2.1 BACKGROUND
The Low Income Home Energy Assistance Program (LIHEAP) is a block grant authorized by the Omnibus Reconciliation Act of 1981 (OBRA), as amended, and administered within the Department of Health and Human Services (DHHS). In DHHS, LIHEAP is administered by the Division of Energy Assistance (DEA) within the Office of Community Services (OCS), which is a part of the Administration for Children and Families (ACF). The purpose of LIHEAP is to provide grants to LIHEAP grantees (States, Territories, and approximately 140 Indian Tribes and Tribal organizations) to assist low income households in meeting the costs of home energy.
Section 2609A(a) of the Low Income Home Energy Assistance Act of 1981 (title XXVI of Public Law 97-35, the Omnibus Reconciliation Act of 1981, 42 U.S.C. 8621, as amended), authorizes the Secretary of the Department of Health and Human Services to set aside up to $300,000 each fiscal year to make grants to State and public agencies and private nonprofit organizations; or to enter into contracts or jointly financed cooperative arrangements with States and public agencies and private nonprofit organizations, to provide training and technical assistance related to the Low Income Home Energy Assistance Program (LIHEAP).
The Consolidated Appropriations Act, Public Law 112-74 (2011) appropriated $3.4 billion for the FY 2012 LIHEAP program and included the following additional provision:
“Provided further, That notwithstanding section 2609A(a), of the amounts appropriated under section 2602(b), not more than $3,000,000 of such amounts may be reserved by the Secretary for technical assistance, training, and monitoring of program activities for compliance with internal controls, policies and procedures.”
The overall mission, goals and objectives of OCS are as follows:
(1) Mission: To work in partnership with states, communities, and other agencies to provide a range of human and economic development services and activities which ameliorate the causes and characteristics of poverty and otherwise assist persons in need.
(2) Goals: To increase the capacity of individuals and families to become self-sufficient, to revitalize communities, and to build the stability and capacity of children, youth, and families so that they become able to create their own opportunities.
(3) Objectives:
· To provide financial resources through block grant initiatives for planning, coordination, management, provision of services and physical renovation;
· To provide related instructional materials to support planning, program development, resource identification and coordination as well as the deployment and management of economic development efforts and social service support activities;
· To leverage Federal, State and local resources through inter-agency agreements and public/private partnerships; and
· To disseminate information regarding the results and effectiveness of the discretionary and block grant activities.
2.2 PURPOSE

Additionally, the Contractor shall provide a team of qualified personnel to work with ACF Federal staff to recommend improvements to the design of the LIHEAP monitoring system, protocols and the performance of compliance reviews.
The objective of this contract is to acquire the necessary resources to conduct LIHEAP reviews in accordance with Federal requirements.

c. It is expected that the reviews will help OCS to establish internal controls that ensure grantees and sub-grantees are effectively and efficiently compliant with the applicable laws and regulations and are able to effectively implement the LIHEAP block grant.
d. The Contractor is expected to design and implement a process that prioritizes the monitoring activities that OCS plans to conduct. For example, the scope defines parameters of the review such as the period of time reviewed, the availability of necessary documentation or records, and the locations at which field work shall be performed.
3. Methodology. Reviewers should design the methodology to provide sufficient, competent, and relevant evidence to achieve the objectives of the review. Methodology includes both the types and extent of review procedures used to achieve the review objectives.
The reviewers shall conclude the planning with a memorandum addressed to the selected grantees, announcing the review objectives, scope, and methodology and of the reviewers’ basis for those decisions.

· To review parties based on unexpected emergency changes affecting their LIHEAP programs, e.g., fraud investigations, significant personnel and/or leadership changes, major changes in capacity to administer the program, etc.
· To assess, in the course of such visits, the program integrity of such parties--including systems, internal controls and procedures to detect and deter waste, fraud and abuse; and
· To evaluate compliance with LIHEAP statute [42 U.S.C. § 8621-8630) and block grant regulations (45 C.F.R. Part 96); OMB Circulars and other Federal requirements.
In providing technical assistance, the Contractor shall collaborate with grantees and, if appropriate, sub-grantees or Contractors, to ensure that programs meet statutory requirements, achieve performance outcomes, and submit timely and accurate data for grant reports, performance management, and program evaluations.
All such visits shall use the Government standards for reviews published by the U.S Government Accountability Office (GAO), unless otherwise specified.

Reviewers also shall document and report suspected fraud, illegal acts, and violations of provisions of grant agreements directly to State and Federal Officials.
Until directed otherwise by the COR, the Contractor shall submit to the COR monthly reports that cover grantee concerns, issues affecting monitoring performance, and issues affecting cost. The Contractor shall submit such reports on a monthly basis within 10 days of the end of the month covered by the report.
Task 7 Documentation/Working Papers Conduct and document fieldwork in accordance with GAO’s standards, OCS protocols and any other requirements that OCS specifies; Federal requirements and guidance for each site visit.
This task shall be conducted in conjunction with Federal personnel initially, but shall be conducted independently later, once approved by OCS. The fieldwork shall be documented through appropriate working papers that are consistent with those used by OCS personnel, which are also consistent with the Government standards for performance reviews published by GAO unless otherwise specified. Working documentation including attachments shall be stored on professionally-indexed electronic copies.
The documentation related to planning, conducting, and reporting on the review should contain sufficient information to enable an experienced auditor, who has had no previous connection with the review, to ascertain from the review documentation the evidence that supports the auditors’ significant judgments and conclusions. Sufficient competent evidential matter shall be obtained through inspection, observation, inquiries, and confirmations to afford a reasonable basis for any recommendations made in the final report.
Working papers shall document:
· The objectives, scope, methodology and results of the evaluation, including any sampling and other selection criteria used;
· The work performed to support significant judgments and conclusions, including descriptions of transactions and records examined.
Task 8 Compliance Review Reporting Prepare detailed reports on the compliance review visits.
This task shall be conducted in conjunction with federal personnel initially, but shall be conducted later, independently, once approved by OCS.
Draft and final reports shall be consistent with those written by OCS personnel and shall be consistent with the Government standards for performance reviews, as published by the GAO unless otherwise specified. The draft and final reports so generated shall be subject to OCS approval.
Prepare a draft report of the conclusion of the site visit, which is clear, simple and structured in a manner so that Grantees can easily read and understand the findings, recommendations and any necessary follow up.
The draft reports shall address (but not limited to) the following:
(1) The effectiveness and efficiency of operations; the reliability and usefulness of financial reporting; the degree of compliance with applicable laws and regulations, provisions of contract, or grant agreements;
(2) Whether or not assets have been safeguarded; whether or not the grant is progressing toward its intended outcomes and is meeting its intended purpose; and
(3) The extent to which the grantee so reviewed achieved accomplishments or performance best practices.
The preparation of program documentation should be appropriately detailed to provide a clear understanding of its purpose and source and the conclusions the auditors reached, and it should be appropriately organized to provide a clear link to the findings, conclusions, and recommendations contained in the report. Working papers should support and be indexed and cross-referenced to the draft report.
Once the draft is reviewed and cleared by OCS, reviewers shall notify Grantee officials of tentative findings and recommendations made during the course of the visit.
The final report shall be cross-referenced to the draft report. Any changes made shall be supported by appropriate working papers. Reviewers shall ensure that the final report is fair, complete, and objective, and provide the draft report to Grantee officials for review and comments.

Contractor audit personnel shall comply with GAO’s Government auditing standards for continuing education and training requirements.
