is due to an emergency breakdown, the Contractor shall notify the CO and COR as soon as practicable.

Performance Requirements Measures

25.0 Contractor’s Performance

The government expects the contractor to work at an acceptable performance level throughout the life of the contract, and the contractor’s performance shall be given significant consideration when evaluating recommendations for future government contracts and/or awards.

26.0 Acceptable Performance

Acceptable performance is achieved if 95% of the requirement is successfully satisfied. The Contractor’s acceptable performance will be rated in COR reports and in the Contractor Performance Assessment Reporting System (CPARS) as Satisfactory, Very Good, or Exceptional.

27.0 Unacceptable Performance

Unacceptable performance is achieved if less than 95% of the requirement is satisfied (e.g., work specified by contract is incomplete or work is not IAW the PWS and manufacturer’s specifications). If the performance is deemed unacceptable for any objective (required task), the COR will determine the possible cause of this unacceptable performance.

Unacceptable performance caused by actions of the Contractor shall be reported to the Contractor’s on-site representative and request its signature on documentation acknowledging notification. Unacceptable performance caused by actions of the Government shall not be held against the Contractor. If the Contractor disputes the results of surveillance, the COR must refer the Contractor to the CO for resolution. The Contractor’s unacceptable performance will be rated in COR reports and in CPARS as Marginal or Unsatisfactory.

31.0 Definitions

Acceptance: The act of an authorized representative of the Government by which the Government, for itself or as agent of another, assumes ownership of existing identified supplies tendered or approved specific services rendered as partial or complete performance of the contract.

Appurtenance: A structure along the road of value such as guard rails, bridge rails, culverts, and signage.

Base Course: The layer or layers of specified or selected material of designed thickness placed on a subbase or a subgrade to support a surface course. (See Illustration of Road Maintenance Terms.)

Berm: A curb or dike that controls roadway runoff water, or delineates traffic direction

Business Day: Refers to any day in which government normal business operations are conducted. For this contract, a business day will be IAW PWS Paragraph 6.0, Government Regular Working Hours.

Calendar Day: Refers to the period of elapse time, using Coordinated Universal Time or local time that begins at midnight and ends 24 hours later at the next midnight.

Channel: A natural waterway leading into or away from a culvert or bridge.

Contracting Officer (CO): A person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings. The term includes certain authorized representatives of the Contracting Officer acting within the limits of their authority as delegated by the Contracting Officer. "Administrative Contracting Officer (ACO)" refers to a Contracting Officer who is administering contracts. "Termination Contracting Officer (TCO)" refers to a Contracting Officer who is settling terminated contracts. A single Contracting Officer may be responsible for duties in any or all of these areas.

Contracting Officer’s Representative (COR): An individual, including a Contracting Officer’s Technical Representative (COTR), designated, and authorized in writing by the Contracting Officer to perform specific technical or administrative functions.

Contractor: A supplier or service provider that enters into a contract with the Government to provide specific supplies or services to the Government. The term in this contract refers to the prime.

Cross ditch: A shallow ditch placed across the roadbed to remove water from the roadbed surface that can be driven across by full-size pickups or other high clearance vehicles; usually placed diagonal to the centerline.

Culvert: Any structure that provides a passageway, drain, or waterway under a road or embankment.

Day: Unless otherwise specified, it means a calendar day.

Defective Service: A service output that does not meet the standard of performance associated with the Performance Work Statement.

Deliverable: Anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.

Ditch: A relatively long narrow excavation placed to collect or disperse water.

Drainage dip: A drainage structure that was previously constructed within the roadbed surface to form a uniform depression that allows routine passage of vehicles while diverting water from the traveled way.

Drainage ditch: A ditch located parallel to and abutting the roadbed.

Drainage structure: A term identifying manufactured devices placed to control water movements.

Drawings: Illustrations showing detailed maintenance required.

Equipment: A tangible item that is functionally complete for its intended purpose, durable, nonexpendable, and needed for the performance of a contract. Equipment is not intended for sale, and does not ordinarily lose its identity or become a component part of another article when put into use. Equipment does not include material, real property, special test equipment or special tooling.

Facility: An establishment, structure, or assembly of equipment designated for a specific function; something designed, built, installed, etc., to serve a specific function affording a convenience or service.

Foreslope: The slope of the ditch section nearest to the traveled way.

Forest Values: Refers to the forest ecological value (the worth of a forest in terms of what it contributes to the ecosystem as a whole), aesthetic value (the worth of a forest in terms of its natural beauty), and cultural value (the worth of a forest in terms of the way a person was raised to believe in it).

Grade: The vertical alignment of the top surface of the road.

High Clearance Vehicles: Vehicles such as pickups, 4x4s, and log trucks.

Highway Vehicles: Vehicles such as passenger cars, High and low high clearance vehicles.

Hydrologic Function: Physical properties of the occurrence and movement of water on the earth’s surface and in particular that part which crosses transportation systems.

Inspection: Examining and testing supplies or services (including, when appropriate, raw materials, components, and intermediates assemblies) to determine whether they conform to contract requirements.

Invoice: A contractor’s bill or written request for payment under the contract for supplies delivered or services performed.

Lead-off ditch: A ditch used to remove water from roadside drainage ditches, the roadway, cattleguards, or drainage structures such as culverts and drainage dips.

Low Clearance Vehicles: Vehicles such as passenger cars, non 4x4 pickups, vans and other highway vehicles.

Materials: Any substances specified for use in the performance of the work.

Measurement: Method of determining and expressing the quantities of work.

Nominal Dimensions or Weights: The numerical values shown on the drawings or in the specifications as measurements for the work.

Patching: Minor repairs.

Paved Surface or Pavement: Denotes asphalt, concrete, or other stabilized materials excluding natural aggregates. Dust palliative treatments are not considered as pavement.

Quality Control Plan (QCP): An organized written document used by the Contractor for quality control. A contractor’s internal quality assurance procedures for measuring, tracking, reporting, and analyzing contract performance. A contractor’s QCP is separate from the government’s QASP.

Reasonably Close Conformity: Means compliance with customary maintenance tolerances where working tolerances are not specified.

Right-of-Way: A general term denoting land, property, or interest therein acquired for or devoted to a road.

Roadbed: The portion of a road between the intersection of the subgrade and side slopes, excluding that portion of the ditch below the subgrade.

Road Listing: A preliminary listing of road locations and any established work priorities.

Road Maintenance Level 2: Road maintenance level 2 is defined in the FSH 7709.59, sec. 62.32 as “Assigned to roads open for use by high-clearance vehicles. Passenger car traffic, user comfort, and user convenience are not considerations. Warning signs and traffic control devices are not provided with the exception that some signing, such as W-18-1 “No Traffic Signs” may be posted at intersections. Motorists should have no expectations of being alerted to potential hazards while driving on these roads. Traffic normally is minor, usually consisting of one or a combination of administrative, permitted, dispersed recreation, or other specialized uses. Log haul may occur at this level.” Appropriate traffic management strategies encourage, accept, discourage, and prohibit.

Maintenance level 2 roads have the following attributes:

Are maintained for use by high-clearance vehicles and not suitable for passenger cars.

Have low traffic volume and speed.

Typically, there are local roads that connect to collectors and other local roads.

Have dips or cross drains as the preferred drainage treatments.

Avoid the use of culverts, arches, and bridges when possible Typically, they have very few, if any, signs or other traffic control devices.

Are subject to the requirements of EM-7100 and MUTCD for all signs.

Do not consider surface smoothness Do not always provide motorists with alerts to potential hazards.

May not be passable during periods of inclement weather.

Road Maintenance Level 3 Road maintenance level 3 is defined in the FSH 7709.59, sec. 63.32 as “Assigned to roads and maintained for travel by prudent driver in a standard passenger car. User comfort and convenience are not considered priorities. The “Manual on Uniform Traffic Control Devices” (MUTCD) is applicable. Warning signs and traffic control devices are provided to alert motorists of situations that may violate expectations. “Roads in this maintenance level are typically low speed with single lanes and turnouts. Appropriate traffic management strategies are either ‘encouraged’ or ‘accepted’. Discourage or prohibit strategies may be employed for certain classes of vehicles or users.

Maintenance level 3 roads have the following attributes:

Are passable to prudent drivers in passenger cars during the normal season of use.

Usually do not consider user comfort and convenience priorities.

Are subject to the requirements of EM-7100-15 and MUTCD for signs.

Are typically single lane with turnouts visible from either direction.

Typically, it must be driven at low speeds.

May be local or collectors.

Have low-to moderate-traffic volume.

Typically connect to arterial and collector roads or other maintenance level 3 roads.

May include some dispersed recreation roads.

Provide drainage via a combination of dips and culverts.

Typically, it may have potholes or wash boarding.

Road maintenance level 5 Road Maintenance level 5 is defined in the FSH 7709.58,10,12.3 as: “Assigned to roads that provide a high degree of user comfort and convenience. These roads are normally double-lane, paved facilities. Some may be aggregate surfaced and dust abated. The appropriate traffic management strategy is “encourage.”

Maintenance level 5 roads have the following attributes:

Subject to the requirements of Highway Safety Act and Manual of Uniform Traffic Control Devices (MUTCD) Highest traffic volume and speeds.

Typically connect to State and county roads.

Culverts provide drainage Usually arterial and collector.

May include some developed recreation roads.

Usually paved or chip-sealed.

Serviceable Condition: Refers to items that are usable; ready for use; in proper operating condition; durable; clean and in good condition; usable for its intended purpose.

Shoulder: The portion of the roadway continuous to the traveled way for accommodation of stopped vehicles, emergency use, and lateral support of travel way structure.

Slough or Slide: Material deposited on the roadway that may need to be repositioned or removed.

Slump: A localized portion of the roadbed that has slipped, or otherwise become lower than the adjacent roadbed, and constitutes a hazard to traffic.

Standard Specifications for the Construction of Roads and Bridges on Federal Highway Projects: Issued primarily for constructing roads and bridges on Federal Highway projects under the direct administration of the Federal Highway Administration (FHWA). It is also used by the U.S. Forest Service and other federal agencies on their projects. These specifications are cited as "FP-14" indicating "Federal Project" Standard Specifications issued in 2014 and contain both United States Customary and Metric units of measure.

Sub-Contractor: One that enters into a contract with a prime Contractor. The Government does not have privy of contract with the sub-contractor.

Subgrade: Top surface of roadbed upon which subbase, base course, or surface course was constructed.

Supplemental Specifications: Specifications that detail conditions and requirements peculiar to the individual project.

Traveled Way: The portion of the roadway for the movement of vehicles. For purpose of this contract, traveled way includes turnouts and curve widening.

Turnout: A short auxiliary lane on a one-lane road provided for passage of meeting vehicles.

Unit of Measure: The unit and fractions of units shown in the Schedule of Items.

Unsuitable Material: Material removed during maintenance which must be disposed of in designated locations. Includes material with substantial amounts of vegetation or other objectionable material.

Waterbar: A deeper type of cross ditch which is not intended for the passage of low clearance passenger vehicles.

Industrial Fire Precaution Levels terms:

a. Cable yarding systems: A yarding system employing cables and winches in a fixed position.

b. Closed season (Fire Precautionary Period): That season of the year when a fire hazard exists as declared by the responsible agency official.

c. Loading sites/woods site/project area: A place where any product or material (including but not limited to logs, firewood, slash, soil, rock, poles, posts, etc.) is placed in or upon a truck or other vehicle.

d. Low hazard area: Means any area where the responsible agency representative (WDNR, ORF, BIA, BLM) determines the combination of elements reduces the probability of fire starting and/or spreading.

e. Tractor/skidder operations: Include a harvesting operation, or portion of a harvesting operation, where tractors, skidders, or other harvesting equipment capable of constructing fireline, are actively yarding forest products and can quickly reach and effectively attack a fire start.

AGAR Clauses

452.203-71 Anti-Discrimination and Diversity, Equity, and Inclusion (DEI) Compliance (Dec 2025)

(a) By entering into this contract, the Contractor certifies that:

(1) It is compliant with all applicable Federal anti-discrimination laws and the Equal Protection principles of the U.S. Constitution, and it will remain compliant for the duration of the contract.

(2) Neither it nor any subcontractor or teaming partner operates or funds any program, policy, or initiative that promotes DEI in a manner that violates any applicable Federal anti-discrimination laws, including but not limited to Title VI and VII of the Civil Rights Act of 1964, or the Equal Protection principles of the U.S. Constitution, and the Contractor and any subcontractor or teaming partner will not do so for the duration of the contract.

452.204–70 Modification for Contract Closeout (Nov 2025)

(a) If unliquidated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (Contracting Officer) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The Contracting Officer shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) Upon contract closeout for contracts utilizing SAP: if unliquidated funds of more than $1000 remain on the contract, the Contracting Officer shall issue a bilateral modification for deobligation.

The contractor will receive a copy of the modification and will be required to provide a signature.

(The Contracting Officer may also request a “Contractor Release of Claims” be completed by the contractor, although not required for contracts and orders using SAP.) If the bilateral modification and Release of Claims are not returned to the Contracting Officer within 60 days, the Contracting Officer shall release the modification as unilateral and proceed with contract close-out upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(c) Upon contract closeout for contracts utilizing anything other than cost reimbursement, if unliquidated funds of more than $1000 remain on the contract, the Contracting Officer shall issue a bilateral modification for deobligation.
