Limited Source Justification

2. Nature and/or description of the action being approved.
a. Acquisition purpose and objectives.
As part of its Automated External Defibrillator (AED) program, FOH provides comprehensive AED training services. In order to assure continuity of services for this program, FOH needs to procure contractor services to provide training in line with applicable nationally recognized guidelines, the necessary training equipment, and a web-enabled data tool allowing for FOH and Client Agencies to track the provision of training and equipment.
FOH will not be able to fulfill its mission of providing AED program services to other Federal agencies if this bridge contract is not awarded, since there is no other vehicle available to provide continuity of services.
b. Project background.
The current contract, HHSP23320065309DB, was awarded to Medic First Aid International, via GSA Contract # GS02F0010R, on August 30, 2006. The original period of performance was from 09/01/2006 to 08/31/2007, including four one year option periods, and the contract was extended from 9/1/2011 through 03/31/2012 in accordance with FAR 52.217.8.
This acquisition is a result of the need to bridge the gap between the current contract and the commencement of services under a new AED training services contract to ensure continuity of service. The RFP for the competitive contract is expected to be issued on or before 03/28/2012, and award is expected by the end of April 2012. Based on the need for IT certification of the successful offeror’s systems, the transition from the incumbent provider will take somewhere between 90 and180 days following contract award. The follow-on contract, which is the subject of this LSJ, has an expected solicitation issuance date of 03/26/2012 and will be awarded on or before 04/01/2012.
3. Description of the supplies or services required to meet the agency’s needs (including the estimated value).
a. Project title.
FOH AED Program Services: Training, Data Management, Equipment, and AED Personnel support
b. Project description.
Currently, FOH provides AED program services to Federal customer agencies through interagency agreements (IAAs). In order to fulfill its obligations under these IAAs, FOH requires contractor support to provide training, equipment, and AED training related data management. The training classes, which are held at various US and international locations and various times to meet both traditional and non-traditional work schedules, need to be provided by certified instructors in accordance with nationally recognized guidelines. To ensure that training provides students with practical, hands-on experience, FOH also requires that the contractor take and fill orders from FOH for the necessary training equipment. Additionally, FOH requires a web-enabled data management tool to track the provision of, and specific need for, equipment and training.

The bridge contract will be created using the incumbent’s GSA schedule, which has already been determined to be fair and reasonable. In addition, the Contracting Officer will review historical information from the incumbent, Medic First Aid, over the past five years to assess aggregate pricing information.
6. Description of the market research conducted among schedule holders and the results, or a statement of the reasons market research was not conducted.
Market research was not performed for this bridge contract due to the ability of only the incumbent to provide the bridge services. For the forthcoming, competed contract that will take effect after the bridge, market research, including the posting of a sources sought on FedBizOpps, has been conducted.
7. Any other facts supporting the justification.
Due to the large amount of time, effort, and expense necessary to obtain IT clearance, awarding this follow-on to the incumbent contractor while awaiting the commencement of services under a new, competed contract is in the interest of economy and efficiency. The current amount of time required to receive authorization to operate an IT system from the HHS Office of the Chief Information Officer is between 90 and 180 days, a delay that would cause a lapse in service. Additionally, since a new contractor will begin work after the six month bridge contract has expired, awarding the bridge to a non-incumbent would result in the substantial duplication of expenses incurred by HHS when the incumbent received IT approval, and the future expenses for IT approval that will be incurred again for the new contract awardee.
Awarding to Medic First Aid International will prevent a lapse in service delivery.
If FOH is required to conduct a limited or full and open competition for follow-on AED program services, it would take at least six months to select a contractor and commence services under that award. The new contract to cover FOH’s long term needs is anticipated to be awarded by that time. In addition, awarding to a different contractor will likely result in significantly higher costs, since any contractor lacking experience with the AED program will pass along the expenses of a protracted learning curve that will not be recovered over such a short contract term.
8. Statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
