COMBINED SYNOPSIS / SOLICITATION

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.

This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

This solicitation is issued as a Request for Proposal. The documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-03.

This procurement is set aside for small business concerns. The NAICS code is 332312 and the Small Business Size Standard is 500 employees.

Description of Requirement:

Monongahela National Forest, West Virginia Modular Road Bridge Fabrication Specifications

Scope of Work: Design, fabricate, deliver and off load a modular 35-foot road bridge to the Monongahela National Forest at the specified site noted in the Schedule of Items.

The bridge shall be designed and stamped by a registered Professional Engineer in the State of manufacture to HL-93 loading requirements. The bridge shall be capable of supporting a minimum traffic load of 88,000 lbs. This design shall be submitted to the Forest Service for review and approval prior to start of fabrication. Any errors, flaws, or concerns discovered or brought forward during this review shall be remedied to the satisfaction of the Forest Service, prior to fabrication of the structure.

The modular road bridge shall be designed and manufactured to be deployable and in use within two hours (under ideal site and weather conditions) utilizing standard excavation equipment and a small (3-4 person) workforce of operators and laborers. No specialized training or skills shall be required for deployment / installation. All required fasteners and incidental construction supply for deployment and installation of the modular bridge shall be furnished by the supplier.

The bridge shall have a 12’-6” foot wide clear width (face of barrier to face of barrier) x 35 foot in length and be capable of free spanning a min. of 29 ft. The bridge shall be capable of folding in or near the center to ease in transportation, maximum transportation width shall be 8’-6”. The bridge metal components shall be painted with a durable industrial standard paint. Color of said paint must be approved by the COR prior to being applied.

The Fabricator shall furnish all labor, materials, equipment, service and supervision to complete the fabrication and delivery of the modular road bridge as described in these specifications. The Fabricator shall be required to complete all work by April 1, 2020. The Fabricator shall establish a firm delivery date and time for all materials to be delivered to the project site, in coordination with the project COR, to ensure the Forest is ready for delivery. Contact COR 72 hours prior to any deliveries. It will be the responsibility of the manufacturer to coordinate with the Forest Service COR for unloading of modular bridge.

Fabrication: Fabricate all bridge components according to applicable industry standards.

Perform any required welding in accordance with the best modern practice and the applicable requirements of AWS D1.1. The Fabricator’s welder shall be AWS certified.

All exposed rough edges on steel members shall be ground smooth. The deck shall be constructed out of select structural grade southern yellow pine (SEE TABLE 4B) and all wood deck components shall be treated for ground contact treatment, approved by AWPA.

Acceptance: Acceptance is based on a review and acceptance of the design by the U.S.F.S. Once the design is verified and accepted, fabrication will be authorized. Design and engineering calculation date for the structure should be provided with the bid, for review (prior to bid acceptance).

A visual inspection of the structure will be made on delivery to ensure the absence of material defect and to ensure structural compliance with the contract, specifications, and prevailing industry standards.

Any identified deficiencies will be remedied by the contractor prior to final acceptance.

Payment: The accepted quantities shall be the actual number of units completed, delivered, and accepted, measured as Each, one entire unit, will be paid at the contract price per unit of measurement for the pay items. Payment will be full compensation for the work prescribed in this Specification.

Delivery Details/Period of Performance:

Recommended contract time is 14 calendar days.

The Fabricator shall be required to complete all work by April 1, 2020. The Fabricator shall establish a firm delivery date and time for all materials to be delivered to the project site, in coordination with the project COR, to ensure the Forest is ready for delivery. Contact COR 72 hours prior to any deliveries. It will be the responsibility of the manufacturer to coordinate with the Forest Service COR for unloading of modular bridge.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. AGAR 452.228-71 Insurance Coverage (NOV 1996)

Pursuant to the clause "Insurance - Work on a Government Installation (52.228-5)," the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.

(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence.

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage.

(d) Air craft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger liability, and $200,000 per occurrence for property damage. Coverage for passenger liability bodily injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

Sustainable Acquisitions

The Contractor shall comply with FAR Part 23 Sustainable Acquisition Policy and all associated laws, rules, regulations, and executive orders referenced therein. Contracts that include the supply of products and for the acquisition of services (including construction) that include the supply of products, require that the products provided are—

(1) Energy-efficient (ENERGY STAR® or Federal Energy Management Program (FEMP)-designated); (applicable if FAR Clause 52.223-15 is included)

(2) Water-efficient; (applicable if FAR Clause 52.223-15 is included)

(3) Biobased; (applicable if FAR Clause 52.223-2 is included)

(4) Environmentally preferable (e.g., EPEAT®-registered, or non-toxic or less toxic alternatives); (applicable if FAR Clause 52.223-13,14, or 16 are included)

(5) Non-ozone depleting; (applicable if FAR clause 52.223-11,12,20, or 21 are included), and/or

(6) Made with recovered materials (EPA-Designated products) (applicable if FAR clause 52.223-9 or 17 is included).

(b) The required products in the contract actions for services include products that are—

(1) Delivered to the Government during performance;

(2) Acquired by the contractor for use in performing services at a Federally-controlled facility; or

(3) Furnished by the contractor for use by the Government.

Data rights – General

1. The contractor will treat all deliverables under the contract as the property of the U.S. Government for which the Government Agency has unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest.

2. The contractor will not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records.

3. The contractor will not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act.

4. The contractor will not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract.

5. The Government Agency owns the rights to all data/records produced as part of this contract.

6. The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor will deliver sufficient technical documentation with all data deliverables to permit the agency to use the data.

7. The contractor agrees to comply with Federal and agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.] or state of completion [draft, final, etc.].

8. No disposition of documents will be allowed without the prior written consent of the contracting officer. The agency and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701.

Records may not be removed from the legal custody of the agency or destroyed without regard to the provisions of the agency records schedules.

9. The contractor is required to obtain the contracting officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, this contract.
