12405B24Q0408, SNARC outfall evaluation and ADEQ permit modification DOCUMENTS TO BE INCLUDED IN QUOTE: In order to be considered for award Offerors shall provide 1) a Quote on company letterhead detailing the item description, unit price per item, discounts for trade-ins, total price and valid for at least 60 days after receipt of quote; and 2) FAR 52.212-3, OFFEROR REPRESENTATIONS AND CERTIFICATION-COMMERCIAL GOODS AND COMMERCIAL SERVICES; The Representation and Certification section must be completed electronically in the System for Award Management (SAM) website at www.sam.gov.

REJECTION OF QUOTATION: Failure to demonstrate compliance will be caused to reject the quote without further discussions. All responsible sources may submit an offer and will be considered.

AGAR Clauses 452.204-70 Modification for Contract Closeout

As prescribed in USDA’s Contracting Desk Book 404.804 and 413.302-5, insert the following clause:

MODIFICATION FOR CONTRACT CLOSEOUT (DEVIATION JULY 2022)

“Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to FAR part 13,

(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a Release of Claims be completed by the contractor, although not required for contract and orders using SAP.) If the bilateral modification and Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.”

QUOTED PRICE MUST INCLUDE: any delivery costs as well as any applicable duties, brokerage, or customs fees.

DELIVERY DUE DATE: The Government requires delivery on or before 120 ARO, however, each offeror shall include their proposed delivery schedule as part of their quotation.

PAYMENT: Any award made under this solicitation is subject to 31 CFR Part 208 which requires all payments made by the government to be made by electronic funds transfer.

Contractors intending to conduct business with the Federal Government MUST register with the System for Award Management (SAM) database prior to submitting quotation. You may register online at www.sam.gov. Any amendment and documents related to this procurement will be available electronically at the Internet site: http://www.SAM.gov.

The government anticipates award of a firm fixed priced contract resulting from this solicitation to the responsible offeror whose offer conforms to the specifications that will be the most advantageous to the government in accordance with FAR 13.106-2. Responses shall include technical specifications, descriptive material and capabilities of the offeror’s equipment. Offerors shall identity where the offered item meets or does not meet each of the Government's functional and performance minimum specifications listed herein.

FAR 52.212-2, Evaluation-Commercial Products and Commercial Services, the significant evaluation factors, in the relative order of importance, are (i) technical capability of the item offered to meet the Government requirement including delivery date; (ii) past performance; and (iii) price, based on F.O.B. Destination. Award will be made based on overall BEST VALUE to the Government.

The government anticipates award of a firm fixed priced contract resulting from this solicitation to the responsible offeror whose offer conforms to the specifications that will be the most advantageous to the government in accordance with FAR 13.106-2. Responses shall include technical specifications, descriptive material, and capabilities of the offeror’s equipment. Offerors shall identity where the offered item meets or does not meet each of the Government's functional and performance minimum specifications listed herein.

A site visit is scheduled for Wednesday September 4, 2024, at noon until 3:00pm CT.

Questions regarding this combined synopsis/solicitation are due no later than 4:00 PM CT on September 5, 2024. Answers to any questions received by that time will be posted as an amendment to this combined synopsis/solicitation.

Quotes must be received no later than September 12, 2024, at 4:00pm Central Time.

Project Title: Outfall Design and NPDES Permit Modification for NPDES permit AR0049352 Location: Stuttgart National Aquaculture Research Center 2955 Hwy 130 East, Almyra, AR 22003 Project Description:

The USDA ARS SNARC is in need of discharge design modifications to better comply with monitoring parameters in NPDES permit AR0049352 while still meeting the operations needs of the facility. The project will consist of three main components:

1. Evaluate current outfall, redesign and develop plans to separate the currently permitted sanitary and aquaculture process outfalls.

2. Design an EPA compliant disinfection process for the separated sanitary and process outfalls meeting the facilities needs and regulatory requirements.

3. Modify the existing National Pollutant Discharge Elimination System (NPDES) permit to reflect the new outfall designs and discharge characteristics.

Scope Of Work:

1. Conduct on-site investigations, permit reviews, and evaluate current needs to optimize outfall discharges meeting all regulatory requirements.

2. Prepare construction drawings and specifications for changes needed.

3. Develop a draft permit modification application that incorporates the new outfall designs and discharge characteristics. This will include:

a. Updating the facility description to reflect the new outfalls.

b. Providing detailed information on the outfall design, construction materials, and location.

c. Revising discharge limitations and monitoring requirements, if necessary, based on the new outfall configuration.

4. Preparing any other information required by the permitting agency.

5. Coordinate with the permitting agency throughout the modification process.

6. Prepare responses to any agency comments or requests for additional information.

7. Obtain final approval of the NPDES permit modification from the permitting agency.

Deliverables:

1. Outfall design report with drawings and specifications.

2. NPDES permit modification application package.

3. Final approved NPDES permit.

Schedule:

A detailed project schedule will be developed upon contract award. The anticipated timeline will consider factors such as site investigation complexity, permitting agency review times, and construction lead times.

Acceptance Criteria:

The project will be considered successful upon achieving the following:

1. The outfall design meets all technical requirements and regulatory standards.

2. The NPDES permit modification is approved by the permitting agency.

3. All deliverables are completed according to the SOW and approved by the assigned contracting officer.

Change Orders:

Any changes to the scope of work identified during project execution will require a written change order signed by both parties. The change order will detail the specific changes, associated costs, and impact on the project schedule.
