Quotes will be submitted in accordance with the instructions set forth in this document. Statement of Work
SCOPE OF CONTRACT
This contract requires services for reducing populations of Northern Rocky Mountain Pocket Gophers by effectively applying bait below the ground surface in the gopher burrows. The Contractor shall furnish all labor, equipment, supervision, transportation, supplies, and incidentals to perform all specified work.

(a) Salmon River Ranger District (South Zone) Slate Creek Ranger District (South Zone), Red River Ranger District (South Zone), Elk City (South Zone), Gopher Baiting on the Palouse Ranger District (North Zone), North Fork Ranger District, (North Zone), Lochsa Ranger District (Central Zone), and Powell Ranger District (Central Zone) Moose Creek (Central Zone) of the Nez Perce - Clearwater National Forests. Specific areas to be treated under this contract each year will be identified on task orders issued by the Contracting Officer.

(2) Boundaries. Most subitem unit boundaries will be adjacent timbered ground and roads. No buffer strips outside the unit boundaries will be required to be treated.

CONTRACTOR-FURNISHED PROPERTY AND SERVICES
(a) The contractor shall furnish sufficient steam rolled oat “groats” (hulled grain) with molasses sticker containing 0.5% strychnine alkaloid to treat all subitems. The bait must be registered for controlling northern pocket gopher by underground hand placement in forest plantations. Bait used shall be prepared during the current calendar year, newly obtained and delivered to the project in unopened bags. Efforts will be made to minimize transportation and handling of the bait to minimize decline in efficacy. Verification of preparation date, acquisition date, and supply source shall be furnished to the Contracting Officer before bags are opened. The Contracting Officer shall approve the bait provided prior to commencement of work. Substitute bait types will not be permitted unless authorized in advance, in writing, by the Contracting Officer. The districts will not receive any shipment of the gopher bait. There are no facilities that are suitable for storage of the bait at the district offices.
NOTE: The substitution of zinc phosphide (2.0%) bait may be allowed on all items. This substitution would be agreed to in writing at the time the contract is issued.
(b) The Contractor shall comply with Idaho State law covering storage, handling, and application of pesticides and will assume full responsibility as a licensed pesticide applicator.
The Contractor shall present proof of licensing at the prework meeting.
(c) The Contractor shall keep bait in a well-marked locked container while not in use. Transferring bait to dispensing containers shall be done over plastic sheets or within a self-contained bait storage bin.
Individual bait dispensers will have covers to prevent spillage. Between one teaspoon and one tablespoon of bait shall be deposited into the gopher’s underground burrow through a hole made in the top of the burrow.
The hole shall then be immediately covered up with a piece of paper which is weighted down with enough dirt to hold it in place. The paper shall be large enough to completely cover the hole and to be readily visible for inspection. If bait is accidently spilled at any time during the course of the project, it shall be either returned to the container from which it came or immediately buried at least 2 inches below ground surface.
In no case will large quantities (greater than two tablespoons) of bait be buried in one location of forest land.
(d) The Contractor shall furnish the Government with a daily summary of the amount of bait used on each subitem treated.
BAITING REQUIREMENT
(a) Bait sets placed in the main runways of burrow systems with recent gopher activity are the only sets considered to be effective in reducing gopher populations. Main runways are usually found at least one foot away from a push pile. For a bait set to be considered satisfactory, it must be of the proper amount and placement in the main runway, not covered with soil or debris, with the hole completely covered with paper, and no exposed bait or spillage above ground.
(b) All recent gopher activity within the contracted areas shall be treated with satisfactorily placed bait sets. All recent push piles will be considered acceptably baited if a satisfactory bait set is located within the specified spacing distance in any direction from the center of the push pile. The spacing distance for each subitem will be specified in the Task Order.

DEFINITIONS
(a) Main Runways. A main runway (main run) is a continuous burrow 2 1/2 - 3 1/2 inches in diameter and over three feet long (maximum 200') used by a pocket gopher to travel to various parts of its territory.
Main runways are found at varying soil depths. During the spring and after heavy rainstorms, the main runway may occur within six inches of ground level. After extended dry periods, the runways may occur at 6 to 18 inches in depth. Main runways are usually found at least one foot away from a push pile.
(b) Lateral Run. A burrow (run) used for the sole purpose of eliminating dirt from a burrow or nest during construction or repair. The lateral run is usually smaller in diameter, shallower in depth, shorter in length than a main runway and ends at a surface mound or push pile.
(c) Push Pile. A mound of dirt made by the gopher, consisting of dirt removed from a burrow or nest during construction or repair, that is often fan or kidney-shaped with a clearly defined vertical rise or dome shape.
(d) Recent Gopher Activity (Recent Push Pile). A pocket gopher constructed push pile which has covered or partially covered the current year's vegetation and/or is still in a mounded or dome shape.
(e) Bait Set. A quantity of bait (one teaspoon to one tablespoon) placed in an underground gopher burrow.
(f) Territory or Burrow System. A piece of ground occupied by one or a family of pocket gophers. It is an underground tunnel system that is usually several to many feet wide and usually more than 30 feet long on the long axis. It is visible above ground by push piles and earth plugs.
SAFETY REQUIREMENTS AND GUIDELINES
(a) CAUTION – Strychnine is poisonous. The manufacturer’s label is to be used as the reference for correct precautionary measures to be taken when working with the pesticide.
Action – Strychnine causes convulsions due to super stimulation of nervous system; exhaustion; asphyxia.
Toxicity – High – Acute oral LD 50-20 mg./kg.
Hazard – To the applicator, moderate; no absorption through unbroken skin; avoid breathing dust. Strychnine has an exceedingly bitter taste and its presence is readily detected.
(b) The Contractor and/or his authorized field representative shall review with the COR symptoms and treatment of accidental strychnine poisoning prior to start of work. The COR or designated inspector will be on site at all times to monitor the work and to assure that safety guidelines, application, and handling procedures are followed.
WEATHER AND GROUND CONDITIONS
(a) The COR will determine when weather conditions and soil moisture are unsatisfactory for baiting and will temporarily suspend work when these unsatisfactory conditions exist. The Government will not be liable for additional costs arising from or related to temporary work suspensions due to unsatisfactory ground or weather conditions.

(b) When ground conditions are again satisfactory for resumption of work, the Contracting
Officer will issue a resume work order. The contractor shall comply with oral resume work orders.
Any oral resume work order will be followed up in writing.
RESOURCE PROTECTION
(a) The Contractor shall exercise extreme care to prevent damage to existing facilities, developments, and resources.
(1) Existing Facilities. If existing facilities, such as roads, erosion dips, barriers, and drainage facilities, are damaged by the Contractor or his personnel in conjunction with work performed under this contract, they shall be replaced or repaired prior to final payment at no cost to the Government.
(2) Protection of Stream courses. The Contractor shall protect stream courses from damage occurring in conjunction with work performed under this contract. Water sources of all types shall be protected from pesticide contamination by the following:
(i) For all Items, no baiting shall take place within 50 feet of any stream bank.
(ii) Contractor or employees that have been in a baited area shall not enter a stream course for any reason, including but not limited to; washing of self or equipment, or to quench thirst.
(iii) No bait will be stored within 200 feet of any water source.
(iv) Treatment will be suspended when soils are too wet or heavy rain is predicted.
GOVERNMENT QUALITY ASSURANCE SURVEILLANCE PLAN
(a) Inspection. The government’s inspections will determine compliance with specifications and provide the basis for computing the rate of payment. Inspections will consist of visual observations and/or sample plots to determine compliance with the specifications. The plots will be located throughout the treated areas to obtain a representative sample of the work. Each contract subitem will be inspected separately and inspection results will not be averaged with those of other contract subitems. Inspections will be documented on Rodent Control Inspection Sheets.
Determination of the acceptability of the work performed will be based on these inspections, which will be considered conclusive except as otherwise provided in the contract. The Contractor or his representative may observe inspections while they are underway.
(1) Inspection: Baiting Quality. Pocket gopher baiting on representative sample plots will be examined to determine compliance with the Baiting Requirement. Only those plots which contain recent gopher activity requiring treatment under the specifications of this contract will be used in the calculation of baiting quality. The sample size will generally be 0.5% of the treated area, although the government reserves the right to increase or decrease the sampling intensity as needed to determine compliance.
(2) Plot Procedures
a. All subitems will be inspected separately. 1/50 acre plots (16.7 foot horizontal radius) or
1/100 acre plots (11.8 foot horizontal radius) may be taken.

b. Inspection within each plot will be done as follows:
.1 L o c a t e and mark the plot centers on the ground in an unbiased manner.
.2 Determine and record the number of recent push piles located within the plot requiring baiting.
.3 Record the number of recent push piles satisfactorily baited.
.4 A n y set within the spacing specified may be inspected for the following: (Note that some sets providing coverage for push piles on a plot may not be located within the plot radius.)
(A) Proper amount and placement of bait in main runway and not obscured or covered with soil or debris.
(B) Hole properly covered to eliminate light.
(C) Exposed bait or spillage.
c. Any recent push pile on the inspection plot that is within the required spacing distance of a satisfactory set will be recorded as satisfactorily baited. A set not meeting the requirements of (A) through (C) above will render the push piles exclusively within the required spacing to it, unsatisfactorily baited.
d. The quality of baiting will be computed as follows:

(3) Unsatisfactory Baiting and Rebaiting
a. If the percentage of baiting quality fails below 70%, the Contractor will be immediately notified in writing and the Contractor will be ordered to rebait the subunit. If the quality of future baiting is not raised above 70% within two consecutive workdays after receipt of the notice of unsatisfactory baiting, the Contractor’s right to proceed with the work may be terminated.
b. In the event the area is rebaited pursuant to a. above, a reinspection will be made of the entire subunit and payment will be based on the reinspection. The cost of reinspection shall be at the Contractor’s expense.
c. Any uncleaned spillage or baiting done within the specified stream course buffer area at the time of the project will be grounds for termination for default.
ADDITIONAL DELIVERIES OR PERFORMANCE REQUIREMENTS
(a) Contract Time and Required Rate of Progress. Effective gopher baiting is dependent upon proper soil and weather conditions at the time of baiting. These conditions only prevail for a limited length of time. It is therefore imperative that work be started promptly after conditions for baiting become suitable.

The Contractor shall maintain progress at a rate which will assure completion within the contract time. The minimum acceptable rate of progress will be calculated by dividing the total units of work for each item by contract time specified. In the event the Contractor is delayed and falls more than three calendar days behind the progress rate required above, the Contractor's right to proceed is subject to immediate termination. If more than one area is available, the Government will prescribe the work sequence.

Work may be performed on each Item in succession provided the required rate of progress is maintained.
A notice to proceed will be issued as soon as weather and ground conditions are favorable for baiting. Contract time will start on third day after the post office has issued a notice of certified mail to the Contractor, or when work commences, whichever is sooner. Failure of the Contractor to pick up certified mail will not be considered excusable.
Whenever it is determined that environmental or physical conditions become unsuitable for baiting, the Contractor will move to another area prescribed by the COR. When no other area is available, the work will be suspended. It is the responsibility of the Contractor to maintain contact sufficient to determine when conditions again permit baiting. CONTRACT TIME WILL BE INCREASED ONLY BY THOSE
DAYS WHEN CONDITIONS ARE NOT SUITABLE FOR BAITING.
(b) The Government prefers that the workday average approximately eight hours on site but will consider alternative workday schedules submitted in the technical proposals.
(c) The contractor shall work no more than six days per week, with either Saturday or Sunday being the designated day off. The mandatory day off WILL be counted as a day of contract time.
(d) Only one crew will be permitted to work on one Item at a time.
MEASUREMENT AND PAYMENT
Method of Measurement. The subitem acreages will be determined on a horizontal plane within the boundaries as indicated in the contract or work order.
(a) Remeasurement.
(1) The Contractor may at any time after award, but prior to final payment, request remeasurement of any treatment area. The request must be made in writing. Remeasurement will be made within the established boundaries.
(2) If remeasurement indicates a variance of five percent or less, the Contractor shall pay for the actual cost of remeasurement, and no adjustment will be made in the acreage as stated in the Schedule of Items.
(3) If remeasurement indicates a variance greater than five percent, payment will be based on the remeasured acreage and the Government will pay for the remeasurement.
(b) Method of Payment.

(1) Calculation of Payment for Rodent Control.
a. Upon completion of the inspection of a subitem the COR will calculate the pay rate.
b. If the quality of baiting is 70% or above, the per acre price will be paid, less a deduction of 1% for each 1% the quality is below 100%. As an incentive, the deduction will be waived if quality is 90% or above.
c. Where the inspection determines baiting quality for a subitem to be less than 70% the work will be rejected and reworked by the Contractor.
d. If any contiguous area encompassing four acres or more is less than 70 percent quality, the Contracting Officer may separate the unsatisfactory parcel from the remainder of the subitem and require that parcel to be reworked.
(2) Final payment will be made based on the number of acres satisfactorily completed and the quality percentage achieved on each contract subitem, as determined by the COR.
GOVERNMENT QUALITY ASSURANCE
Quality assurance will be performed by the Government during the contract at regular intervals. Methods may include visual survey and review of Contractor quality control documents. Deduction for work may include rework at no cost to the Government or Government acceptance with price reduction.
CONTRACTOR QUALITY CONTROL
The Contractor, not the Government, is responsible for management and quality control actions to meet the terms of this contract. The role of the Government is quality assurance to ensure contract standards are met.
1. Quality Control Plan. The contractor shall establish and maintain a complete Quality Control Plan to ensure the requirements of the contract are provided as specified. One copy of the contractor’s Quality Control Plan shall be provided to the contracting officer as part of the contractor’s proposal. An updated copy if needed must be provided to the contracting officer on the contract start date and as changes occur.
Records of quality inspections shall be kept and made available to the Government throughout the performance period and for the period after contract complete until final settlement of any claims under this contract.
A description of the site-specific quality control inspection plan shall be provided within thirty
(30) days of contract award. The plan shall include (1) control procedures for security of Government-provided items such as required credentials, keys, and lock combinations; (2) location of the inspection documents; (3) corrective or preventive actions that will be taken to meet quality standards; and (4) a customer comments feedback system.
2. Government Review. The Government will review the Contractor Quality Control Plan to determine if it is adequate. If the plan is adequate, the Government will accept the plan. If the plan is not adequate as submitted, the deficiencies will be identified to the contractor in writing. The contractor shall correct all
12363N23Q4213 NEZ CLW Gopher Baiting Page 9 of 38 identified deficiencies and submit a corrected Contractor Quality Control Plan within ten working days or contract start date, whichever is sooner.
Note: The Government reserves the right to modify performance standards and/or metrics during the life of this contract; to ensure that the right outcomes are being assessed and that the performance standards are appropriate. Any changes will be accomplished via a bilateral contract modification.

PERFORMANCE BASED SERVICE CONTRACT
This is a performance based, commercial service contract. Performance based means the Contractor is responsible for an end product. If an end product is not provided, an adjustment to the payment will be made.
COMMERCIAL SERVICES CONRTRACT
A commercial item contract streamlines the terms and conditions to resemble those already used in the everyday marketplace.
KEY PERSONNEL
The key personnel specified in the Offeror's Technical Proposal are considered to be essential to the work being performed hereunder. Prior to diverting any of the specified individuals to other programs, the Contractor shall notify the Contracting Officer reasonably in advance and shall submit justification (including proposed substitutions) in sufficient detail to permit evaluation of the impact on the contract. No diversion shall be made by the Contractor without the written consent of the Contracting Officer: Provided that the Contracting Officer may ratify in writing such diversion and such ratification shall constitute the consent of the Contracting Officer required by this clause. The contract may be amended from time to time during the course of the contract to either add or delete personnel, as appropriate.
PREWORK CONFERENCE
Prior to commencement of work, the COR will arrange a meeting with the Contractor to discuss the contract terms and work performance requirements. Also, at this meeting such things as work progress schedule and fire prevention and suppression plans shall be developed and established in writing.
A Contracting Officer’s Representative (COR) will be designated to represent the Contracting Officer for the duration of this task order. The COR is not authorized to make any commitments or changes that will affect price, quality, quantity, delivery, or any other term or condition of the contract.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors, applies to all contracts subject to the Service Contract Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
