C.1 SCOPE OF CONTRACT
This contract requires water and wastewater testing and reporting services and related work in compliance with its terms, specifications and provisions. This includes furnishing labor, equipment, supervision, operating supplies and incidentals.

C.3 TECHNICAL SPECIFICATIONS
All water and wastewater testing shall be in accordance with all EPA standards, regulation, Small System Compliance Technology List for the Surface Water Treatment Rule and Total Coliform Rule (EPA-815-R- 98-001), Total Coliform Rule, NELAC and ORELAP Standards and Methods. A Handbook for Small Non-community Water Systems serving less the 3,300 persons (EPA 816-13-06-001).
C.4 Contractor shall submit test results to the appropriate State entities as required as well as submit all test results via fax, email or Postal Service to Eric Grim at eric.grim@usda.gov Water/Wastewater Program Area Manager, USDA Forest Service, 3040 Biddle Road, Medford, OR 97504 for all tests processed.
C.5 Samples to be tested will be delivered by Forest Service personnel to testing lab.
C.6 Contractor shall be responsible for providing sample container, testing and providing test results as described above. Forest Service personnel, or others acting in behalf of the Forest Service, will be responsible for picking up sample containers, taking the physical samples and delivering samples to the designated lab.
a. Contractor’s laboratory (designated location) must be geographically located with the general Test Area/Ranger district(s) it serves.
b. Contractor must understand the Forest Service has a concessionaire who samples water during the months of May through October at Fish Lake/Doe Point Campground, North Fork Campground and Whiskey Springs Campground. The awarded contract does not cover water testing at these sites during this time frame.
Concessionaire is responsible for the inclusive water testing at these sites.

FAR 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.
FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 calendar days of the expiration date of the contract; provided, that the Government shall give the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract.
If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

FAR 52.215-5 FACSIMILE PROPOSALS (OCT 1997)
(a) Definition. "Facsimile proposal," as used in this provision, means a proposal, revision or modification of a proposal, or withdrawal of a proposal that is transmitted to and received by the Government via facsimile machine.
(b) Offerors may submit facsimile proposals as responses to this solicitation. Facsimile proposals are subject to the same rules as paper proposals.

(d) If any portion of a facsimile proposal received by the Contracting Officer is unreadable to the degree that conformance to the essential requirements of the solicitation cannot be ascertained from the document--

(2) The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the offeror; and

M. Evaluation factors for award
FAR 52.212-2 EVALUATION – COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
1. Price
2. Past Performance
3. Technical Capability (Technical Specification Drinking Water)
4. Experience and Qualifications
The Government may reject any or all quotes, issue orders to other than the lowest quote, and waive minor informalities or irregularities in quotes received. If necessary, the Government may conduct discussions with any quoter.
The Government may issue an order on the basis of quotes as received, without entering into discussions with any quoters. Therefore, each initial quote should contain the quoter’s best terms.
It is intended that award will be made on an all or none basis.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE
The Contracting Officer designates the Contracting Officer's Representative (COR).
The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government, which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract.)
