This Amendment Address questions from the industry.

Amendment 1

This amendment addresses questions from the industry call held on 12/21/2020 at 1:30 pm EST.

1. Why were there not Spec attached to the solicitation?

The USDA will not be using their spec, the USDA will be asking the industry for their product spec and we will evaluate the product spec to see if it will fit into any of our programs.

2. Why were there not delivery dates on the solicitations?

Delivery dates will be determined after the USDA see what the industry has available, at which time the USDA will ask vendors what they can delivery at what time.

3. Will I be able to submit a proposal with 6/10 cans?

Yes, you will be able to submit a proposal for any size up to a 6/10 can.

4. How is Phase 1 entered into WBSCM? Since we are not entering specific ship to pricing or item pricing, will we be exporting / importing the Excel document and attachments?

There is a solicitation (2000007473) that a vendor will be able to use the directions we attached and go into the solicitation and upload their BOA.

5. How will you notify vendors if our BOA accepted?

In 3.1.8 of the BOA acceptances could be commutated by email, telephone or signed SF 30.

6. If through this solicitation we sell something to the USDA that you do not have specs for, what does the inspection service grade the product against?

Inspection service will use the vendor’s commercial items description list and the ingredients list to evaluate the product.

7. Current pack year (page 6). We have 2019 and 2020 pack. Will you accept 2019 pack?

We have taken current pack year language out of the BOA so vendors will tell the USDA what pack years they have available and the Government will determine if the pack year will meet the program needs.

8. Waiver – you list excusable delays (page 9) include “epidemics, quarantine restrictions…, delays of common carriers.” Are waivers acceptable that fall within these delays? What kind of proof is required within our waiver request?

The USDA will consider any documentation a vendor has such as newspaper articles, letters from the Health department or notices to the public on company letterhead.

9. We will be quoting full truckload pricing – “Quantities procured by the Government may be less than full truckloads quantities”. (page 6). How will we be notified if a load is less than truck load quantities, as that will affect the freight rate/pricing.

Any delay will be looked at by the Government on a case by case bases.

10. How do you add or remove items on your BOA as inventory positions change?

Vendors will be able to access the BOA in WBSCM to update with their current inventory,
