1. DESCRIPTION/STATEMENT OF WORK
Refer to scope of work for details of each Contract Line Item Number (CLIN) treatment area Acres are estimated pending availability of funds.
Basis of Award: One contract will be awarded to the most qualified responsive responsible bidder. The following factors will be considered: past experience, past performance, technical approach, price most advantageous to the government.
Successful contractor must be registered in SAMS prior to award.
2. SPECIFICATIONS:
Brief Description of the Work Requirement Brief Description of the Work Requirement The intent of this contract is to use Forest Service approved herbicides to control non-native invasive plants (NNIP) within Forest Service gravel pits and adjacent to gravel pits on National Forest System (NFS) lands across the Eagle River-Florence and Lakewood-Laona Ranger Districts of the Chequamegon-Nicolet National Forest.
CLIN 1,2, & 3 East Zone Gravel Pit Treatment: Treatment of 100 infested acres, 100 gross acres, of NNIP infestations including but not limited to, spotted knapweed (Centaurea stoebe), Canada thistle (Cirsium arvense), marsh thistle (Cirsium palustre), bull thistle (Cirsium palustre), wild parsnip (Pastinaca sativa), reed canarygrass (Phalaris arundinacea), and common tansy (Tanacetum vulgare), occurring within 23 gravel pits on NFS lands across the Eagle River-Florence and Lakewood-Laona Ranger Districts in Florence, Long Lake and Tipler Townships, Florence County, WI, Argonne, Armstrong Creek, Alvin, Blackwell, Hiles, Popple River and Ross, Wabeno Townships, Forest County, WI, Lakewood, Townsand, Mountain, and Riverview Townships, Oconto County, WI, Phelps Township, Vilas County, WI, and Three Lakes Township, Oneida County, WI in 2027 (CLIN 1), 2028(CLIN 2) and 2029 (CLIN 3) with option years 2030 and 2031 (CLIN 4&5) (see Attachment 1-CLIN 1,2, and 3 East Zone Gravel Pit NNIS Treatment Infestations and Attachment 2 -CLIN 1, 2, and 3 East Zone Gravel Pit NNIS Treatment Maps). Treatment shall occur when the majority of NNIP species are either in the rosette, vegetative, or bolting/early flowering stages, which is anticipated to be between the beginning of June until Mid-August. Gross acres are the total area that is covered by the invasive species infestation. Infested acres are the gross acres multiplied by the percent cover of the invasive species at a site.
For example, if an invasive species covers 5 acres of ground, but only infests 10 percent of this area, the infested acres are 0.5 acres.
Treatment Requirements
Infestations of non-native invasive species are highly variable depending on the gravel pit and species and can range from small and scattered too large and dense. The gravel pits will need to be traversed and treated in their entirety, as depicted on the attached maps (Attachments 2). Gravel pits may be adjacent to non-National Forest System lands with non-native invasive species infestations occurring across multiple ownerships. Treatment of non-National Forest System lands is not part of this contract. Boundary lines are often difficult to locate on the ground, and use of GPS is the only reliable method to determine property boundaries with any accuracy.
The contractor will treat NNIP infestations with herbicides that have been approved by the Forest Service and include triclopyr, metsulfuron methyl, glyphosate, aminopyralid, imazapic, and clopyralid. The Contractor is responsible for using the correct chemical and mixture for the contract area in accordance with manufacturer’s instructions and any applicable laws or regulations. All herbicide mixes must also include a dye to indicate
12363N26Q4152 EAST ZONE NNIS TREATMENT Page 3 of 50
Revised 04/27/2026 Page 4 of 13 where herbicides have been applied. Site inspections will be conducted during and after contract implementation to check on target species applications.
The Contractor is responsible for treating all NNIP infestations as depicted on the included maps, as well as NNIP infestations found incidentally during treatments (see Attachment 2-CLIN 1, 2, and 3 East Zone Gravel Pit NNIS Treatment Maps). The Contractor is required to submit GPS coordinates of new NNIP infestations not previously inventoried.
This contract will allow the use of ATVs on designated roads and trails with a spray wand and tank, as well as backpack sprayers and handheld sprayers. Other methods of application may be acceptable with prior approval of the COR. Since native vegetation is abundant in most contract areas, the contractor shall spot spray target plants, exercising caution to avoid spraying non-target native plants and minimizing the drift from herbicide application. Large scale broadcast spraying will not be allowed. If ATVs are to be used, the Contractor shall bring clean (free of mud and plant parts) ATVs to the Forest.
The Contractor will keep a daily treatment log (see Attachment 3-Treatment Forms) of work activities. The treatment log will include date, location, target NNIP, herbicide used, mix rate, quantity of herbicide used, adjuvants used, approximate acreage covered, number of man-hours, and weather conditions (temperature, wind direction, and wind speed). The treatment log must be submitted with the final bill. Complete payment will not be made without the treatment log.
The Contractor will need to possess a GPS unit capable of loading the NNIP infestations, both polygon and point shapefiles. Both maps and geospatial data (polygon and point shapefiles) will need to be used to properly identify the extent of NNIP infestations on the ground (see Attachment 2-CLIN 1, 2, and 3 East Zone Gravel Pit NNIS Treatment Maps).
Performance Requirements
The Contractor and/or whomever will supervise the herbicide treatments must possess a current Wisconsin pesticide applicators license at the time of the treatment. The Contractor must also possess a current Commercial Pesticide Application Business License. Information on Wisconsin pesticide certification is available from the following sources:
• Wisconsin Department of Agriculture, Trade, and Consumer Protection (WDATCP). P. O. Box 8911 Madison, WI 53708. 608- 224-4560 http://www.datcp.state.wi.us/arm/agriculture/pest-fert/pesticides/licenses/comm_app_cert.jsp
• University of Wisconsin-Extension, Department of Agronomy, 1575 Linden Drive, Madison, WI 53706.
608-262-7588. http://ipcm.wisc.edu/PAT/ The Contractor shall furnish all labor, equipment, herbicides, carriers, herbicide dye, supervision, transportation, supplies, and incidentals. The Contractor shall periodically report treatment progress to the COR.
A designated Contract Inspector will also regularly visit with the Contractor on site, checking that the treatments are progressing and following the specified methods.
The Contractor and any employees must follow all label safety requirements and recommendations. At a minimum, this would require all applicators and handlers to wear long-sleeved shirts and long pants, eye-protection, chemical-resistant gloves, and shoes plus socks. Contractor must have clean water and soap for applicators and handlers to be able to wash their hands. Contractor must also provide enough clean water to provide first aid in case of eye contact with herbicide. This would include clean water to rinse eyes for 15-20 minutes.
Contractor will mix herbicides in accordance with manufacturers’ instructions and any applicable laws or regulations. The contractor is responsible for the cleanup of any spills and will notify the COR immediately of any spills.
It is preferred that the contractor possesses a working mobile phone to be able to contact the Forest Service as needed and/or emergency personnel if necessary. The Contractor will need to possess a GPS unit capable of loading gravel pit polygons. Both maps and GPS data will be used to properly identify the extent of the gravel pit and the area to be treated.
The Contractor and all treatment staff must be able to identify all target NNIP at all life stages in the field.
The Contractor shall progressively accomplish the work at a rate that will result in completion of the contract

Revised 04/27/2026 Page 5 of 13 within the time specified.
Government Furnished Resources
The Contractor will be provided a geospatial file, point and/or polygon shapefiles of the NNIP infestations to be treated. Copies of maps and the daily treatment form can be provided upon request. If deemed necessary by the Contractor and the COR, the Contractor will be issued a USFS Yale key to access infestations behind locked gates. This will require the Contractor to sign a USDA-Forest Service Personal Custody Property Receipt and acknowledge financial responsibility for the value of items lost or damaged. The USFS Yale key shall be returned with the daily treatment forms and final bill. Complete payment will not be made until both are submitted to the COR.
Security and Other Special Requirements No special security requirements.

March 2025 Class Deviation
This Call Order incorporates two FAR class deviations to ensure compliance with Executive Orders 14148, 14173, 14168, and 14208, issued since January 20, 2025. It also removes references to AGAR clauses and provisions that have been rescinded. These updates reflect recent policy changes and remove outdated requirements, as detailed below.
The following FAR provisions and clauses are hereby removed in their entirety from the LMIR BPA:
• 52.222-21 Prohibition of Segregated Facilities
• 52.222-26 Equal Opportunity
• 52.222-55 Minimum Wages for Contractor Workers Under Executive Order 14026/1
1/This provision was removed to comply with the Executive Order 14236 titled "Additional Rescissions of Harmful Executive Orders and Actions," dated March 14, 2025.
The following FAR clauses now include deviations to align with recent Executive Orders:
• 52.212-3 Offeror Representations and Certifications—Commercial Products and Commercial Services (MAY
2024) (DEVIATION FEB 2025)

• 52.223-2 Reporting of Biobased Products Under Service and Construction Contracts (MAY 2024) (DEVIATION FEB
2025)
Ther following references to AGAR Clauses and provisions are hereby removed to comply with AGAR Rule
2024-22463 (89 FR 81014):
• AGAR 452.211-74 Period of Performance (FEB 1988)/2
• AGAR 452.215-73 Post Award Conference (NOV 1996) /2
• AGAR 452.219-70 Size Standard and NAICS Code Information (SEP 2001) /2

• AGAR 452.236-77 Emergency Response (NOV 1996)
• AGAR 452.236-78 Fire Suppression and Liability (MAY 2014)
• AGAR 452.237-74 Key Personnel (FEB 1988) /2
2/AGAR clauses and provisions that were included in full text have been retained, with only the AGAR reference removed.
The following AGAR clauses is hereby included:
• AGAR 452.236-70 Emergency Response, Fire Suppression and Liability (NOV 2024)
The following FAR and AGAR clauses have been added, effective April 2026:
• FAR 52.222-90, Addressing DEI Discrimination by Federal Contractors (APR 2026).
• AGAR Clause 452.203-72 Unenforceable Supplier Terms (APR 2026)
All call orders will incorporate these changes by reference at award.
Disclaimer: System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in agency solicitations.
Examples include 52.222-25, Affirmative Action Compliance, and paragraph (d) of 52.212-3, Offeror

Representations and Certifications—Commercial Products and Commercial Services. Contracting officers will not consider these representations when making award decisions or enforce requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.
In advancement of Section 2 of Executive Order 14208, the removal of requirements related to Executive Order 14057 eliminates all non-statutory sustainability requirements or preferences in purchases of food service wares, including paper straws. In addition to removing requirements related to Executive Order 14057, the attachment also reflects recent updates to Code of Federal Regulation citations for the U.S. Department of Agriculture’s BioPreferred® Program, a statutory purchasing preference program.
These class deviations will remain in effect until rescinded or incorporated into the FAR.

As prescribed in AGAR 433.104-4 (a)(5)(ii), the following Notice for Filing Agency Protests shall be included in every solicitation.
NOTICE FOR FILING AGENCY PROTESTS
United States Department of Agriculture (USDA) Ombudsman Program
The USDA is committed to issuing solicitations and awarding contracts in a fair and prompt manner. The Ombudsman Program for Agency Protests (OPAP) was established to address protest issues within the agency, providing an alternative to costly and time-consuming litigation. Operating independently, OPAP offers relief comparable to that granted by the Government Accountability Office (GAO). Interested parties are encouraged to resolve concerns through USDA’s internal Alternative Dispute Resolution (ADR) process before pursuing external forums such as the GAO. Concerns may be addressed informally or through a formal agency protest filed with either the Contracting Officer or the Ombudsman.
Informal Forum with the Ombudsman
1. Initial Point of Contact: Interested parties who believe a specific USDA procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer.
2. Escalation: If the Contracting Officer is unable to address their concerns, interested parties are encouraged to contact the USDA Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Utilization of the informal forum does not suspend any time requirement for filing a formal protest with the agency or other forums.
3. Required Information: To ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman
1. Effort to Resolve: Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions.
2. Independent Review: If the protester’s concerns remain unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest with either the Contracting Officer or, alternatively, with the Ombudsman under the OPAP program. Contract awards or performance will be suspended during the protest period unless justified in writing for urgent and compelling reasons or determined in writing to be in the best interest of the Government.
3. Resolution Timeline: The agency’s goal is to resolve protests within 35 calendar days from the date of filing.
4. Required Information: Protests shall include the information set forth in FAR 33.104(a)(3). Failure to submit the required information may result in a delay or dismissal of the protest.
5. Timeliness: Protests must be filed within the timeframes specified in FAR 33.104.
6. Submission: Formal protests under the OPAP program should be submitted electronically to SPE.inquiry@usda.gov and the Contracting Officer.
Election of Forum. By initiating a protest with the USDA, the protester agrees not to pursue the same matter with the Government Accountability Office (GAO) or any other external forum while the agency protest is pending. If a protest is filed externally, the agency protest will be dismissed.
