COMMERCIAL SERVICES (DEVIATION NOV 2025)

(a) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. As a minimum, offers shall include—

(1) The solicitation number;

(2) The name, address, telephone number of the Offeror;

(3) The Offeror’s Unique Entity Identifier (UEI) and, if applicable, Electronic Funds Transfer (EFT) indicator;

(4) Information necessary to evaluate the factors contained in the provision at 52.212-2 or as described in the solicitation;

(5) Responses to provisions that require Offeror completion of information, representations, and certifications (other than those collected via the System for Award Management (SAM)); and

(6) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and any solicitation amendments.

(b) Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(c) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers and any modifications or revisions to the Government office designated in the solicitation by the time specified in the solicitation.

(2) Any offer, modification, or revision received after the time specified for receipt of offers is “late” and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.

(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(4) Offerors may withdraw their offers by written notice to the Government received at any time before award.

(d) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.

(e) Debriefings. If a postaward debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:

(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed Offeror’s offer.

(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.

5. Quoters shall submit a written response to this solicitation Non-Price Evaluation Criteria, based on Factors 1

– 3, below. Document shall be sent in Adobe PDF format.

FACTORS DESCRIBED:

FACTOR 1 – PAST PERFORMANCE The Past Performance evaluation will be accomplished by reviewing aspects of an Offeror's recent and relevant Past Performance, as it directly relates to the services being procured under this solicitation, winter tree planting on the Umpqua National Forest, and as defined in Addendum to FAR 52.212-2 Evaluation – Commercial Products and Commercial Services.

(A) Past Performance information described herein is required on the offeror and all subcontractors, teaming partners, and/or joint venture partners proposed to perform on the proposed effort.

(B) Relevant Past Performance. The offeror shall include documentation regarding their relevant past performance as it directly relates to the services being procured under this solicitation. The offeror SHALL NOT go back any farther than 3 years for the submitted data. The past performance data shall document a successful history of past contract performance. Past Performance seeks to affirm an Offeror’s ability to conform to contract requirements, timeliness, quality of workmanship, business practices such as cost and schedule control, and customer satisfaction.

(C) In conducting the Past Performance evaluation, the Government reserves the right to use both the information provided in the offeror’s Past Performance submission and information obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems, The Contractor Performance Assessment Reporting System (CPARS) at https://www.cpars.gov, and commercial sources.

Offerors are reminded that both independent data and data provided by offerors in their offers may be used by the Government to evaluate offeror past performance. However, the burden of providing thorough, complete, and current past performance information as requested in this paragraph remains with the offerors.

The overall past performance evaluation is a subjective decision based on the whole of all data received. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

(D) Submission Requirements. The offeror shall provide documentation outlining the offeror’s past performance on contracts, as a prime or subcontractor, of the same or similar in nature, size, and complexity to the services being procured under this solicitation. For each past performance project listed, provide the associated contract number, project title, total contract value, period of performance, location, your contract role (indicate prime or subcontractor), and a contact (reference) name and phone number, and email address.

FACTOR 2 – EXPERIENCE Experience reflects the Offeror’s technical understanding and capabilities, and the relevance of work or activities that are similar in nature, size, complexity, scope, and the geographical conditions of the Umpqua National Forest.

(A) Experience is required for the offeror and all subcontractors, teaming partners, and/or joint venture partners proposed to perform on the proposed effort.

(B) Submission Requirements. The offeror shall provide documentation outlining the offeror’s experience in timber tree planting projects of the same or similar in nature, size, and complexity to the services being procured under this solicitation. Provide examples of relevant projects and activities that adequately reflect your experience.

FACTOR 3 – QUALITY CONTROL Monitoring Quality. In general terms, describe the method, or combination of methods to be utilized to monitor quality for all work required in the Statement of Work. (See Page 3 of Statement of Work for description of a Quality Control Plan). Further explain how this method(s) ensures Quality Performance.

Name who will perform Quality Control and Inspection, and their experience.

FACTOR 4 - WORK PLAN AND CREW MANAGEMENT The offeror shall provide a work plan and schedule to ensure timely performance. Crew management, crew size, and safety measures are relevant factors to ensure successful performance and compliance.

FACTOR 5 – PRICE is approximately equal in importance to factors listed above; however, cost may control award. Pricing provided on Schedule of Items, Attachment 1.

(End of Provision)

8. Submit offer by email to paula.winningham@usda.gov so that it is delivered into this inbox by the due date and time. Emails should contain two separate attachments (Response to Evaluation Criteria, Schedule of Items for pricing) in an Adobe PDF format. Be aware that large attachments may increase the time required to deliver an email.

It is the Quoter’s responsibility to confirm receipt of the offer from CO Paula Winningham.

Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

1) FACTOR I – PAST PERFORMANCE. The Past Performance evaluation will assess the relative risks associated with an offeror’s likelihood of success in performing the solicitation’s requirements as indicated by that offeror’s record of past performance. Performance risk is assessed at the factor level after evaluating aspects of the offeror’s recent past performance and focusing on performance that is relevant to the services and/or products being procured under this solicitation. Past performance areas of evaluation include quality, timeliness, business practices, and customer satisfaction.

A. Recency Assessment. An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past 3 years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated.

B. Relevancy Assessment. An assessment of the past performance information will be made to determine if it is relevant. An award will not be made to any offeror who receives an “Unacceptable” past performance rating.

2. Offerors without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, will not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

2) FACTOR 2 – EXPERIENCE Offeror’s technical understanding and capabilities, and the relevance of work or activities that are similar in nature, size, complexity, scope, and the geographical conditions of the Umpqua National Forest.

1. Assigning Ratings. The Experience Factor will be assigned one of the ratings defined below. An award will not be made to any offeror who receives an “Unacceptable” rating.

3) FACTOR 3 – QUALITY CONTROL. The Contractor shall provide a Quality Control Plan (QCP). The

Plan must demonstrate how the Contractor shall assure that quality of performance meets the objectives and requirements of the contract. Describe how quality will be monitored to ensure performance standards are met. The results of the monitoring should reflect quality performance.

Assigning Ratings. The Quality Control Factor will be assigned one of the ratings defined below. An award will not be made to any offeror who receives an “Unacceptable” past performance rating.

4) FACTOR 3 - WORK PLAN AND CREW MANAGEMENT

Subfactor 1: Include crew size, work schedule, and production rate per acre, per day, that will allow you to complete the work to meet performance time for work you are proposing to do.

Subfactor 2: Describe supervision plan, who will supervise, and your ability to adjust crew sizes to complete the work acceptably and on time.

Subfactor 3: Crew Management and Safety: Describe personal protection equipment (PPE) provided, your communications plan, other safety measures.

Each sub-factor will receive one of the adjectival ratings defined below. To receive an acceptable rating for this factor, all sub-factors must be rated acceptable.

Quality Control Evaluation Ratings Rating Description

Acceptable Offer clearly meets the minimum requirements of the solicitation.

Unacceptable Offer does not clearly meet the minimum requirements of the solicitation.

(a) Options/Conditional Work (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(b) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.

Interested parties are encouraged to resolve concerns through USDA’s internal Alternative Dispute Resolution (ADR) process before pursuing external forums such as the GAO. Concerns may be addressed informally or through a formal agency protest filed with either the Contracting Officer or the Ombudsman.

Under this informal process, the agency is not required to suspend contract award performance. Utilization of the informal forum does not suspend any time requirement for filing a formal protest with the agency or other forums.

3. Required Information: To ensure a timely response, interested…
