Solicitation # 1231ME-18-Q-0019
Foreclosure Legal Services for the State of Texas
Q. 1. There are many processes involved in bankruptcy, such as Proof of Claim, Plan review, plan objection, notice of payment change, final cure payment, motion for stay relief. Is the quote for Chapter 7 bankruptcy to be a total amount for all processes for each bankruptcy case? Is the quote for Chapter 13 bankruptcy to be a total amount for all processes for each bankruptcy case?
ANSWER: You can quote a total maximum “not to exceed” sum for the routine bankruptcy services under Texas law on the form for that line item. You can place an asterisk indicating to refer to an additional attached separate sheet for a price breakdown.
Q. 2. The Completion Timeframe (in months) is stated to be from “time of complaint/petition to title conveyance.”
Texas is a non judicial state, so there is no complaint or petition. What is the trigger for the start of the timeline? Date of referral? Date of first legal (notice of sale posted)? Another event?
What is the definition of “title conveyance”? Date of foreclosure sale? Date Substitute Trustee’s Deed Recorded? Another triggering event?
ANSWER: The trigger event should be deemed the acceptance date of the referral.
