(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6 of the Federal Acquisition Regulation, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

(ii) This solicitation is issued as a Request for Quotation (RFQ).

(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-03.

(iv) This procurement is total set aside for Small Business. The PSC is F014, Natural Resources/conservation- Tree Thinning. The NAICS code is 115310, Fuels Management Services the Small Business Size Standard is $34,000,000.00.

DESCRIPTION

The expected result of this project is to mechanically alter fuel loadings on approximately 203.6 acres of base items. Units are composed of primarily mixed conifer. Trees masticated will vary in size from small diameter saplings up to the 9-inch maximum cut diameter. Fuel loadings estimated between 15-35 tons/acre. Some units contain dense patches of small diameter of mixed conifer regeneration saplings.

Treatment units are located mostly on flat aspects with elevations ranging from 4500 feet to 5500 feet.

Slope within treatment units varies from 0 to 30% with an average of 10% or less.

Fuels shall be slashbusted/masticated to alter the fuel profile resulting in slash within close contact to the ground increasing the rate of decomposition.

The Forest Service has marked all treatment units with plastic flagging and boundary tags containing unit name and number. Color of flagging will be orange, pink, or pink and black striped.

TREATMENT OBJECTIVES

To meet the objective of this contract, the contractor shall: Masticate standing trees to achieve leave tree outlined in the detailed unit sheet. Trees to be masticated shall not exceed 9-inch DBH. Leave trees should follow species priority list identified in the unit description document.

Masticate slash between 1-9 inches in diameter and over 6 ft. in length to a maximum of 4 ft. segments within 12 inches of the ground. This may require more than one pass in areas of heavier fuel concentrations and acceptable results shall include mastication occurring on 90 percent of the acres on each unit and Protect residual trees from scarring as a result of contract operations and Mastication shall avoid operations that would result in penetration of the duff layer and contributing to exposure of mineral soil and Perform treatment operations when soil moisture levels are below forest standards and guides. Soil compaction mitigation requires that operations will be restricted to periods of dry conditions and frozen conditions.

a) Dry conditions are defined as periods when a handful of soil squeezes into a loose ball which falls apart rapidly when the hand of soil is tapped from behind with the other hand.

b) Frozen conditions are defined as periods when the combination of frozen ground and/or snow cover is sufficient to support equipment without detrimental soil impacts.

Work will be suspended if soil moisture levels subsequently exceed standards and guides due to adverse or unusual weather conditions.

Mechanical equipment shall not be operating within 100 feet of intermittent streams.

LOCATION

Work will occur on the Wallowa-Whitman National Forest. Project Maps contained in “List of Attachments” reflect site locations of individual units. The information contained in these maps is complementary to the Technical Specifications.

Contractor shall notify the COR when pay items are complete and ready for inspection prior to moving out of the general area. Any unit not meeting contract requirements shall be reworked at the Contractor’s expense. Maps will be provided to the successful quoter, at the post-award conference, with detailed access information and will show all treatment unit numbers and locations.

MOBILIZATION

Mobilization covers the price of move in and out of equipment for each unit ordered. Mobilization units ordered are for each group of units by geographical area.

EQUIPMENT REQUIREMENTS

All mechanical equipment proposed for use on this contract shall meet the following specifications:

1) Steel and rubber tracked machine. No machine shall have steel tracks over rubber tires.

2) Ground pressure not exceeding 7.5 pounds per square inch

3) Climbing/working ability up to 30 % slope

4) Capable of moving within stands without damaging leave trees

5) Effective arm reach of 20 feet minimum

6) Ability to masticate fuels to desired specifications

7) Ability to perform work from existing skid trails or slash mats.

8) Operator cab, engine and arm shall be able to rotate 360 degrees

9) Non leaking fluid systems

Equipment shall be capable of reducing materials 9 inches in diameter to less than 12 inches in depth by means of a power-driven rotary head or similar device capable of chopping, chewing or grinding wood fiber and be able to maneuver within tree spacing of 10 to 12 feet without damage to leave trees.

GOVERNMENT’S QUALITY ASSURANCE SURVEILLANCE PLAN

The Government may conduct visual inspections of each unit to determine compliance with performance standards. Inspectors will ensure that the soil related objectives are adhered to and the remaining slash is no more than 4 ft. in length and is within 12 inches of the ground and there are no scars on remaining trees that were the result of operations.

Pay items will be inspected separately and inspection results on one pay item will not be averaged with those of the other pay item. The contractor is encouraged to observe verification inspections and will receive inspection summaries upon request.

PAYMENT

Contractor shall notify the COR when pay items are complete and ready for inspection prior to moving out of the general area. Any unit not meeting contract requirements shall be reworked at the Contractor’s expense.

MEASUREMENT

a) All units of measure have been traversed or calculated using a GPS system.

b) Re-measurement Upon Contractor’s Request: The Contractor may request (in writing) the remeasurement by the Government of any pay item. If re-measurement determines a variance of 5 percent or less, adjusted to the nearest whole acre, the Contractor shall pay the cost of re-measurement and no adjustment will be made in the acreage. If re-measurement determines a variance of greater than 5 percent, adjusted to the nearest whole acre, the Government will pay the cost of re-measurement and payment will be based on the re-measured acreage.

c) Acceptance will be based on 100% visual inspection of units. If visual inspection finds that occasional work elements do not completely conform to performance standards but non-conforming elements are not representative of overall work quality, the work will be accepted. If non-conforming work is indicative of an overall quality of work problem, rework will be required.

PART II CONTRACT CLAUSES AND PROVISIONS

(viii) 52.212-1 Instructions to Offerors – Commercial Products and Commercial Services (SEP 2023) (Provision)

Addenda to provision 52.212-1:

Addenda to paragraph (b) Submission of Offers:

1) Quoters must have an active entity registration in the System for Award Management in order to submit an offer. https://www.sam.gov/SAM/

2) Quotes shall be submitted in response to this solicitation in two volumes. Volume I, Technical Proposal. Volume II, Price Proposal. ueiSAM shall be affixed to each volume. (Unique Entity Identifier)

a) Volume I, Technical Proposal – The technical proposal shall address the evaluation factors in 52.212-2. At a minimum technical proposal shall include:

i) Past Performance – Provide a list of similar projects completed by your firm over the past three years. Similar project is defined as similar to US Forest Service Mastication Services as specified. Include a brief description of the project, dollar amount, year completed, and project owner contact information (name, phone, and email). The offeror may provide information on problems encountered on the contracts and subcontracts listed and the corrective actions taken to resolve those problems. The Government may obtain information from existing contract files. In the event that there is no past performance information available, the offeror will receive a neutral rating in this factor.

ii) Representations and Certifications – Fill in the check boxes for provisions 52.204-24, found in Part III, Representations and Certifications of this solicitation and include a copy with Volume I, Technical Proposal.

b) Volume II, Price Proposal – Include the following: 1) completed, (iv) Schedule of

Items/Price Schedule, of this solicitation, 2) Acknowledge any amendments issued to contractors on the parent BPA call. for this solicitation by completing and signing the posted SF-30, and 3) Include the completed price schedule contained in (v) Schedule of Items/Price Schedule of this solicitation.

(ix) 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) (Provision)

(a) The Government may award multiple contracts as a result of this Request for Quote to the responsible offeror(s) whose offer conforms to the RFQ requirements. A comparative evaluation of the quotes including price, past performance and technical capability will be made in accordance with FAR 13.106‐2(b). Offerors must be determined responsible according to the standards of FAR Part 9 to be eligible for award.

(b) The Government will select the quote that represents the best benefit to the Government to fulfill the requirement based on the judgment of the contracting officer and Forest Service users.

(1). The contracting officer will read all quotes.

(2). Quotes deemed too expensive or not practical for the Forest Service will not be considered further and without notice to the submitter.

(3). The Forest Service will compare quotes against each other in an impartial and simplified manner based on FAR part 13. Source selection techniques described in FAR part 15 will not be used.

(4). The Government may ask questions to one or more submitters but is not obligated to do so.

(5). The Government may reject all quotes.

(6). The contracting officer and Forest Service users may use any means available to examine the past performance.

(7). The Government may discuss price or price discounts with the one or more submitters before awarding an order or rejecting all quotes.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (NOV 2021) (Provision)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at

52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision—

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense

Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for

Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award

Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".

(d) Representation. The Offeror represents that—

(1) It ☐ will, ☐ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that—

It ☐ does, ☐ does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.

(e) Disclosures. (1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment—

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number;

and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services—

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment—

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the PSC of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.

52.204-26 Covered Telecommunications Equipment or Services-Representation (Jun 2023) (Provision)

a) Definitions. As used in this clause—

Covered application means the social networking service TikTok or any successor application or service developed or provided by ByteDance Limited or an entity owned by ByteDance Limited.

Information technology, as defined in 40 U.S.C. 11101(6)—

(1) Means any equipment or interconnected system or subsystem of equipment, used in the automatic acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information by the executive agency, if the equipment is used by the executive agency directly or is used by a contractor under a contract with the executive agency that requires the use—

(i) Of that equipment; or

(ii) Of that equipment to a significant extent in the performance of a service or the furnishing of a product;

(2) Includes computers, ancillary equipment (including imaging peripherals, input, output, and storage devices necessary for security and surveillance), peripheral equipment designed to be controlled by the central processing unit of a computer, software, firmware and similar procedures, services (including support services), and related resources; but

(3) Does not include any equipment acquired by a Federal contractor incidental to a Federal contract.

(b) Prohibition. Section 102 of Division R of the Consolidated Appropriations Act, 2023 (Pub.

L. 117-328), the No TikTok on Government Devices Act, and its implementing guidance under Office of Management and Budget (OMB) Memorandum M-23-13, dated February 27, 2023, “No TikTok on Government Devices” Implementation Guidance, collectively prohibit the presence or use of a covered application on executive agency information technology, including certain equipment used by Federal contractors. The Contractor is prohibited from having or using a covered application on any information technology owned or managed by the Government, or on any information technology used or provided by the Contractor under this contract, including equipment provided by the Contractor’s employees; however, this prohibition does not apply if the Contracting Officer provides written notification to the Contractor that an exception has been granted in accordance with OMB Memorandum M-23-13.

(c) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (c), in all subcontracts, including subcontracts for the acquisition of commercial products or commercial services.

52.209-7 Information Regarding Responsibility Matters (OCT 2018) (Provision)

(a) Definitions. As used in this provision—

Administrative proceeding” means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.

Federal contracts and grants with total value greater than $10,000,000” means—

(1) The total value of all current, active contracts and grants, including all priced options; and

(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).

“Principal” means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

(b) The offeror ☐ has ☐does not have current active Federal contracts and grants with total value greater than $10,000,000.

(c) If the offeror checked “has” in paragraph (b) of this provision, the offeror represents, by submission of this offer, that the information it has entered in the Federal Awardee Performance and Integrity Information System (FAPIIS) is current, accurate, and complete as of the date of submission of this offer with regard to the following information:

(1) Whether the offeror, and/or any of its principals, has or has not, within the last five years, in connection with the award to or performance by the offeror of a Federal contract or grant, been the subject of a proceeding, at the Federal or State level that resulted in any of the following dispositions:

(i) In a criminal proceeding, a conviction.

(ii) In a civil proceeding, a finding of fault and liability that results in the payment of a monetary fine, penalty, reimbursement, restitution, or damages of $5,000 or more.

(iii) In an administrative proceeding, a finding of fault and liability that results in–

(A) The payment of a monetary fine or penalty of $5,000 or more; or

(B) The payment of a reimbursement, restitution, or damages in excess of $100,000.

(iv)In a criminal, civil, or administrative proceeding, a disposition of the matter by consent or compromise with an acknowledgment of fault by the Contractor if the proceeding could have led to any of the outcomes specified in paragraphs (c)(1)(i), (c)(1)(ii), or (c)(1)(iii) of this provision.

(2) If the offeror has been involved in the last five years in any of the occurrences listed in

(c)(1) of this provision, whether the offeror has provided the requested information with regard to each occurrence.

(d) The offeror shall post the information in paragraphs (c)(1)(i) through (c)(1)(iv) of this provision in FAPIIS as required through maintaining an active registration in the System for Award Management, which can be accessed via https://www.sam.gov. See 52.204-7.

52.212-3 Offeror Representations and Certifications – Commercial Products and Commercial Services (MAY 2024) (Provision)

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract.

If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
