About this file

This document contains answers to vendor questions regarding a federal solicitation for a data quality contract. The solicitation seeks assistance evaluating and improving data quality in the Food Safety Inspection Service's data systems. The work involves utilizing test systems, assessing data tables for issues, and writing SQL code to resolve quality problems. Python, R, and SQL are the primary tools, along with Microsoft Office. The period of performance is one year. There are three contract line items covering full-time and part-time resources, though the part-time requirements are unclear. The statement of work lacks detail on the different line items and whether personnel qualifications vary. The resume requirements and number of key personnel are also ambiguous. Clarification is requested on these patent ambiguities by the proposal deadline of September 28, 2022.

Text version

Page 2 of the solicitation lists two options, CLINs 0002 and 0003. 0003 is identified as "Part-time" but there is not elaboration of how many hours per week or month constitutes part-time, nor what either CLIN is supposed to do, as distinguished from CLIN 0001. While there is a performance period for 0001 (until September 30, 2023), there is no performance period specified for either CLINs 0002 and 0003.

These are Option CLINs with the hours being 2080 and 1040 respectively. The period of performance would happen during the base year.

Page 4 if the solicitation states that CLINs 0002 and 0003 are also for the "Base Year", but does not specify what "part-time" constitutes for CLIN 0003, nor does it distinguish the scope of CLINs 0002 or 0003 from CLIN 0001.

The scope of the CLINs is the same.

Page 5, B.7 PERIOD OF PERFORMANCE (FEB 2007) states, "The total period of performance shall not exceed 12 months", but does not suggest why there are 3 separate CLINs for the work.

There are three separate CLINs in the event that the government has the budget/ability to add more personnel to the effort.

The SOW on pp. 30-42 do not mention there being more than just the "Key Personnel" (Section 7.0, pp. 38-39), which is presumable CLIN 0001. Therefore the SOW does not provide information on CLINs 0002 and 0003, what they are, what they are for (their respective scope), or what constitutes "Part-time" for CLIN 0003 (that is, how many hours is part-time?).

There is one Key Personnel associated with this effort; the other two CLINs are options.

SOW 7.0, pp. 34-35, states, "The efforts associated with all tasks described above shall be provided for a base period of 12 months and four 12-month option periods." Yet, there are no CLINs to price the four 12-month option periods since CLINs 0002 and 0003 are in the base period. Also there is a clear patent ambiguity in the actual period of performance because of B.7 vs. SOW 7.0.

We are not asking for option years. This is a mistake in the document.

This patent ambiguity raises the following issues: Is the period of performance one year or one year plus 4 option periods? What do CLINs 0002 and 0003 represent? Do CLINs 0002 and 0003 have the exact same requirements/personnel qualifications as CLIN 0001? How many hours per week or month, should a part-time resource work? Are each of CLINs 0001, 0002, and 0003 to be Key Personnel?

The second patent ambiguity concerns the resume:

SOW 7.0 Contractor's Key Personnel, p. 39, states, "The resume shall explain, in detail; the qualifications of the proposed personnel to include how they meet the qualifications outlined in the statement of work."

Solicitation, p. 43 states, "The contractor must clearly present the separate credentials of each proposed key personnel and must provide a concise summary of each individual’s separate duties and responsibilities as proposed for this project."

SOW 7.0 is worded to suggest there is only one key personnel. However, p. 43 suggests there are multiple key personnel, possibly one for each of CLINs 0002 and 0003, also. Furthermore, there is patent ambiguity in whether the phrase "duties and responsibilities as proposed for this project" on p. 43 and "qualifications outlined in the statement of work" on p. 39 are referring to the same thing, and whether that thing is either the 10 bullet points of SOW 7.0 pp. 38-39, or if it refers to the duties and responsibilities of the SOW 3.0 Technical Requirements / Tasks, pp. 32-34, Tasks 1 through 4.

There is one Key Person; however, submit resumes for the options CLINs as well.

This patent ambiguity raises the following issues: Is there just one key personnel or is there a separate key personnel for each of the three CLINs? If the latter, are the personnel requirements identical for all three? Is the "Personnel Submission", which are the resume(s) supposed to show what each of the key person(s) is supposed to do with regard to Tasks 1 through 4? Or are the resume(s) supposed to show how each of the person(s) meets the 10 bulleted requirements of SOW 7.0?

There are three key personnel, and each person needs to meet all of the requirements.

Given the proposal submission deadline, I request you address the above two patent ambiguities as soon as possible.
