SECTION 1: PURPOSE AND PRICING

1. Purpose

The Forest Service is issuing this BPA call as part of the solicitation for the parent BPA to remove danger/hazard trees that are a safety issue as a result of numerous large wildfires in the state of Oregon.

The quote/pricing that the vendor provides in this BPA call will assist to determine fair and reasonable pricing for the awarding of the parent BPA. The quote/pricing that you submit will be the pricing that will be considered in awarding a part of the parent BPA.

1.2 BPA Call Type

This BPA call is being issued as a firm fixed-price procurement.

SECTION 2: SCOPE

2.1 Scope

The work is along roads that are throughout the fire perimeter on a variety of complex terrain that requires specialized equipment to perform the work in a safe and efficient manner. These trees need to be removed for the safety of employees, cooperators, contractors, and the public.

The nature of the work requires the contractor personnel to be well qualified in the profession of felling trees, stacking, decking and hauling. All contractor personnel will be required to have and maintain all licenses, qualifications and certifications required by industry, state and federal agencies.

Roads vary from main paved roads with no shoulder and parallels rivers to standard level 2 forest roads with surface rock and native surfaces. Terrain varies from flat and rolling to steep and rocky with deep drainages. Work to be performed includes, but is not limited to directional felling of trees, skidding of trees, processing of trees, hauling to a safe decking location, decking of logs, and piling of slash. Due to the large number of danger trees along these roads and complexity of terrain, orderly operations will be necessary to facilitate a challenging task in a safe manner. Government personnel will provide plans in mitigating hazards from the fire and guidance to ensure resource protections are in place. Government personnel will also provide Danger Tree Cutting guideline and specific cutting prescriptions for identifying danger trees that shall be followed. Additional guidance will be provided throughout the life of the contract. Resource concerns will be identified by government personnel on the ground and made known, so avoidance, protection or other site-specific mitigations can occur.

2.2 Daily Work

Pre-operational briefings will be conducted approximately every three days by the Contracting Officer Representative (COR). It’s anticipated that work plans and maps will likely be provided and updated approximately every three days. The pre-operational briefing will include standards for performing work.

The Contractor shall be responsible for all logistical support (e.g. fueling, chase truck, etc.) of the Contractor’s resources throughout the life of this contract (include all logistical support in your quote. It will not be priced separately but include in each line item with the equipment).

Each day is based on a 10.5-hour operational shift, from 7:00 AM to 5:30 PM, with a one hour lunch break. For the Hand Falling Modules (2 fellers), a day is considered 7 hours from 7:00 AM to 5:30 PM with 3.5 hours for lunch and rest. Actual operational hours (e.g. start/end time, etc.) may be adjusted if mutually agreed upon between CO and Contractor.

2.3 Contract Time and Payment

There is no guarantee of full-time work for the entire 30 days shown in the Schedule of Items. There may be non-working days in the performance period. If a piece of equipment/person is not working for that day, no payment will be made for that equipment/person. Payment will not be made for hours/time when equipment is broken down and not operational. If operations are suspended by the Forest Service while work is in progress due to unfavorable weather and soil conditions, the contractor shall be paid the full daily rate for that day.

The transport vehicle will be used to transport equipment to areas of work throughout the fire area.

Transport vehicle may be needed to transport equipment from one road to the next, especially if pavement doesn’t allow for walking equipment, or if roads are too far apart. Transport vehicles will only be on an as needed basis.

A transport may not be needed where work is confined to one location where heavy equipment can easily “walk” to various work sites as needed. Government personnel will provide approximately one day of notice before a transport is needed. Payment will be made at the daily rate shown in the Schedule of Items for each day a transport is retained or used.

NOTE: If during the course of operations, if it is determined that a piece of equipment or falling module is no longer needed, they will be released from the project and paid for all time accrued prior to release.

2.4 Work Location

2.5 Equipment Needed

Due to the varied complexities of this work, a multitude of equipment is needed to be successful.

Rubber tired machines are needed to work on pavement, skidders with cable line is needed for hand felled trees on steep slopes where trees are hung up. Shovels are needed to be able to reach on tall cut banks above roads and fully suspend trees in resource sensitive areas. The following describes specific needs and equipment capabilities to successfully perform this work:

Harvester and Feller-Buncher will need to be able to cut and process danger trees on broken and rocky terrain. Harvester and Feller-Buncher operators will need to identify and directionally fell danger trees per felling specifications provided by government personnel.

Danger Tree identification specifications will be in Designation by Prescription form, prescribing a desired outcome based off specific fire and physical damage. Government personnel will be available to monitor this identification process. Felling to lead for safe and efficient tree removal as well as contour felling in resource sensitive areas will be required. Felling trees up to 20” and possibly greater is needed.

Bunching trees to facilitate efficient skidding/forwarding and reducing soil impacts is required. Grousers will need to be removed from the rubber tires to allow for traveling over paved roads.

Forwarders will need to fully suspend trees and logs from the point of felling to deck locations identified by the Forest Service. Grousers will need to be removed from the rubber tires to allow for traveling over paved roads.

Skidders will skid logs from point of felling or bunching to decks identified by the Forest Service.

Skidders shall stay on routes that will reduce soil impacts as much as possible. Cable line may need to be pulled from the skidders to retrieve logs on steep ground. Tire chains may need to be removed for traveling over pavement.

Processors will need to delimb and buck trees to preferred lengths identified by government personnel.

Slash shall be managed in a way to allow for safe and clean piling. Processors may be working with a Shovel for sorting and decking, however, if a shovel is not available at the time of processing, the processor is expected to sort and deck as best as possible.

Shovels will need to retrieve trees off cut banks and bunch trees on roads to facilitate safe and efficient skidding. Shovel logging certain areas may be required. Shovels may be needed to sit at the landing and neatly sort and deck logs by species, length and product as specified by government personnel.

Shovels may need to fully suspend logs out of resource sensitive areas to protect resources of concern.

Slash piling shall occur as directed by Forest Service. Piles shall be reasonably free of dirt and debris, using a lift and stack method to facilitate burning. Decking locations in the proximity of the project will be identified which provide for safety during the danger tree project. As work progresses more landing sites may be designated if needed for safety and efficiency.

Skyline Yarding with a Yarder, or a Yoader may be the method that is most efficient and least impactful to Forest Resources in some situations. Yarders shall be capable of yarding trees up to 300 feet with leading end suspension.

Hand fellers will need to identify and directionally fell danger trees per felling specifications provided by the government personnel. Danger Tree identification specifications will be in Designation by Prescription form, prescribing a desired outcome based off specific fire and physical damage.

Government personnel will be available to monitor this identification process and provide additional guidance. Felling to lead for safe and efficient tree removal as well as contour felling in resource sensitive areas will be required. Felling on varied terrain will occur, including steep and rocky ground.

Some limited limbing and bucking may be necessary.

Log Trucks may be used to haul logs to a safe decking location identified by government personnel.

The Log trucks will be requested on an “as needed basis” with government personnel providing approximately 2 days advance notice.

All equipment shall work together in a workmanlike and orderly fashion to provide for a safe, efficient, and respectful working environment. Work will be performed in a fire environment and will adhere to safety standards set by the Forest Service, including communications for firefighter personnel. Contractors are not required to be wear nomex clothing or be “red carded” for working on a fire. The work locations are nearly free of fire, but some areas do have some activity.

The Contractor shall comply with all applicable Federal, State and local laws, executive orders, rules and regulations applicable to its performance under this contract. This applies to all current and future certification and training needs for any heavy equipment being used while work is in progress.

2.6 Personal Protective Equipment

The contractor will train in the safe operation and use of equipment to all workers using such equipment.

Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards or processes encountered in a manner capable of causing injury or impairment in the function of any part of the body.

Defective or damaged personal protective equipment shall not be used.

The contractor shall provide, at no cost to the employee, to each employee who operates a chain saw, chain saw chaps and assure the chaps are worn during saw operations. These chaps must be approved by Underwriters Laboratory or meet Forest Service specification 6170-47. The chaps shall cover the full length of the thigh to the top of the boot on each leg.

The contractor shall assure that each employee wears foot protection that provides adequate traction and ankle support and must meet OAR 437-007-1320. Employees operating chain saws shall wear foot protection that is constructed with cut-resistant material which will protect the employee against contact with a running chain saw.

The contractor shall provide, at no cost to the employee, and assure that each employee who works in an area where there is potential for head injury from falling objects or flying objects wears a hard hat that meets the minimum requirements of American National Standards Institute (ANSI) standard Z89.1-1977 and meets the NFPA 1977 (1998 edition) standard.

The contractor shall provide, at no cost to the employee, eye protection where there is potential for eye injury due to flying objects. This eye protection must meet the minimum requirements of ANSI standard Z87.1-2003.

The contractor shall provide, at no cost to the employee, hearing protection where there is a potential for hearing loss due to high intensity noise e.g., chain saw operation

2.7 Safety

(a) Hand felling, limbing and bucking is inherently dangerous. Hazards include, but are not limited to:

chainsaw injuries, long driving distances on low-grade forest roads, tripping hazards, hypothermia, fatigue, muscle strains, chemical burns, gasoline fire potential, dehydration, insect stings, overhead/falling debris, and lightning. Chainsaw hazards result from improper cutting techniques and fatigue, inattention to proper safety procedures and bar-tip location, improperly held/positioned chainsaw, poorly trained sawyers and lack of, or inadequate personal protective equipment.

(b) Driving along forest roads during early and late hours, before or after sunlight will subject drivers and riders to low light angles, dusty conditions, icy and/or muddy roads; as well as encounters with log hauling trucks, road machinery, hunters not watching the roadway, campers and other forest users that may not be intently aware of other motorists who are sharing the roadway.

(c) Other typical hazards include:

(1) Tripping hazards on forest vegetation and other debris including rocks and other hazards inclusive of slippery surfaces during periods of rain and snow.

(2) Hypothermia may occur at anytime regardless of the absence of extreme weather conditions.

(3) Fatigue may occur towards the end of the working day.

(4) Muscle strains may occur due to improper lifting, bending, twisting, or turning particularly when mounting and dismounting heavy equipment.

(5) Chemical burns may occur during the transfer of oil or gas, or by the unexpected discharge of chemical fire extinguishers.

(6) Gasoline fires may occur at anytime, but are most likely during refueling hot chainsaws, or during the transfer of petroleum products.

(7) Dehydration may occur during both warm and cool periods, and whenever employees are performing arduous tasks while neglecting to ingest adequate fluids that contain electrolytes.

(8) Insect stings or bites may occur at anytime while in the forest and may include ticks, bees, wasps, or other types of biting stinging insects.

(9) Overhead and/or falling debris may occur at anytime in the work area. It may include treetops breaking out during periods of windy conditions, snow stress, or because of decaying limbs/trunks.

Also included are rolling rocks, logs, and other debris which might become dislodged on steep slopes.

(10) Lightning should be regarded as a serious threat whenever active cumulonimbus’s (thunderhead clouds) are forecast for the area, especially while working near or under tall trees.

(d) Contractor’s Operations shall facilitate Forest Service’s safe and practical inspection of Contractor’s Operations and conduct of other official duties on Contract Area. Contractor has all responsibility for compliance with safety requirements for Contractor's employees. In the event that a conflict develops between the requirements of this contract or agreed upon methods of proceeding hereunder and State or Federal safety requirements, the contract shall be modified and Contractor may request an equitable adjustment.

NOTE: Contractor shall provide a job specific safety plan addressing the hazards identified above and other potential hazards known to the Contractor. The plan shall be presented at the post award conference for discussion when awarded a BPA call.

2.8 Protection of Resources

(1) The Contractor shall be responsible for any damage caused by their personnel and/or equipment to existing structural improvements such as fences, property line monuments, bearing trees, road surfaces, trails, signs, road blocks, drainage structures, water developments, etc. as a result of contract activities. The Contractor, at their expense, shall restore damaged property back to its original condition in a timely manner.

(2) In the event that any cultural or archaeological sites or any threatened or endangered plant species are discovered during operation of the contract, work will be suspended in the immediate vicinity of the site(s) until a reconnaissance survey is completed by the Government.

(3) The Contractor shall protect all known and identified historic and prehistoric sites against destruction, obliteration, removal or damage during contract operations.

(4) The Contractor shall bear all costs of restoration, provided such payment shall not relieve the Contractor from civil or criminal remedies otherwise provided by law.

2.9 Noxious Weed Control

In order to prevent the spread of noxious weeds into the Contract Area, Contractor shall be required to clean all off-road logging and construction equipment prior to entry on to the Contract Area. This cleaning shall remove all soil, plant parts, seeds, vegetative matter, or other debris that could contain or hold seeds. Only logging and construction equipment so cleaned and inspected by the Forest Service will be allowed to operate within the Contract Area. All subsequent move-ins of equipment to the Contract Area shall be treated in the same manner as the initial move in. "Off-road equipment" includes all logging and construction machinery, except for log trucks, chip vans, service vehicles, water trucks, pickup trucks, cars, and similar vehicles.

Contractor shall employ whatever cleaning methods are necessary to ensure that off-road equipment is free of noxious weeds. Equipment shall be considered free of soil, seed, and other such debris when a visual inspection does not disclose such material. Disassembly of equipment components or specialized inspection tools is not required.

Unless otherwise agreed, Contractor shall give the Forest Service at least 24 hours’ notice when equipment is ready for inspection. Notification will include an agreed upon location where the equipment will be available for inspection by the forest service.

New infestations of noxious weeds, of concern to Forest Service and identified by either Contractor or Forest Service, on the Contract Area or on the haul route, shall be promptly reported to the other party.

Contractor and Forest Service shall agree on treatment methods to reduce or stop the spread of noxious weeds when new infestations are found. A current list of noxious weeds of concern to Forest Service is available at each Forest Service office.

SECTION 3: ADMINISTRATIVE MATTERS

3.1 Government Inspection Procedures – Informal (Visual)

(1) The COR, or a designated inspector, will make daily inspections while work is in progress, to assure work is proceeding satisfactorily. The COR, or designated Government Technical Monitor-GTM (inspector), will be present every day for the full duration of operations. Therefore, the Contractor shall not move onto the next section until the COR, or designated GTM, approves the completed work and gives the go ahead to move onto the next area.

(2) The COR or GTM, will determine compliance with contract specifications through informal, 100 percent visual inspections. In the event visual inspection indicates work to be in non-compliance with specifications, prompt corrective action and/ or rework shall be required.

3.2 Key Personnel Requirements

At all times during performance of this contract and until the work is completed and accepted, the

Contractor shall directly superintend the work or assign and have on site a competent representative superintendent who has authority, in writing, to act for the Contractor. This individual shall be able to speak clearly and read proficiently in English.

3.3 Personnel Requirements

All personnel must be well qualified to accomplish the work anticipated for this BPA. If work to be performed requires a license or certification, the professional proposed must meet this requirement.

3.4 Contracting Officer

The CO has the overall responsibility for the administration of this BPA. The CO is authorized to take actions on the behalf of the Government to amend, modify or deviate from the BPA terms, conditions, requirements, specifications, details and/or delivery schedules. However, the CO may delegate certain other responsibilities to his/her authorized representative. The CO is the only individual authorized to direct and/or redirect the effort or in any way amend any of the terms of this BPA. Any changes made by the Vendor without CO authority will be made at the Vendor’s own risk.

The same statements are true for Ordering Contracting Officers (OCO).

3.5 Ordering Contracting Officer

Calls may be issued by other than the BPA CO. Each Ordering Contracting Officer (OCO) will have overall responsibility for the administration of the call. The OCO may appoint, in writing, a Call Level Contracting Officer’s Representative (COR) or Government Technical Monitor (GTM) for technical oversight on a call.

3.6 Contracting Officer’s Representative (COR)

The COR is responsible for administering the performance of work under each call. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of the BPA or call be effective or binding upon the Government unless formalized by proper contractual documents executed by the CO in advance of the change.

Whenever, in the opinion of the Vendor, the COR requests effort outside the scope of the BPA or call, the Vendor should so advise the CO. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

3.7 Government Technical Monitor (GTM)

The OCO may delegate duties for inspection and contract compliance to a Government Technical Monitor (GTM). The GTM is responsible for checking the Vendor's compliance with the technical specifications and call terms and conditions. The delegation must be in writing and provided to the Vendor.

3.8 Invoice Instructions

SECTION 4: CALL PROCEDURES

4.1 Competition

This BPA call has been inserted into the parent BPA solicitation for competitive pricing and to help determine fair and reasonable pricing for the parent BPA. The pricing that is provided in this solicitation will be used to make multiple BPA call awards of urgent danger/hazard tree removal on federal lands in Oregon.

4.2 Call award

Once an award determination has been made, a legally binding, firm fixed-price call will be issued to the successful BPA vendor signed by the Ordering Contracting Officer. No work will begin until the Vendor has received a signed call.

All BPA Calls are subject to the terms and conditions of the parent Blanket Purchase Agreement

(BPA). In the event of conflict between a BPA Call and the parent BPA, the parent BPA shall control.

SECTION 5: TERMS AND CONDITIONS

5.1 FAR CLAUSES (Federal Acquisition Regulations)

Some of these clauses are in the parent BPA but are being included in this BPA call to reiterate their importance.

FAR 52.228-5 -- INSURANCE -- WORK ON A GOVERNMENT INSTALLATION (JAN

1997)

(a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract.

(b) Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government’s interest shall not be effective --

(1) For such period as the laws of the State in which this contract is to be performed prescribe;

or

(2) Until 30 days after the insurer or the Contractor gives written notice to the Contracting

Officer, whichever period is longer.

(c) The Contractor shall insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The Contractor shall maintain a copy of all subcontractors’ proofs of required insurance and shall make copies available to the Contracting Officer upon request.

FAR 52.237-1 SITE VISIT (APR 1984)

Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

FAR 52.247-21 CONTRACTOR LIABILITY FOR PERSONAL INJURY AND/OR

PROPERTY DAMAGE (APR 1984)

(a) The Contractor assumes responsibility for all damage or injury to persons or property occasioned through the use, maintenance, and operation of the Contractor’s vehicles or other equipment by, or the action of, the Contractor or the Contractor’s employees and agents.

(b) The Contractor, at the Contractor’s expense, shall maintain adequate public liability and property damage insurance during the continuance of this contract, insuring the Contractor against all claims for injury or damage.

(c) The Contractor shall maintain Workers’ Compensation and other legally required insurance with respect to the Contractor’s own employees and agents.

(d) The Government shall in no event be liable or responsible for damage or injury to any person or property occasioned through the use, maintenance, or operation of any vehicle or other equipment by, or the action of, the Contractor or the Contractor’s employees and agents in performing under this contract, and the Government shall be indemnified and saved harmless against claims for damage or injury in such cases.

AGAR CLAUSES (Agriculture Acquisition Regulations)

AGAR 452.228-71 INSURANCE COVERAGE (NOV 1996)

Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence.

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and 500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

AGAR 452.236-74 CONTROL OF EROSION, SEDIMENTATION, AND POLLUTION

(NOV 1996)

A. Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).

B. Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams, or impoundments; or into natural or man-made channels. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.

C. Mechanized equipment shall not be operated in flowing streams without written approval by the Contracting Officer.

AGAR 452.236-77 EMERGENCY RESPONSE (NOV 1996)

(a) Contractor's Responsibility for Fighting Fire. (1) The Contractor, under the provisions of FAR clause 52.236-9, PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND IMPROVEMENTS, shall immediately extinguish all fires on the work site other than those fires in use as a part of the work. (2) The Contractor may be held liable for all damages and for all costs incurred by the Government for labor, subsistence, equipment, supplies, and transportation deemed necessary to control or suppress a fire set or caused by the Contractor or the Contractor's agent or employees.

(b) Contractor's Responsibility for Notification in Case of Fire. The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site.

(c) Contractor's Responsibility for Responding to Emergencies. When directed by the Contracting Officer, the Contractor shall allow the Government to temporarily use employees and equipment from the work site for emergency work (anticipated to be restricted to firefighting). An equitable adjustment for the temporary use of employees and equipment will be made under the CHANGES clause, FAR 52.243-4 or FAR 52.212-4 (c) Changes.

AGAR 452.211-5 PERIOD OF PERFORMANCE (FEB 1988)

The period of performance of this BPA call is from date of award through December 30, 2020.

It is imperative that work begins withing 1-3 business days upon receipt of the Notice to Proceed as this is a time sensitive project.

AGAR 452.215-73 POST AWARD CONFERENCE (NOV 1996)

A post award conference with the successful offeror is required. It will normally be scheduled within 1-3 days after the date of contract award. The conference will be held at the TBD.

5.2 Loss, Damage or Destruction

For equipment furnished under this agreement WITH operator, the Government shall not be liable for any loss, damage or destruction of such equipment, except for loss, damage or destruction resulting from the negligence, or wrongful act(s) of Government employee(s) while acting within the scope of their employment. The operator is responsible for operating the equipment within its operating limits and responsible for safety of the equipment.

Resources furnished under this agreement may be operated and subjected to extreme environmental and/or strenuous operating conditions which could include but is not limited to unimproved roads, steep, rocky, hilly terrain, dust, heat, and smoky conditions. As a result, by entering into this agreement, the contractor agrees that what is considered wear and tear under this agreement is in excess of what the resource is subjected to under normal operations and is reflected in the rates paid for the resource.

5.3 Final Cleanup

Before final acceptance, all areas occupied by the Contractor in connection with the work shall be cleaned of all Contractor's rubbish, trash (could include chemical containers, used engine oil, oil filters, oil cans, grease cartridges), refuse, excess materials, temporary structures, and equipment, and all parts of the work area shall be left in a neat and presentable condition.

5.4 Project Conduct

It is extremely important that inappropriate behavior be recognized and dealt with promptly.

Inappropriate behavior is all forms of harassment including sexual and racial harassment.

HARASSMENT IN ANY FORM WILL NOT BE TOLERATED. Nonprescription unlawful drugs and alcohol are not permitted at the project site. Possession or use of these substances will result in the Contractor being released from the Project. Though Marijuana and CBD may be legal in the state of Oregon they are NOT allowed on Federal property or while working on a Federal contract.

Federal law categorizes Marijuana as a controlled substance under Schedule 1 under the Controlled Substance Act, meaning knowingly or intentionally possessing the drug is illegal. Drug or alcohol abuse resulting in unfitness for duty will normally result in the Contractor being released from the incident. During off-project periods, personnel are responsible for proper conduct and maintenance of fitness for duty. Sexual harassment is defined as unwelcome sexual advances, request for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment when (1) submission to such conduct is made either explicitly or implicitly a term or condition of an individual's employment, (2) submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual, or (3) such conduct has the purpose or effect of unreasonably interfering with an individual's work performance or creating an intimidating, hostile, or offensive working environment.

5.5 Suspension for Other Than Government Convenience

The Contracting Officer may issue orders to suspend work wholly or in part for such periods of time as deemed necessary because of: 1) Weather or ground conditions when further prosecution of the work might cause environmental or resource damage to the project, access roads, or adjacent property. Such actions would include but are not limited to instances such as siltation of streams, damage to access roads, rutting of project roads which causes otherwise suitable soils to become muddy or unsuitable for further work; or 2) failure of the Contractor to comply with specifications such as but not limited to: height of material on the ground following treatment, damage to leave trees, operating equipment not meeting fire requirements, or when conditions exist which do not meet safety requirements. Whether or not a suspend work notice is issued, the Contractor shall be responsible for correcting any damage caused by his/her operation, whether inside or outside project limits, at no cost to the government. Such suspensions shall not be considered as suspensions for the Convenience of the Government under FAR 52.242-14 Suspension of Work, and shall not qualify for equitable adjustment.

5.6 Safety and Insurance

Contractor’s insurance shall cover all employee accidents as specified by state law. The Contractor shall provide first aid to employees when needs arise due to work under this contract. In life threatening situations, first aid may be given by the Government and further medical aid will be charged back to the Contractor. If a crew person becomes ill or injured while working under this contract and requires transport to medical facility or hospital, the costs shall be at the Contractor’s expense. If a crew person is ill or injured while under this contract, the crew person could be evacuated by the Government at Contractor expense.

5.7 Protection of Resources

The Contractor shall be responsible for any damage caused by their personnel and/or equipment to existing structural improvements such as fences, property line monuments, bearing trees, road surfaces, trails, signs, road blocks, drainage structures, water developments, etc. as a result of contract activities. The Contractor, at their expense, shall restore damaged property back to its original condition in a timely manner.

In the event that any cultural or archaeological sites or any threatened or endangered plant species are discovered during operation of the contract, work will be suspended in the immediate vicinity of the site(s) until a reconnaissance survey is completed by the Government.

The Contractor shall protect all known and identified historic and prehistoric sites against destruction, obliteration, removal or damage during contract operations.

The Contractor shall bear all costs of restoration, provided such payment shall not relieve the Contractor from civil or criminal remedies otherwise provided by law.

5.8 Commencement Prosecution, And Completion Of Work

The Contractor shall be required to (a) commence work under this contract within 1-3 business days after the date the Contractor receives the Notice to Proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than December 30, 2020. The time stated for completion shall include final cleanup of the premises. Estimated date notice to proceed will be issued is October 19, 2020.

5.9 Use of Premises

The Contractor shall comply with the regulations governing the operation of premises which are occupied and shall perform the contract in such a manner as not to interrupt or interfere with the conduct of Government business.

Before any camp is opened or operated on National Forest land or lands administered by the Forest Service, written permission shall be obtained through the Contracting Officer.

A camp is interpreted to include the camp site or trailer parking area of any employee working on the project for the Contractor. Such permission, if granted, will be without charge to the Contractor.

The Contractor shall request permission (in writing) from the appropriate Ranger District to use campsites. If permission is granted, the District Ranger's letter shall specify all conditions and requirements.

It is further stipulated that in addition to clean-up of any camp sites, the Contractor is required to remove all his equipment from National Forest land before final acceptance and payment of the project.

Portable chemical toilets, self-contained holding tanks, approved pit or vault toilets which meet State Code are required.

5.10 Storage of Materials and Equipment

Materials shall be stored to assure the preservation of their quality and fitness for work. Approved portions of the right-of-way or other areas on Government land may be used for storage purposes.

All storage sites approved by the Government shall be restored to a satisfactory condition at the Contractor's expense

5.11 Use of Roads By Contractor

The Contractor is authorized to use all roads under the jurisdiction of the Forest Service that are open and necessary for direct route access to the contract work sites for all activities necessary to complete each BPA Call. This authorization is subject to the limitations described below, when such use will not damage the roads or national forest resources, and when traffic can be accommodated safely.

Keep existing roads open to all traffic during contract work and maintain them in a condition that will adequately accommodate traffic. Perform no work that interferes or conflicts with traffic or existing access to the roadway surface until a Written Plan or approval has been received for the satisfactory handling of traffic. Provide and post Traffic Control Signs and Devices in conformance with the “Manual on Uniform Traffic Control Devices” (MUTCD), if applicable. Do not proceed with work on the project until all required signs are in place.

Before shutting down any operations, leave all travel ways in a condition suitable for traffic.

Unless otherwise provided, traffic delays may not exceed 30 minutes.

5.12 Notification of Subcontracting

The Contractor shall notify the Contracting Officer prior to entering into any subcontract arrangement. The subcontractor shall have the experience and be equipped for such work. The written notification shall include as a minimum:

(a) The name, address, and telephone number of the subcontractor.

(b) The date upon which the subcontract was entered into and its duration

(c) A detailed description of the work being subcontracted including a listing of contract items, units, etc., as appropriate.

(d) Documentation of the subcontractor's representative authority.

Subcontracting any portion of the contract shall not relieve the Prime Contractor of any responsibility under this contract. Any subcontract agreement shall contain all terms and conditions of the prime contract.
