About this file

This is a Questions and Answers (Q&A) document for Request for Quote (RFQ) 123A9426Q0055, issued September 16, 2026, addressing vendor inquiries regarding a Total Small Business Set-Aside for analytical laboratory instrument manufacturing under NAICS 334516.

The document clarifies four key procurement requirements: (1) A class waiver for the Nonmanufacturer Rule has been granted for laboratory equipment under NAICS 334516, permitting large businesses to supply end items, meaning items do not require small-business manufacturer status; (2) Thermo Scientific brand-name products are acceptable when offered by small-business resellers without separate manufacturer authorization, provided the reseller meets FAR 52.219-33 Nonmanufacturer Rule requirements and the quotation clearly documents the specified configuration and required warranty; (3) Per FAR 52.204-7, offerors must maintain active SAM.gov entity registration at the time of quotation submission and again at award; and (4) There is no blanket requirement for U.S. manufacturing of all quoted equipment beyond standard FAR Part 25 clauses (Buy-American, Trade Agreements) incorporated in the solicitation package, with offerors required to comply only with those specific country-of-origin clauses as specified in the solicitation.

Request for Quote (RFQ) 123A9426Q0055 Vendor Questions

September 16, 2026

1. Because this is a Total Small Business Set-Aside under NAICS 334516 and the specified/equal equipment may be manufactured by a large business, has SBA granted a Nonmanufacturer Rule waiver for this acquisition, or must the end items be manufactured by a qualifying small-business manufacturer?

A class waiver for nonmanufacturer rule has been granted for laboratory equipment under NAICS 334516 (Analytical Laboratory Instrument Manufacturing) ,meaning a large business may supply the end items under the SBA’s waiver (13 CFR 121.1202;

GovInfo 2010). Therefore, the end items do not have to be manufactured by a qualifying small-business manufacturer.

2. Are Thermo Scientific brand-name products acceptable without a separate manufacturer authorization letter if oƯered by a small-business reseller, provided the quotation documents the exact required configuration and warranty?

OƯering Thermo Scientific brand equipment via a small-business reseller is permissible without a separate manufacturer authorization letter, provided the reseller meets FAR 52.219-33 Nonmanufacturer Rule requirements (i.e., primarily engaged in trade, takes ownership, provides U.S.-made end items). As long as the quote clearly documents the specified configuration and includes the required warranty, the brand-name oƯering is acceptable.

3. Is an active SAM.gov entity registration required at the time the quotation is submitted, or only prior to award? Please identify the applicable solicitation provision if possible.

Per FAR 52.204-7, the oƯeror must be registered in SAM at the time the quotation is submitted, and again at award.

4. Please confirm whether all quoted equipment must be manufactured in the United States, or whether country-of-origin requirements are limited to the clauses incorporated in the solicitation package.

There is no blanket requirement that all quoted equipment be manufactured in the U.S. beyond the standard clauses incorporated in the solicitation. Buy-American, Trade Agreements, and related FAR Part 25 clauses set forth the applicable country-of-origin rules. OƯerors should comply only with those clauses as specified in the solicitation.
