Performance based means the Contractor is responsible for an end product/service. If an end service is not provided, an adjustment to the payment may be made. A commercial item contract streamlines the terms and conditions to resemble those already used in the everyday marketplace.

1.3.1 Performance of Work by the Contractor

The Contractor shall perform on the site, and with its own organization, work equivalent to at least 50% percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.

1.4. SITE VISIT. A pre-site inspection is available at the Troy Ranger Station. Contact Darrin Jackson (Contracting Officer) at (208) 765-7230 to schedule an appointment.

Therefore, the Contractor shall obtain approval from the CO for all subcontractors prior to entering into any subcontracts.

The Contractor's request for approval shall be written and include the specific work to be accomplished by the subcontractor (a SF-1413 form will be used for all sub-contractor requests).

1.7. CONTRACTING OFFICER (CO). The CO is a person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings. The CO can appoint representatives to act on their behalf (see section 1.8).

1.8. CONTRACTING OFFICER REPRESENTATIVE (COR). A COR will be appointed by the CO to monitor the Contractor’s performance and have the right to inspect and accept or reject the services as required by the contract. An Inspector may also be appointed by the COR to monitor the Contractor’s performance and have the right to inspect services as required by the contract. The name and telephone number of the COR and inspector under the contract will be furnished to the Contractor in writing. If a COR is not appointed, at a minimum, an inspector will be appointed to inspect work performed. The Inspector will report results of inspections to the COR and provide records of inspections to the Contractor.

1.9. QUALITY CONTROL PLAN (QCP). The Contractor shall develop and maintain a quality control program to ensure janitorial services are performed in accordance with commonly accepted commercial practices and services and the standards identified in the Performance Work Statement (see section 1.14 and 2.6 for work schedule) to cover all services and all facilities performed under this contract. A written QCP shall be included with the response to this Solicitation to the CO. 1.10. QUALITY ASSURANCE AND INSPECTIONS. The Government may inspect contract services using a variety of methods, however the primary means of inspecting all types of work is the periodic method. The Government shall inspect and evaluate the Contractor’s performance to ensure services are received in accordance with the requirements set forth in the contract. The COR or Inspector may inspect by watching actual task performance, physically checking a completed task (both scheduled and unscheduled), checking a management information report; investigating customer complaints and/or surveys; conferring with building occupants/managers; or any combination of the above; or otherwise inspecting the task or its results to determine whether or not performance meets the standards contained in this Performance Work Statement.

For inspection of daily tasks, all Government inspections will be completed at the completion of the janitorial shift, or the beginning of the next day of work. For weekly tasks, Government inspections will be completed within two business days following completion of work; for quarterly, semi-annual, and annual tasks, Government inspections will be completed within 10 business days following notification of completed work being ready for inspection. A hard copy of the inspection results will be delivered to the Contractor, and the Contractor will initial and return the hard copy to the COR (or Inspector) within one calendar week; notification of inspection results may also be sent via email or phone call in addition to hard copy.

NOTE: The Contractor shall use the Janitorial Compliance Checklist to track completed tasks (See Attachment 04, Janitorial Compliance Checklist). The Contractor or Contractor representative will promptly initial this sheet when tasks are completed, such as at the end of the evening’s cleaning shift. Initialing this sheet may serve as notification to the COR and Inspector of completion of work for daily and weekly tasks. Quarterly, semi-annual, and annual task completion requires separate notification in writing (such as by email) to the COR and Inspector when work is complete and ready for inspection (see section 1.10).

When an inspection of a quarterly, semi-annual, or annual task indicates defective performance, the Contractor or Contractor’s representative should then confirm defective work and perform corrective work as needed within two calendar weeks and will notify the COR and Inspector immediately when complete so the rework can be re-inspected. The Contractor shall be required to rework the effort until the performance objective is achieved, or a payment deduction could be taken. For weekly tasks, this confirmation and corrective action will be taken within 5 business days.

1.10.1 GOVERNMENT SURVEILLANCE. The Government, through its’ COR (and/or Inspector), will be monitoring the Contractor’s performance under this contract as described above. All monitoring observations will be recorded by the Government and maintained in the contract folder.

1.11. PERFORMANCE REQUIREMENTS SUMMARY (PRS). The contract service requirements are summarized in the PRS (section 5.10) and relate directly to required services. The performance standard briefly describes the minimally acceptable levels of service required for each item. The PRS and the Contractor’s Quality Control Plan provide information on contract requirements, the expected level of Contractor’s performance, and the expected method of Government surveillance and confirmation of services provided. Procedures as set forth in FAR 52.212-4(a) Contract Terms and Conditions – Commercial Items, Inspection/Acceptance, will be used to remedy all deficiencies.

The Contractor shall be responsible for maintaining satisfactory standards of employee competency, conduct, appearance and integrity, and shall be responsible for taking such disciplinary action with respect to the employee(s) as may be necessary.

No persons other than Forest Service personnel and Contractor’s employees 16 years of age or older shall be on the premises during performance of the work, nor may the Contractor bring any animals (other than certified service animals) on the premises, unless the CO’s written permission is obtained. Contractor’s personnel may not smoke on Government premises.

A key or code will be issued to the Contractor. Such key is the property of the Government and will be returned upon the expiration of the contract, or sooner if requested.

Under no circumstances shall the Contractor or Contractor’s employees allow outside doors to be propped open and unattended while cleaning is being performed; the Contractor and Contractor’s employees shall exercise care when entering and exiting the building, making sure that the outside doors used are securely closed and locked when not in immediate use.
